SSI drawn to Parliament’s The Subordinate Legislation Committee considered the instrument on 13/03/07 and attention by the Subordinate Legislation raised the following points: Committee: 1. To ask why article 2 has a paragraph (1) when there are no subsequent paragraphs in that article. 2. Whether the Executive satisfied with the transitional provisions to be put in place by article 17, given that existing governors will become members of the newly established court for the remainder of their term of office, and that there shall not be more than 24 members of the new court in total, including members who have been appointed or elected under article 4? 3. Whether the reference to “any governors in office” in article 17(1) includes staff governors appointed under article 4(1)(c) of the Queen Margaret College, Edinburgh (Scotland) Order of Council 1994 (SI 1994/2371)? 4. To seek an explanation of the purpose

The Subordinate Legislation Committee considered the instrument on 13/03/07 and agreed to ask the Executive whether it intends to correct the drafting error that is contained in paragraph 11 of schedule 1, given its response to the SLC on the Education (Graduate Endowment, Student Fees and Support) (Scotland) Amendment Regulations 2006 (SSI 2006/323). The Executive said that it would correct the error, but it did not and the error has now reappeared.

The Subordinate Legislation Committee considered the instrument on 13/03/07 and three points arose. First, to ask the Executive why the definition of "European Economic Area" that is used in the regulations differs to that used in Scottish statutory instruments 2007/149, 2007/151, 2007/152 and 2007/153. Secondly, to ask the Executive to explain how the requirement that a United Kingdom national insurance number be included in a completed application sits alongside the exception to the requirement that a UK NI number be provided if requested, which is granted in regulation 9(5). Thirdly, to ask whether the Executive is content that the cross-references that are contained in paragraph 2(4)(b) of schedule 2 are correct.

The 2004 Regulations were made under the Debt Arrangement and Attachment (Scotland) Act 2002, which was substantially amended by the Bankruptcy

The purpose of this instrument is to amends the Bankruptcy Fees (Scotland) Regulations 1993 (the 1993 Regulations) to allow the Accountant in Bankruptcy (AiB) to charge fees for direct access to the Register of Insolvencies, which will be available on-line from 2 April 2007. The 1993 Regulations, as amended, will set out daily and annual fees for on-line searches. UK non-profit bodies will be exempt from these fees. The 1993 Regulations are also amended so that certain fees are payable to the AiB in advance. 4.
