REAL ESTATE AUCTION BROCHURE
                         John W. Rodat, Commissioner, Department of Management and Budget

                             Dear Prospective Bidder,
                                     These are challenging times and the next few years
                             will not be easy. All of us are making difficult choices and
                             doing more with less. We have navigated tough times
                             before and have successfully led the way by embracing
                             opportunities with open minds and renewed vigor.
                                  With an active regional approach we have fostered

                          our Rail Trail project will link neighborhoods and enhance

         We need to build upon the assets of our community: our links by air,

         Together we can renew growth, create opportunity and ensure a bright

                          REVISING ALBANY COUNTY’S PROPERTY DISPOSITION PLAN
                    TO REQUIRE AUCTION BIDDERS TO SUBMIT REHABILITATION PLANS
Introduced: 2/11/08 by Messrs. McCoy, Rahm, Higgins, Scavo, Ms. Chapman, Messrs. Domalewicz, Joyce, Audit and Finance
Committee, Messrs. Aylward, Beston, Bullock, Clay, Clenahan, Commisso, Ms. Connolly, Messrs. Cotrofeld, Dawson, Ethier,
Gordon, Horstmyer, Houghtaling, Infante, Ms. Maffia-Tobler, Mr. Mayo, Ms. McKnight, Messrs. Morse, Nichols, Reilly, Steck,
Timmins, Ward and Ms. Willingham:
         WHEREAS, By Resolution No. 190 for 2005, the Albany County Legislature revised the County’s
Property Disposition Plan to reduce chances that auctioned parcels would fall into the hands of bidders
with little or no serious intention of rehabilitating or maintaining the properties, and
        WHEREAS, The revisions were designed to ensure that those who win bids at County auctions of
tax-foreclosed properties have demonstrated by prior actions a serious intent to improve and maintain
the properties they own, or meet conditions relating to financing and code compliance when bidding on
properties with historic, cultural, archeological or architectural significance, and
         WHEREAS, Among the revisions are requirements that bidders on all properties certify that they
have no unresolved building construction or fire safety code violations on properties they own or have not
lost title to a property within two years because of delinquent tax foreclosure, and
       WHEREAS, These safeguards to prevent speculators from buying tax-foreclosed properties and
adding to the blight of abandoned buildings could be further strengthened with a requirement that bid-
ders at County auctions state their intended use of the property, plans for rehabilitation of the property
and how they plan to finance the improvements, now, therefore be it
       RESOLVED, That the Director of Finance is requested to devise a questionnaire for bidders at
County auctions of tax-foreclosed properties to state their intended use of the property, plans to rehabili-
tate the property and how the improvements would be financed, and, be it further
       RESOLVED, That the Albany County Property Disposition Plan is amended to indicate that the Al-
bany County Legislature shall consider the responses to the questionnaires in the approval process with
respect to the disposal of property, and, be it further
       RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this
resolution to the appropriate County Officials.

       THESE ARE TAX FORECLOSED PARCELS—BUYER BEWARE!

   These properties came into County ownership due to unpaid taxes—in many cases the
   assessed value exceeds the taxes that were owed.
   Do your research and bid only on those that you
   have fully investigated:
              • Buildings are bought AS IS—no guarantee of con-
                   dition;
              •    If you have not seen the property, do not bid;
              • If you have not read the Property Folders, do not
                   bid;
              • Eviction of Occupants is the responsibility of the bidder after closing.

                                                      It is a good idea to check:
                                                      •    Current Water and Sewer Bills;
                                                      •    Codes Violations;
                                                      •    Current Year Tax Bill (will be pro-rated at closing);
                                                      • Zoning and Planning Allowed uses after closing—prior use does
                                                      not guarantee future zoning .

   When Coming to the Property Showings:
              •    Dress appropriately, many properties are in poor condition;
              •    Children are not allowed in these buildings;
              • Bring flashlight, notepad, camera to document conditions that might affect your bid price.

       THESE ARE TAX FORECLOSED PARCELS—BUYER BEWARE!
When Coming to the Property Showings:
          •     Dress appropriately, many properties are in poor condition;
          •     Children are not allowed in these buildings;
          • Bring flashlight, notepad, camera to document conditions
                that might affect your bid price.

  PLEASE DO NOT BID ON A PARCEL UNLESS YOU HAVE INSPECTED IT AND
                             ARE CERTAIN THAT YOU WISH TO PURCHASE IT.
               THE COUNTY OF ALBANY WILL NOT RELEASE BIDDERS FROM
                                                              A MISTAKEN BID.

Please read the Terms and Conditions carefully! If you do not already know how much you can afford to
invest, find out. Keep in mind that there is no contingency in the Terms and Conditions or Contract if you
are unable to obtain financing. If one or more of the properties interests you, attend the Scheduled
Showings listed in this brochure. Due to insurance restrictions, children under the age of 18 are not al-
lowed in the Auction Properties.
If you are seriously interested in a property, have an inspector or contractor look over the property with
you. Check the water and sewer bills due on the property—they will be your responsibility after closing.
Determine what the property is worth to you “as is” — if this amount is within your price range, then this is
your working bid.
Listen carefully to announcements made before the Auction. All of the announcements take precedence
over written materials. This is how the County corrects, updates, adds, or deletes information before the
bidding starts.
Winning the bid on a parcel does not mean you have bought the property. Bids recorded at the auction
site will be reviewed by the Division of Finance for tax delinquent bidders, former owners, and other is-
sues. Once reviewed, the bids will be forwarded to the County Executive and the County Legislature for
approval.
                         It is YOUR responsibility to research conditions before bidding!
