    The Fair Debt Collection Practices Act (FDCPA) prohibits harassment or abuse in collecting a debt such as threatening violence, use of obscene or profane language, publishing lists of debtors who refuse to pay debts, or even harassing a debtor by repeatedly calling the debtor on the phone. Also, certain false or misleading representa�tions are forbidden, such as representing that the debt collector is associated with the state or federal government, or stating that the debtor will go to jail if he does not pay the debt. This Act also sets out strict rules regarding communicating with the debtor. The FDCPA applies only to those who regularly engage in the business of collecting debts for others -- primarily to collection agencies. The Act does not apply when a creditor attempts to collect debts owed to it by directly contacting the debtors. It applies only to the collection of consumer debts and does not apply to the collection of commercial debts. Consumer debts are debts for personal, home, or family purposes.

If a communication is made in good faith on a subject in which the party communicating it has a legitimate right or interest in communicating it, this communication may be exempt from slander liability due to a qualified privileged.

It is often used in cases where parties either do not imply a legal commitment or in situations where the parties cannot create a legally enforceable agreement. It is a more formal alternative to a gentlemen's agreement. A MOU is often used to articulate a form of a written mutual agreement between two or more parties and outlines a commitment between the parties to work together toward the same purpose or goals. A MOU can have the binding power of a contract. Whether or not a document constitutes a binding contract depends only on the presence or absence of the legal elements of a contract which are: 1. An agreement; 2. Between competent parties; 3. Based on genuine assent (voluntarily and with intent of agreement); 4. Supported by consideration (value – usually money); 5. Made for a lawful objective; 6. In the form required by law (in writing in this case)
