Any Title VII or ADA claims regarding the failure to transfer claim (January 2004) is barred by limitations. Denial of the lateral transfer, write-ups and meetings with supervisors are not materially adverse employment actions, and cannot support Plaintiff’s Title VII, ADA or retaliation claims. Defendant’s motion for summary judgment arguing that Plaintiff’s numerous absences made her not qualified for the position she held is denied. Summary judgment in favor of the Defendant is also granted as to Plaintiff’s Title VII and ADA claims because Plaintiff has failed to present any competent summary judgment evidence that Defendant’s reasons for the adverse employment actions are not true, but are mere pretexts for discrimination or retaliation. ... more>>
