PURGATORY SKI RENTALS RENTAL _ LIABILITY RELEASE AGREEMENT PARENT

							     PURGATORY SKI RENTALS RENTAL & LIABILITY RELEASE AGREEMENT
               PARENT- PLEASE READ CAREFULLY BEFORE SIGNING

1 . I agree on behalf of my child that he/she will accept for use as the equipment to be rented to
him/her, and will accept full responsibility for its care while it is in his/her possession.
2 . I will be responsible for the replacement at full retail value of any equipment to be rented to my
child, but not returned to Purgatory Ski Rentals.
3. I understand that my child must return all equipment by the agreed date in clean condition to
avoid any additional charges.
4 . I understand that my child will receive instruction on the use of his/her equipment and must
fully understand its use and function before each use.
5. I have made no misrepresentation regarding my child’s:

6. I agree that my designated guardian will verify that the visual indicator settings recorded on
the rental form agree with the numbers appearing in the visual indicator windows of the
equipment listed on the rental form.
7. I agree to hold harmless and indemnify Purgatory Ski Rental, its owners, agents and
employees, as well as the equipment manufacturers and distributors for any loss or damage,
including any results from claims for personal injury, death or property damage related to the
equipment to be rented by my child.
8. I understand that there are inherent and other risks involved in the sport of snow
skiing/snowboarding for which the rental equipment is to be used, that injuries are a common and
ordinary occurrence of the sport, my child and I freely assume those risks.
9 . I understand that a ski-boot-binding system will not release at all times or under all
circumstances where release may prevent injury or death, nor is it possible to predict every
situation in which it will release, and it is therefore, no guarantee of my child’s safety. I further
understand that the snowboarding equipment being furnished is designed to not release and
does not protect against any type of injury. This system does not eliminate the risk of injuries to
the user’s knees or to any other part of the user’s body.
10. I hereby agree to release from any legal liability The Purgatory Ski Rentals and its and its
owners, agents and employees, as well as the manufactures and distributors of the rental
equipment from any and all liability for damage and injury or death to my child or to any person or
property resulting from the selection, installation, maintenance, adjustment or use of the rental
equipment and for any claim based upon negligence, breach of warranty, contract or other legal
theory, accepting full responsibility on behalf of my child for any and all such damage, injury or
death which may result.
1 1 . This agreement is governed by the applicable law of the state of Colorado. If any part of this
agreement is determined to be unenforceable, all other parts shall be given full force and effect.
12. In exchange for, and in consideration of I contractually agree that any and all disputes
between myself and Purgatory Ski Rentals arising from my use of any of this equipment or my
participation in the sport of snow skiing or snowboarding, and including any claims for personal
injury and/or death, will be governed by the laws of the state of Colorado and the exclusion
jurisdiction thereof will be in the state or federal courts of the state of Colorado.
