					                           ACTION PLAN
          FOR THE IMPLEMENTATION OF THE NATIONAL
                 ANTICORRUPTION STRATEGY
                    IN THE PERIOD 2004-2005

This Action Plan comes to update the Governmental Action Plan for the
Implementation of the National Anticorruption Strategy adopted by
Decision No. 84 of the Council of Ministers on February 13, 2002.
This updated Action Plan is a fundamental organizational and managerial
instrument for the implementation of the objectives and priorities outlined in the
governmental strategy and as such, it is an integral part thereof. In this Action
Plan, the implementation up to now has been considered, and the following was
made: analysis and assessment of the present situation of the corruption and the
level of risks for corruption in the country, and in the various public spheres.
Considered were the national experience gained and the conclusions,
evaluations and recommendations of the competent bodies of the European
Union, the World Bank, the International Monetary Fund, the national and
international nongovernmental organizations, as well as the expertise and the
recommendations of the international anticorruption organizations at the United
Nations Organization, of the Organization for Economic Cooperation and
Development, and the Council of Europe (the EAC).

The horizon viewed in the updated Action Plan covers the period 2003-2005,
during which the legal, organizational and public conditions necessary to
achieve the main objectives of the national strategy shall be finally established.

By the end of that period the country should have established an integrated
institutional, legal and informative anticorruption environment, based on
the European Community’s principles and standards in corruption
counteraction. Besides, a significant presence of the nongovernmental
organizations in the regulation of processes generating corruption should
be available, and the necessary public climate of intolerance should be
established.
Being an organizational and managerial instrument, this Action Plan of open
character within the frameworks of the objectives outlined in the National
Anticorruption Strategy, and specified in the Action Plan itself. It is subject to
ongoing updating, in compliance with the changes in the social environment, in
the viewpoints concerning the ways and means to be used to achieve the
objectives set, and with changes in the financial, organizational and other
possibilities for the fulfillment of its tasks.
The Action Plan for 2004-2005 proceeds from the assessments of the National
Anticorruption Strategy concerning the negative consequences and the risks
caused by the corruption in Bulgaria, and the long-lasting importance of the
strategic objectives developed therein. In the Action Plan, the intensification of
the democratic processes in the country during the last two years and the social
climate of intolerance were taken into account, created as a result of the
implemented measures, as well as the legal prerequisites and the organizational
conditions for a more effective counteraction to corruption.

At the same time, the Action Plan for 2004-2005 is based on the analytical
evaluation of the unwavering public opinion that there is a generally high level
of corruption, of the unsatisfactory situation concerning such essential
components of the social system, as openness and accountability of the
management to society, the relatively slow progress in the sphere of de-
regulation and de-centralization of the fiscal system, and of the public
management. Considered was also the fact that – in spite of the large-scale
legislative and organizational work done, the effectiveness of the services
provided by the administration to the citizens and the relevant responsibility,
continue to be far below the European standards.
The Action Plan renders account to the organization of the fight against
corruption and the positive results in the restraint of corruption in the spheres of
police, customs, and tax administration; in the license regimes, in privatization,
and in the post-privatization control. At the same time, it accounts for the
dynamics in the risks for corruption and their nonetheless high level in such
public spheres as awarding of public procurements, privatization and post-
privatization control, license and authorization regimes, the regime of
construction, the customs regime, the tax control, investigation and jurisdiction,
public health and education.

The Action Plan’s objectives and tasks account for the elements of high
potential of anticorruption, introduced into the social practice by intensifying
the processes of deregulation and modernization of the administrative system,
by expanding the free market relations and intensifying the civil control over
the management, as well as by contributing through such steps to the prevention
of a corrupt situation in the country from developing in negative direction.
The Action Plan is based on the priority of the Government to fight against
corruption and its concern about society, expressed in the implementation of
substantial and effective measures against all forms of corruption, at which the
Government focused on measures of prevention, and on the understanding that
overcoming of corruption will be an important political condition for Bulgaria’s
accession to the European Union.

The Action Plan accepts for important indicator the fact that the ranking of the
Republic of Bulgaria improved as regards the comparative index set by the
international nongovernmental organization “Transparency International”,
according to which from the 66th place (with the worst ranking of 99th place in
1998), the country moved up to the 49th place in 2000, and up to the 47th place
in 2002, so that – according to this index, it managed to become equal the
Central European countries. The Action Plan is directed towards maintaining
and accelerating this positive tendency.

In order to restrict and overcome the factors and conditions, which generate
corruption, the Action Plan comes to organize the efforts in the following main
directions of activities: strengthening the institutional system for corruption
counteraction, development of the legal fundamentals for the fight against
corruption, modernization of the administration to provide effective
services to the citizens and the businesses, perfection of the operation of the
tax and the judicial system, formation of conditions to restrict corruption
in such spheres, as public procurements, economy, customs, police and the
special services, intensification of the social intolerance and immunity to
corruption, and anticorruption cooperation between the public institutions,
the nongovernmental organizations and the mass media.

In order to follow the above directions, the Government will arrange for
the accomplishment of the following main objectives and tasks:

1.  DEVELOPMENT OF A COMMON INSTITUTIONAL AND
LEGAL   ENVIRONMENT, IN ORDER  TO   OVERPOWER
CORRUPTION

      - Strengthening the capacity of the specialized system of the Executive
      Power for corruption counteraction;
      - Improvement of the organization of the public structures, for a more
      efficient counteraction of corruption;

      - Improvement of the interaction between the specialized structures of
      the Executive Power, the National Assembly, the judicial system and
      the national control system;

      - Strengthening the status and professionalism of the administration
      concerning matters related to corruption counteraction;
                          Main tasks and measures

1.1. Undertaking of a national survey, in order to assess the current levels of
corruption and of risks for corruption, and the factors generating them within
the Executive Power structures.

      In charge: the Anticorruption Coordination Commission, jointly with
      the Ministers, the Agency Chairpersons and the Regional Governors.
      (In this survey, the leading nongovernmental organizations and the
      media shall be involved, and shall cooperate. This survey shall come to
      an end with a clear definition of the main forms of corruption, with
      suggestions for anticorruption measures and with highlighting the most
      efficient anticorruption measures and steps to be taken in the period
      2002-2003. The Minister of Justice shall initiate undertaking of a
      similar survey in the judicial system, as well).

1.2. Organizational and structural further establishment, functional and
personnel strengthening of the specialized institutional system for corruption
counteraction.
Development of a suggestion for legal measures (within the Law Amending and
Supplementing the Law on Administration), to strengthen the position and
status of the Anticorruption Coordination Commission (ACC), as a centralized
administrative body involved in the matters concerning corruption
counteraction, and to strengthen the role of the inspectorates at the ministries in
their fight against corruption.

1.3. Development of a suggestion for the legislative regulation of the status
and functions of the specialized anticorruption structures at the ministries,

1.4. Strengthening the capacity of the Anticorruption Coordination
Commission, to perform advance investigations in order to examine and shed

signals of corruption.

      standards of anticorruption instruments: the Convention for
      Combating Corruption, when officials of the European Communities

      addressed to the Bulgarian country by the European Commission, by

5.2.   Enforcement of the anticorruption reform in the customs houses

       - Perfection of the customs legislation, and achieving the European
       standards of legislation and practice in combating corruption;

       - Improvement of the technological information exchange with the
       customs authorities in the European countries, and especially with the
       neighboring countries;
       - Raising the efficiency of the functions “Intelligence and
       Investigation” at the Agency “Customs”, design and application of an
       efficient system for internal audit;

       - Introduction of a new policy of professional ethics directed towards
       raising the level of professional ethics in the sphere of customs offices;

       - Opening the Bulgarian Customs Agency towards the public;
       transparency in the customs administration’s activity, introduction of
       more efficient measures for collaboration with the business community,
       and better public relations;

       - Improvement of the interaction with the judicial authorities, with the
       procurator’s and investigation offices, as well as with other public
       authorities.

5.2.1. Undertaking of a thorough survey of the structure, organization of the
functions in the structures involved in customs control and of the existing
systems within the Bulgarian Customs Agency, and development on this ground
of measures to optimize the distribution of resources in the Agency “Customs”,
to achieve effective control and reduction of the risk for corruption.

8.  MAINTENANCE    OF    THE   ORGANIZATIONAL                               AND
FINANCIAL RESOURCES FOR THE ACTION PLAN
8.1. The ministries, agencies and the regional governors shall draw up and
approve organizational plans for accomplishing the tasks and measures from the
Action Plan. If for a specific task coordinated efforts are required, joint plans
shall be drawn up. The possibilities for the EU pre-accession programs to
contribute to the implementation of the tasks shall be considered at their
maximum.

8.2. Undertaking of assessment concerning the progress in the
accomplishment of the Action Plan by the end of each semester. At the end of

counteraction, and the report shall be discussed and adopted by the Council for
Corruption Fighting at the Council of Ministers.
