NOTICE OF PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF KING TAKE NOTICE that the Council of the Corporation of the Township of King passed By-law Number 2009-63 on the 6th day of July, 2009 under Section 34 of the Planning Act, R.S.O, 1990. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the by-law by filing with the Clerk of the Corporation of the Township of King not later than the 4th day of August, 2009 a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, together with 2 separate cheques in the amounts of $125.00 (certified cheque or money order only)payable to the Minister of Finance, and a $150.00 cheque representing Clerk’s Department Administrative processing fee, payable to the Township of King. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the Ontario Municipal Board website at www.omb.gov.on.ca or from the Clerk of the Township of King. Please note the Board will only accept filing fee payments by certified cheque or money order. An explanation of the purpose and effect of the By-law and a key map showing the location of the lands affected by the By-law are attached below. Only individuals, corporations or public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party. EXPLANATORY NOTE RE: BY-LAW NUMBER 2009-63 Purpose: The purpose of By-Law 2009-63 (File no. Z-2008-13) is to amend By-law 2008-46. By-law 2008-46 is the site specific zoning by-law which was approved by Council on June 16, 2008, together with related draft plans of subdivision (File nos. 19T-06K01, 19T-06K04, 19T-06K05, 19T-06K06, 19T-06K07). In general, the proposed amendments are related to the updated detailed architectural and urban design guidelines for the related subdivisions and are generally limited to development standards such as garage widths, garage projection and garage placement, and driveway/minimum landscape area for smaller lots, revisions to the Holding provisions, as well as other refinements and administrative amendments. Location: The lands affected by Bylaw 2009-63 form part of the King City East neighbourhood and are generally located in the west part of Lots 2 and 3 and the east part of lots 4,5 and 6 Concession 3 (map attached). Effect: The effect of the Bylaw will be to revise the restrictive land use zones within each subdivision area to control the permitted land use and to establish development standards to regulate the location of buildings and structures to be built within each plan of subdivision.
