					YORKSHIRE DALES NATIONAL PARK AUTHORITY

OCCUPANCY RESTRICTION STATEMENT

Since the adoption of the Local Plan in 2006 this Authority has restricted new housing to meet local
needs as defined in Local Plan Policy H2, justification, paragraphs 4.38 & 4.39. Applicants are
advised that all new dwellings approved against the policies outlined below will be subject to a legal
agreement restricting occupancy to local needs.

H1 Key Service Centres - within the H1 development boundaries, where the development is for two
or more houses the Authority will negotiate 50% affordable housing where there is evidence of need.
A legal agreement will be sought to ensure the restriction of the affordable housing in perpetuity.

H2 Service Villages & H3 Small Villages - within the H2 & H3 development boundaries, planning
permission will be subject to a legal agreement restricting the occupancy of the new dwelling(s) in
perpetuity to meet local need.

H4 Housing in the Countryside – if a dwelling permitted under this policy becomes unoccupied and
no suitable occupant is forthcoming after the property has been advertised for 6 months, the Authority
will consider varying the occupancy condition to local needs. A legal agreement will be sought to
ensure the restriction of the occupancy in perpetuity.

H5 Affordable Housing on Exception Sites - all dwellings will be, and will remain, available for
people with a local housing need. A legal agreement will be sought to ensure the restriction of the
occupancy in perpetuity.

H6 Sub-division of existing houses – outside the housing development boundaries listed in Policy
H1 (Key Service Centres) all additional dwelling units created through sub-division will be restricted to
meet local needs. A legal agreement will be sought to ensure the restriction of the occupancy in
perpetuity.

F3 Residential Lets & Self-Catering Holiday Accommodation – if the proposed is for residential
use occupancy will be restricted to meet local needs. A legal agreement will be sought to ensure the
restriction of the occupancy in perpetuity.

Please note if you do not agree to limit the occupancy of the proposed dwelling(s) to persons meeting
the Authority’s local occupancy criteria, the application is likely to be recommended for refusal due to it
being contrary to the Yorkshire Dales Housing Strategy.

As of 1st April 2006 this Authority now charges for work incurred by officers in drawing up an
Agreement. These costs on average tend to be in the region of around £330 plus VAT, although if the
matter is straightforward the charge is likely to be less.
