The above said property is free from all kind encumbrances such as prior sale gifts, Mortgage, litigation, disputes, stay orders, attachments, acquisitions, charges liens, Sureties etc. Whereas the Party No.1.for his/her/their bonafide needs and requirements has agreed To sell the above said property for a total sale consideration of Rs (Rupees Lacs only) including (Transfer charge, Allied charge, with any type of tax charge) up to Physical Possession and Party No.2.has agreed to purchase the same on the following terms and conditions of this agreement. NOW THIS AGREEMENT WITNESSETH AS UNDER: 1. That the Party No.2 has paid an amount of Rs = (Rupees only.) as earnest money paid on or before Date 2. The balance sale consideration amount of Rs will be paid by on or before 3. All liabilities up to the date like vacant land tax /house tax other tax of finalization of deal will be paid by Party No.1. and the same will be paid by Party No.2 after Finalization of the deal. 4. That the Party No.1 shall not create any charges over the said Property after the execution of this agreement and Party No1.has no right to sell it to any body else after the signing of this Agreement.
5. That Party No.2 has agreed to purchase the said property from Party No.1 on the condition that Party No.1 undertakes to bear all losses, which may be suffered by Party No.2, in case the ownership title of Party No.1 of said property is found to be defective. 6. That the Party No.1 will deliver the vacant physical possession of the said property at the time of full and final payment and transfer document, concerned documents in favor of the purchase or his nominee. 7. If the Party No1 could not execute this agreement to sell then the Party No.1 will pay double of the earnest money to Party No.2 And if Party No.2 fails to pay the balance Consideration amount within the due date then the amount of Earnest money will be forfeited by the Party No.1. 8. That Party No.1 has given his/her/their consent to the above, condition without any reservation. 9. That Party No1 hereby, further confirms and declares that this agreement is IRREVOCABLE and shall be final and binding on them, their heirs, executors, administrators and assigns. 10.
