I agree to abide by Dallas iMedia Network’s Inc. operating policies and procedures as stated in its current iMedia Member Manual. I represent that the contents of any and all programs submitted for playback are in compliance with all laws, including, but not limited to Texas Penal Code Sec. 43.21, et. seq. (obscenity). I agree that program material I tape, and submit for cablecast and streaming delivery on iMedia’s website will not contain: A. Obscene material; B. Any commercial advertising; C. Any promotional material concerning products or services presented for the purpose of any solicitation of money or other things of value, unless specifically exempted under the terms of iMedia’s operating rules; D. Any material, which constitutes libel, slander, invasion of privacy or publicity rights, unfair competition, violation of trademark or copyright, which might violate any local, state, or federal law. I assume full responsibility for the content of all program material I submit for cablecast and webstreaming delivery, and will ensure that such program material will not violate any right of any third party. Before the programming material is cablecast or delivered via web streaming, I will obtain all approvals, clearances, licenses, and any other applicable permission documents for the use of any program material which I submit for cablecast, including but not limited to approvals by broadcast stations, networks, sponsors, music licensing organizations, copyright owners, performer’s agents, all persons appearing in or referred to in the program material, or any other approvals that might be necessary to transmit or produce such material over the cable system and internet. I indemnify and hold harmless Dallas iMedia Network, its staff and Board of Directors, and the cable franchise holder against any claims arising out of any use of the program material that I have submitted for cablecast and webstreaming delivery; or any breach of the Statement of Compliance, including but not limited to any claims regarding libel; slander; invasion of privacy or publicity right; non-compliance with applicable laws and unauthorized use of copyrighted material and/or violation of laws prohibiting obscenity. I understand that I may be criminally or civilly liable for performing or producing such programming material which is cablecast or delivered via webstreaming. I agree that I shall not represent myself as an employee or agent of Dallas iMedia Network and will not provide or receive monetary exchange for member use of iMedia facilities and equipment. I agree to pay the costs of any repair or replacement of equipment or materials resulting from damage, misuse, or theft while such equipment or materials are in my possession or control. I shall not use Dallas iMedia Network channels, equipment or facilities for any financial gain or other commercial purposes. I understand that programming produced through member use of Dallas iMedia equipment must be submitted for cablecast and webstreaming on Dallas iMedia Network, and such programming footage is prohibited for other use without applicable fees and the permission of Dallas iMedia Network.
