It is estimated that approximately 50% of general practitioners working together in a single practice do so without a written agreement or the agreement that they do have is out of date. The purpose of a general practice partnership agreement is to define what the general practitioners who have entered into practice together agree to do for each other and what the other practitioners expect in return. If a current general practice partnership agreement is not in effect, the partnership is considered to be a partnership at will. A partnership at will has many implications of which practitioners may not be aware. For example, in partnership at will any partner can dissolve the partnership with immediate effect. Also, if any partner dies unexpectedly or retires from a partnership at will, this will have the effect of completely dissolving the partnership. Thus, a general practice partnership agreement has many legal advantages that are of benefit for all the practitioners in the partnership. The process of drafting a partnership agreement may also reveal needs and expectations that had not been previously addressed.
