In the computer age we live in, ID theft is becoming more and more of an issue. Luckily the legislators have taken some steps to pass some legislation in this area and protect people from it but when it came to the 2006 congress, there were a few bills about it which were pending. The Data Accountability and Trust Act was going to tell individuals when there was a breach of their personal information except when there was no reasonable basis risk of identity theft or fraud. Part of the problem with this bill passing was the establishment of what was defined as sensitive information and what wasn't. The Financial Data Protection Act wanted to inform people whose personal information was breached and would be used in a manner which would harm them. When it says harm it means financial loss. There was also the Cyber-Security Enhancement and Consumer Data Protection Act which is more limited than some of the other data security bills. It concerns major security breach which involve at the information of at least 10000 people. It is not sure how often this will be used but its good to know that its there. When a contract has been breached one has to decide what type of justice will remedy the breach. There are different types of remedies and the one which will be applied depends on the circumstances and the type of breach. Restitution happens when there have been tangible losses and the wronged party wants those back. Reliance is when a person has suffered losses due to the contract being breached and wants to be paid back what was lost. Expectancy is when the contract isn't followed out and the wronged party wants to be paid out as if it was. Substitution relief is when there is no real way to make good on what happened so money is the best there is. Compensatory damages are those for a direct and foreseeable loss while punitive damages are for those which are not recoverable such as murder, libel or defamation. Nominal damages are a token amount. So according to the situation one has to decide which damages are most appropriate and how much. A medical case when a person suffers pain and injury will be different from a business case when a deal hasn't been followed through on. A breach of contract is quite a serious offence as if it happens the contract in question can be declared null and void. Given the legal nature of it, its best that everything concerning a contract and any breaches is followed through formal channels. If someone believes a contract to be breached they should write a legal notifying the party in question that they believe the contract has been breached and they should state why. Depending on the severity of the breach, the consequences will vary. It can range from asking to simply not happen again to damages being paid. Typically a breach occurs in an employment situation. An employee has violated the contract is some way and now the employer has the right to tear up and cancel the contract. This happens with athletes when they misbehave and then the team sacks them. If the reverse happens and the employee is wronged they will ask to be recompensed as opposed to cancel the contract. They may be paid less then they should be – instead of canceling the contract they will ask for the money in question.
