Footnotes & Declaration

Footnote (1)
The Rehabilitation of Offenders Act 1974, provides for many people who have been
convicted of certain criminal offences the opportunity to have no need to refer to these
convictions or the circumstances relating to them in the course of their daily lives. Certain
convictions can, therefore, be regarded as “spent” after the lapse of a period of years
under the terms of the Act. The National Health Service employment for which you are
applying is excluded in the provisions of the Act unless otherwise stated in the job
description. Unless stated, you are required not to withhold information about
convictions which for other purposes are “spent” under the provisions of the Act. This
means that all previous convictions must be declared. If you are offered employment, any
failure to disclose such convictions could result in dismissal or disciplinary action. Any
information given, however, will be completely confidential and will be considered only in
relation to the post for which this application form refers.

I declare that I have: (a) No previous convictions

will be taken to ensure data is processed fairly, kept secure, protected against loss or
damage & only disclosed (unless required by law or legal process) on a need to know
basis. Under the Act you are entitled to ask us in writing to provide copies of certain data
we hold about you, upon payment of the appropriate fee.

                         __

Registration with the General Medical Council or General Dental Council
imposes on doctors and dentists the duty to provide a good standard of
medical care for, and to behave appropriately towards patients. NHS
Employers also have a duty to ensure that patients receive a good standard of
medical care and ensure as far as possible the safety of patients. In
accordance with NHS Circular PCS(DD) 2001/1, we therefore need to
establish if you have been found guilty of a criminal offence, been bound over
or cautioned or are currently the subject of proceedings which might lead to a
conviction, an order binding you over or a caution, in the UK or any other
country.

Applicants for posts in the NHS are exempt from the Rehabilitation of
Offenders Act 1974. Application packs include a declaration for applicants to
compete declaring any previous or pending prosecutions or convictions,
including those considered “spent” under this Act. This will also include a
declaration of any cautions or bind overs. We also need to establish if you
have been the subject of any fitness to practise proceedings in the past, or if
any fitness to practise proceedings are being contemplated, by a licensing or
regulatory body in the UK or another country and this is also reflected in the
declaration.

Attached is a declaration which you must complete and return with your CV.
Please note that your application cannot be processed unless this form
is received with your CV. This information will be treated in confidence and
will not debar you from appointment unless the selection panel considers that
it renders you unsuitable for appointment. In reaching such a decision we will
consider the nature of the conviction/action, how long ago it took place and
any other factors which may be relevant.

Failure to disclose a criminal offence, having been bound over or
cautioned or that you are currently the subject of criminal proceedings
which might lead to a conviction, an order binding you over or a caution,
or fitness to practise proceedings undertaken or being undertaken by an
appropriate licensing or regulatory body, may disqualify you from
appointment, or result in summary dismissal/disciplinary action and
referral to the General Medical Council [General Dental Council] for
consideration if such a discrepancy came to light.

If you would like to discuss what effect any previous convictions, police
investigations or fitness to practise proceedings taken or being taken either in
the UK or by an overseas licensing or regulatory body might have on your
application, you may telephone Anne Holmes, Medical and Dental Team
Lead, on 0141 278 2657 in confidence, for advice.

                                   REF: 22491D

BACKGROUND INFORMATION

Oral and Maxillofacial in-patient services for Greater Glasgow (population 910,000) and Argyll and
Clyde (population 430,000) have been centralised to the Regional Maxillofacial Unit at the Southern
General Hospital in Glasgow for adults and paediatric craniofacial procedures and at Yorkhill
hospital for all other paediatric oral and maxillofacial services including cleft lip and palate.

There are 19 in-patient operating sessions a week with 5 of these dedicated to acute trauma cases at
the Southern as well as an all day and day case lists at Yorkhill. As well as trauma the Unit has a
large throughput of head and neck cancer, orthognathic surgery, craniofacial surgery, cleft lip and
palate and jaw joint and salivary gland pathology.

Dento-alveolar cases are treated mainly on 2-Day Case lists, but occasionally cases are admitted.

There is a large outpatient department consisting of 4 operating surgeries and associated consulting
rooms. The department is in constant use for consultant clinics, review clinics, and operating under
local anaesthesia. There is also a large multidisciplinary oncology clinic once a week and various
other combined clinics (orthognathic planning, surgical dermatology including Mohs, cleft lip and
palate and rehabilitation etc).

The Maxillofacial Technicians laboratories and medical illustration services are adjacent to the
outpatient clinic and provide comprehensive and specialist services the department.

The Consultants based in Glasgow provide outpatients services to the other main hospitals in Glasgow
and Argyll and Clyde Health Boards Areas. The SHO’s however, remain within the Southern Unit
and only occasionally visit other hospitals.

The Regional Unit is visited by other West of Scotland Consultants who take part in the on-call rotas,
the treatment of Maxillofacial trauma and the oncology service.

The Maxillofacial Unit is part of the Regional Services Directorate and in this way is closely allied to
Neurosciences and ENT.
