Dear Minister I write in relation to the report (CPA/2007/02) laid before Parliament by the Commissioner for Public Appointments in Scotland (‘the Commissioner’) concerning appointments to the Cairngorms National Park Authority and Loch Lomond and the Trossachs National Park Authority. At its meeting on 2 October 2007, the Committee considered the Commissioner’s report as well as the recent correspondence between you (and your officials); and the Commissioner (and her office). The Committee carefully considered the views both you and the Commissioner expressed and agreed that both views appear to be legitimately held. However upon reflection the Committee agreed that it would be premature for it to recommend a course of action to the Parliament to resolve this issue without first providing you and the Commissioner a further opportunity to reach agreement on the way forward for future appointments to these bodies. The Committee therefore agreed that I should write to strongly encourage you and the Commissioner to work together to seek a practical, joint solution for future appointments of this nature. In this regard the Committee would welcome a written response detailing any agreed suggested course of action from you by Monday 7 January 2008. A similar request will also be made of the Commissioner. These responses will then be considered by the Committee at its meeting on 15 January 2008 and, if necessary, the Committee will then also consider what further, if any, action should be taken as a result of the responses from you and the Commissioner.

The Committee is optimistic that by working together you and the Commissioner can agree a workable solution for future appointments.
