FBWD is a form of undertaking where a seller or a grantor states that s/he holds clear title of ownership of a real estate and is authorize to trade it off to a buyer irrespective of the time s/he held the property. This deed clearly mentions the names and addresses of the grantor and the grantee(s) along with the amount involved in the transaction. It can be used for conducting promissory notes which may or may not be blank that are generally used in real estate transactions.
Once it gets breached, the aggrieved parties get entitled to go to the court in order to justify their fairness and their share in the party. Governed by Uniform Commercial Code- Article 2, the variations have been adjusted from state to state. The buyer can defend his/her title to the parcel of property by using the deed as a legal promise. The warranty may be of different types like expressed, implied and breached. Specific representations can be made by the sellers and the buyers during complex commercial transactions.
