11   TO AMEND CHAPTER 3, TITLE 56 OF THE 1976 CODE, TO
12   PROVIDE THAT THE DEPARTMENT OF MOTOR VEHICLES
13   MAY ISSUE OPERATION DESERT STORM-DESERT SHIELD
14   VETERANS LICENSE PLATES, OPERATION ENDURING
15   FREEDOM    VETERANS    LICENSE    PLATES,    AND
16   OPERATION IRAQI FREEDOM VETERANS LICENSE
17   PLATES.

19   Be it enacted by the General Assembly of the State of South
20   Carolina:
21
22   SECTION 1. Chapter 3, Title 56 of the 1976 Code is amended by
23   adding:
24
25                    “ARTICLE 101.
26   OPERATION DESERT STORM-DESERT SHIELD VETERANS
27               SPECIAL LICENSE PLATES
28

30      Section 56-3-10110. (A) The         department     may      issue
31   “Operation Desert Storm-Desert Shield Veteran” special motor
32   vehicle license plates to owners of private passenger-carrying
33   motor vehicles or light pickups having an empty weight of seven
34   thousand pounds or less and a gross weight of nine thousand
35   pounds or less registered in their names who are veterans of
36   Operation Desert Storm-Desert Shield who served on active duty
37   in the Persian Gulf at anytime during the period of August 2, 1990,
38   to February 28, 1991. The motor vehicle owner must present the
39   department with a DD214, or other official documentation that
40   states that he served on active duty during Operation Desert Storm-
41   Desert Shield, along with his application for this special license
42   plate. The special license plate may have imprinted on it an

 1   emblem, a seal, or other symbol that honors veterans of Operation
 2   Desert Storm-Desert Shield. The special license plate must be
 3   issued or revalidated for a biennial period which expires
 4   twenty-four months from the month it is issued. The fee for this
 5   special license plate is the regular motor vehicle registration fee
 6   contained in Article 5, Chapter 3 of this title and a special motor
 7   vehicle license fee of twenty dollars.
 8      (B) Notwithstanding any other provision of law, from the fees
 9   collected pursuant to this section, the Comptroller General shall
10   place sufficient funds into a special restricted account to be used
11   by the Department of Motor Vehicles to defray the expenses of the
12   department in producing and administering the special license
13   plates. The remaining funds collected from the special motor
14   vehicle license fee must be placed in the state’s general fund.
15      (C) Before the department produces and distributes a plate
16   authorized under this section, it must receive:
17        (1) four hundred or more prepaid applications for the special
18   license plate or a deposit of four thousand dollars from the
19   individual or organization seeking issuance of the license plate. If a
20   deposit of four thousand dollars is made by an individual or
21   organization pursuant to this section, the department must refund
22   the four thousand dollars once an equivalent amount of license
23   plate fees is collected for that organization’s license plate. If the
24   equivalent amount is not collected within four years of the first
25   issuance of the license plate, then the department must retain the
26   deposit; and
27        (2) a plan to market the sale of the special license plate that
28   must be approved by the department.
29      (D) If the department receives less than three hundred biennial
30   applications and renewals for a particular special license plate
31   authorized under this section, it shall not produce additional
32   special license plates in that series. The department shall continue
33   to issue special license plates of that series until the existing
34   inventory is exhausted.”

36   SECTION 2. Chapter 3, Title 56 of the 1976 Code is amended by
37   adding:

39                    “ARTICLE 102.
40    OPERATION ENDURING FREEDOM VETERANS SPECIAL
41                  LICENSE PLATES

 1      Section 56-3-10210. (A) The         department      may      issue
 2   “Operation Enduring Freedom Veteran” special motor vehicle
 3   license plates to owners of private passenger-carrying motor
 4   vehicles or light pickups having an empty weight of seven
 5   thousand pounds or less and a gross weight of nine thousand
 6   pounds or less registered in their names who are veterans of
 7   Operation Enduring Freedom who served on active duty fighting
 8   against terrorism at anytime following September 11, 2001 until
 9   the operation is completed. The motor vehicle owner must present
10   the department with a DD214, or other official documentation that
11   states that he served on active duty during Operation Enduring
12   Freedom, along with his application for this special license plate.
13   The special license plate may have imprinted on it an emblem, a
14   seal, or other symbol that honors veterans of Operation Enduring
15   Freedom. The special license plate must be issued or revalidated
16   for a biennial period which expires twenty-four months from the
17   month it is issued. The fee for this special license plate is the
18   regular motor vehicle registration fee contained in Article 5,
19   Chapter 3 of this title and a special motor vehicle license fee of

14      Section 56-3-10310. (A) The         department      may      issue
15   “Operation Iraqi Freedom Veteran” special motor vehicle license
16   plates to owners of private passenger-carrying motor vehicles or
17   light pickups having an empty weight of seven thousand pounds or
18   less and a gross weight of nine thousand pounds or less registered
19   in their names who are veterans of Operation Iraqi Freedom who
20   served on active duty in Iraq or the Persian Gulf at anytime from
21   March 20, 2003, until the operation is completed. The motor
22   vehicle owner must present the department with a DD214, or other
23   official documentation that states that he served on active duty in
24   Iraq during Operation Iraqi Freedom, along with his application for
25   this special license plate. The special license plate may have
26   imprinted on it an emblem, a seal, or other symbol that honors
27   veterans of Operation Iraqi Freedom. The special license plate
28   must be issued or revalidated for a biennial period which expires
29   twenty-four months from the month it is issued. The fee for this
30   special license plate is the regular motor vehicle registration fee
31   contained in Article 5, Chapter 3 of this title and a special motor
32   vehicle license fee of twenty dollars.

18   SECTION 4. This act takes effect upon approval by the Governor.
