The Lake Huron Joint Board of Management (LHJBOM) is the owner and provides governarlce for the
Lake Huron Primary Water Supply System. Benefiting member municipalities currently participating in
the LHJBOM include the City of London, Municipality of Bluewater, Municipality of North Middl€Êex,
Municipality of Lambton Shores, Municipality of South Huron, Township of Lr¡can-Biddulph, Municipality
of Middlesex Centre and the Municipality of Strathroy-Caradoc.

The Lake Huron Primary Water Supply System is comprised of the Lake Huron Water Treatment Plant
located near Grand Bend, the McGillivray Booster Purnping Station and Reservoir, the Exeter-Hensall
Booster Pumping Station and Reservoir, the Arva Terminal Reservoir, the Komoka-Mt. Brydges
Booster Pumping Station, and the associated interconnecting transmission water mains, which includes
the primary, Strathroy, Exeter-Hensall, and Komoka-Mt. Brydges transmission water mains.

The LHJBOM provides management oversight for the Quality Management System (QMS), approves
and monitors policy and continual improvement, and also provides the necessary resource support for
the successfut implementation and ongoing viability of the QMS at all of its facilities.

The LHJBOM currently utilizes the services of an independent contract Operatiñg Authority who
operates and maintains the Lake Huron Primary Water Supply System on behalf of the LHJBOM.
Ùnder the QMS, the Operating Authority is responsible for implementing and maintaining the QMS in
partnership with the LHJBOM.

Together, the LHJBOM and Operating Authority are committed to:

'       Providing the customer with clean, safe drinking water.

"   Managing and operating the Lake Huron Primary Water Suppty System in a responsible manner in
    accordance with documented quality management policies and procedures.

        Being a quality leader in the business sector in which we participate.

o       Promoting owner and consumer confidence in the safety of the drinking water supply.

o   At a minimum, meeting all relevant legislative and other requirements and encouraging our
    suppliers and subcontractors to similarly meet these requirements.

"       Promoting resource stewardship, including conservation'

The LHJBOM and Operating Authority will periodically undertake appropriate reviews, evaluations and
performance measuiements of its operations to ensure compliance with the LHJBOM Quality
Management Policy.

The LHJBOM and Operating.Authority are committed to accomplishing our goals through the
dedication, support and partìcipation of allemployees, and maintenance and continual improvement of
our Quality Management SYstem.

         Describe your Drinkin g-Water System
         The Lake Huron Water Treatment Plant (WTP) employs pre-chlorination, screening, powder
         activated carbon addition (seasonally on an as-required basis), coagulation, flocculation,
         sedimentation, dual-media filtration, post-chlorination, and sodium hydroxide addition to
         treat raw water obtained from Lake Huron. The WTP intake crib and raw water intake pipe
         have an estimated gross capacity of 454.6 Megalitres/day (MLD). The WTP rated capacþ
         is 340,0 MLD.
        The distribution system is comprised of the McGillivray Booster Pumping Station and
        Reservoir, the Exeter-Hensall Booster Pumping Station and Reservoir, the Arva Terminal
        Reservoir, the Komoka-Mt. Brydges Booster Pumping Station (PS#4) and the associated
        interconnecting transmission water mains, which includes the primary, Strathroy, Exeter-
        Hensall, and Komoka-Mt. Brydges transmission water mains.
        The drinking water system is monitored at various locations throughout the system via a
        Supervisory Control and Data Acquisition (SCADA) system.

That the Board of Management for the Lake Huron Primary Water Supply System APPROVE the
proposed CAO Bylaw as attached.



Bylaw No.5, a bylaw relating to the appointment of a Chief Administrative Officer for the Lake Huron
Primary Water Supply System, was introduced and approved on March 20,2008. This Bylaw included
a definitíon of the Chief Administrative Officer as the "General Manager of Environmental Services and
City Engineer" of the Administering Municipality, and atlowed the Chief Administrative Officer to
delegation duties and authorities, in whole or in part.



Earlier this year, the City of London began an organizational review which among other things
eliminated the position of General Manager of Environmental and Engineering Services. For reasons of
efficiency, that position has been combined with the main duties of another vacant Generat Manager
position within the City of London. ln order to ensure this Joint Board of Management receives the
senior level oversight and management support required, it is recommended that the responsibilities of
the Board's Chief Administrative Officer be appointed to the City of London - City Engineer. ln order to
transfer these responsibilities, Bylaw No. 5 must be updated to reflect the current titles within the City of
London organizational structure.

The City of London's CÍty Engineer is currently held by Mr. John Braam (Director of Water & City
Engineer). Mr. Braam's background, knowledge, experience and presence in the municipal water
sector in Ontario make him an ideal candidate for this position and in keeping with the intent of the
current bylaw and original assignment of these duties.

ln order to assist with the transition period, it is proposed the Mr. Braam assume full duties for the next
scheduled meeting of the Board, scheduled to occur on August 4, 2011. ln addition a similar transfer
will take place with respect to Recipient Co-Chair position on the Agreement Management Committee
for the HELP Clean Water Project, effective the , next meeting of that committee scheduled for August
23,2011.

Supply System as follows:

1.0     ln this by-law, unless the context otherwise requires:

    "Administering Municipality" means the corporation of the city of London;

    "Board" means the Joint Board of Management for the Lake Huron Primary Water Suppty System;

2.1    Section 1 "Definitions" of By-Law No.2 (August 31, 1999), in part, specifically with regard to the

3.1    In this by-law and all other by-laws and resolutions of the Joint Board of Management for the
       Lake Huron Primary Water Supply System, the Chief Administrative Officer of the Lake Huron
       Primary Water Supply System shall be the City Engineer of the Administering Municipality.

3.2
'      The Chief Administrative Officer of the Lake Huron Primary Water Supply System shall be
       responsible for the provisions and obligations of the Administering Municipality as provided by
       the Transfer Order for the Lake Huron Primary Water Supply System W1/1998) dated
       September 15, 2000, as amended by by-law, or directed by by-law or resolution of the Board
       from time to time.

3.3    The City Engineer of the Administeríng Municipality may delegate the appointment of the Chief
       Administrative Officer, in whole or in part, in respect to the responsibilities of the Administering
       Municipality regarding the Lake Huron Primary Water Supply System. Delegation of the
       appointment of the Chief Administrative Officer shall be in writing to the Board.

3.4    The delegation of the appointment of the Chief Administrative Officer may be rescinded at the
       discretion of the City Engineer of the Administering Municipality. Rescinding the delegation of
       the appointment of the Chief Administrative Officer shall be in writing to the Board.

At the time of writing this report, constructíon on site is underway with only a few complications, largely
related to weather. The bedding for the new turfstone driveway to the new building extension has been
installed, the excavation for the foundation for the new building has been completed and the footings
have been placed.

The íssues that have been encountered to date include:
    1.   lnterference caused by an existing underground duct bank located during the excavation,
         required the footing to be re-engineered prior to the completion of the foundation construction,
         resulting in an extra cost valued at approximately 924,300.
    2.   The cooling water pipes for the existing generator needed to be exposed within the excavation
         to install new silencers. At the time of exposing the existíng cooling water pipes, these pipes
         were discovered to have no restraints installed and came apart when the supporting soils were

           removed. A temporary repair was conducted to remedy this until the old generator                       is
           decommissioned, resulting in an extra cost valued at approximately $9,500.

The Lake Huron primary water transmission main was originally constructed in 1966 and consists of
approximately 47km of 1200mm concrete pressure pipe from the water treatment plant in the
Municipality of South Huron, north of the community of Grand Bend, to a terminal reservoir located west
of the community of Arva within the Municipality of Middlesex Centre. The 1200mm water transmission
main was partially twinned in 1996 at three (3) different locations utilizing both steel and concrete
pressure pipe for a total approximate distance of 21km (each segment approximately 7km), to reduce
the risk of a main break over potentially "failure-prone" high pressure areas along the pipeline.

The engineering assignment awarded to Stantec Consulting at the December 2009 meeting of the
Board consisted of a Municipal Class Environmental Assessment and Preliminary Design Report, along
with further definition of the scope of work for the project and identification of limiting factors associated
with the proposed pipeline twinning project, as well as the provision of some assistance in the ongoing
landowner consultation process.

The Board of Management for the Lake Huron Primary Water Supply System (LHPWSS) awarded the
engineering assignment to undertake the Municipal Class Environmental Assessment and Preliminary
Design for twinning of the Lake Huron Primary Transmission Main to Stantec Consulting Ltd. on
December 10, 2009 in accordance with the approved procurement and consultant selection process.

Municipal Class Environmenta! Assessment
The Municipal Class Environmental Assessment (Class EA) study report component of the project was
completed in March 2011 and defines the scope of the project, limits of the study area, outlines the
selection of the preferred twinning segment locations, and estimates the duration of construction. The
Class EA report evaluated and identified Alternative 2 - "Twin within Existing Transmission Main
Easement" as the prefered alternative.

As part of Class EA process, notification was sent in the form of letters to all potentially affected
landowners throughout the easement corridor and applicable agencies to engage the public in a
manner so to inform them of the project and maintain communiðation througñout tne assessment
process. ln advance of the finalization of the Environmental Assessment process, a draft copy of the
Class EA document was forwarded to the Lake Huron Pipeline Landowners Association for information
and comment.

Following completion of the Class EA study report and upon receipt of Lake Huron Pipeline
Landowners Association review comments, a Notice of Completion was published in the Saturday April
2,2011 edition of the London Free Press as well as other local papers informing the public that the
LHPWSS will proceed with the design and construction of this project subject to any comments
contained within the Class EA for a period of 3O-days which concluded May 3, 2011.

Upon conclusion of the public review and comment period, one review submission was received on
behalf of the Lake Huron Pipeline Landowners Association requesting from the Minister of Environment
that a Part ll Order under the Environmental Assessmenf Acf be undertaken elevating this project to a
Schedule C so to inventory and address environmental concerns and mitigation measures as
requested by the association. At the present time due to the nature and sensitivity of the ongoing
negotiations with the association, Stantec is preparing rebuttaldefense documents, with the assistance
of the legal firm retained for the ongoing negotiations with the Landowners Association, in support of
the project concluding as a Schedule B and progressing through to detailed design.

Preliminarv Desion Report
The preliminary design phase of the project was initiated in January 2010 and a Preliminary Design
Report was completed in March 2011.

The finalized preliminary design proposes to extend parallel twinning of two sections of the primary
transmission main last constructed in 1996 within the existing transmission easement with a new 1200
mm (4ft) diameter transmission main. The 'North Section" runs from the interconnection chamber at
Shipka Line running south west to South Rd west of Blackbush Line parallel to the existing pipeline for
a length of approximately 3,350m. The "South Section" runs from the interconnection chamber at
Maguire Rd north of Maple Lodge Dr southeast to Elginfield Rd (formerly Highway 7) parallel to the

existing pipeline alignment for a length of approximately 4,200 m. The general location of the proposed
twinning sections are identified in Appendix A attached to this report.

As part of the Preliminary Design Report, Stantec provided a preliminary construction cost estimate of
of approximately $26,648,335 (excluding HST), based on a number of assumptions regarding
construction conditions and connection requirements. Board staff have reviewed the preliminary
construction cost estimate and have concluded that it is very conservative and contains several
assumptions that would not apply. Based on similar projects undertaken in the region, including the
pipeline twinning for the Elgin Area Primary Water Supply System currently underway, it is the opinion
of staff that the construction cost should be in the order of $19 million, including detailed engineering.

Desiqn-Build Procurement Process
Subject to the approval of the Class EA document by the Ministry of the Environment, and based upon
Board approval at the March 2011 meeting, this project is cunently proceeding as a design-build
project. An expedited three stage design-build competitive procurement process is being undertaken
with the award anticipated for Board approval at the October 6, 2011 Board meeting. Based on
comparable projects, it is anticipated that the proposed Lake Huron Primary Water Transmission Main
Twinning Project will be substantially complete by December o12O12.




This project is included as one component of the HELP Clean Water initiative; a partnership between
the Lake Huron Primary Water Supply System, the Elgin Area Primary Water Supply System and the
City of London for regionally-significant water-related projects. This project has received grant funding
from senior levels of government under the Building Canada Fund and accordingly additional reporting
and coordination requirements are requisite to meet the obligations of the Contribution Agreements.
Each of Canada and Ontario are contributing up to one-third of the eligible project costs, to a maximum
contribution of $9,433,333 (each).

The fìnancial statements for the Lake Huron Primary Water Supply System are audited on an annual
basis and provided to the members of Board of Management for information. Copies of the audited
statements are also forwarded to each of the benefiting municipalities.

Normally the audit of the financial statements and the provision of the auditors report is completed by
mid-April of each year, however due to the implementation of PSAB 3150 for the Lake Huron Primary
Water Supply System, the completion of the audit was delayed.

1.     Slgnificant accounting policies

       The financial statements of the Lake Huron Area Primary Water Supply System are the
       representation of management, prepared in acoordance with Canadian generally accepted
       accounting principles as defined in the Canadian lnstitute of Ghartered Accountants Public Sector
       Accounting Handbook. Since precise determination of.many asseß and liabilitles depends upon
       future events, the preparation of periodic financial statemenß necessarily involves the use of
       estimates and approximations.

       (a)     Accrual accountlng

               Sources of financing and expenses are reported on the accrual basis of accounting.

       (b)     Non-flnancialassets

               Non financial assets are not available to discharge existing liabilities and are held for use
               in the provision of services. They have useful lives extending beyond the current year
               and are not intended for sale in the ordinary course of operations.

               i)    Tangible capital assets

               Tangible capital assets are recorded at cost which includes amounts that are directly
               attributable to acquisition, construction, development or betterment of the asset. The
               cost, less residual value, of the tangible capital assets, excluding land and landfill sites,
               are amortized on a straight line basls over their estimated useful lives as follows:

               Annual amortization is charged in the year of acquisition and in the year of disposal using
               the half year rule. Assets under construction are not amortized until the asSet is available
               for productive use.

               ii)    Contributions of tangible capital assets

               Tangible capital assets received as contributions are recorded at theír fair market value at
               the date of receipt and also are recorded as revenue.

               iii)   lnterestcapitalization

               The intereSt costs associated with the acquisition or construction of a tangible capital
               asset are not capitalized.

       (c)     Revenue recognition

               The Company recognizes revenue when water is drawn by each customer, collection of
               the relevant receivable is probable, persuasive evidence of an arrangement exists and
               the sales price is fixed or determinable.

     (d)     Use of estimates.

             The preparation of financial statements in conformity with Canadian generally accepted
             accounting principles requires management to make estimates and assumptions that
             affect the reported amounts of assets and liabilities and disclosure of contingent assets
             and liabllities at the date of the financial statements and the reported amounts of
             revenues and expenses during the year. Significant items subject to such estimates and
             assumptions include the valuation allowances firr reqeivables.

             ln addition, the City's implementation of the Public Sector Accounting Handbook PS 3150
             has required management to make estimates of historical cost and useful lives of tangible
             capitalassets.

             Actual results could differ from those estimates.

2.   Nature of reporting entity

     The final transfer order for Lake Huron Area Primary Water Supply System was effective
     September 15, 2000, transferring assets along with any other real property to The Corporation of
     the City of London in trust to act as the Administering Municipality on behalf of the participating
     municipalities.

     Under the transfer order, the works, properties and all assets, liabilities, rights and oblþations of
     the system are conveyed, assigned and transferred to The Corporation of the City of London as
     Trustee. Each of the benefitting municipalities, for so long as the municipality is serviced by the
     works has an undivided beneficial ownership interest ln the works as tenant in common with all
     other municipalities jointly. The proportion that each municipali$'s interest bears to the total of all
     municipalities' interests shall be in the same ratio that the quantity of water supplied from the
     works to the municipalities at any time and from time to time bears to the total quantity of water
     supplied to all municipalities at such time. At present, he benefitting municipalities are The City
     of London, the Municipalities of Bluewater, South Huron, Lambton Shores, North Middlesex,
     Lucan-Blddulph, Middlesex Centre and Strathroy-Caradoc.

     The transfer order established a joint board of management to govem the management of the
     water supply system. The joint board of management is comprised of eleven representatives of
     the municipalities appointed by the respective councils of participating municipalities. The

             The write-down of tangible capital assets during the year was nil (2009 - nil).

5.   Bank indebtedness

     As the Administering Municipalty, the Corporatlon of the City of London manages the daily
     oÞgrations of the joint water board. The Corporation maintains a separate general ledger on
     behalf of the joint water board. Funds are transferred to and from the joint water board bank
     account as funds are paid and received by'the City of London.

     At December 31, 2010, the Lake Huron Area Primary Water Supply System is showing bank
     indebtedness of $1,355,358.(2009 - $1,726,015), which represents funds due to the City of
     London bank account for expenses paid on behalf of the joint water board.

7.   Fair value of financial lnstruments:

     (a)     The carrying values of cash and short-term investments, trade accounts receivable and
             accounts payable and accrued liabilities approximate their fair values due to the relatively
             short periods to maturity of the instruments.

             The fair value of long-term debt approximates its carrying value as interest rates are
             similar to cunent market rates of interest available to the Company.

     (b)       Credit and foreign curency risk:

             The Company is not exposed to any foreign cunency or credit risk.

on the regional water supply system's Key Performance lndicators for information.



The Board of Management for the Lake Huron Primary Water Supply System has received periodic
reports since 2003 on the performance of the system with respect to contractual and regulator
obligations, as well as environmental performance and quality management, related to our
management system approach to administering and governing the water supply system.

ln order to provide a higher-level assessment to the Board on the overall performance of the system in
general, staff have initially developed five (5) Key Performance lndicators (KPl) to be reported to the
Board on a periodic basis. The proposed KPls are identified and briefly summarized as follows:

    1. Process Lost Water: Water is used         and/or "lost" throughout various parts of the treatment
          processes. This includes the need to clean filters through a backwash process, periodic draining
          of tanks, pump seals, and tank cleaning.
          Excess waste of water within the plant can occur for a variety of reasons, including increased
          frequency of filter backwashes due to chemical treatment process imbalance, treatment "upset"
          due to a rapid change in raw water quality or slow response of chemical treatment processes,
          and lack of adequate filter maintenance. There will always be "unaccounted for wated' within the
          treatment system, and may vary seasonally due to seasonal raw water quality, but it is prudent
          to limit the amount of "lost wate/'as much as possible in order to maximize cost effectiveness.
          The Process Lost Water KPI is a measure of the volume of treated water discharged from the
          water treatment plant versus the volume of raw water extracted from the source water. Typically
          for the Lake Huron water treatment plant, this KPI should be in the order of 5%

    2.   Non-Revenue Water: Water can be lost within a municipal water distribution system, and can
         typically be attributed to:
             o Leakage from the distribution pipelines and services, typically through joints and pipe
                 fractures;
             . Meter accuracy, which can also diminish overtime due to wear;
             . Meter reading errors;
             ¡ Maintenance and construction activities, typically associated with flushing programs;
             o Theft;
             o Storage (water accounted for but not sold and is stored within a reservoir, water tower,
                 or standpipe)

         Although the regional water transmission system is much smaller and less complex that a
         typical municipal water distribution system, these factors will generally still apply.
         The Non-Revenue Water KPI is a measure of the volume of water supplied (sold) to the
         benefiting municipalities versus the volume of treated water discharged from the water
         treatment plant. Typically for the Lake Huron water system, this KPI should be in the order of
         4% or less.

    3.   Energy Efficiency: A significant amount of energy is required in order to extract, treat, transmit
         and monitor water being supplied to the benefiting municipalities. The quantity of energy
         consumed at any given time can vary appreciably due to needed pumping rates to supply the
         benefiting municipalities (day versus night, and summer versus winter).
         It is important to note that the most'efficient use of energy' can be counter productive to energy
         cost effectiveness as the commodity cost of the energy can vary significantly over time (day
         versus night, and seasonally) inespective of the most efficient way of moving the water through
         the system. ln that regard, the 2011 Capital Budget projected a proposed future study which
         reviews pump optimization and energy efficiency, cunently projected for 2012.
         The Enerqv Eff¡ciencv KPI is a measure of the total kilowatt-hours of energy consumed per
         cubic meter of water volume of treated water discharged from the water treatment plant.
         Typically for the Lake Huron water system, this KPI should be in the order of 750kwh per million
         litres of water.

    4.   Disinfection: One of the single most important aspect of the treatment and supply of drinking
         water is disinfection during the treatment process, as well as ensuring adequate amount of
         residual chlorine to ensure secondary disinfection in the transmission and distribution systems.
         The quantþ of chlorine utilized for primary (treatment) and secondary (distribution) system may
         vary depending on the quality of the source water, water temperature, and desired residual
         quantity of chlorine within the water distribution systems.
         Excess utilization of chlorine within the water system can be indicative of degraded source
         water quality, reduced effectiveness of water treatment processes, and degraded water quality
         within the distribution system.

         The Disinfection KPI is a measure of the total amount of chlorine per cubic meter of water
         volume of treated water discharged from the water treatment plant. Typically for the Lake Huron
         water system, this KPI should be in the order of 2.3 kg of chlorine per million litres of water.

    5. Chemical Efficiency: Beyond the disinfection        process within the treatment plant, numerous
         other chemicals are required to ensure the effective treatment of water. Chemicals utilized
         within the water treatment plant include aluminum sulphate (alum) and polymers for the effective
         removal of particles from the source water, chlorine for disinfection, powder activated carbon for
         taste and odour control, and caustic soda for conosion control.
         Excess or inadequate utilization treatment chemicals can be indicative of ineffective treatment
         processes, inadequate maintenance and/or operation of the treatment systems, or degraded
         source water quality.
         Due to a monitoring issue, the caustic soda data from August 2010 to present contained
         inaccuracies, therefore the quantity of caustic soda had to be removed from the cunent
         chemical efficiency KPI in order to avoid skewed results.

         The Chemical Efficiency KPI is a measure of the total amount of treatment chemicals utilized
         per cubic meter of water volume of treated water discharged from the water treatment plant.
         Typically for the Lake Huron water system, this KPI should be in the order of 27 kg per million
         litres of water (excluding caustic soda).



Future quarterly reports to the Board will provide periodic updates of seasonal variations of KPI's in
comparison to base 'benchmark" values. This will also provide the opportunity to identify and target
efficiency and optimization programs for the regional water system, with the objective to reduce overall
long-term costs of the water system, as well as opporlunities to improve operational practices and
processes.

Pursuant to Board of Management resolution, this Compliance Report is prepared on a quarterly basis
to report on general, regulatory and contractual compliance issues relating to the regional water
system. For clarity, the content of this report is presented in two basic areas, namely regulatory and
contractual, and does not intend to portray an order of importance or sensitivity nor a complete list of all
applicable regulatory and contractual obligations.

Recent Requlatory Chanqes:

.   Policy Decision: Second Extension            of the 2007 Canada-Ontario Agreement (COA)
    Respecting the Great Lakes Basin Ecosystem
    The current COA expired, and was previously extended for one year to March 31, 2011 . Because
    the process to amend the Canada-U.S. Great Lakes Water Quality Agreement (GLWQA) is
    ongoing, the governments of Ontario and Canada considered a further extension to the COA to
    maintain momentum on the restoration, protection and conservation of the Great Lakes Basin
    Ecosystem while the GLWQA is being amended. The Canadian and Ontario governments have
    decided to move forward with the second extension (to June 24, 2012). Through the extension,
    Canada and Ontario are considering amendments to update and refresh some commitments under
    the Agreement. They will be implementing six new commitments related to harmful pollutants,
    nearshore framework, stewardship activities, binational cooperative monitoring programs, aquatic
    invasive species complete prevention plan, and spills prevention and response. Once the
    binational Great Lakes priorities are confirmed, priorities under a new COA will be realigned and
   redefined.

New Envifonmental Bill of Riqhts (EBR) Reqistry Postinqs: At the time of drafting this report, there
are proposed regulations, protocols and guidelines posted on the Environmental Bill of Rights (EBR)
Registry for comment, or in the draft consultation process with the Ministry of the Environment (MOE)
or other agencies as follows:

r  Policy Proposal: Proposed Amendments to the technical rules made under section 107 of
   the Clean Water Act, 2006 with respect to the preparation of an assessment report.
   The goal of the Clean Water Act is to protect existing and future sources of drinking water as part of
   the overall commitment to human health and the environment. A General Regulation under the Act
   establishes the requirements for preparing terms of reference, assessment reports, and source
   protection plans. ln addition, the Act authorizes technical rules governing the preparation of an
   assessment report. Proposed amendments to the technical rules include alignment of the technical
   rules with new guidance documents that have recently been developed for the dgvelopment of
   water budgets to ensure a consistent approach is used across the province, and amended rules
   regarding climate change data in the preparation of water budgets.
Potential impacts on the Board: None anticipated.

r   Regulation Proposal: Proposed Regulatory Amendments as a Result of Ghanges to
    Environmental Protection Act and Ontario Water Resources Act, as Amended by the Open
    for Business Act, 2010
r   Regulation Proposal: Requirements for Submitting a Gomplete Environmental Compliance
    Approval Application
    The MOE has developed legislation that will enable a modernized approvals system in Ontario.
    The MOE is developing a risk-based approach to environmental approvals that will focus on
    environmental protection, while still providing enhanced services for businesses. For example,
    there will be a simplified registration process for activities/sectors with potentially lower
    environmental impacts. The framework has two processes; a registry process for prescribed
    activities, and an approvals process for activities not prescribed that require a detailed technical
    review of submitted documentation as well as public input. Various regulations are currently in
    development to address proposed classifications, application requirements etc.
 Potential impacts on the Board: None anticipated. The guidance document for the proposed
framework indicates that the proposed new modemized approach to the approvals process is not
intended to include legislative changes to the existing processes related to permits to take water,
renewable energy approvals, drinking water systems and municipal licensing, or licensing and
certification prog rams.

Quarterlv Water Qualitv Reports: Although no longer required to be submitted to the Ministry of the

March 31't, 2011 inclusive was completed by the Board's Operating Authority, American Water Canada
Corp (AWCC). The full Quarterty Report for the primary system is posted on the Water Systems'

information. A summary of water quality sample results will continue to be provided and posted on a
quarterly basis for the Board's and the public's information.

O.Req. 170/03. Section 1l "Annual Reports": Under the Drinking Water Systems Regulation
(O.Reg. 170103), an Annual Report for the Lake Huron Primary Water Supply System (LHPWSS) is
required to be prepared by February 28th,2011 by the contracted operating authority. Although the
report is no longer required to be submitted to the Ministry of the Environment, the LHPWSS is required
to provide copies of the report to drinking water systems that obtain water from this system. Copies of
the report were forwarded to the benefiting municipalities as required. The report summarizes water
quality and maintenance information for the 2010 calendar year. The Annual Report is posted on the
Water Systems'website at www.watersupplv.london.ca for public information. All Annual Reports are
available for viewing at the Lake Huron Water Treatment Plant and at the Board's Administration Office
in London. Copies of all reports are available to the public upon request and free of charge as required
by O.Reg. 170103.

O.Req. 170/03. Section 22 "Summarv Reports             for Municipalities":   Under the Drinking Water
Systems Regulation (O.Reg. 170/03) a summary report is required by March 31't of each yearwhich:
    ¡ Lists the requirements of the Act, the regulations, the system's approval and any order that the
      system failed to meet at any time during the period covered by the report, and the duration of
      the failure. For each failure referred to, a description of the measures that were taken to correct
      the failure is required.
    ¡ ln order to allow the system's owner to "assess the capability of the system to meet existing and
      planned uses of the system" provide a summary of the quantities and flow rates of the water
      supplied, including monthly average and maximum daily flows and daily instantaneous peak
      flow rates, with a comparison to the systems rated capacity and flow rates in the Certificate of
      Approval.
The Summary Report was completed by the contracted operating authority and submitted to the MOE
on March 25th, 2011 deadline. The report is posted on the Water Systems' website at
www.watersupplv.london.ca for public information and printed copies of the report were forwarded to
the benefiting municipalities as required by Regulation. All Summary Reports are available for viewing
at the Lake Huron Water Treatment Plant and at the Board's Administration Office in London. Copies
of all reports are available to the public upon request and free of charge as required by O.Reg. 17OlO3.



ARTIGLE 3. "Manaoement. Operation and Maintenance of the Facilities - General":
At the time of writing this report, the Administering Municipality had not yet received the first quarter
Operations and Maintenance Report from American Water Canada Corp. (AWGC). A quarterly
administration meeting between Board staff and AWCC is scheduled to take place on June 20, 2011.
Board staff informally meets with AWCC on a monthly basis to discuss operations and maintenance
issues, and on a formal basis quarterly to review contractual performance. Copies of the quarterly
Operations and Maintenance Reports are available at the Board's Administration Office in London upon
request.

Management System for the Lake Huron Primary Water Supply System BE RECEIVED for information.



The completion of corrective actions in a timely fashion, and implementing measures to ensure the root
cause of issues are addressed to make certain issues do not recur, continue to be an ongoing
challenge. A number of action items remain outstanding from 2009 and 2010, with additional items
being recently identified from internal audits and inspections. lt is clear that this will be an ever
increasing challenge in 2011 as the end of the existing contract with the Operating Authority draws
near.




Environmental Management System (EMS)
The Lake Huron Primary Water Supply System (LHPWSS) has an Environmental Management System
(EMS) which has been registered to the 1SO14001 standard since December 19, 2003. The LHPWSS
underwent a three-year re-registration audit on September 3, 2009 and is now registered to the
1SO14001 :2004 standard for another three-year period (ending March 2013).

Drinking Water Quality Management System (DWaMS)
ln 2005, a Drinking Water Quality Management System (DWOMS) was integrated with the existing
EMS and the combined EMS/DWQMS system is maintained for the LHPWSS by the Operating
Authority, American Water Canada Corp. (AWCC). The LHPWSS received the official DWQMS
accreditation in June 2009. The accreditation is the first issued in the province and is valid until June
10,2011. Accreditation is normally for 3 years; however the 2 year accreditation cycle for the LHPWSS
is due to the LHPWSS participation in the Ministry of the Envíronment's DWQMS pilot implementation
program. The Operating Authority was technically accredited as part of the pilot program in December
2006, which resulted in a modified accreditation cycle. Moving forward, the normal 3 year accreditation
cycle will be in effect and is tied to the system's Municipal Drinking Water Licence.

As the existing DWQMS accreditation is only valid until June 10,2011, the Operating Authority has
expressed concem to the external registrar, the Canadian General Standard Board (CGSB), that a re-
accreditation audit has not yet been scheduled. ln a similar fashion, Board staff have expressed
concern to the Ministry of the Environment about the timeliness of the re-accreditation process. As of
May 9, 2011, CGSB has confirmed that they will work on the necessary paperwork to extend the
existing accreditation until they can complete the re-accreditation process.

Management Rev¡ew
The documented EMS/DWQMS requires management review by Senior Management a minimum of
once annually to ensure that the management team of the Board and the Operating Authori$ stay
informed of environmental and quality issues. ltems discussed at the management review include
water quality test results, environmental performance, legislative changes, significant non-
conformances, corrective actions, changing circumstances and business strategies, and resource
requirements.

ln order to carry out more effective management reviews, the Board's administration has opted to
conduct shorter management review meetings at more frequent intervals generally coinciding with the
scheduled monthly operations meetings. Although each Management Review aspect may not be
covered at each meeting, over the course of the year the entire system is reviewed at least once.
Management Review meetings were held on February 9 and April 13,2011. The Management Review
meeting minutes can be found in Appendix A of this report for the information and reference of the
Board.

lnternalAudits
Pursuant to the íntemational 1SO14001:2004 EMS standard and the Provincial DWQMS             standard,
periodic "internal" audits are performed by the Board's administration to ensure continued compliance
with legislated and other requirements, as well as conformance with the 1SO14001:2OO4 EMS standard
and DWQMS standard. lnternal audits also ensure that the ongoing operation of the water supply
system complies with the EMS and DWQMS as implemented. As required by the standard, intemal
audits are performed a minimum of once annually.

As required by the    1S014001:2004 standard, intemal audits of legal and other requirements are
required to be conducted at least once every three years. The operating contract between the Joint
Board and the Operating Authority is one of these requirements that must be audited. An intemal
contract audit took place on April 15, 201 1 . The most significant finding during the audit was that for
the audit period, reporting and payment deadlines were often not being met. This was also identified in
2008 and was attributed to the loss and subsequent replacement of management staff of the Operating
Authority. A summary of the contract audit is included as Appendix B of this report for the information
and reference of the Board

ExternalAudits
Annual surveillance audits (third-party extemal audit) are conducted for both the EMS and DWQMS,
with a recertification audit taking place every third year. The external registrars for the EMS and
DWQMS are QMI and the Canadian General Standards Board (CGSB) respectively. External audits
review all aspects of the EMS or DWQMS, including the intemal audits conducted by the Board's Water
Compliance Coordinator, the subsequent management reviews, and conective actions. No external
audits were conducted during this reporting period.

Corrective Actions
At the October 1, 2009 Board meeting, the Huron Board requested that all 2008 corrective action items
be completed by the end of the year, and the 2009 corrective action items be 90% completed.
Currently the 2008 action items are 99% complete, the 2009 action items are 90% complete, the 2010
action items are 56% complete, and the 2011 action items are 297o complete. There has been no
change in the completion of action items by the Operating Authority since the last quarterly report to the
Board. A Corrective Actions Summary can be found in Appendix C of this report for the information and
reference of the Board.

At the March 3, 2011 Board meeting, the Huron Board expressed concem over the number of
corrective actions identified. The number of corrective actions isn't necessarily a bad thing, as
corrective actions represent continual improvement of the system. Rather, concern should be
expressed over corrective action items that are typically reoccurring. This indicates that the root
causes of the findings are not being addressed to prevent them from reoccuning. An assessment of
reoccuning conective actions can be found in Appendix D of this report for the information and
reference of the Board.

PLAN.DO.CHECK.IMPROVE
It should be noted that the 'PLAN-DO-CHECK-IMPROVE' system required by the 15014001 and
DWQMS standards requires continuous monitoring of the EMS/DWQMS, with periodic review and
audits conducted to demonstrate conformance. A key concept of this approach (Plan-Do-Check-
lmprove) is that it does not require or expect 100% conformance, but promotes an environment of
continual review and improvement by identifying shortfalls, implementing corrective measures, and
setting objectives and targets for improvement.

The monitor, review and audit philosophy is integrated in not only the monitoring of the registered EMS
and DWQMS, but also the Board's contract with American Water Canada Corp.

Effectiveness of the EMS/DWQMS
On an annual basis, top management will review the continuing suitability, adequacy and effectiveness
of the EMS/DWQMS from an overall perspective. Top management must review the EMS/DWQMS
from a macro level, looking at trends, resources, challenges, successes, and improvements in order to
assess the overall effectiveness.

Although notable issues and challenges have been observed, top management has seen improvement
in several areas of the EMS/DWQMS over the past years. lmprovements noted have been
maintenance and calibrations of EMS/QMS related equipment, and the Operating Authority has
dedicated more resources in 2O11to help maintain the EMS/QMS.

Areas    of the EMS/DWQMS that still require improvement include the Operating Authority's
management of subcontractors, difficulty with management of change for new capital projects, and
verifying the effectiveness of corrective actions that have been implemented. With the end of the initial
operating contract with the cunent operator, continued progress in2011-2012 could be impacted by the
procurement process and staff turnover. Particular focus will have to be made on the procurement
process to limit the impact on the EMS/QMS. Board staff will ensure that these areas are the focus for
improvement in 2011.

Overall, the EMS/DWQMS has continued to prove its worth as being beneficial, as the management
systems prompt positive changes to be made not only in the management and administration, but in the
ongoing operation of the system. Therefore, it is the opinion of Board staff that overall the
EMS/DWQMS continues to be effective




The internal audits and frequent management review meetings continue to effectively identify system
deficiencies. The EMS and QMS for the Lake Huron Primary Water Supply System continue to be
suitable, adequate and effective.

Lake Huron Environmental Management System Policy
Handout: Lake Huron Environmental Policy

The Lake Huron Environmental Management System Policy was revised to include the Komoka-Mt.
Brydges Booster Pumping Station and watermains. The Policy was reviewed and approved. The
policy will be brought forth to the Lake Huron Water Board on March 3,2011 for approval.

Effectiveness of the EMS/QMS

The effectiveness of the EMS/QMS was discussed. lmprovements noted have been maintenance and
calibrations of EMS/QMS related equipment, and the Operating Authority dedicated more resources in
2010 to help maintain the EMS/QMS. Areas to continue to focus on in 2011 are the management of
change process and the effectiveness of completing conective actions. lt was noted that with the end
of the initial operating contract with the current operator, continued progress in 2O11-2012 could be
impacted by the procurement process and staff turnover. Particular focus will have to be made on the
procurement process to limit the impact on the EMS/QMS.

Actions Required:
Andrew Henry will report on the overall effectiveness of the EMS/QMS to both Joint Boards of

Review of Previous Management Review Meeting Minutes

Action items from the January 31s and February 9th, 2011 meeting were discussed. The following
action items are still outstanding or have been updated:

Average day fluoride residual spikes over 1.0 mg/L were reported at Elgin in 2008.
Greg Henderson will look into whether AWCC is reporting fluoride dosage or fluoride residual.
Update: AWCC is reporting both fluoride dosage and residual in the monthly report. The data being
graphed is fluoride dosage. Greg will update the graphs with fluoride residual instead of dosage.

Pre-Chlorine, specifically at Elgin has been trending upwards over the past couple of years. Karel
Kamerman and Robert King will investigate if the pre-chlorine data includes the crib chlorine usage.
Update: Karel reported that crib chlorination is not being included with pre-chlorine for Elgin; this still
needs to be determined at Lake Huron.

Huron caustic soda usage has risen significantly. This is likely due to a faulty levelsensor. AWCC
shallfix the faulty levelsensor. Karel Kamerman and Robert King willfix the erroneous data and
provide correct caustic soda usage. Greg Henderson will eliminate erroneous data from graphs and
update with corected data.
Update: Erroneous data has been removed from graphs. The data for caustic soda usage has been
collected but still needs to be calculated.

Huron post-chlorine usage and dosage have been trending upwards. Vaughan Martin has indicated
the operations staff has had difficulty controlling the post-chlorine dosage on SCADA. Andrew Henry
will discuss the use of the Mantra system with John Walker
Update: Andrew will go back on talk with John about the use of the Mantra system and ensure
lnsyght implemented what was agreed upon.

The majority of corrective actions deadlines pertainÍng to the Huron DWQMS lnternal Audit have now
passed. Karel Kamerman will update the CAF tracking sheet and provide a copy to RWS.

Results from Joint Board of Management Meetings

The Huron Environmental Policy was endorsed by the Lake Huron Joint Board of Management at the
March 3,2011 meeting. However, Board asked for consideration of stronger language with regard to
" . .. encourage suppliers and sub-contractors.' After discussion, it is recommended to keep the

terminology the same. Changing the terminology could open this up for auditing, and would require
staff to police/audit every subcontractor to ensure they follow applicable environmental laws and
legislation.

Resources needed to Maintain the EMS/QMS

AWCC has reported that they still need resources to help continually improve and maintain the
EMS/QMS. AWCC noted that hiring the second QA/QC Manager had initially helped with the backlog
of corrective actions, but with a QA/QC Manager going on maternity leave, the training of the temporary
QA/QC Manager has taken time and the backlog continues. AWCC also reported that software
solutions will help free up more of their time. Upgrades to VantagePoint will reduce the amount of time
required to access SCADA data and will allow more time for EMS/QMS items. A document
management system will help with the annual review and revisions of EMS/QMS and Emergency
Response procedures.

Deviations from Critical Control Point limits and Response Actions

Deviations from critical control points for the EAPWSS and the LHPWSS were discussed.

Actions Required:

As discussed at the monthly operations meeting held earlier, a chlorine analyzer is needed at the Elgin
terminal reservoir outlet. Two analyzers may be needed (one on north side, one on south side).
AWCC to review the location options and provide a recommendation.

Due to the high number of chlorine alerts at Elgin, Vaughan Martin is to instruct operations staff to
target free chlorine residual leaving the plant at 1.2 mg/L when the raw water temperature reaches
12oC (to coincide with zebra mussel control for convenience). The free chlorine target for the winter
months shall be 1.0 mg/L. The EAPWSS will only accommodate municipal requests for higher chlorine
under special circumstances.

Due to the high number of fluoride alerts at Elgin, AWCC to consider installing a motorized valve at the
fluoride pump to replace the manual ballvalve. The motorized valve will be linked and programmed
into SCADA to allow the operator to shut off fluoride flow if the plant is offline, and start dosing fluoride
after plant start up.

Etgin had 2 alerts for exceedences of aluminum residual. Greg Henderson will investigate the cause
for these exceedences.

Huron had I alerts for exceedences of alum residual. Erin Kirk inquired about plant status at the time
of these alerts. AWCC reported that there is an issue with alum dosing on SCADA. Vaughan Martin
and John Walker will review the deficiency list to determine if the issue has been noted to be
corrected.

AWC indicated that Elgin filter media top-ups will have to wait until September 2011 as filters cannot be
offline for a long period at this time. AWC has received quotes for rebuilding filters 3 and 4. During the
rebuilds, AWC recommends underdrain inspections be undertaken at the same time. Andrew Henry
to note for budget purposes.

AWC suspects a rupture in the post-chlorine line at Huron. They may be dosing chlorine upstream of
the injection point. This will require a shutdown to investigate.

SUMMARY

Audit Purpose:
The purpose of the audit was to veriff conformance of the Operating Authority (American Water
Services Canada) and the Lake Huron and Elgin Area Joint Boards of Management to their operating
contracts. Non-conformances are identified below.

As a requirement of the 15014001 Environmental Management System (EMS), a contract audit must
be conducted once every three years. The last contract audit was conducted in October, 2008.

supply system by the current contracted operating authority, American Water Services Canada, for the
period of their operating tenure, starting January 1,2OO2.

Within sixty days at the end of each contract year, the Operator shall provide the Joint Board with a
detailed report summarizing the operations and maintenance activities of the previous contract year.
The Operator must conduct an annual inspection and review of the civil, structural and site-related
assets as well as the mechanical and electrical equipment and provide the results of the reviews as
part of the Annual Operations and Maintenance Report.

A separate Annual Operations and Maintenance Report has not been provided since 2003. The annual
regulatory compliance report which is prepared for the Ministry of the Environment (MOE) as required

The Clean Water Act establishes a process to determine protection zones for wellheads and surface
water intakes for municipal drinking water systems, assess the vulnerability of intakes and wellheads,
identiñ7 threats to the intakes and wellheads, and develop Source Protection Plans to manage and
control the risks to the drinking water systems. The risk assessment process established under the
Clean Water Act is premised on the principle that an activity (business operation, residential septic
system, storage of chemicals, etc.) or site condition due to past activities can potentially pose a threat
to an intake or wellhead, and the degree of risk to the drinking water systêm is related to both the threat
itself and the vulnerability of the intake or wellhead.

In all cases, the assessment of threats (biological or chemical) is related to human activities (past
conditions or present activities). By way of example, the storage of 1.5 million litres of Urea Ammonium
Nitrate can pose a risk to a drinking water intake or wellhead, and the degree of risk (significant,
moderate, minor, negligible) depends on how vulnerable the intake or wellhead is in relation to the
storage system.

The development of Source Protection Plans is premised on the control of activities, through land use
controls (zoning bylaws, official plans, etc.) or other controls (permits and approvals, prohibitions, etc.)

in order to manage and mitigate the risks to the drinking water system at the source. ln theory, this
should also controlfuture risks by controlling and preventing future threats.

ln the cunent version of the Clean Water Act and the development of Source Protection Plans, the
vulnerability of the intake and wellhead is assumed to be static. The vulnerability rating of an intake or
wellhead may be changed in future as a result of specific site investigations, such as subsurface
geotechnical and groundwater studies, which amends previously unknown conditions near the
wellhead. The Clean Water Act and the technical rules for risk assessment does not contemplate an
activity which could specifically change the vulnerability of an intake or wellhead.

For example, a new quarry near a wellhead (subsequent to the vulnerability assessment undertaken)
would change the vulnerability as it provides a direct flow path for contaminants to the wellhead. The
act of extracting the soil and quarry material in itself does not constitute a risk to the drinking water
system as it is not an activity associated with a microbiological or chemical contaminant.

During informal discussions with the Ministry of the Environment, it was recognized that this theoretical
situation could represent a flaw in the Clean Water Act, but could potentially require amendments to the
Clean Wate¡ Act and its regulations. At that time, Ministry staff indicated that the focus of the Clean
Water Act and source protection activities are being specifically directed to the mitigation of significant
threats as currently defined under the Act, and there are no efforts at this time to address activities
which change the vulnerability of intakes and wellheads.

Although it is not immediately apparent that there are any proposed or existing activities in the region
which increase the vulnerability of the intake for the Lake Huron Primary Water Supply, it is the position
of Board staff that the Ministry of the Environment be encouraged to assess the potential implications of
activities which may increase the vulnerability of an intake or wellhead, and develop threat and risk
assessment tools to be incorporated as part of the development Source Protection Plans in Ontario.

On September 12, 2002 the Lake Huron Primary Water Supply System (LHPWSS) Board of
Management approved the current version of Policy 28 - Bulk Water Sales (Attached as Appendix A).
Since that time, the contracted Operating Authority has been responsible for the provision of bulk water
to local agriculture or construction operations in accordance with the Policy. Due to operational
challenges within the facility, including limited staff resources, the contracted operating authority have
not been able to fully follow this policy.

On April 29,2011 the administrative staff of the municipalities of South Huron, Bluewater and Lambton
Shores were informed that the LHPWSS would consider terminating the current practice of providing
bulk water to local farmers.

The policy adopted by the Board of Management in September 2OO2 allows for the provision of bulk
water for the purpose of agricultural or construction use. The policy was initially adopted by the Board
as a result of a pre-existing practice by the previous owner/operator of the facility (Ministry of the
Environment and the Ontario Clean Water Agency) whereby the plant operator would load local
farme/s trailer-mounted tank with water from an onsite hydrant. Typicatly this water is used for fertilizer
operations.

Ïhe Board and   Board staff were not made aware of this previous practice until early 2002 when the
contracted operating authority was contacted by local farmers to arrange filling their tanks. At that time
it was discovered that the previous operator of the facility was charging the farmers $25 for a "small
load' (typically 2,500 to 4,000 gallons) and $50 for a "large load' (greater that 4,500 gallons). No
monies were remitted to the Board in the interim period from the time of ownership transfer (2000) to
the start ofthe new contact (January 2002).

On an annual basis, between 725,000 litres (160,000 gallons) and 900,000 litres (200,000 gallons) are
supplied to area farmers at the water treatment plant. To date, Board staff are not aware of any
construction contractors that have been supþlied bulk water at the water treatment plant.

Upon adoptíon of the Bulk Water Sales Policy (Polioy #28), the current contracted operating authority
has continued to supply bulk water to area farmers. Due to limited operating staff available, this practice
has been difficult to sustain and has resulted in the lack of recording the percon receiving the water and
the volume of water supplied. ln addition, the operator never charged the farmer for the water.

The cunent practice of supplying bulk water through a hydrant at the water treatment plant has resulted
in increased maintenance and repairs to the hydrant. In order to maintain the current practice and
supply of water to local farmers and contractors in accordance with the Board Policy, an additional
operator is required at the plant and an increased level of maintenance and repair to the hydrant needs
to be undertaken.

At the time of drafting the original policy in 2002, Board staff were informed that the municipalities of
Bluewater and South Huron were reviewing a proposed bulk water policy but cunently only use 'bulk
wate/ for municipal operations or municipal capital projects. The Municipality of Lambton Shores
maintains two bulk water filling stations in Forest and Norfolk, operated on accounts with key/cards.
The use of hydrants for bulk water is restricted to emergencies only.

As an alternative to rescinding the current policy and terminating bulk water sales to local farmers and
contractors vià the onsite hydrant, the Board could choose to install a bulk water filling station operated
on accounts with key/cards, similar to that utilized by various municipalities. !t is the recommendation of
Board staff that the supply of treated municipal drinking water (bulk or otherwise) to individual
consumers should remain the purview of the municipalities.

The estimated cost to install a bulk filling station at the water treatment plant, including an account
management system and road modifications for traffic management, is anticipated to be in the order of
$125,000 to $150,000, with an estimated annual operating and maintenance cost of $5,000.

To date, the contracted operating authoriÇ has not identified the amount of bulk water supplied on an
annual basis nor have they charged and remitted the funds in accordance with Board's Bulk Water
Sales policy (Policy #28). This is largely due to the lack of resources to appropriately manage the
practice of bulk water supply to area farmers and contractors.

It is the recommendation of Board staff that the current policy of supplying bulk water at the water
treatment plant to local farmers and contractors be rescinded, and that area municipalities consider
appropriate policies and practices within their respective water distribution systems.

The Ministry of the Environment (MOE) conducts an annual inspection of the Lake Huron Primary
Water Supply System (LHPWSS). The objective of the inspection is to determine the compliance of the
drinking water system with requirements under the Safe Drinking Water Acf, associated regulations,
and MOE issued licenses, permits and approvals. An inspection report is issued by the MOE which
outlines any non-compliances as well as recommended best management practices.

Violations identified in an inspection report, if any, have been evaluated by the MOE based on potential
risk to the community. Any identified violations are monitored for compliance with the minimum
standards for drinking water in Ontario as set forth under the Safe Drinking Water Act and associated
regulations. Where risk is deemed to be high and/or compliance is an ongoing concern, violations are
forwarded to the Ministry's lnvestigation and Enforcement Branch by the MOE lnspector.



Non-Compliances and Best Management Practices
The MOE conducted an inspection at the LHPWSS on February 10,2011 and the inspection report was
issued on April 2A, 2011. A complete copy of the MOE inspection report, as issued, is available to the
Board upon request. The report noted seven (7) non-compliance issues and nine (9) recommended
best management practices.

Best management pnactices are recommendations only and not considered mandatory requirements.
ln the interest of continuous improvement, the MOE recommends that drinking water system owners
and operating authorities consider these practices as well as measures to implement them. A summary
of the best practice issues is found in Appendix B of this report.

This Board report contains a summary of the findings and action plans only, as the final inspection
report issued by the Ministry of the Environment is 127 pages in length. Copies of the complete
inspection report are available from the Regional Water Supply office in London upon request.

Risk Rating
The MOE applies a risk rating methodology to establish an annual inspection rating. Each non-
compliance identified in the inspection report is evaluated based on the potential to compromise the
delivery of safe drinking water. The primary goal of this type of assessment is to encourage ongoing
improvement and to establish a way to measure improvement. A low inspection rating doeé not
necessarily mean that drinking water is unsafe, rather it is an indication of the degree to which there is
room for improvement with respect to meeting provincial regulatory requirements.

This methodology has been used consistently over a period of years, and therefore can serve as a
comparative measure both provincially and specifically to the LHPWSS. The following table ouflines
the inspection rating for the LHPwss over the past five inspection periods.

                                   A visual examination of unit process equipment indicated that regular routine

                                   documentation provided indicated that many of the devices tested in December of 2010
                                   had malfunctioned and had not been repaired nor re-tested at the time of inspection. On
                                   February 18,2011, further information provided by the operator indicated that the
                                   backflow devices would be repaired and completed in the following week. Also during
                                   the LHPWSS plant physical inspection, it was observed that annual inspection and
                                   calibrations are not identifiable on multiple testable backflow devices located throughout
                                   the plant.
                                   Additionally, as noted during the previous inspection at the Exeter/Hensall Pumping
                                   Station the rechlorination system was found to have excessive sodium hypochlorite
                                   leaks; corrosion of pipíng and appurtenances; poor building ventilation, and heavy
                                   condensation on all piping. lt should be noted that the owner will be taking steps to
                                   retrofit the HVAC design of the Exeter/Hensall Pumping station Facility and have
                                   provided a tentative project completion date of the upgrades by September, ZOll.

Background
,The new Exeter-Hensall pump station was constructed as part of the Exeter-Hensall Pipeline design-
 build project, completed in late 2008. Since that time, it has been noted that significant pipe sweating is
occurring, impacting the control systems, electrical cabinets and pipe finishes. The constructed air
 handling units were found to be insuffìcient to remove the amount of humidity actually experienced at
this location, and additional dehumidification and modifications to the air handling controls are required.

creation and development of a WaterMastewater Agency Response Network for Ontario, and receive
this report for information.

ln the last decade, various water/wastewater agency response network (WARN) programs have been
implemented or are being developed in each state of the United States of America (USA), as well as
the Province of Alberta. The program is premised on the principle of "lJtitities hetping tltilities", and
designed as a type of voluntary mutual-aid between water and wastewater utilities in a region. The
program is being coordinated in the USA through the American Water Works Association (AWWA).

Many municipalitíes in Ontario have specific mutual aid agreements between them and a neighbouring
municipality for fire fighting assistance, and there may be an informal "understanding" that a municipal
water or wastewater utility could call upon its neighbouring utility for assistance. ln recent years,
concern has been raised in respect of this latter informal practice with regard to liability, legal and
regulatory requirements, and Workplace Safety and lnsurance Board (WSIB) requirements. The WARN
program establíshes a legal framework where any subscribing utility can call upon the assistance of
other subscribing utilities, with the response being provided within the context of a blanket "mutual aid"
type of agreement. The blanket agreement would cover all aspects of legal liability, availability of
response and the provision of services, and health and safety requirements, to name a few.

A 'Frequently-asked-Questions" fact sheet, developed by the American Water Works Association                  is
attached to this report as Appendix A for the Board's information and reference.

WARN in Ontario
ln previous years, Board staff have investigated the possibility of establishing a mutual-aid type of
agreement between the benefiting municipalities of the Lake Huron Primary Water Supply System and
the Elgin Area Primary Water Supply System. During the course of the investigation, similar
discussions have been undertaken with the Ontario Water Works Association (a Section of the
American Water Works Association), the Critical lnfrastructure Assurance Program via the Minístry of
the Environment, and Emergency Measures Ontario.

Similar efforts were being undertaken within the Ontario Water Works Association to establish an
Ontario-based mutual assistance program, based on the AWWA WaterMastewater Agency Response
Network. The purpose of a WARN system is to enable municipalities to provide mutual aid in preparing
for, and responding to, intem.rptions in water and wastewater services resulting from natural and man-
made disasters. ln the event of an emergency, the WARN program is one tool in the toolbox' for
responding to and dealing with significant emergencies which are beyond the immediate capacity of the
utility. This is especially beneficialwhen there is a ôommunity-wide, county-wide or greater emergency,
wherein a given utility can be more self-sufficient allowing the community emergency response to focus
resources in other areas if needed.

Participation in the WARN program does not specifically require a subscribing municipality to respond
to any and all calls for assistance, nor does it obligate a subscribing municipality to call upon         all
subscribers for assistance in the even of an emergency.

On April 7, 2011 the O\Â/WA arranged for municipal representatives to attend a workshop entitled
"Utilities Helping Utilities: MutualAid Response Networks for Water and Wastewater Systems." OIÂ/WA
sent invitations to a small group of municipalities intending to get a representative sample of the Ontario
WaterMastewater utilities. Municipalities in attendance included Guelph, Sudbury, Peterborough,
Durham, London, Waterloo, Niagara, Windsor, Toronto and Midland. An Ontario WARN Leadership
Team chaired by Peterborough (Patricia Skopelianos) and co-chaired by London (Andrew Henry, Lake
Huron/Elgin Area Water Supply) was established. The responsibilities of the Leadership Team include
establishing the OnWARN govemance structure and mutual aid agreement and establishing the
OnWARN membership network. Attendees were tasked with confirming their membership on the
OnWARN Leadership team and gathering sample mutualaid agreements.

A follow-up meeting of ihe Leadership Team was held on May 12,2011 in Toronto, and the established
Leadership Team is now fully committed to the development of an Ontario-based WARN program.

Exa m ple WARN P rog ra mlS ce n a rio
Events such as 9/11, the 1994 Northridge earth-quake, the 1997 Red River flood, and Hunicane
Katrina in 2005 identified a need for water and wastewater utilities in the USA to create intra-state
mutual aid and assistance programs, and further discussions are ongoing with developing inter-state
agreements between state WARN progmms. WARNs were developed because Water and Wastewater
utilities require specialized resources; critical infrastructure depends on water services; and promoting
mutual aid/assistance meets with emergency preparedness and response requirements.

ln 2006 four States implemented WARNs (Florida, California, Louisiana and Texas) and currently forty
seven American States and the Province of Alberta have developed and implemented WARN
initiatives. Delaware, Mississippi and Alaska have not yet fully implemented a WARN, but have started
the process.

ln 2008 the AWWA studied the benefit of utilities participation in a WARN. The study included literature
reviews, consultations with utiliÇ managers and a survey. Seventy eight utilities responded to the
survey; a significant number were located in North Eastern USA, 11o/o ol water utility respondents
represented utilities which served a population greater than I million and 16% of the wastewater
respondents represented utilities which served a population greater than 1 million. The findings include
the following:
    o      82o/o of the 76 respondents provided mutual aid and/or assistance in the last 20 years. The most
           common forms were personnel (86%), generators (38%), other equipment (67%), vehicles
           (49o/o), other parts and supplies (35%), laboratory services (17Vo\. Financial aid, chemicals, and
           water, were less common (all11o/o or less)
    o      The costs to participate in a WARN, exclusive of the cost of actually providing mutúal aid,
           includes staff time to develop resource listing for databases and legal and planning costs to
           establish and maintain participation.

Based on the information available at this time, the following has been identified as potential benefits to
participation in the proposed Ontario WARN program:
    o     Establishment of an Ontario WaterMastewater Agency Response Network (OnWARN) is
          encouraged by the Ministry of Environment, Emergency Measures Ontario and Environment
          Canada, as the initiative supports voluntary Federal and Provincial programs aimed at
          strengthening resiliency of Canada's critical infrastructure. The support of a large utilities such
          as Toronto, London, and Windsor would likely influence other utilities to become members and
          thereby strengthen the resiliency of the Ontario WaterMastewater sector as a whole.
    o     Establishment of a standard mutual aid agreement with other water utilities will help utilities to
          better predict, track and recover costs associated with providing and receiving mutual aid.
    o     The mutual aid agreement template developed as part of the OnWARN initiative can be
          extended to other parties. The Kansas mutual aid network KASMAP includes gas and electric
          utilities. The New Hamshire mutual aid network (NHPWMA) includes other public works
          departments such as transportation and building inspectors.
    r     An OnWARN would provide an additional forum for municipal water and wastewater utilities to
          network, and share operational and emergency preparedness information with other utilities.
          There is an opportunity to work collaboratively, share information and pool resources in the area
          of emergency planning, as well as the opportunity to develop and participate in joint training
          sessions and exercises.

As evidenced by its successful implementation and use in the United States and the Province of Alberta,
the WaterMastewater Agency Response Network program is seen as a potentially significant benefit to
water and wastewater utilities in Ontario. Board staff are cunently participating in the development of a
program and template agreement for and Ontario-based WARN prog!?¡m, along with other municipalities
such as Guelph, Sudbury, Peterborough, Durham, Waterloo, Niagara, Windsor, Toronto and Midland.

The Board's endorsement of the development of this program will be beneficial, and afford the
opportunity for the regional water systems to showcase the program to the area municipalities.

1.   What is a WaterMastewater Agency Response Network (WARN)?
     o   A WARN is a network of utilities helping utilities.

      o Under no circumstances is a utility to send resources if it impacts their ability to manage daily operations or
          manage response to its own emergency.
      o   Resources remain under the authority of the sending utility, and as such can be recalled any time.


7.    What happens if equipment on loan is damaged or stolen?
      o Articles Vll, Vlll, and lX of the sample agreement offer a framework for how to manage the issue of loss or
          damage with clear identification of cost reimbursement, dispute resolution, and indemnification.


8.    Are WARN mutuat aid and assistance activities eligible for FEMA reimbursement?
      o   FEMA reimbursement may apply only after a Presidential declaration of emergency.
      r   FEMA-specific requirements related to WARN include:
            o The agreement was in effect p¡lg¡ to the response/deployment to the incident.
            o The assistance must be requested by the utility ín need;
            o The work performed, supplies used and materials consumed are directly related to the disaster and
                is otherwise eligible for FEMA assistance;
                The entity can provide documentation of rates and payment for services, if requested; and


9.    Will a utility be reimbursed for the use of their resources?
      o While a utility may offer assistance free from reimbursement, Article Vll of the sample agreement details
          how a utility that sends assistance is reimbursed by the utility in need.


10. How is WARN different from an existing statewide mutual aid program managed by emergency
    management?
    o Statewide mutual aid/assistance agreements typically require a declaration of "emergency' by a local and/or
      state officialto activate the agreement; WARN agreements do not require the declaration of an emergency,
      saving criticaltime in response to needs identified by the utility.
    o Statewide programs typically do not include private utilities; WARN agreements do.
    . Statewide agreements are managed by the state emergency management agency;WARN is managed by
          utilities.


ll.   ls WARN help available for disasters other than hurricanes or earthquakes?
      o   WARN is avaílable ín all types of emergencies, whether they are small, medium, or large. WARNs have
          been activated to respond to a wide variety of emergencies such as fires, floods, and water supply
          contamination as demonstrated in the report Economic Benefits of Forminq & Participatinq in WARN.
      .   Signatories to a WARN agreement can provide and/or request assistance any time their system needs
          emergency assistance.


12. Who should be involved in helping develop and sustain a WARN?
    . Utility owner/operators with varied professional association representation
    o State water and wastewater primacy agency (State health, environmental protection, etc.)
    o State emergency management and/or homeland security agency

13. What help is available to form a WARN?
    o AWWA reporl- Utilities Helpinq Utilitíes: An Action Plan For Mutual Aid and Assistance Networks for Water
      and Wastewater Utilities provide the foundation for the formation of a WARN program.
    o EPA can often help wíth post workshop support on a case-by-case basis, depending on available funding
      and the specific needs of-the program. Support could include facilitation of meetings and workshops,
      administrative support, and answer technical questions.


14. How do WARNs work across state lines?
   o   The key issues of interstate response are differences in tort liability, immunity and licensing requirements.
   o   Currently, the Emergency Management Assistance Compact (EMAC) is being used by all fifty states and the
       District of Columbia to share resources across state lines, because it already addresses the key issues.
   o   AVVWA is a member of the EMAC Advisory Gouncil with intent to facilitate greater cooperation and
       coordination between WARN and EMAC.
   .   The water sector is evaluating issues related to improving interstate aid while working with the
       administrators of EMAC to ensure that it can be used effectively for the water sector.


15. Existing WARNs do not appear to be legal entities. Should they acquire non-profit organization status?
    o At this point none of the WARNs have established themselves as a separate entity requiring any special
       status, as there are no funds transferred between the members and the WARN.
    ¡ ln several instances utitities or associations have acted as a grant recipient on behalf of the WARN, thus
       acting as the fiduciary agent, to support training, website, and related activities
   r   Existing WARN programs are free for utilities to participate.


16. Are funds available to support the WARN efîort?
    o Each existing WARN program has handled things differently, with many using voluntary time/services that
       may be supplemented with funding from various sources, such as supporting associations or state primacy
       agency grants.
    r The collaboration with primacy and emergency management agencies on the WARN program may lead to
       opportunities to fund specific WARN activitíes.
    ¡ Some existing WARNS have used Homeland Security and US EPA grants. Others have obtained local
       grants.


17. What does managing a WARN entail?
    . Establishing regular meetings of the leadership team and/or steering committee which can be done via
      phone conferences, web conferences or face to face.
    o Coordinationwith professionalassociation meetings.
    o Facilitate annual meetings or quarterly/monthly conference calls of the steering committee to address
      develop issues, plan WARN activities.

18. How do we get a website going?
    o AWWA has reserved the domain name for every state, Canadian Province, and Mexico.
    . A\A/WA will release the domain name when a steering committee has been established and is prepared to
       initiate development of a website at no charge.
    . Other existing WARNs have offered their source code free of charge to emerging WARNS.

19. lf a resource database is established, how is it updated and who updates it?
    . Many WARN websites include resource databases that are maintained by the member utilities.
    o Reminder e-mails are sent to the member utilities to remind them to update the information.
    o A\Â/WA's Water and Wastewater Mutual Aid and Assistance Resource Tvpino Manual provides consistent
        terms and definitions for specific resources to expedite both requests and responses and has been
        recognized as a resource by EMAC.


20. How do WARNs support training and exercises?
    o   WARNs historically have held annual meetings which include training components.
    .   A small fee for the training has been charged to pay for material duplication and food.
    o   Each WARN has created a set of its own best practices, including FIaWARN's review of lessons learned
        from the 2005 hurricane season.
    o   Nationally, a variety of supporting training has been or is being developed including NIMS and can be
        conducted at WARN programs.
    .   Many WARN programs have conducted tabletop exercises based on EPA's WARN Tabletop Exercise
        Facilitator Guide.


21. How do you get members to buy-in to the WARN concept?
    o While the benefits of participating in a WARN is obvious to many, others require more explicit evidence.

On September 10, 2009, Genivar Consultants submitted their report for "The Hydraulic and Operation
Study of the Lake Huron Water Transmission Sysfem; Hydraulic lesfs, Analysis and
Recommendations - Final Report." ln this report, Genivar preformed operational tests and computer
modeling for hydraulic pressure transients. These were used to study and update flow and surge
control systems and strategies for the Lake Huron water treatment plant and the McGillivray booster
pumping station. The report considered appurtenances such as air compressors and surge tank level
controls at both facilities.

The existing air compressors supply air for the surge tanks (also known as hydro-pneumatic surge
tanks). The study reviewed the sizing of the air compressors with respect to the anticipated changes in
liquid levels in the surge tanks with one to four pumps in operation. The replacement compressors can
delíver a sufficient level of service with a lower air supply and power consumption rating, based on the
hydraulic tests and analysis.

Genivar noted that changes to the Electrical Code would require substantial electrical upgrades if new
similar air compressors were provided with equivalent capacity. Further, the upgrades would have to be
undertaken immediately in order to address the risks associated with the current system. Using its
experience with several large tank and compressor designs on other projects, Genivar examined the
option of using lower-Capacity compressors for the LHPWSS and found that this option would be the
most cost effective solution for the LHPWSS, and would not increase the risk to the plant provided that
appropríate control modifications were also undertaken.

Genivar understood that the liquid level control system for the surge tanks are not being used as it was
originally intended, with different level control probe sets based on the number of pumps in operation.
The controlled released of excess pressures from the surge tanks at the water treatment plant also was
examined and it is preferable to minimise venting since this air had to be compressed at some cost.



On Wednesday April 13, 2011, the tender for the Surge Tank Compressors and Líquid Level Sensors
Replacement Project closed. Below is a summary of the tender results (excluding HST, but including a
$35,000.00 contingency allowance).

RE: Hensall lVater Usage Increase Investigation

Dear Andrew,

Thank you for taking the time to meet with Bluewater, B.M Ross & Associates, and Veolia staff
on March 18 to review Bluewater's current investigation into elevated water usages in the
Hensall distribution system.

As discussed, in November of 2010 it became apparent that water usage in Hensall has increased
since connecting to distribution from the Lake Huron Primary Water Supply System in January
of 2W. Attåched to this letter is Figure I presenting monthly water usages for periods before
and after connecting to the LHPWSS supply. The three year (2006 - 2008) monthly average
usage prior to connection was 16,653 m' while the cunent monthly average (2010 - 2011) is
29,820mr (2009 data was omitted from average value calculation due to several anomalies in the
data). This represents an increase of 13,167 m3 per month, or under the current water rate
structure an annual cost to Bluewater of approximately $57,000.

Bluewater has engaged the services of B.M Ross & Associates to assist with investigating
potential sources ofthe increased usage. To date we have investigated four possible causes
including increased residentiaUcommercial water usage, a leak in tlie system, a metering error in
the old Hensall well system, and a metering error in the LHPWSS owned Airport Road meter.

Increased Commercial/Residential V/ater Usage
Attached to this letter is Figure 2 presenting the total annual usage of metered commercial
customers in the Hensall distribution system. The2007 - 2010 annual average use for monthly
and quarterly commercial customers is 8,886 m3 and 26,073 m3respectively. A review of the
annual commercial water usages prior to and after connecting to the LIIWPSS supply does not
reveal any significant increase. As such, we do not believe that the increased water usage is a
result of increased commercial water use.

Residential customers in the Hensall distribution system are not metered, however changes in
water use patterns can be determined by reviewing annual sewage flows. Presented in Figure 3
are the monthly sewage flows to the Hensall sewage treatment plant from 2007 - 2010. The
average monthly flowprior to connecting to the LHPWSS supply was 15,836 m3. After

connection, the average monthly has decreased slightly to 14,146 m3. Based on this information,
we do not believe that the increased water usage is a result of increased residential water use.

Distribution System læak
To date a formal leak detection program has not been undertaken for the Hensall distribution
system, however informal inspections have occurred. During the fall flushing program the
municipality's contract operating authority (Veolia Water Canada) instructed its flushing crew to
pay particular attention to ponding or an¡hing visual cues that might suggest a leak in the
Hensall system. After flushing every section of the system they reported that there were no signs
of water escaping. The Village of Hensall is located on clayey soils, and we feel that a leak of
this magnitude over the past two years would most definitely have surfaced.

It is possible that a potential leak could be escaping through the sanitary or storm sewers. It is not
Iikely that the leak is entering the sanitary sewers based on the negligible change in sewage flows
as discussed above. To date we have been unable to observe the storm sewer outlets for the
village due to snow cover and spring melt. When the weather permits we plan on reviewing each
storm sewer outlet to observe if there is an increased flow.

Error in Hensall Well System Meter (Pre-2009ì
We have reviewed with Veolia the possibility of a meter error occurring in the old Hensall
distribution system prior to connecting to the LHPWSS (i.e. was the meter was reading too low
leading to a lower than actual average water usage?). Veolia has informed Bluewater that the
meter for the well distribution system was a small diameter mechanical meter that was changed
out annually, with each new meter properly calibrated prior to installation. As such, we do not
think that it is likely that there was an error with the meter reads for the former well distribution
system.

Error in the Aimort Road Meter (Post-2009)
We understand that the as constructed drawings indicate the current flow meter measuring
Hensall water usage is an 8-inch magnetic meter. We also understand that this size of meter was
chosen based on flows that were anticipated to be present in the system after Greenfield Ethanol
connected to the distribution system. As you are aware, Greenfield Ethanol is not cunently
connected to the distribution system and has not provided a timetable for when they reasonably
expect to construct in Hensall. As discussed at our March 18,2011 meeting, the current flows for
the distribution system are much less than were anticipated when the meter was selected, and
could potentially lead to errors in the flow reading.

Enclosed at the end of this package is flow data for Hensall from 2006 - 2008 which we feel is
generally representative of typical flows for the distribution system. We are requesting that you
and your staff review the flow information, and determine if a more appropriate meter size could
be used to record Hensall water usage until such a time that the flows anticipated from the
Greenfield Ethanol plant are realized. We also request that you review the operating philosophy
of the Hensall supply and provide any suggested changes that you feel may optimize metering
accuracy.

For Bluewater's purposes, it is beneficial for us to fully rule out a metering error as the source       of

the increased water usage. We are prepared to undertake an extensive leak detection program to
determine if there is/are leaks in the system. However, this is a costly approach, and it would be
beneficial for all other potential sources of the increase to be ruled out before such an investment
is made.
