					                        Item 7: Intellectual Property Rights


IPR Considerations:

      1G cannot be put in a position of responsibility for the data it delivers.

      Is it important that IPR be clearly specified for each type of data?
           metadata
           raster/image data
           WMS data service provided by source
           GeoSciML/data

      Different contributing organizations will have different access policies.

      Same policy regarding private and commercial use of 1G data ?

      Fees/license/business model:
          Are all 1G data available with for no fee/single license?
          Will there be a licence agreement between providers & 1G?
          Will there be a licence agreement between OneGeology and those outside the consortium
         who want to use the data?

      Who owns the IPR on the foreground rights (i.e. systems and data that OneGeology creates as a
     result of its work?)

Options:

    1.   All data ownership remains with the source. Source/origin for all data will accompany
         data = source/origin owns data and is fully responsible for liability/quality and setting
         use policy?

    2.   Are we going to create a single “Consortium Agreement” which will detail all the IPR
         arrangements?

    3.     Should 1G investigate policy for commercial possibilities for the data?

Example: Global Mapping Data use policy

           1.   Registration, acceptance of policy required to download data.

           2.   Non-commercial use encouraged, acknowledgement requested.

           3.    Commercial-use policy, default is non-commercial use, user responsibility to
                contact source for permission, not 1G.
