First account current and petition for Allowance of Fees.

THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE NOTED:
  1. Need proposed order.
  2. Letters testamentary issued on 6/5/07.
  3. Did decedent have a predeceased spouse who received Medi-Cal benefits? Need
     verified supplement.
  4. Representative reports that claims totaling $11,872.11 have been filed; that the
     estate consists of $1,000 personal property and a Rancho Cucamonga real
     property inventoried at $365,000; that the real property was in danger of being
     foreclosed upon and therefore family friends (Kenneth McPheeters and his fiancé,
     Marcia Hines) loaned money to the estate to keep the property afloat; that the
     property has not been able to be sold; that a tenant at low rent has been obtained;
     that the property has negative equity; but that the family friends who have loaned
     money to the estate are willing to acquire the real property and provide sufficient
    cash on top of satisfying the existing mortgage to pay statutory fees, any additional
    costs of administration, and to pay creditors $0.25 on the dollar. Representative
    has noticed the creditors including serving a copy of this accounting.
    Representative will also serve a Notice of Proposed Action upon creditors. Issues:
        a. Representative states that an amended I&A will be filed to verify the current
            value of the real property. UPDATE: Reappraisal for Sale I&A filed
            2/13/09 indicating $210,000 real property value.
        b. One of the claims is a $1,367.22 claims by the Franchise Tax Board for
            decedent’s personal income taxes. Question whether this claim can be
            unilaterally negotiated downward and whether, instead, this claimant would
            be entitled to full satisfaction before other claims are negotiated. Need
            verified supplement.
5. It is unclear whether representative intends this accounting to be final. The title
    does not reflect a final accounting and there is no proposed distribution. On the
    other hand, statutory fees are requested (see below). Note also that the
    accounting indicates a $60,000 anticipated loss on value of real property based
    upon the forthcoming Supplemental I&A. In light of the pending nature of the real
    property disposition (see above), suggest court treat the filing as an account current
    and require a final accounting after the real property status is finalized and creditors
    are paid.
6. Representative waives compensation.
7. Atty seeks $10,320 statutory fees. Calculated. Issues:
        a. Fees would not be proper until a final accounting. See note above re finality
            of accounting.
        b. The base upon which fees are calculated could change based upon the
            Supplemental I&A to be filed and/or the deal for disposition of the real
            property.
        c. Appears that counsel received a $2,500 cost advance from representative
            and that only $985.91 has been used on costs. Counsel would need to
            credit any remaining balance of the advance.
8. Representative requests $2,500 reimbursement for costs advanced (deposited with
    atty for cost advance).
9. Accounting shows loss of $1,000 estate personal property caused by foreclosure of
    storage unit. Question whether representative met the fiduciary duty to maintain
    estate property.
10. Summary of Account and schedules are not in form per Pr.C. 1060 et seq. Also,
    Summary of Accounting contains unusual entries such as anticipated loss on value
    of real property and a negative $84,216.83. Accounting therefore cannot be
    sufficiently analyzed. Need corrected accounting.
11. Need copies of bank statements per Local Rule 20.908 if there are remaining
    accounts (cannot be discerned from the accounting).
12. Need notice of hearing and proof of service for Franchise Tax Board per Request
    for Special Notice.
RECOMMENDATION
Need to clear notes. Court may wish to deem this filing a status report and require work-
out of real property and creditor issues, then the filing of a proper final accounting.

  6 Summary of Account does not balance. In addition, charges and credits do not
     appear to be properly presented per Pr. C. § 14061(b). It cannot be determined
     whether or not this accounting balances. Need to file proper accounting to comply
     with Pr.C. §1060.
  7 Petitioner identifies expenses that were incurred and paid as set forth in Schedule
     “I” totaling $31,668.00. However, expenses are not dated or itemized. Need
     verified supplement itemizing expenses.
   8 It appears there is income received from rental property. However, there are no
      supporting schedules showing the nature or purpose of each item, the source of the
      receipt, and the date thereof per Pr. C. § 1062. Need verified supplement.
   9 There are four creditor’s claims from HSBC Bank Nevada for $431.54, Citibank
      USA NA for $805.13, FIA Card Services (BofA) for $11,481.45 and Ditech.Com for
      $191,000.00. Petitioner states that debts are justly due and have not been paid
      because the estate is insolvent. However, there are no allowances or rejection
      notices in the file regarding these claims. Need verified supplement confirming
      status of these claims.
   10 Petitioner alleges there are insufficient assets to pay all debts of the decedent and
      of the estate, all administration expenses, including charges for legal advertising,
      probate referee’s fees, bond premiums, and income taxes, if any, have not paid
      and the estate is not in a condition to be closed. How does petitioner anticipate
      paying the amounts owed? Need verified supplement.
   11 Petitioner proposes distribution of a half interest in the estate. However, final
      distribution may occur when all debts have been paid or adequately provided for
      and the estate is in a condition to be closed per Pr. C. § 11640 et seq.
   12 Petitioner alleges that estate is not in a condition to close and requests the
      administration of this estate to continue. However, petitioner does not indicate the
      reasons why the estate cannot be closed and an estimated time needed to close
      administration of this estate. Need verified supplement.

RECOMMENDATION:
Need to clear notes. In the alternative, Court may wish to deem this proposed accounting
as a status report and require a full and final accounting. If approved, set next hearing re
Accounting Review for 06-08-10. Any accounting to be filed 30 days in advance.

         Livacich. Objectors state that decedent executed a Declaration of Trust and
         pour over Will on 4/27/07 which revoked all previous wills. The 2007 Will
         expressly excluded Lorraine Livacich (petitioner) other than for a distribution
         of $10. Furthermore, the 1991 document offered by petitioner is not an
         original and is not a duplicate original. Thus, the document should be
         presumed revoked by the 2007 document.
     2.  Objections have been filed by Lorraine Livacich.
     3.  Need to file notice of hearing and proof of service in accord with C.C.P §
         413.10. The persons to be served are listed in Pr. C. § 8110. Proof of
         personal service as to Nancy (Troutman) Livacich filed. Proof of Substituted

First account and petition for fees.

THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE NOTED:
  1.   Letters testamentary issued on 9/11/06.
  2.   Accounting period 4/23/06 to 3/31/09 (35 months).
  3.   Assets on hand $1,120,439.48.
  4.   Petitioner reports that there was significant litigation with surviving spouse, Lisa
       Krech but that those issues have been resolved via a stipulated settlement
       whereby the remaining estate will be divided equally into trusts for the three
       minors with assets to be distributed when the minors turn 25. That settlement
       has been approved by the court.
  5.   Petitioner reports that the estate is not ready to close because estate real
       property must be sold and proceeds from the sale of stock in a closely held
       corporation partially owned by decedent must be received.
   6.     Petitioner and atty each seek $17,772.51 preliminary statutory fees. Statutory
          fees are calculated as $25,389.30 making the current partial request 70% of the
          total. Petitioner states that over 70% of the statutory administration services are
          completed, leaving only the real property sale, receipt of proceeds of stock sale,
          and final accounting to be completed. Partial fees may be allowed by the court
          in an amount “on account of services rendered up to that time, that the court
          determines is proper.” Pr.C. 10830(c). Only concern is that if the Rancho
          Cucamonga estate real property (decedent’s 50% interest has a $475,000 I&A
          value) is sold for a significant loss on sale then final statutory fees would be
          reduced accordingly and the presently-requested fees could end up being more
          than 70% of the total. Court may wish to inquire re present value or any
          pending sale of the real property. JTD.
   7.     Petitioner’s attys requests extraordinary fees ($2,231.25 by Overton, Lyman &
          Prince and $7,376.81 by Cassady Corporation). Itemized, relates to
          litigation/mediation:
          a. First request calculated based upon 12.75 hrs at $175/hr. JTD.
          b. Second request (Cassady Corporation) includes invoices that do not state
               hours worked or billing rate. Counsel states only that there were 23.2 hrs at
               an average $316.72/hr without specifying any given hours billed or rate for
               any listed task. The billing also includes fax, postage, copying, etc. that are
               not allowable per Local Rule 20-909 (those charges are administrative
               overhead). See Exhibit E. Need verified supplement removing unallowable
               costs and itemizing tasks/rates.
          c. Extraordinary compensation is normally not allowed until estate is ready for
               final distribution. Local Rule 20-904.
   8.     Petitioner states that the Mahoney & Soll law firm that assisted with the litigation
          against Lisa Krech will file a separate fee petition. See other page.
   9.     Petitioner states that the, Patricia Lobello, GAL appointed for the three minor
          beneficiaries, will file a separate fee petition.
   10.    Petitioner requests authority to make preliminary distribution of the cash on
          hand, approximately $500,000, per the settlement agreement (distribution to
          trusts for the minor beneficiaries). Petitioner states that there are no
          outstanding creditor claims due other than an American Express claim that is
          now time-barred. However, question whether the court wants to allow the
          estate to become illiquid when there are proposed requests for fees to be made
          (see above), uncertainty regarding any sale of estate real property, potential
          need for cash to facilitate preparation for sale of real property, etc. Note also

     other co-trustee of the trust is Richard Salvador Hernandez. Petitioner alleges that
     co-trustee, Richard, is hostile and will not cooperate with petitioner in the
     administration or the management of the trust. Petitioner requests that the court
     remove Richard as co-trustee. Petitioner alleges Richard has changed all the locks
     to the only real property in the trust, has allegedly failed or declined to act to
     cooperate in listing the property for sale and has allegedly acted in a totally
     adversarial manner.
  2. Petitioner requests that the court surcharge Richard per Pr. C. §§ 16420(a)(3) and
     16440 for breach of trust plus attorney fees and costs associated with bringing this
     petition and damages and lost profits in an amount be proven at trial.
  3. Petitioner further requests punitive damages against Richard per Pr. C. § 16420(b)
     for the alleged malicious and oppressive manner the beneficiaries of the trust have
     been allegedly treated. Question how this is actionable by the trustee? Need
     verified supplement or Points and Authorities to support request.
   4. Objections and Cross Petition filed by Richard Salvador Hernandez. Richard
      is requesting that the court remove Anna as co-trustee for alleged elder
      abuse, breach of fiduciary duty and fraud. There is a pending civil case in

THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE NOTED:
  1. This appears to be a Medi-Cal planning transaction.
  2. The petitioner and the respondent have been married for 24 years. The wife is the
     ill spouse. She is 51 years old. Petitioner alleges that ill spouse lacks capacity to
     make the transmutation. The well spouse is 45. Ill spouse currently resides at
     home.
  3. Well spouse proposes to transfer community residence to himself as his sole and
     separate property as a precursor to seek Medi-Cal benefits. The value of the real
     property is $750,000. It should be noted that the home is exempt assets for Medi-
     Cal planning purposes. Petitioner alleges that the nursing home costs will be
     $5,000-$6,000 and that the real property will render him ineligible for Medi-Cal
     assistance unless petitioner is allowed to implement specific estate planning
     authorized by recent Federal and State legislation. . Petitioner alleges that while
     these assets are exempt the transfer is necessary in order to maintain the
     institutionalize spouse’s eligibility for Medi-Cal assistance. However, Title 22 CCR
     Section 50425(c) indicates that the Ill spouse would still be eligible for Medi-Cal if:
          a. The applicant or beneficiary is absent from the property for any reason,
             including admittance to long term care, and declares in writing that he/she
             intends to return to the property to live.
            b. The applicant or beneficiary no longer lives on the property, does not intend
               to return to the property, the property is not otherwise exempt and the
               property cannot be readily converted to cash but a bona fide effort is being
               made to sell the property.
            c. A sibling or child aged 21 or over of the applicant or beneficiary has
               continuously resided on the property for at least one year immediately prior
               to the date the applicant or beneficiary entered a long term care facility.
            d. When the Medi-Cal applicant or beneficiary formerly used a home as his/her
               principal residence, and the individual's subjective intent is to return to the
               home, that home is an exempt resource. It is irrelevant whether there is
               objective evidence which indicates that the individual will not return to the
               home.
               (Question what authority is petitioner bringing this petition? Need verified
               supplement explaining.)

     The corrected accounting report alleges the real property went into foreclosure, but
     was taken out of foreclosure. Question if Attorney Hubert loaned the estate money
     at 10% interest. If so, how much money and has attorney been reimbursed? Need
     to file verified supplement.
2. The final Inventory and Appraisal filed 6/27/05 of $85,800 does not match the
    beginning balance of the accounting of $54,000 [which $54,000 appears to be the
    value from reappraisal for sale Inventory and Appraisal]. Need corrected
    accounting.
3. Accounting has been deemed to be by counsel on behalf of client. Verification of
    counsel filing accounting on behalf of client is needed.
4. There are “additional funds received from attorney Hubert” listed under charges in
    the amount of $18,975.48; however, there is no matching schedule to compare
    values. Need to file verified supplement with correct supporting schedule.
5. Schedule B there is $71,579.44 in receipts from attorney Hubert. However, it
    appears that the miscellaneous receipts were calculated incorrectly and the proper
    amount should state $71,793.56 (tabbed).
6. There total expenses within disbursements indicate a total of $22,803.05. However,
    the calculation is incorrect based on figures provided and the proper amount should
    state $21,930.05. Therefore, the accounting does not balance. Furthermore, there
    is an asterisk for the amount to Brickley Construction for 02/15/92 rather than an
    actual amount. Need an amended accounting that has proper amounts.
7. The petition appears to be a request for a final accounting; however, there is no
    prayer in the report.
8. The court revoked IAEA powers on 10/26/05 as there were allegedly no assets to
    cover a bond. Question if the bond lapsed for lack of payment of premium and if
    so, how long the estate was without bond? File verified supplement.
9. There is a letter from the SBCERA indicating proceeds were paid to Susan Castro
    as the administrator of his estate. Thus, it appears that the retirement benefits
    should have been inventoried and made a part of the estate. However, no
    inventory was ever completed for the SBCERA retirement proceeds. Question
    what the amount of proceeds that were received, as there are no benefits listed
    under receipts. Need to file verified supplement.
10. There was a reference to a savings account at Redlands Federal account number
    43-XXXX-8-9 of $8,100 in the decedent’s will that was not properly executed and
    therefore, not admitted to probate. Question whether the savings account was an
    asset as of the date of death and if so, why it was not listed in the Inventory and
    Appraisal or schedule of receipts? Need to file verified supplement.
11. Original petition indicates the decedent may have had a safety deposit box.
    Question whether there was a safety deposit box at the date of decedent’s death
    and question the contents of the safety deposit box? Need to file verified
    supplement.
12. Question if a change of ownership statement was filed with the county assessor’s
    office? There may be substantial Supplemental property taxes due. File verified
    supplement.
13. The following receipts listed are not supported by a copy of a mortgage statement
    or other documentation to confirm payment was made to the estate. Need same
    for the following:
        a. 06/29/93 Earthquake refund California $248.26
        b. 08/04/94 Escrow Surplus $248.26.
        c. 10/05/95 Escrow Surplus $195.66.
        d. 09/21/99 Escrow Surplus $27.60.
        e. 08/15/00 Fleet Mortgage refund $392.94. This entry to Fleet Mortgage also
           appears under disbursements as a payment of $392.84 on 08/16/00. Need
           to file verified supplement explaining why a refund was reapplied to same
           mortgage company.
14. There are receipts for rent from 01/14/92 – 11/20/03. However, the following
    questions need a verified supplement for further explanation.
        a. There are missing months and or reductions of rent for the real property
           when it appears there were consistent renters occupying the real property.
                 i. 06/20/96 rent was reduced $100.
                ii. 02/01/08 rent was $250 instead of the average $500.
               iii. There is no rent receipt for 11/2000 or 11/2001, but it appears the
                    same renter [Rivera] was occupying the real property.
              iv. There are no rental receipts from 06/2003 – 11/20/03.
                v. The real property has not earned rent for 5 ½ years.
              vi. According to the transcripts on 11/29/07 rents were being paid of
                    $500 a month; however, was not being collected for several months.
                    Question why there are no rents from 02/01/91 – 01/14/92 or after
                    11/20/03. Homeowner’s insurance policy through Central City
                    Insurance states “tenant occupied” through 06/09/07 (tabbed). Need
                    to file copies of all rental agreements to coordinate and confirm the
                    rental income paid/not paid during the 19-year accounting period.
              vii. An interest earning bank account was never opened. Court may wish
                    to require a copy of the attorney/client trust account ledger for all
                    income and disbursements.
15. The following disbursements to Source One/Fleet Mortgage/Wamu [mortgage
    payments] have the following discrepancies. Need to file verified supplement for
    further explanation.
        a. There is duplicate a payment of $309 for 08/04/94. Question if this is an
           accounting error?
        b. From 1996-2006 the alleged mortgage payments ranged from $3,758 a year
           to $6,034.76. Question why the payment amounts were not consistent as
           there was rental income being received?
16. The following disbursements need a verified supplement.
        a. 03/30/94 Sam Hubert re plumbing problem $121.56. Question if Sam
           Hubert is related to counsel as report indicates no agents used were related
           to the fiduciary.
        b. There are three entries for Home Depot of exactly $16.57 each on different
           dates. However, Home Depot receipts provided do not indicate the amounts
           stated. Question if this is an accounting error?
        c. There are disbursements for bonding company. However, the following
           dates/amounts need further verification.
                 i. 06/09/98 $446 there is no invoice.
                ii. 06/09/01 $446 there is no invoice. There is also an entry of $750 for
                    3 years of bond that covers the 2001 period. Question whether bond
                    premium was paid in duplicate or even triplicate for the same period
                       of coverage. Petitioner has check numbers and dates written on the
                       receipts. Court may wish to require copies of cancelled checks.
                  iii. 06/09/04 $446 there is no invoice.
   17. Petitioner does not state whether all taxes [property as well as income] have been
       paid nor does petitioner request a reserve for taxes. Question whether proper
       fiduciary income tax returns were prepared as rents were received for the real
       property the majority of the accounting period? Also need verified supplement to
       state whether all local taxes, including real property taxes, have been paid.
   18. Need statement of compliance with Pr.C.§9202 re notice to Director of Health
       Services.
   19. The prior administrator, Susan Castro, appears to reside at the same address listed
       on the original pleadings. The court may wish to require Ms. Castro to verify the
       accounting as required per Pr.C. §1021. In addition, the court may wish to set OSC
       re failure to appear and file an accounting as well as explain why sanctions should
       not be imposed for failure to file an accounting. Issue Citation and have Ms. Castro
       personally served.

RECOMMENDATION
The accounting cannot be approved as currently filed. Need to clarify acts of former
administrator with verified supplement as requested as well as clear notes.

   5.     Petitioner seeks $13,281.82 per a settlement agreement by which trustee and
          beneficiary agreed to a fee based upon 1% of trust value. Calculated. There

   7.     In a supplement filed 3/30/09, petitioner states that, administrators Gordon and

          administrators turn over the documents or that petitioner be able to deduct the
          cost of lien sale from their share of distribution in order to gain title to the
