Consignment Contract
Agent: Allison Mitkowski 6110 E 5th St Apt #210 Tucson, AZ 85711 Email: amitkoequine@yahoo.com (919) 607-6567 Owner: Horse For Sale: Conditions of Consignment Contract: Allison Mitkowski and its associates act as agents and are not responsible for buyer and seller errors or misunderstandings. All representations and guarantees are strictly between the buyer and seller. Sellers are liable for any incomplete registration papers, transfers and certificates even if these errors are not noticed by Allison Mitkowski and its associates. Horses will be sold as registered in the sale if all appropriate and required registration papers are received by Allison Mitkowski. Fees: Consignment fees are non refundable and are due at the time the horse(s) are sold. The consignment fee is 10% of selling price of _____ per horse. Showing of the horse to potential customer will be a fee of $35. The consignor has the privilege to "no sale" or "pass out" his/her horse. There will be no fee assessed for this privilege. Consignors (Sellers) must pay all applicable fees before loading their horse(s). Payment: All horses must be paid for the day of the sale. Checks written for an amount over $15,000.00 must accompany a current (30 days) bank letter of credit that is made out to "Allison Mitkowski". Horse Health Papers: All horses brought on site must have a current (within the last 12 months) negative coggins test. This includes horses that are not in the sale but have brought to help in the demonstration sessions. Those horses that have been transported from out of state must have a health certificate from a practicing veterinarian and a permit. Health certificates MUST reflect the current coggins test. Safety/Liability: The safety of all participants at the sale is of utmost importance to Allison Mitkowski. All horses must be stalled or in trailer while at the sale unless being demonstrated for the safety of all attending. Parents are responsible for their children, and children should NOT be left unattended. All participants of the sale attend at their own risk. Allison Mitkowski is NOT responsible for horses, any accidents, or loss of property at the sale. Prior arrangements must be made for any horse(s) left overnight at the sale location. Under Arizona law (Arizona Revised Statutes s 12-553), an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risk of equine activities.
