                                           ZONING BY-LAW




At a special meeting of the council of the Municipality of East Bolton, held at the town hall, on March
12, 2001, under the chairmanship of the mayor, Joan Westland-Eby, with councillors Sally Crocker,
Bruno Beauregard, Pamela Galvin, Lise Barrette and Douglas McGregor present, and forming a
quorum in accordance with the law .

WHEREAS the Municipality has the power, by virtue of the law, to adopt, amend or repeal a by-law
concerning zoning on its territory;


WHEREAS it is timely to replace the Zoning By-law as a result of the revision of the development
plan of the MRC Memphrémagog and the adoption of its revised planning program;


WHEREAS it is timely to replace the Zoning By-law with an amended and enhanced by-law;


WHEREAS the applicable adoption procedure has been duly followed ;



CONSEQUENTLY, it be and is ordered and decreed by this by-law, as follows :

                                DECLARATORY AND INTERPRETIVE PROVISIONS

                                           DECLARATORY PROVISIONS




                                                                         TITLE                   1.1
This by-law is entitled the Zoning By-law.

This by-law applies to the entire territory of the Municipality.

A permit issued by virtue of this by-law does not in any way
remove the applicant‟s obligation to obtain any certificate or permit
required under any other by-law, law or applicable provision.

                                                                         BY-LAWS                 1.4
Any earlier by-law related to zoning as well as all provisions
adopted by virtue of the power to zone contained in an earlier by-
law are hereby repealed for all legal purposes whatsoever.

All dimensions given in this by-law are in metric units in the
International System (IS). Imperial measurements are only given
for the purposes of information and may not be used to apply the
by-law.

                                                                     DISCREPANCY

In the case of any discrepancy between a provision in the Zoning
by-law and the Building or Subdivision By-law, the provision in
the Zoning By-law takes precedence.
                                                                     SUBDIVISION OF THE
                                                                     TERRITORY INTO
                                                                     ZONES                1.8
For the purposes of applying this by-law, the territory of the
municipality is divided into zones. Each zone is identified by a
letter or combination of letters. This basic identification
corresponds to the general character of the zone. Zones with the
same general characteristics are distinguished by a number
separated from the basic identification by a hyphen. Each zone,
identified by its own unique combination of numbers and letters,
constitutes a separate zone distinct from any other.

Unless otherwise stated, the limits of a zone coincide with the
median line of roads, streams, rivers and the railway, as well as
with the property lines and boundaries of the Municipality.

                                                                     DEFINITIONS          1.9
Unless the context gives a different meaning, the words and
expressions used in this by-law are understood to have their usual
meaning, with the exception of the words here defined.

Abattage d'arbres : Tree cutting

Tree cutting - when at least one tree of a commercial species of
at least 10 cm at the D.C.H (diameter at chest height) is cut per
year.

Abri d'auto- Auto Shelter, Carport

An open construction, part of the main building or private garage,
used for storing or parking an automobile, and having at least 40
% of the walls open and unobstructed. When one side of the
shelter is formed by the wall of an adjacent building, the area of
this wall is not included in calculating the 40 percent.


Abri pour embarcation : Boat shelter

A structure built above the littoral, with or without a roof and
supported by walls or posts, to provide shelter for a boat. A
gangway or exterior platform attached to the shelter is considered
as a dock and shall respect the norms for a dock.

Abri forestier : Forest shelter or cabin

A rudimentary building constructed in the wild and intended to
shelter people on an occasional basis and for short periods of
time, never to exceed 180 days in total per year, for such
recreational activities as hiking, sports hunting or fishing, or for
scientific research activities in the wild. It consists of a single
room, the floor area of which does not exceed 20 m² and has no
running water.

Affiche : Sign

A sheet of paper or cardboard bearing a message intended to
promote a show, exhibition, or an event, or intended to
disseminate a public notice or any other information in the public
interest.

Aire d’alimentation extérieure – Feedlot, exterior

An area outside a building where animals are kept on a periodic
 or continuous basis, and where they are fed exclusively with
fodder from outside this feedlot.

Assiette d'un chemin : Roadway

The part of a road used for car traffic. The roadway includes the
surface on which vehicles travel and the shoulders (the space
between the ditches).

Auberge : Inn

Hotel establishment having a maximum of 20 bedrooms. The
operator of such an establishment must obtain a permit under the
Hotels Act. The inn may have food services facilities.

Auvent : Awning

A shelter that can be put up and taken down, projecting above
one or several openings (door, window, French window) or above
a terrace or outside steps, to protect against inclement weather or
the sun.

Avant-toit et marquise : Eaves and Canopy

A roof projecting from a facade of a building (front, rear or side),
the projection on the ground of which does not exceed 1.22 m (4
ft.) in length.

Babillard : Notice board

A board for notices placed outside a building, on which is posted a
menu, schedule, calendar of events or other similar information
related to the establishment inside the building. The notice board
may be placed flat on the wall or on a post, portico or overhead
signpost.

Barge de plaisance : Houseboat

A flat-bottom boat designed so that the user(s) can drink, eat, and
sleep on board.

Base d'enseigne : Base for a sign

A volume of concrete, masonry, wood or any other material built
on the ground or partially buried, having a maximum height of
80 cm, intended to support a sign. This volume may be full,
partially empty or may be used as a container for planting.

Bas relief

The part of a sign projecting slightly (less than 10 cm) in relation to
the background.

Bâtiment : Building

Any construction other than a vehicle or a good designed as a
vehicle, that is used or intended to be used to shelter or receive
persons, animals or other things.

Bâtiment accessoire : Accessory Building

A shed, lean-to, private garage, shelter for a car or private
greenhouse when detached from the principal building, or a boat
shelter.


Bâtiment principal : Principal (main) Building

A building used for the principal use of the property. This main use
is authorized for the location on which the building is standing, or
has an acquired right.


Bed & Breakfast

Synonymous with a gîte touristique, room and board for tourists.


Bois commercial : Commercial-grade Wood

Commercial-size trees that exceed 10 cm at the D.C.H (diameter
at chest height).

Carrière : Quarry

A place where consolidated mineral substances are extracted
from open pits for commercial or industrial purposes, or to meet
contractual obligations.

Chemin : Road

Any traffic lane intended for the movement of automobiles.

Chemin de débardage : Logging roads (forestry)

Road developed through a forest stand to transport wood to a
storage or stacking area.

Chemin forestier : Loading Road

Road developed on a site to transport wood from the stacking
area to the public road or public type of road.

Chemin privé : Private Road

Any road that is not a public road.

Chemin public : Public Road

A road that belongs to a municipality, or the Canadian or Quebec
government, on which the free movement of goods and persons is
authorized.

Construction : Construction

An ordered assemblage of materials. Without limiting the
generality of the preceding sentence, the term construction
denotes a building, sign, reservoir, gas pump, fence, swimming
pool.

Corde : Cord (wood)

A volumetric unit of measurement of 128 ft.³, equivalent to 4 ft. in
height X 4 ft. in width X 8 ft. in length, or approximately 3.625 m³ .

Coupe à blanc : Clear cutting

The cutting or harvesting of all the trees of commercial size in a
given stand of trees.

Coupe de récupération : Salvage cutting

The cutting of dead or damaged trees that have suffered damage
causing rapid deterioration of the ligneous material, as a result of
a natural phenomenon such as lightning, up-rooting, an ice storm,
etc.

Coupe sanitaire : Sanitation cutting

Felling and removal of deficient, defective, decayed, damaged or
dead trees, in order to prevent the propagation of insects and
disease.

Cour arrière : Back yard

"Back yard" refers to the open area, between the rear lot line and
the rear wall of the main building and any rectilinear extensions,
to the property limits. See sketch under Marge de recul:Setback.

Cour avant : Front yard

Refers to the space between the road line and the front façade of
the principal building and any rectilinear extensions to the limits of
the property. See the sketch under Marge de recul:Setback.

Cour de ferrailles : Scrap yard

A place used to take apart, compact, store or recycle car bodies or other
scrap metal.

Cour latérale : Side yard

The residual space of the parcel of land once the front and back yards
and the space occupied by the principal building have been removed.
See sketch under Marge de recul:Setback.

Cours d'eau : Body of water (Watercourses)

Intermittent or permanent bodies of water or watercourses, as shown on
the Zoning Plan which forms an integral part of this by-law.

Cours d'eau permanent nommé : Permanent, named bodies of
water (Watercourses)

Permanent bodies of water named on the Zoning Plan that forms an
integral part of this by-law.

Demi-étage : Half storey or floor

A storey, the floor area of which is equivalent to a maximum of 80 % of
the floor area of the floor directly below, under the roof, the slope(s) of
which have an incline of between 1:2 and 3:2.

Dépanneur : Convenience store

A retail establishment that is intended to supply daily, local and
immediate needs, and offers a variety of standard consumer goods,
such as foodstuffs, hygiene products, newspapers and cigarettes, the
floor area of which does not exceed 150 m² (1,615 ft.²). This type of
establishment is open at least eighty-four (84) hours per week.

Dépendance : Outbuilding

Synonymous with Accessory Building.

D.H.P

The abbreviation used for the diameter of a tree measured at chest
height, that is at 1.3 metres above the ground.

Drainage forestier : Forest drainage

All the works (ditching, construction of sedimentation ponds, etc.) carried
out to reduce the humidity of the soil while promoting surface drainage
and water infiltration.

Emprise de rue : Road right-of-way

The land used as a traffic lane, in compliance with the Subdivision
By-law or for which an acquired right exists.

Enseigne : Sign

Any collection of letters, words, figures or numbers, any graphic
representation, any collection of fixed or blinking lights including
electronic or numeric billboards, all symbols, emblems or logos, all
flags, pennants or streamers, any human or animal figure or any
other constructed mass, inflated or otherwise constituted, as well
as any other assemblage, device or means used or intended to be
used to inform, notify, announce, identify or publicize an
enterprise, profession, service, establishment, activity, place,
destination, event, entertainment, product or project, which is
visible from the outside and which is an independent
construction, a part of a construction or attached to one, or is
painted on one, including the structure and the display's support.

Enseigne animée : Animated sign

A sign on which all or part of the colour, the display or message
may be changed by modifying the position of the source of light or
by electronic or alphanumeric displays.

Enseigne à plat : Flat sign

A sign whose surface is parallel to the surface of the wall to which
it is affixed and is at a maximum distance of 30 cm from it.

Enseigne clignotante : Flashing sign

A sign equipped with a device to produce intermittent lighting or
lighting of variable intensity.

Enseigne commerciale ou d'affaires : Commercial or
business sign

A sign that identifies a business, profession, service,
establishment, activity, entertainment, project or commercial or
business premises or a place where services are located, carried
on, sold or offered on the site where the sign is located.

Enseigne communautaire : Community sign

A grouping, on the same standard or upright, of several
commercial- or business-type signs, project signs or directional
signs, put there by public authority or a group or enterprise
mandated by a public authority.

Enseigne commune : Communal sign

A sign that identifies a commercial centre, a real estate grouping
or any other grouping of at least three (3) establishments in which
the establishments or occupants are identified.

Enseigne de projet : Project sign

A sign announcing a subdivision, development, construction or
renovation, enlargement or restoration project. Aside from
information concerning the project; these signs may include all the
information relating to the phasing and financing, the contractor as
well as the professional resources involved.

Enseigne d'identification : Identification sign

A sign on which appears the name and address of the owner or
occupant of a building, his profession or field of activity, the name
and address of an edifice as well as the use for which it is
intended, without, however, any reference to a product or
trademark.

Enseigne directionnelle : Directional sign

A sign indicating the direction to follow to reach a destination.

Enseigne éclairée : Lighted sign

A sign on which is projected a light from a light source of constant
or variable intensity at a distance from it.

Enseigne en projection : Projecting or perpendicular sign

A sign whose display surface is perpendicular or at an angle to
the surface of the wall to which it is affixed or whose display
surface is parallel to this wall surface and at a distance of more
than 30 cm from it.

Enseigne lumineuse : Luminous sign

A sign designed to emit an artificial light by means of a light
source placed inside translucent or transparent sides. This
category includes signs made of fluorescent tubes.

Enseigne mobile : Mobile sign

A sign or part of a sign to which one can transmit a rotating,
alternating or other movement.

Enseigne portative : Portable sign

A sign placed on or built on a vehicle, part of a vehicle, a trailer or
other moving surface or any other device allowing it to be moved,
or on any other support, including a sign painted or printed on a
vehicle, part of a vehicle, a trailer or other moving surface or any
other device allowing it to be moved, or on any other support, with
the clear intention of making an advertisement, directional or
commercial or business sign.

Enseigne publicitaire : Advertising sign

A sign advertising an enterprise, profession, service,
establishment, activity, place, destination, event, entertainment,
product or project situated, carried out, sold or offered elsewhere
than the site where the sign or panel is located.

Ensemble d'intérêt patrimonial : Historic site

A part of the territory designated as a site of historic interest on
the Zoning Plan that forms an integral part of this by-law.

Entrepôt : Warehouse

A commercial or industrial building used for storage of
merchandise.

Établissement :Establishment

A commercial, industrial, professional, public or institutional
enterprise carried on in the building. When there are two or more
establishments in the same building, each establishment shall be
separated from the others by walls, and no direct access between
them may be created.

Étage : Floor or Storey

That part of a building, other than the basement or cellar, or attic,
situated between the surface of one floor and the underside of the
next floor above, or the ceiling if there is no floor above. A
technically empty space of more than 2 m clearance is considered
as a storey in the calculation of the number of storeys.

Étage (premier) : First floor

The first floor is the floor which is situated at a maximum height of
1.4 m (4.6 ft.) above the average ground level measured around
the perimeter of the building.

Façade : Facade

Each of the elevations of a building.

Façade avant : Front facade

The facade of a building situated along the roadside.

Faîtage : Ridgepole

The ridge line of the roof of the building, excluding towers,
chimneys, antennas and other structures not forming part of the
roof.

Fenêtre verte : Open view

A window-opening created along a screen of planting by pruning
or removing trees and shrubs.

Fondation permanente : Permanent Foundation

A load-bearing structure made of poured concrete or cement
blocks or mortared stone that carries the weight of the building to
the ground.

Fossé : Ditch

A man-made excavation to carry run-off water or drain a parcel of
land.

Garage commercial : Commercial garage

Any building or part of a building used for repair, sale or servicing
of motor vehicles or machinery, for payment.

Gestion liquide : Management of liquid farm wastes

A method of managing the liquid component of animal wastes,
sometimes mixed with straw or bedding and some cleaning water;
these wastes are in liquid form and are handled by pumping.

Gestion solide – Management of solid farm wastes

A method of managing the manure from animal wastes and their
bedding; it is stored in solid form and handled by loader.

Gîte touristique : Bed and Breakfast establishment

Accommodation offered inside a dwelling where a maximum of
four (4) rooms are rented to customers and restaurant services
are offered only to these customers.

Habitable : Habitable

Meets the norms in the National Building Code insofar as lighting,
ventilation, salubrity, area and the height of rooms are concerned.

Habitation bifamiliale : Duplex (Two-family dwelling unit)

A duplex is a building comprised of two (2) separate living units
having separate entrances or giving onto a common enclosed
entry hall.

Habitation en rangée : Row house

A dwelling situated in a group of at least three contiguous dwelling
units, each having at least one party wall with another dwelling
unit.

Habitation isolée : Detached dwelling

A dwelling having natural lighting on all four sides; it does not
share a party wall with another building.

Habitation jumelée : Semi-detached dwelling

A dwelling unit having a party wall with only one other dwelling
unit.

Habitation multifamiliale : Multi-family dwelling unit

A building containing at least three (3) housing units; generally
distributed over more than one storey, with separate entrances or
sharing an entry hall or common hall.

Habitation unifamiliale : Single-family (detached) dwelling

A building containing a single dwelling unit.

Hauteur d'un bâtiment : Height of a building

The distance between the ridgepole of a building and the average
grade level around the perimeter of the building, average grade
level being established based on the highest and lowest point of
natural ground situated around the perimeter of the building.

Immeuble protégé : Protected property

Among the following properties :

-    a building occupied by a use from the commercial group, with
     the exception of short-term types of establishments;

-    a municipal park;

-    a public beach or marina;

-    the site of a teaching establishment or institution as defined in
     the Health and Social Services Act (R.S.Q., c.S-4.2);

-    a campground;

-    a building situated on an outdoor recreation centre (base de
     plein air) or a building that is part of a nature study centre;

-    the chalet or club-house for a ski centre or golf club;

-    a temple or house of worship;

-    a summer theatre;

-    a hotel, vacation centre or youth hostel as defined in the
     regulations respecting tourist establishments;

-    a vineyard or food service outlet holding an operating permit
     for year-round operations.

Cycle paths not in a municipal park are not considered as
protected real estate.

Inspecteur en bâtiment : Building inspector

Refers to the building inspector named by resolution of the
municipal council and his/her assistant, also named by the
council.

Installation d'élevage : Facility for raising animals

Refers to a building for raising animals or a feedlot in which
animals are kept, and a construction or storage area for farm
manures or a group of several such structures when each
structure is separated from its neighbour by not more than
150 metres and when all are part of the same operation.

Kiosque d'information : Information stand or booth

A circular or polygonal sectional construction, greater in height
than width, located in an area to which the public has access and
intended to be used for notices of public interest. An information
booth installed on a private property is not considered as a sign if
it does not contain any information allowing it to function as a
directional, advertising or commercial sign.

Lac : Lake

All lakes identified on the Zoning Plan that forms an integral part of this by-
law.

Largeur (d'un terrain) : Width of a parcel of land

The distance, measured along the front lot line, between the lines defining
the parcel of land.

Ligne arrière : Rear lot line

The line defining the property and situated on the side opposite to the
front line. There is no rear lot line on a property bounded by more than
one road. See the illustration under Marge de recul : Setback.

Ligne avant : Front lot line

The dividing line between a property and the road. See the illustration
under Marge de recul : Setback.

Ligne des hautes eaux : High water mark

The place where the predominance of aquatic plants gives way to the
predominance of terrestrial plants or, if no aquatic plants are present, the
place, in the direction of the water, where the growth of terrestrial plants
stops. When it is impossible to determine the high water mark from the
vegetation, the line corresponds to the top of a retaining wall or the
maximum water mark apparent on a construction designed to hold back
the water.

Ligne latérale : Side or lateral lot line

The line joining the rear lot line of a property to the front lot line, or, in the
case of a property bounded by more than one road, any line delimiting the
property that is not the front lot line. See the illustration under Marge de
recul : Setback.

Littoral : the Littoral

The part situated between the banks or shores of a lake or body of water.

Logement: Dwelling unit

A dwelling unit is made up of a group of rooms in which a person may
prepare a meal, eat, sleep and use sanitary facilities. Each dwelling unit
shall have access directly to the outside or through a common entry with
another dwelling unit, so it possible to go outside without having to go
through part of or right through another dwelling unit.

Lot : Lot

Land identified by a distinct number and delineated on the
cadastral plan prepared and presented in accordance with the
Civil Code and the Cadastre Act.

Lot de coin (d'angle) : Corner lot

Lot situated at the intersection of two (2) or more streets that, at
their meeting point, form an angle not exceeding one hundred and
thirty-five degrees (135°).

Lot desservi : Serviced lot

A lot situated on a road served by sewer and water systems.

Lot intérieur : Interior lot

A site other than a corner lot.

Lot non desservi : Unserviced lot

A lot situated on a road where there is no sewer or water system.

Lot partiellement desservi : Partially serviced lot

A lot situated on a road where there is either a sewer or a water
system.

Lot transversal : Transversal or through lot

An interior lot having a frontage on two (2) streets.

Maison mobile : Mobile home

A single-family, factory-produced dwelling, detached on all sides,
with a roof the minimum pitch of which corresponds to the
Requirements of the National Building Code, Table 9.26.3.A, and
designed be lived in year-round, and moved to its final destination
on its own chassis with removable wheels. Such a home shall
have a minimum width of 4.27 m and a minimum length of 12 m.
Any structure of this type, the dimensions of which are smaller, is
considered to be a trailer.

Maison motorisée : Motorized home

Any type of vehicle, registered or not, used or intended to be used
as a place where people may live, eat and sleep, and designed to
be driven on its own chassis, powered by a motor that is an
integral part of said vehicle. Such a vehicle is called a “camper” or
 “Winnebago”.

The use of a motorized home or camper is only permitted on a
seasonal basis (less than 180 days per year) and solely within a
camp ground, no matter how long it is there.

Marge de recul : Front setback line

The distance between a line delimiting a parcel of land and the
most prominent part of the facade of a building. A stairway leading
to the basement or ground floor, a gallery, stoop, cornice, chimney
or bay window is not considered to be a "prominent part".




Marge de recul arrière : Rear setback

The setback in relation to the rear lot line.

The setback in relation to each front lot line.

Marge de recul latérale : Side setback

The setback in relation to each side lot line.

Marina : Marina

A site developed on the shoreline and the littoral, or the littoral, to
allow boats or other pleasure craft to anchor or tie up at a wharf or
dock, and permit persons or merchandise to board and disembark
or be loaded or unloaded from a boat or pleasure craft; and
arranged to offer sales, rental, maintenance and other commercial
services related to nautical activities in addition to the rental or
sale of boats or other craft.

Marquise : Canopy

A permanent roof projecting from the entrance to a building or
above a stoop, gallery or terrace, or a free-standing roof
supported by one or more columns and covering an area
arranged or built for an activity.

Mezzanine : Mezzanine

A level between the floor and the ceiling of a room or storey, or an
interior balcony.

1)     A mezzanine is not considered to be a storey in the
       calculation of the height of a building if its total area does not
       exceed 10 % of the total floor area of the floor over which it
       projects.

2)     A mezzanine does not constitute a storey in the calculation of
       the height of the building if its floor area does not exceed
       40 % of the total floor area of the floor below, and if no
       obstacle higher than 1.070 mm blocks the view of the floors
       above and below the mezzanine.

Milieu humide : Wetlands

All wetlands identified on the zoning plan that is an integral part of
this by-law. Are also considered wetlands, all marshes designated
on plan 6-0661 dated April 1992 annexed and becoming part of
the present bylaw. Should there exist a divergence between the
limits on zoning plan 6-0795-Z and plan 6-0661, the limits used
will be those denoting the largest surface of marshes or wetlands.
The delimitation of wetlands extends to the line where the shrubby
growth characteristic of wetlands ends.

Ouvrage : Works

All interventions that change or modify the natural condition of a
site, including the forest cover.

Panneau de signalisation privé : Private sign

A sign installed on private property, to inform and direct visitors to
the site; this sign may be related to a route, activity areas,
restrictions or methods of access. A maximum area equivalent to
20 % of the sign or board may be used to identify the place or the
establishment.

Panneau-réclame : Billboard

Synonymous with enseigne publicitaire : advertising sign.

Pavillon secondaire : Secondary residential building (lodge,
cottage)

A building situated on the same property as a detached single-
family house, and used for residential purposes complementary
to the main dwelling (e.g. : guest house, staff cottage).

Pente : Slope

The angle, measured vertically, between the horizontal and an
upright straight line, joining two points situated 30 m. apart on the
ground, for a parcel of land.

Pente (définition applicable pour l'abattage d'arbres) : Slope
(definition applies to tree cutting and natural landscapes)

The incline of a parcel of land measured from the height of the
slope to its base over a minimum distance of 30 m.

Peuplement et peuplement forestier : Stand of trees, forest
stand

A group of trees similar in plant composition, structure, age,
distribution in space and health, which distinguishes it from the
surrounding forest stands.

Piscine : Swimming pool

Refers to an in-ground or above-ground pool if, in the latter case,
it respects the following dimensions:

-    60 cm (1,97 ft.) high;
-    4,5 m (14,8 ft.) in diameter for circular pools;
-    16 m² (170 ft.²) of surface for non-circular swimming pools.

Placard publicitaire : Advertising bill or poster

A temporary sign placed in a store window, a window, a door or
any other place provided for this purpose, and intended to
advertise a sale, a feature product, or a short-term event.

Plage publique : Public beach

A beach that belongs to a municipality, or the Canadian or
Quebec government.

Plan de gestion : Forestry management plan

A document signed by a forestry engineer, showing the cadastral
boundaries of a given property, the forest stands, their area and
the silvicultural activities planned.

Plan de l'opération cadastrale : Plan for a cadastral operation

A plan giving a graphic representation of the parcel of land that is
the subject of the cadastral operation, bearing a specific number
for each lot created. This plan is prepared by a land-surveyor and
is intended to be forwarded to the provincial department in charge
of cadastral plans or the land registry.

Plaque professionnelle ou d'affaires : Professional or
Business nameplate

A sign that identifies the occupant of the building to which it is
affixed, by name, title and type of activity carried on.

Poste d'essence : Gas bar

An establishment solely for the sale of gas, and, secondarily, for
the sale of products needed for vehicles to function.

Pourcentage d'occupation du sol : Land use percentage

This ratio is obtained by dividing the total area of all buildings by
the area of the site.

Prescription sylvicole : Forestry prescription (requirements
or provisions to be carried out)

Document signed by a forestry engineer, locating and prescribing
a forestry activity in a forest stand.

Profondeur moyenne d'un terrain : Average depth of a parcel
of land

The quotient obtained by dividing by two the sum of the lengths of
the side lot lines.

Quai à emplacements multiples : Wharf with multiple berths

A structure on the shore and littoral, or on the littoral, comprising
at least three (3) spaces rented, sold or otherwise made available,
designed to allow persons to board and disembark, and
merchandise to be loaded, and unloaded, from a boat or other
craft, where various commercial services may not be authorized,
with the exception of the rental or sale of berths for crafts.

Quai privé : Private dock or wharf

A structure on the shore and the littoral, or on the littoral,
comprising a maximum of three (3) berths to allow persons to
board and disembark and merchandise to be loaded and
unloaded, from a boat or other craft. See also Abri pour
embarcation :Boat shelter.

Quai public : Public Wharf

A structure belonging to a government or municipality, where
persons can board or disembark, and merchandise can be loaded
or unloaded, from a boat or other craft, or where various
commercial or other types of services can be offered to boats and
other crafts.

Réparation : Repair, renovation

The act of returning to its original state an existing structure or
construction, provided that there is not more than 50% of this
structure or construction to repair and that there is no change in
the original dimensions of the structure in question. (Definition
applies to construction on the shore or littoral and wetlands.)

Rive : Shore or bank

The shore or bank is a strip of land 10 metres deep that extends
towards the land starting at the high water mark, when the slope is
less than 30 % or when the slope is greater than 30 % and has an
embankment less than 5 metres in height.

The shore or bank is a strip of land 15 metres in depth that
extends towards the land when the slope is continual and is
greater than 30 % or when the slope is greater than 30 % and has
an embankment of more than 5 metres in height.

Riverain : Waterfront

Adjacent to a lake or body of water.

Roulotte : Trailer

A trailer or semi-trailer, registered or not, mounted on wheels or
not, used or intended for use as a place where people may live,
eat, sleep and designed so that it may be attached to a motor
vehicle and towed or otherwise moved by such vehicle.

Rue : Street

Synonymous with Chemin : Road.

Sablière : Sandpit

An open pit where non-consolidated mineral substances, including
sand and gravel, are extracted from a natural deposit, for
commercial or industrial purposes or to fulfill contractual
obligations.

Serre privée : Private greenhouse

A greenhouse used for the growing of vegetables, for
consumption or pleasure, by the owner of the greenhouse and
not intended for sale.

Site de camping : Campsite

Space within a camping ground, allocated to a camper for a fee
and landscaped to allow a tent to be put up, or a tent-trailer,
camper, motorized camper, recreational vehicle or any other such
equipment to be installed, whether or not public utilities (such as
water, electricity, toilet-cleaning) are available within said space.

Superficie de plancher : Floor area

The sum of the areas of basement and each storey of a building,
the area measured at the exterior circumference of the exterior
walls. In calculating the floor area, the space taken by elevators
and stairwells must be counted, along with the floor area of any
mezzanine.

Superficie d'un bâtiment : Surface area of a building

The surface area of the horizontal projection of a building at
ground level, including all porches, verandas, skylights, and
ventilation shafts, but excluding terraces, steps, cornices, exterior
stairways, outdoor loading platforms and interior and exterior
yards.

Table champêtre : “Table champêtre” (Country dining)

An establishment that is a member of the Fédération des
agricotours du Québec.

Table d'hôte

Food service offered inside a single-family dwelling, for a
maximum of 20 patrons per day. The maximum area that can be
used for this purpose is 30 % of the floor area of the ground floor
only. Any building in which this activity is carried out shall be
situated on a parcel of land having an area of 8,000 m² of more.

Terrain : Site, property or parcel of land

A piece of land owned by one (1) person, formed of one or more
lots or parts of lots, used, or that may be used, for a principal land
use.

Terrain (définition applicable pour l'abattage d'arbres) :
Site or property (definition applicable to tree cutting only)

A parcel of land described by one or more lot numbers on the
official cadastral plan or subdivision plan prepared and deposited
according to articles 3029, 3043 and 3045 of the Quebec Civil
Code or in one or several property transfers by metes and bounds
or by a combination of both, and constituting one parcel of land in
a single block, partially or totally owned by the same landowner.

Terrain de camping : Camp Grounds

All grounds (including camping sites, community areas,
thoroughfares, reception and service buildings) where, for a fee,
one may camp for a short time, whether with a tent, tent-trailer,
camper, motorized camper, recreational vehicle or any other such
equipment, or under the stars; whether or not the establishment

and provided the campers are not admitted to remain camping
with their equipment for a period exceeding six (6) months.

considered architectural metal within the meaning of this by-law.

one or more persons. Inside an accommodation establishment is
found:

-    a bedroom consisting of a single room ;

-    a suite consisting of at least two communicating rooms one of

-    a studio (tourism), that consists, like the suite, of at least two
     communicating rooms, or a single room of at least 23 m².
     equipped for the preparation of meals (electrical appliances ,
     dishes and utensils, etc);

-    tourist home (housekeeping unit) consisting of at least one
     bedroom, a living room and a kitchenette-dinette, the area of
     which is at least 40 m².

Usage : Use

The purposes for which a building is used, occupied or intended
to be used or occupied.

Vacant : Vacant

Refers to a site not occupied by a building.

Vente de garage : Garage sale

The sale of cast-off furniture and objects used for domestic
purposes belonging to the occupant of the dwelling unit situated
on the property where the objects are displayed, the number of
which does not exceed the normal requirements of the occupant.

                                           ADMINISTRATIVE PROVISIONS



                                                                              APPLICATION
                                                                              OF THE BY-LAW         2.1
The building inspector is responsible for applying this by-law.

                                                                              INFRACTIONS and
                                                                              PENALTIES             2.2
Any person who acts in such a way as to contravene the zoning
by-law commits an infraction.

For an infraction against articles 13.1 to 13.11:

-    if the person who commits the offence is an individual, he or
     she is liable for a minimum fine of $750.00, and a maximum
     fine of $1,000.00, plus costs for each infraction. In the case of
     repeated offences, he is liable for a minimum fine of
     $1, 500.00 and a maximum fine of $2,000.00. plus costs for
     each infraction;

-    if the offender is an entity (a moral person) it is liable for a
     minimum fine of $1,500.00 and a maximum fine of $2,000.00,
     plus costs for each infraction. In the case of repeated
     offences, the minimum fine for a moral person is
     $3,000.00 and a maximum of $4, 000.00, plus costs for each
     infraction.

For an infraction against any other article of this by-law:

-    if an individual contravenes the by-law, he or she is liable for a
     minimum fine of $100.00 and a maximum fine of $1,000.00,
     plus costs, for each infraction. In the case of a repeated
     offence, the person is liable for a minimum fine of $200.00 and
     a maximum fine of $2,000.00, plus costs, for each infraction.

-    if the offender is a legal entity, (a moral person) it is liable for a
     minimum fine of $200.00 $ and a maximum fine of $2,000.00,
     plus costs, for each infraction. In the case of a repeated
     offence, it is liable for a minimum fine of $400.00 and a
     maximum fine of $4,000.00, plus costs for each infraction.

In all other cases, if the infraction continues, each day it continues
is considered a separate offence.

In addition to the measures in the preceding paragraphs, the
Municipality may exercise all other rights that would enable it to
have the provisions of this by-law respected.

                                   PROVISIONS RELATED TO ACQUIRED RIGHTS

                                                                      ACQUIRED RIGHTS             3.1

A non-conforming construction that exists at the date of the coming into force of
this by-law, and a non-conforming use of a construction or a parcel of land is
protected by acquired rights, provided that this use was carried out or the
construction built in compliance with the by-laws in force at the time.

A use not in compliance with this by-law, but protected by an acquired right,
shall immediately cease if it has been abandoned, stopped or was interrupted
for a period of 12 consecutive months.

Despite the preceding paragraph, in the case of a derogatory industrial use
protected by acquired rights, a period of 36 months is accorded should the use
be abandoned, ceased or interrupted, before loss of acquired rights resulting in
permanent cessation of activities.

                                                                      MARINA                      3.3

The acquired rights of a non-conforming wharf or dock or marina are not pre-
empted by the seasonal withdrawal of the platforms making the wharf or dock, if
they are not withdrawn for more than twelve (12) consecutive months.

A non-conforming use or construction protected by acquired rights may not be replaced by another
non-conforming use or construction.

Despite the preceding paragraph, a derogatory industrial use protected by acquired rights may be
replced by another industrial use providing that this industrial use is included in class A, B or C of
the industrial group as defined in article 4.6.

The non-conforming use of a parcel of land or a construction, protected by acquired rights, may be

          a) A use which is derogatory to the present by-law and which existed on June 15th, 1989, is
         limited to the property as it existed on June 15 th, 1989.
         A use which is derogatory to the present by-law and which was put into place after June
    15th,1989, is limited to the property as it existed on April 26 th, 2001;

           b) For all non-industrial uses the expansion of a derogatory use is limited to 25% of the
          property used on June 15, 1989 if the use existed on that date or on April 26, 2001 if the
          derogatory use was put into place after June 15, 1989. For industrial uses the expansion is
          limited to the entire property used on June 15, 1989 if the use existed on that date or April 26,
          2001, if the derogatory use was put into place after June 15 th, 1989.

           c) For all non-industrial uses, the expansion of a derogatory use of a building is limited to
          50% of the area of the building in use on June 15 th, 1989 if the use existed on that date or
          April 26, 2001 if the derogatory use was put into place after June 15, 1989. For industrial
          uses, an expansion of 100% of the area of the building as existed on June 15 th, 1989 is
          permitted if the use existed on that date or April 26, 2001 if the use was put into place after
          June 15th, 1989.

          d) the extension shall respect all construction and zoning norms in force.

                                                                   EXTENSION OF

A non-conforming construction protected by acquired rights may not be extended or modified except
in compliance with this by-law.

Nevertheless, the enlargement within the prolongation of the existing walls is permitted (see sketch)
as long as this enlargement does not increase the degree of non-conformity.

When a construction is non-conforming by the simple fact that it does not meet the requirements for
minimum dimensions of the principal building, this construction may be enlarged without necessarily
bringing it into compliance with the minimum requirements of this by-law in this regard.

Notwithstanding the second and third paragraphs, it is forbidden to make any kind of modifications
to a construction located on or above the shore or littoral of a lake, unless it is maintenance or
repair work or interior renovation, work on exterior wall-cladding, fenestration or work only intended
to extend to ground level exterior wall cladding or decorative wooden trellising from the lowest floor
to ground level. Without restricting the generality of the prohibition decreed in this paragraph, it is
forbidden to:

     a) close-in the walls or windows or by any other means enclose the perimeter of a gallery or
            veranda, and this way enlarge the interior space of the building;

     b) close-in, by a continuous foundation, using concrete, stone, wood or any other material, the
        perimeter of a building built on piles or pilings, blocks or any other foundation of this nature.

                         PROVISIONS RELATED TO THE CLASSIFICATION OF USES




                                                                      GENERAL
                                                                      CONSIDERATIONS        4.1
For the purposes of this by-law, a series of uses classed by
groups of uses has been drawn up. This listing is based on
compatibility between various uses in terms of their physical
characteristics, the degree to which they are interdependent and
the gravity of the level of danger represented by normal or
accidental nuisances for safety, salubrity and convenience in the
surrounding area and for public health.

Each group of uses identified in articles 4.2 to 4.6 is divided in
sub-groups, identified by a letter. The sub-groups may be further
subdivided, and these subdivisions are identified by a number.

The various types of dwelling units are :

A)     Single-family dwellings, with the exception of mobile homes:

       1.     detached single-family dwellings;

              -     accountants;
              -     urban planners;
              -     real estate agents;
              -     other professions.

       3.     business and professional offices integrated in a
              dwelling, that is :

              -     business and professional offices as described in
                    sub-paragraphs 1 and 2, installed inside a dwelling
                    unit, and according to the following conditions:

                    .    this use may only be carried on in the basement
                         or on the ground floor;

                    .    this use may not occupy more than 40 % of the
                         area of the basement or more than 40 % of the
                         area of the ground floor;

                    .    this use shall not, in any case, for any reason,
                         generate any kind of exterior storage
                         whatsoever.

B)     Services, that is:

       1.     services for the maintenance of personal objects and
              non-medical personal care, such as :

              -     hairdressing salons;
              -     beauty salons;
              -     tailors;
              -     shoe repair shops;
              -     photographers;
              -     other services of a similar nature.

       2.     financial services such as :

              -     banks;

              -     medical clinics;
              -     pharmacies;
              -     health clinics (alternative medicine) (acupuncture,
                    chiropractic, physiotherapy, etc.).

       6.     animal care services such as :

              -     veterinary clinics;
              -     boarding kennels for animals.

       7.     services integrated into dwellings, that is :

              -     services for the maintenance of personal objects
                    and non-medical personal care described in sub-
                    paragraph 1; art galleries, studios and artists‟
                    workshops including the exhibition and sale of works
                    made on-site, subject to the following conditions:

                    .    this use may not be carried out on a floor other
                         than the basement or ground floor;

                    .    this use shall not occupy more than 40 % of the
                         surface area of the basement or more than 40 %
                         of the floor area of the ground floor;

                    .    this use shall not, in any case, or for any reason,
                         generate exterior storage of any kind.

              seating places; that is:

              -     dining rooms;

              inside but there are no seats inside, that is :

              -     snack counter;
              -     counters for service to cars.

D)     Retail establishments, that is:

       1.     food stores, such as :

              -     grocery stores;
              -     butcher shops (delicatessen);
              -     pastry shops;
              -     bakeries;
              -     fruit and vegetable shops;
              -     dairy bars;
              -     dépanneurs – convenience stores.

       2.     other retail establishments such as :

              -     jewellery shops;
              -     dry goods shops;
              -     book stores;
              -     boutiques;
              -     hardware stores;
              -     shoe shops;
              -     flower shops (without on-site cultivation);
              -     fabric stores;
              -     pharmacies.

       3.     retail establishments for the sale of farm products.

       3.     outdoor commercial activities such as :

              -     golf courses (with restaurant);
              -     sugar shacks.

       4.     high-impact outdoor activities related to bodies of water,
              such as:

              -     swimming centres;
              -     marinas.

B)     Establishments and agricultural uses related to raising
       animals, that is :

       - kennels;
       - stables;
     - beef-, sheep-, horse-, goat- and other types of animal-
     raising operations not covered by paragraph C).

C)     Establishments and agricultural uses related to industrial
       production industrial (animals raised in confinement), that is :

       -    raising of fur-bearing animals;
       -    pig farming;
       -    slaughterhouses;
       -    chicken farming.

                                                                           INDUSTRIAL         4.6
A)     Industries in Class A:

       Industrial and commercial establishments not belonging to
       the retail sales group, that meet the following requirements :

       -    they are neither the cause on an on-going or intermittent
            basis of noise, dust, odour, gas, heat, flashing lights, nor
            of any other kinds of inconveniences for the immediate
            surroundings;

       -    they do not offer any danger of explosion or fire;

       -    all operations, without exception, are carried out inside a
            completely closed-in building;

       -    no merchandise is left outside the building for any period
            whatsoever.

B)     Industries in Class B are :

       Industrial establishments and commercial establishments not
       part of the retail group, that meet the following requirements:

       -    only exterior storage of machinery, transportation
            vehicles, equipment or finished products or semi-finished
            products are authorized provided that a fence 2 m (6.5 ft.)
            high, with a maximum of 15 % openings per sq. metre
            and made of architectural metal panels, shields the
            stored products from view from the road. Bulk storage of
            materials or matter such as scrap metal, garbage made
            of metal, wood chips, coal, salt or solid chemical products
            is prohibited.

C)     Industries in Class C are :

       Industrial and commercial establishments that do not belong
       to the retail group, and for which storage of all kinds of
       products, even in bulk, is permitted, provided that a fence
       2 m (6.5 ft.) high, with openings of a maximum of 15 % per
       sq. metre, and made of architectural metal panels, shields
       the stored products from view from the road.

D)     Extractive activities, that is :

       -    gravel pits;
       -    sandpits;
       -    quarries;
       -    primary and secondary transformation activities of raw
            materials extracted on-site (screening, crushing, cement
            mixing, asphalt blending, etc.).

E)     Industrial recovery or recuperation activities (including
       warehousing or storage, and establishments for the handling
       and transformation of recovered materials), that is :

       -    scrap yards;
       -    garbage recycling activities.

F)     Industrial craft activities employing a maximum of 3 persons,
       occupying a maximum surface area of 90 m², and not
       causing any noise, smell or noticeable dust outside, and

       - wood-working shops;
       - cabinet-making shop.

       When carried out inside a dwelling:

       - this use may not be carried out on any floor but the
         basement or ground floor.

       - this use shall not occupy more than 40 % of the area of
         the basement or more than 40 % of the area of the ground
         floor.

       The use may be carried out inside a dwelling or in an
       accessory building to a dwelling.


                                                                            4.7 OTHER
                                                                            USES
           This group „other uses‟ includes all the uses not specifically
           enumerated in the classifications of the present by-law or
           which do not meet the formulated descriptions.

           Notwithstanding the first paragraph, the following are uses
           exclusive to the group „other uses‟:
           - Establishments offering nude dancers or strip-tease
              shows;
           - Retail or rental establishments offering erotic,
              pornographic or sexually explicit materials (other than
              video rentals for home viewing and general stores
              where erotic, pornographic or sexually explicit
              magazines are sold provided that the majority of
              products for sale or rent in these establishments are
              not of this nature);
           - Establishments providing cubicles for viewing of
              movies of an erotic, pornographic or sexual nature,
              whether by projector or video cassette, tattoo parlours;

-    buildings and facilities related to the water system, sewer
     system, telecommunications system or the electrical
     distribution system, pumping station, measuring or
     transformation station,reservoir, switching exchange, etc.;

-    hiking trails (pedestrian, equestrian, cross-country skiing,
     snowmobiling, etc.) and nature study and interpretation
     activities without any infrastructure, except in zones RUR-1,
     RUR-2, RUR-16 and RUR-17 in which a platform up to 3 m x
     4 m may be erected, to allow installation of a tent, and to erect
     forest shelters or cabins with a maximum density of 1 shelter
     or tent per /2 ha if they are intended to serve as shelter for
     users in a recreational project;

-    garage sales;

-    secondary residential                   buildings   except   in   seasonal-
     recreational zones.

In the case of incompatibility, this article takes precedence over
the grids in article 5.7.

                                                                          PROHIBITED USES

Notwithstanding any provision of this by-law, the following uses
are prohibited in all zones :

-    storage and burial sites for solid wastes;

-    permanent storage and burial sites for dry materials;

-    sites for the treatment of septic system sludges;

-    sites for the disposal of untreated septic system sludges;

-    scrap yards for old cars ;

-    industrial establishments having a total area of all buildings,
     including the principal building and all accessory buildings,
     that exceeds 200 m² for each establishment.

                                                                          COMMUNICATIONS
                                                                          INFRASTRUCTURES       5.3

Installation of an infrastructure, a line or a carrier for the
transportation of energy (including such energy-producing material
as gas or oil) or for telecommunications is prohibited in the
following areas :

-    in wetlands;
-    less than 300 m from a scenic and panoramic road;
-    in an area or grouping of heritage interest ;
-    in a corridor of superior visual interest specifically zone RUR-
     16;
-    in zones CONS-4 to CONS-8, CONS-18 to CONS-20.

Modification of an energy or telecommunication transportation
infrastructure is prohibited in the environments described in the
above paragraph. Moving such a structure is prohibited except to
transport it outside these areas.

The maximum height of a telecommunications infrastructure is set at
20 m.

The prohibitions in this section do not apply to a
telecommunications infrastructure located on a property occupied
by a residential building, provided that the infrastructure be directly
linked to the residential use, and that the height of the structure
measured from ground level not exceed 30 m.

buildings, when the buildings are situated at a distance less than
the minimum front setback required in that zone, the minimum

                                                                           GRIDS                5.6
The following rules apply to the interpretation of the specifications
grids forming part of article 5.7:

a)     How to read the groups of uses, sub-groups and
       subdivisions of sub-groups

       The listing of groups of uses, sub-groups or subdivisions of
       sub-groups in a specifications grid refers to the classification
       of uses set out in Chapter 4. The column “Ref.” Gives the
       construction of the series of numbers or letters that identify
       these groups, sub-groups or subdivisions of sub-groups. First
       is the number of the group, which corresponds to the number
       of the pertinent article in Chapter 4; then the identification of
       the sub-group, indicated by a letter; then the identification of
       the subdivision of the sub-group, indicated by a combination
       of letters and numbers.

       The nomenclature of groups of uses, sub-groups and
       subdivisions of sub-groups follows that found in Chapter 4.
       However, for reasons of space, the nomenclature has been
       shortened in the grid in certain places. At all times, the
       reference in letters and numbers has priority over
       nomenclature.

b)     Permitted Use

       In the specifications grid, when an “X “ appears in the
       column for a zone, vis-à-vis a sub-group or subdivision of a
       sub-group, all uses of this sub-group or of this subdivision of
       the sub-group are permitted in the zone.

       When an “X” appears in the column of a zone vis-à-vis a
       specifically authorized use, only that use is permitted in that
       zone and all other uses in the sub-group or the subdivision of
       a sub-group that are part of that group of uses specifically
       authorized, are excluded, except for another use that is
       specifically authorized.

     a) Prohibited uses

       Any use that is not specifically authorized in a zone or any
       use that is not part of a sub-group or a subdivision of a sub-
       group authorized in a zone is a prohibited use in this zone.

       If it appears that a use, in applying the first paragraph, would
       be prohibited in all zones, then this use is authorized in zone
       RUR-8, except where the use in question is a use mentioned
       in article 5.2.

d)     Authorized building or construction
       The authorization of a use implies permission to erect any
       principal building, any accessory building or any construction
       needed for the exercise of this use, subject to the various
       norms and prescriptions laid down in the land use planning
       by-laws with regard to buildings and constructions.

       An exception to the rule of the first paragraph applies to
       constructions listed in the specifications grid. In this grid,
       when no “X “ appears in the column for a specifically
       authorized construction, then this construction is prohbited in
       the zone even if it might be attched to a use authorized in the
        zone. Nevertheless, on any lake or body of water with the
       exception of the Missisquoi River, a dock or boat shelter may
       be built or a floating platform may be installed, even if this
       type of construction is not specifically authorized for the zone
       in which the lake or body of water is located.

e)     Priority of siting standards and the dimensions of
       buildings

       In a case of incompatibility between a norm related to siting
       or the dimensions of buildings provided for in the
       specifications grid and a standard related to siting or
       dimensions of buildings provided for elsewhere in this by-law,
       the latter prevails.

i)     Description of notes

       (1)     Maximum of 10 rooms.

       (2)     Sale of agricultural products grown on the farm operation where the farm stand is located.

The space situated in the front, rear and side yards must be kept
free of all structures. All that is permitted in these spaces are:

a)     steps leading to the first floor or the basement; porches,
       porticos, stoops, balconies, verandas, solariums and eaves,
       provided that they do not project more than 2 m (6.5 ft.) into
       the setbacks, leaving a minimum distance of 1 m (3.3 ft.)
       from the front, rear and side lot lines;

b)     bay windows, oriel windows and chimneys, at least 2.44 m
       (8 ft.) in width and forming part of the building, provided that
       the encroachment does not exceed 60 cm (2 ft.) nor is it less
       than 1 m (3.3 ft) from the front, side and rear lot lines;

c)     awnings and canopies up to a width of 1.85 m (6 ft.)
       maximum in residential zones, and 3.05 m (10 ft.) in other
       zones, provided that they do not encroach more than 2 m
       (6.5 ft.) into the minimum setbacks, leaving a minimum
       distance of 1 m (3.3 ft.) from the front, side and rear lot lines;

d)     sidewalks, plantations, driveways or other landscaping
       features, fences; enclosing wall, retaining wall;

e)     temporary car shelters;

f)     parking spaces and driveways or access roads to the
       property;

g)     signs;

h)     private garages and car shelters;

i)     septic systems;

j)       landscaping and recreational facilities complementary to
         residential uses, such as a tennis court, swimming pool, or

         from the front, side and rear lot lines;

k)       islands for gas pumps;

l)       the standards to hold lighting systems, surveillance systems
         or flags ;

m) booths or farm stands intended to be used for the sale of
   products from the farm, leaving a minimum distance of 1 m
   (3.3 ft.) from the road right-of-way.

The following constructions and uses are pemitted only in the side
and back yard:

-    accesory buildings not mentioned in article 6.1;

-    loading and unloading areas;

     -      steps leading to a storey other than the first floor, provided
            that no part of the step is situated more that 1.85 m from
            the building; these steps may encroach 1.5 m into the side
            or rear setback, leaving a minimum distance of 1 m
            (3.3 pi) from the front lot line and 0.6 m (2 ft.from the side
            and rear lot lines.

-    heating oil tanks;

-    gas cyclinders and meters;

-    solar energy captors;

-    air-conditioning equipment.

Unless there is an indication to the contrary, the uses and
constructions listed in the first paragraph shall be situated at least
2 m (6.5 ft.) from the side and rear lot lines.

The grounds of a lot occupied by a building shall be wooded,
planted with grass or landscaped so as not to leave the ground
bare, within a delay of 18 months after the date of the end of the
work for which a building permit was issued.

The first 60 cm (2 ft.) of land, measured from the limit of the road
right-of-way, may not be raised above the planted land adjacent to
the inside of the right-of-way. This strip of land shall remain free of
fences, party fences, walls, hedges, trees, signs or other
constructions or landscaping elements.

                                                                          BUILDING               6.6
Any person who demolishes a building shall clear the land of all
debris and level the site of the demolished building within sixty
(60) days of the beginning of the demolition.

                                                                          TRIANGLE DE

On any property at a road intersection, a triangle of visibility shall
be left free of all shrubs, trees, fences, retaining walls or other
works the height of which is greater than 75 cm (2.5 ft.).

Two sides of the triangle are formed by the lines of the road right-
of-way. Each of these sides shall be a minimum length of 8 m (26
ft.) measured from their point of intersection. If the corner is
rounded, the distance is measured from the point of intersection of
the extended road right-of-way lines. The third side is formed by
the straight line joining the ends of these two sides.

A vehicle, recreational vehicle or other recreational equipment
such as a boat, snowmobile, all-terrain vehicle, trailer or tent trailer
may be parked or stored outside, on a property occupied by a
residential use (art. 4.2). However, a trailer, tent-trailer or boat so
stored may not be occupied.


Parking and outside storage of a heavy vehicle on a vacant
property are not permitted except in industrial zones.
                                                                           EXTERIOR
                                                                           STORAGE           6.9
In all zones, it is permitted to store firewood not intended for sale
but solely for the needs of the occupant of the principal building
situated on the parcel of land where the wood is stored.

Outside storage of any product, object or material other than
firewood is not permitted except in industrial zones, and subject to
the following conditions:

-    the storage of bulk materials (gravel, earth, wood, cement,
     etc.), chemical products, products or materials to be recycled
     or recuperated (paper, wood, cardboard, glass, metal, scrap
     metal, etc.), or of vehicles or machinery not in service is not
     permitted except in the back yard;

-    storage of finished products, equipment or products or
     material to be used in production, except those mentioned in
     the sub-paragraph above is not permitted except in the side or
     back yard;

-    the storage area shall be enclosed by a fence;

-    the storage may not exceed a height of 3 m (9.9 ft.).

                                              PRINCIPAL BUILDING




                                                                         DIMENSIONS       7.1
a) Minimum Dimensions

     The front façade of a principal building shall have a minimum
     width of 6 m.

     The maximum width of the front façade of a principal building
     is 25 m, except in agricultural and rural zones, where it is set
     at 40 m, and in industrial zones, where it is set at 50 m.

b) Minimum Habitable Area

     The minimum habitable floor area for a single-family or two-
     family dwelling is set as follows:

     -     a detached single-family or two-family dwelling:
           70 m²/dwelling unit;

     -     a semi-detached single-family or two-family dwelling:
           55 m²/dwelling unit;

     -     single- or two-family dwellings or row houses:
           55 m²/dwelling unit;

     Notwithstanding the first paragraph, the minimum habitable
     floor area of a mobile home is set at 50 m².

     For multi-family dwelling, the floor area obtained by dividing
     the total habitable floor area by the total number dwelling units
     may not be less than 40 m². This rule applies to a mixed-use
     building that includes more than (two) 2 dwelling units,
     considering in the calculation only the habitable floor area of
     the part occupied by the dwelling units. If the mixed-use
     building has two (2) or fewer dwelling units, the habitable floor
     area is set at 50 m²/dwelling unit.

A parcel of land may only be occupied by a single principal
building, unless the property is situated in an industrial zone or
the buildings are used for agricultural purposes, including a
residence attached to the operation, and are situated in an
agricultural or rural zone.

Within the comprehensive development program in the RUR-15
zone, more than one principal building is permitted on a parcel of
land.

                                                                          SITING
                                                                          STANDARDS       7.3
A principal building shall be at least 3 m (10 ft.) from any other
principal building situated on the same parcel of land.

                                                                          HEIGHT          7.4
The maximum height of the principal building is 12 m.

The maximum height set in the first paragraph does not apply to a
building used for the purposes of a religious establishment
(art. 4.4 - A) or a building used for agricultural purposes (art. 4.5).

A construction above the roof (housing mechanical installations
for the building, elevator shafts, or an aedicule for access to the
roof, etc.) is not considered in calculating the height of the building
if it does not occupy more than 25 % of the area of the roof, and if
the total height, including the construction above the roof, does
not exceed by more than 3 m the maximum height set in the first
paragraph.

A chimney, mast, lightning rods or antenna are not considered in
the calculation of the height of the building. However, a parabolic
antenna more than 60 cm in diameter shall be considered unless
it is part of a public or commercial telecommunications network
installed on a building used exclusively for the purposes of this
network.

There must be a principal building on the parcel of land to be able
to have an accessory building, unless the land use is agricultural
(art. 4.5), community (art. 4.4), outdoor commercial (art. 4.3 - G.3)
or a high impact activity related to a body of water (art. 4.3 - G.4).

Notwithstanding the first paragraph, an accessory building may be
permitted on a vacant property only separated from the parcel of
land occupied by the principal building by a public thoroughfare,
and if both properties belong to the same land-owner.

Notwithstanding the first paragraph, a boat shelter may be built on
a vacant shoreline property.

Notwithstanding all other provisions of this by-law, only the
following accessory buildings are authorized on a property
occupied by a principal use of the residential group (art. 4.2)

zones:

-    private greenhouse;
-    shed;
-    boat shelter.

An accessory building shall be at least 3 m (10 ft.) away from all
other buildings.

                                                                           DIMENSIONS       7.9
The maximum area of accessory buildings is set as follows:

a) A parcel of land occupied by a habitation

     The total floor area of all accessory buildings, detached or
     contiguous to the principal building, may not exceed 10 % of
     the area of the parcel of land.

     Notwithstanding the provisions of the first paragraph, if the
     principal building is a mobile home, the total floor area of all
     the accessory buildings may not exceed the floor area of the
     mobile home on its manufacture date.

     The total floor area of all the garages and car shelters may not
     exceed 75 m² (807 ft.²) if the principal building is a single-
     family or two-family dwelling and it may not exceed 30 m² per
     dwelling unit if the principal building is a multi-family dwelling.

b) Other uses

     For a parcel of land occupied by any use other than a
     residential use covered in paragraph (a), the total floor area of
     all the accessory buildings, detached or contiguous to the
     principal building, may not exceed 10 % of the area of the
     parcel of land.

c) Boat shelter

     For the application of this article, the floor area of a boat
     shelter shall not be taken into consideration in the calculation
     of the total floor area of all accessory buildings.

                                                                           HEIGHT          7.10
In residential zones, commercial zone Ca and the seasonal-
recreational zones, an accessory building may have only one
storey and its height may not excced 4.5 m (14.8 ft.) nor exceed
the height of the principal building.

In the agricultural zone, commercial zone Cb, industrial and rural
zones, an accessory building may have only one storey and its
height may not exceed 7.5 m (24.6 pi).

Articles 7.9 and 7.10 do not apply to an accessory building used

It is forbidden to make a bedroom, kitchen or any other habitable
space inside or on top of a detached accessory building.

It is permitted to arrange a habitable space in an accessory
building attached to the principal building, or above such an
accessory building, as long as the siting of the accessory building
 respects the minimum setbacks set for principal building.

Within the comprehensive development program in the RUR-15
zone, habitable spaces in accessory buidings are permitted.

A temporary building used on a construction site shall be installed
a minimum distance of 3 m (9.9 ft. ) from the front line and 1 m
(3.3 ft.) from all other boundaries of the property.

                                                     SECTION 1

                                              PARKING AREAS OR LOTS




                                                                           GENERAL
                                                                           PROVISIONS   9.1
The following requirements apply to any new construction or the
enlargement of an existing building. They are required on an on-
going basis, for the duration of the land use.

1.     Location

       a) Parking spaces shall be situated on the property they
          serve or be provided on a property situated less than
          100 m (328 ft.) from this use.

       b) A parking area in the front yard may not be situated within
          6 m (19.6 ft) of the limits of the road right-of-way. This
          band of 6 m shall be grassed or otherwise landscaped
          with vegetation.

            Notwithstanding the first paragraph, 2 parking spaces at
            most may be arranged in this 6 m strip if these spaces
            serve a single or two-family dwelling, if they are situated
            on the same property as the dwelling unit, and if the
            slope of the land does not exceed 25 %, measured over
            the first 25 metres from the limit of the road right-of-way.

       c) A parking space may not be situated within 60 cm of the
          side or rear lot lines.

       d) The total area of a parking area in the front yard,
          including parking spaces, driveways and access roads
          may not exceed 30 % of the area of the front yard.

       e) Access to the property shall be a minimum distance of
          6 m (19.7 ft.) from the intersection of two road lines.

            However, the minimum distance is 30 m along the following
            parts of Route 245 :

             -    between the northern limit separating the
                  municipalities of East Bolton and Eastman; and the
                  western limit separating the municipalities of East
                  Bolton and Saint-Étienne-de-Bolton;

             -    between the southern limit of the urban perimeter of
                  Bolton Centre and the southern limit of lot 891,
                  Range VII, in the cadastre of Bolton Township.

       f)    An access to a property shall be arranged at a minimum
             distance of 1 m from a line delimiting the property, except
             in the case where the access is a common driveway
             shared by two adjacent properties.

       g) Along those parts of Route 245 identified in sub-
          paragraph (e), a maximum of one driveway from the road
          to the property is permitted for each 100 m of frontage on
          the road.

       The provisions of sub-paragraph (e) do not apply if they
       would result in preventing all direct access to the property. In
       such a case, the location closest to that meeting the
       minimum norm shall be chosen.

2.     Dimensions

       a) The following minimum dimensions apply to all parking
          spaces:

             Length :                      6.1 m (20 ft.)
             Width :                       2.4 m (8 ft.)
             Area :                        14.3 m² (154 ft.²)

       b) A single access to the road may be built on a property
          less than 15 m (49.2 ft.) wide. If the width of the property
          is equal to or greater than 15 m (49.2 ft.), a maximum of
          two accesses to the road may be created. When a
          property is bordered by more than one road, an access is
          authorized for each road according to the same rules.

c)          For a residential use, the maximum width of a driveway is
            6 m (20 ft.). A minimum distance of 4 metres shall be
            respected between the two driveways. However, in a case
            where two accesses are permitted, they may be joined
            together to make a single access, the width of which may
            not be greater than 11 m (36 ft.).

             For other uses, the maximum width of an access from the
             road to a property is 11 m. A minimum distance of 18 m
             shall be respected between two driveways. It is forbidden
             to join two side-by-side driveways together to make a
             driveway wider than 11 m.

       d) The minimum width of a driveway and the minimum width
          of a parking space and the driveway which leads to it,
          are, according the parking angle, as follows:

     Less than 279 m² (3,000 ft.²) of floor area: one (1) space per
     27.9 m² (300 ft.²).

     More than 279 m² (3,000 ft.²) of floor area: ten (10) spaces
     plus one (1) space per 65 m² (700 ft.²).

k) Wholesaling establishment, transportation terminal,
   warehouse, contractors’ yard, timber yard and other
   similar uses

     One (1) space per 46 m² (495 ft. ²)

l)   Single-, two- and three-family dwellings

     Two (2) spaces per dwelling unit for a single-family and one
     (1) space per dwelling unit for two- and three-family units.

     One (1) space per two (2) rooms for the first forty (40) rooms,
     plus one (1) space per four (4) rooms for the number of rooms
     over forty (40).

s) Room and board of all kinds – Mobile home parks - Trailer
   park– Camp grounds

     One (1) space per rental unit plus one (1) space for the owner.

t) Dépanneur- Convenience store

     One (1) space per 12 m² (130 ft.²).

u) Gathering place (including private clubs, exhibition halls,
   stadium, gymnasium, community centre, arena, race course,
   circus, dance hall and other similar places).

     One (1) space per five (5) seats, plus one (1) space per 37 m²
     (400 pi²) of floor area that serves as a gathering place but
     does not contain fixed seating.

v) Common parking areas

     Development of a parking lot to serve more than one use is
     authorized if the total number of spaces corresponds to at
     least 80 % of the spaces required for each use.

All parking lots shall be arranged and maintained according to the
following provisions:

a) All surfaces shall be paved, covered with clean stone, gravel
   or other similar material to eliminate dust and prevent mud.

b) All parking lots without fences having more than 6 spaces,
   unless the area serves only residential uses, shall be
   surrounded by a border made of concrete, asphalt or planks,
   at least 15 cm (6 in.) high, situated at least 60 cm (2 ft.) from
   the lot lines separating adjacent properties. This border shall
   be solidly fixed and well maintained.

c) Each parking space shall be accessible at all times, and shall
   be placed and designed so it is possible to enter or leave it
   without requiring another vehicle to be moved.

d) All parking lots or areas with more than 4 spaces shall be
   designed so that it is impossible to exit by backing directly
   onto the public thoroughfare from a parking space.

e) Lighting should be provided so that only the parking area is
   illuminated.

community purposes (art. 4.4 - B, 4.4 - C, 4.4 - D.3, 4.4 - E, 4.4 -
F).

This area shall be situated on the same property as the principal
use, in the rear or side yard.

       this number above 9,300 m² (100,100 pi²).

The siting and maximum height norms for a fence or hedge are as
follows:

     a) A fence or masonry wall serving as a fence may not
        exceed 1.5 m (4.9 ft.) in height in the part of the front yard
        situated between the limits of the road right-of-way and the
        minimum front setback. The maximum height is 2 m (6.6
        ft.) if the fence or wall is entirely hidden by a hedge.
        Elsewhere on the property, the maximum height is set at
        2.5 m in an industrial zone, and at 2 m in the other zones.
        When a stone pile is arranged or used, its height is
        included in the calculation of the height of the fence or
        wall.

           The provisions of the first sub-paragraph do not apply to a
           temporary fence erected around a construction site, the
           maximum height of which is set at 2 m; a fence enclosing
           a tennis court, the maximum height of which is set at
           6.5 m (21.3 ft.); a fence installed for agricultural purposes
           (art. 4.5); or an entrance gate installed on the access way
           to a property.

     b) Fences shall be built of wood or metal.

           A fence made of steel chain links not covered with a
           factory-applied rubberized coating is only permitted for a
           playground or sports field or for a property occupied by a
           public building, a parking lot, a building used for industrial
            purposes (art. 4.6 - A, 4.6 - B, 4.6 - C, 4.6 - D, 4.6 - E), a
           construction-oriented establishment (art. 4.3 - F) or a
           commercial use related to agricultural operations (art. 4.3
           - H). In the case of a chain metal fence surrounding a
           tennis court, it should be situated at least 2 m (6.5 ft.)
           from all property limits and at least 3 m (9.8 ft.) from a
           principal building;

     c) A fence, masonry wall or hedge shall be situated a
        distance of at least 1 m (3.2 ft.) from the limits of the road
        right-of-way.

     d) A fence or masonry wall that serves as a fence shall be
        entirely within a vertical plane delimited by the profile of
        the adjacent natural ground and an imaginary line parallel

Notwithstanding article 10.1, an exterior depot shall be separated

Barbed wire is only authorized in industrial, agricultural or rural
zones, at the top of a fence at least 2 m in height situated around
an exterior storage area and on fences used for agricultural
purposes.

Notwithstanding the first paragraph, barbed wire is authorized on
a fence erected to prevent access to a place, equipment or an
infrastructure that presents a danger to the public (e.g.: electrical
transforming station, abandoned mine shafts, etc.).

Electrified wire is only authorized on a fence installed for
agricultural purposes in an agricultural or rural zone.

A retaining wall shall be built at a distance of at least 60 cm (2 ft.)

A retaining wall higher than 1.8 m (6 ft.) shall be designed by an
expert in the matter and shall be topped with a fence having a

Construction, installation, maintenance, modification and upkeep
of all signs are regulated by the provisions of this chapter.

These provisions apply as well to all signs already erected subject
to the provisions of article 11.2.

Before the construction, installation or modification of a sign there
shall first be a certificate of authorization issued in accordance
with the prescriptions of the Permits and Certificates By-law.
                                                                         TRANSITIONAL
                                                                         PROVISIONS         11.2
All existing non- conforming signs shall be removed or modified so
as to bring them into conformity with the prescriptions of this by-
law within the applicable period, as follows:

-    in the case of a sign that was already non-conforming prior to
     the coming into force of this by-law, the delay is two (2) years
     as of the date of the coming into force of this by-law;

-    in the case of a sign that became non-conforming as a result
     of this by-law, the delay is five (5) years as of the date of the
     coming into force of this by-law.

During the delay period provided for in the first paragraph, the sign
may be repaired and its message may be changed, except for a
sign that is not permanently fixed to the ground or to a building.

                                       PROVISIONS APPLICABLE IN ALL ZONES

taken into account in calculating the number of signs:

-    a sign related to an election or a public consultation held by
     virtue of a law; it shall be removed within ten (10) days of the
     event;

-    a sign emanating from a public authority relating to the
     movement of automobiles, pedestrians, cycle or rail travel;

-    a commemorative plaque, an inscription related to the history
     or a cartouche or scroll bearing the name of a building or the
     year of construction, having a maximum area 0.4 m².

-    a flag or emblem of a political, civic, philanthropic, educational
     or religious group;

-    a sign identifying a public service (telephone, post office, etc.)
     having a maximum area of 0.4 m²;

-    a single panel or board having a maximum area of 2 m²,
     indicating the business hours and religious activities, set up on
     the site of the establishment;

-    a private board or panel having a maximum area of 0.4 m²;

-    a directional sign having a maximum area of 1 m², if it is
     situated within the urban perimeter, and 0,5 m² in other cases;

-    a sign on a vacant property announcing the sale or rental of
     the property on which it is installed, of a maximum area 0.5 m²
     , for a use from the residential group (art. 4.2) ) and 1 m² for all
     other uses, with one sign at most on each road contiguous to
     the property;

-    a sign announcing the sale or the rental of a building or
     premises in a building, of a maximum area 0.5 m² for a use
     from the residential group (art. 4.2) ) and 1 m² for all other
     uses, with one sign at most on each road contiguous to the
     property;

-    a project sign having a maximum area of 2 m², with one
     sign at most on each road contiguous to the property, which sign
     shall be removed within 30 days of finishing the work;

     (excluding the sale of a product or service), provided that it be
     installed at most 21 days before the event or activity takes place and
     that it be removed three days at the latest after the event or activity;

-    an advertising bill or poster provided that it be installed only for the
     duration of the activity or event and that it be put up on the inside of
     an opening (display window, door, window) of a building;

-    a single, unlighted professional or business plaque, having a
     maximum area of 0.3 m² placed against the surface of the building
     and not projecting more than 10 cm;

-    a single identification sign having a maximum area of 0.4 m², for
     each establishment or site;

-    a community sign.
                                                  PARTICULAR SIGN TYPES
                                                                 11.4

Particular sign types are permitted in zone I-1 as well as the signs
already permitted per zone, in accordance with the established
maximum number of signs, as long as the total height of the signs does
not exceed 5 m and comply to the following dispositions:

1o Signs which are mobile or otherwise animated (by movement or light)
mechanically or electronically at the exterior of a building, which include
an animated component indicating time or temperature and having a
maximum superficial area of 0,5 m2;

2o Signs in the shape of human or animal form or imitating a product,
container or object whether inflatable or otherwise built up in volume. In
any case, a sign of this shape may not have a thickness superior to 30
cm or a superficial area superior to 5 m2;

3o A portable sign whether installed, mounted, fabricated or directly
painted or printed on a material, mobile or not, a vehicle or part of a
vehicle: this type of sign, which does not serve as commercial
identification of the vehicle, registered for the currant year, is permitted,
as long as its superficial area does not exceed 1 m 2 and that it is located
at least 6 m from the road limits;

4o A billboard or publicity sign other than the banner type, publicizing an
event or activity, is permitted with a limit of one per property and a
maximum superficial area of 5 m2.

-    on a post or other support structure for a public utility service.

                                                                CONSTRUCTION   11.6

All signs shall be placed on a safe structure that respects the following
norms:

a)     the sign shall be fixed permanently to the ground or to a building;

b)     when the sign is attached by cables, strain clamps are required;

c) a sign, with the exception of a streamer, banner or flag, shall be
   constructed of rigid material or a flexible material attached to a rigid
   structure except when it is fixed in an opening or on a wall, in which
   case it may be made up of letters and designs made of pieces of at
   most 25 cm (10 in.) thick or of adhesive film if it is fixed to a glassed
   surface;

d) raised metal and unpainted tin may not be used to make a sign,
   whether in whole or in part;

e) a post, overhead signpost, or portico that supports a sign may not
   have a diameter or side longer than 20 cm, unless it is a concrete or
   masonry pillar or a pillar made of cement covered with stucco or
   rough plaster. A post, overhead sign or portico may not be farther
   away from the sign than 30 cm nor be higher than the top of the sign
   by more than 30 cm. A pillar shall be included within a space defined

     by the vertical projection of the sign and shall not exceed it on any
     side by more than 60 cm;

f)   the maximum length of a low wall supporting a sign is 0.1 m for each
     metre of length of the front facade of the principal building, not to
     exceed 5 m. The area of the facade of the low wall to which the sign
     is affixed may not be greater than 4 times the area of the sign. The
     top of the wall may not be situated more than 1.8 m from ground
     level at the base of the wall. If there is an embankment or other filling
     work under the wall, its height is taken into account in the calculation
     of the total height;

g) the base of a sign, whether full or in the form of a planting
   container, may not be more than 80 cm in height, failing
   which, it is considered part of a wall.

h) A sign may not be equipped with a gyrolight or any other
 lighting component which imitates a traffic light or the types
of lighting used on an emergency vehicle;

i)  A sign may not be painted directly onto a low wall, a fence, a
   fence wall or on the wall or roof of a building, with the
 exception of a silo or the wall or roof of an agricultural
building with the sole purpose of identifying the agricultural
producer and on the condition that the superficial area of the
sign not exceed 3 m2.


All signs shall be maintained in good condition. A damaged sign
shall be repaired within thirty (30) days of the damage.

A sign may be fixed against the wall of a building or projecting
out from it, or it may be installed in an opening (door, window,
display window, display glass etc.). It may be fixed on a base, a
low wall, a pedestal, post, pillar or be suspended from an
overhead support or portico. It may also be fixed on an awning or
canopy or be written directly on the fabric of the awning or
canopy.


                                                                         CALCULATION RULES 11.8
A) Calculating the area

     The area of a sign corresponds to one surface (a regular
     geometric figure in the shape of a rectangle, triangle, circle)
     delimited by a continuous or imaginary line enclosing all the
     components of the sign, including all elements making up the
     structure or display support for the sign, but not counting the
     post, pillar, overhead support or portico if they are situated
     less than 30 cm from the sign, whether this structure or
     support be made of a rigid opaque or translucent material, a
     flexible opaque or translucent material, a fabric, trellis or any
     other kind of material.

     The area of a sign having more than one display surface is
     equal to the size of the area of a single surface in the case of
     two (2) opposite but parallel surfaces; it is equal to the sum of
     the areas of each of the surfaces in all other cases.

     The area of a sign made up of a logo, corporate logo, or an
     emblem, an advertising display, a directional sign, a notice-
     board, commemorative plaque, historical inscription, private
     sign panel, or the sign at a gas pump as well as the area of a
     community sign is not taken into account in the calculation of
     total area of signs.

B) Calculation of the height

     The height of a sign is the distance measured vertically
     between the highest part of a sign, including the supporting
     structure in the case of signs on posts, a portico, overhead
     support, base or other supporting structure not attached to a
     building as well as the canopy at the top of a sign, and the
     average ground level established at least a metre from the
     circumference of the sign, any increase in height at ground
     level of more than 30 cm for landscaping purposes being
     deducted.

     The height of a projecting sign is measured by including any
     supporting structure attached to a wall with the exception of
     metallic cables stretched between the end of the support and
     the wall.

C) Setting the number of signs

     The number of signs is equivalent to the number of distinct
     assemblies of elements making up one or another type of
     authorized signs; the number of signs on each property or
     building is determined as follows:

     -     subject to the provisions of the following paragraph, all
           surfaces containing one or the other of the elements listed
           in the definition of the word sign constitute one and the
           same sign;

     -     any assembly grouping more than one type of permitted
           sign constitutes one and the same sign provided that the
           maximum surface of each of the permitted types be
           respected and the maximum area of the sign so
           constituted be in compliance with the biggest area
           authorized for one or another of the types of signs;

     -     two (2) completely parallel and opposite surfaces
           separated by at least 10 cm, are considered as making up
           one and the same sign;

     -     two (2) panels separate from each other by a distance of
           30 cm at most, and situated in the same layout are
           considered to constitute a single sign; they are considered
           to be two (2) signs when they are more than 30 cm apart
           or they are not situated in the same layout.

     a) General provisions

     The dimensions set by this article apply, subject to all
     standards related to the area or height set in article 11.3.

     The maximum areas set in this article do not apply to
     advertising signs.

     With the exception of an advertising sign and a sign as noted
     in the first, second, eighth, twelfth and sixteenth sub-
     paragraphs of the first part of article 11.3, all signs shall be

     installed on the same property as that of the use, activity or
     establishment covered by the sign or be installed on a
     property only separated from it by a public road or railway.

     The minimum distance between two signs not attached to a
     building is 8 m (26.2 ft.).

b) A sign on a post, portico, overhead support, pillar or base

     The sign shall be placed in such a way that no part of it,
     including its support, shall be situated within 2 m (6.6 ft.) of the
     limits of the road right-of-way or any property line. If the
     property is bordered by more than one road, the sign shall be
     situated at a distance of at least 5 m (16.4 ft.) from the point of
     intersection of the road lines or, if the intersection is rounded,
     the point of intersection of the linear extension of the right-of-
     way lines, measured along the front lot line.

     The minimum distance between the sign and all buildings is
     3 m (9,9 ft.).

     The height of the sign may not exceed 5 m (16.4 ft.) nor may it
     exceed the height of the principal building.

     Subject to article 11.10, the maximum area of a sign is 1.5 m².

c) A sign on a low wall

     The wall shall be placed in such a way that no part be situated
     within 2 m (6.6 ft.) of the limits of the road right-of-way. If the
     property is bordered by more than one road, the sign shall be
     situated at a distance of at least 5 m (16,4 ft.) from the point of
     intersection of the road lines or, if the intersection is rounded,
     from the point of intersection of the linear extensions of the
     right-of-way lines, measured along the front lot line.

     The minimum distance between the low wall and any other
     building is 3 m (9.9 ft.).

     The sign shall be fixed flat to one side of the wall and no part
     of it may be higher than the top nor extend beyond the ends of
     the wall. The height of the sign shall not exceed 1.5 m above
     ground level. If an embankment or other filling work is
     arranged below the wall, the height shall be measured in
     relation to the average ground level near the wall, ignoring the
     embankment or filling work.

     The maximum area of the sign is 1.5 m².

d) Flat sign

     The sign shall be installed under the lower edge of the roof.

     No part of the sign may be placed more than 30 cm from the
     wall to which it is attached nor may it extend beyond the ends
     of the wall.

     The maximum area of the sign is 2 m².

e) Projecting or perpendicular sign

     The sign shall be installed under the lower edge of the roof.

     The sign may not project above the road right-of-way unless it
     is attached to a building situated 1 m (3.3 ft.) or less from the
     limits of the road right-of-way.

     The sign shall be placed in such a way that no part of it,
     including its support, shall be more than 1.5 m (4.9 ft.) from
     the wall to which it is attached.

     The clearance under the sign shall be at least 3.3 m (10.8 ft.),
     except if the sign projects above the roadway or public
     sidewalk, in which case the clearance shall be at least 4 m
     (14.6 ft.) above the level of the road or sidewalk, depending on
     the case.

     The maximum area of the sign is 1.5 m².

f) A sign installed in an opening

     The sign shall be made of cut-out lettering or designs
     adhering to, painted or engraved on the glass surface of the
     opening.

     The area of the sign may not exceed 20 % of the glassed area
     of the opening nor be greater than 0.5 m².

g) A sign on an awning or canopy

     The awning or canopy shall be installed under the lower edge
     of the roof, except in the case of a canopy that is not attached
     to the building.

     The sign may not exceed any sides of the awning or canopy.

     No part of a sign may be more than 30 cm from the awning or
     canopy to which it is attached.

     The maximum area of the sign is 2 m ².

Subject to the provisions of article 11.3, the maximum number of
signs is set at one per establishment in agricultural, conservation,
residential and seasonal-recreational zones. It is set at two per
establishment in all other zones.

In the case where several establishments are situated on the
same property, only one sign not attached to the building is
allowed. This sign shall be built on a post, portico, pillar, pedestal
or base. Notwithstanding paragraph (b) of article 11.9, the
maximum area of such a sign is set at 3 m² within the limits of a
grouping of heritage interest, and at 5 m² elsewhere on the
territory.

Only an advertising sign publicizing an establishment offering
short-term stays (art. 4.3 - C.1) or a residential, commercial or
industrial development project, is permitted on the territory of the
municipality.

An advertising sign may not be installed in the following places:

-    within 50 m of the limits of the road right-of-way of a scenic,
     picturesque or panoramic route;

-    within the limits of a heritage grouping.

grouping as identified on the zoning plan.

                                               SECTION 1

                                              FLOOD ZONES

Within a zone in which there is a risk of flooding, illustrated in this
chapter, all constructions, structures and works are forbidden, with
the exception of:

-    work intended to maintain in good condition, to repair or
     modernize an existing building, on the condition that these
     works do not increase the surface area of the building and that
     the work undertaken respect the norms for prevention and
     mitigation provided in the Building By-law in force;

-    an underground public service installation such as a pipeline,
     electric, telephone or cable distribution lines, a pipe for the
     waterworks or sewage system, not including an service entry
     or above-ground electric, telephone or cable distribution line;

-    construction of a water or sewage system in a developed
     sector without services, solely to hook up work done prior to
     February 11,1987;

-    maintenance of a water or sewage system, a thoroughfare or
     a public utility servitude;

-    construction of a septic system for an existing residence,
     provided that the installation is in compliance with the
     provincial regulations in force in Quebec;

-    the installation of a tube well or a well used for agricultural
     purposes;

-    a work or construction used for agricultural purposes, with the
     exception of a dwelling related to an agricultural operation
     unless in this article it is elsewhere allowed;

-    a recreational development for public use involving no
     buildings such as a picnic site, recreational park, a nature

     study site or a hiking trail, on the condition that it is an integral
     part of a general plan and that it does not interfere with the
     natural flow of water or adversely affect the flora and fauna;

-    the construction of a single-family detached or semi-detached
     dwelling, or a two- or three-family detached unit, with one
     dwelling unit per parcel of land and subject to the following
     conditions :

     .     the piece of land on which the construction is to be built
           was not parcelled after February 11, 1987;

     .     the piece of land on which the construction will be built is
           adjacent to a road where water and sewer services were
           already installed as of February 11, 1987;

     .     the capacity of the water and sewage systems in existence
           as of February 11, 1987 shall not be increased;

     .     appropriate preventive measures shall be taken for the
           construction in compliance with the preventive and
           mitigative standards provided in the Building By-law in
           force;

-    the relocation of a public thoroughfare provided that the initial
     site be returned to its natural state or replanted;

-    an accessory building on a parcel of land that is already
     occupied by a principal building, on the condition that the total
     area of the accessory buildings covered does not exceed
     40 m².

For zones where there is a risk of flooding, the level of flooding is
represented by the ground level at the limit of the flood zone
illustrated nearest the site of the proposed or existing work.

                                                                         ZONES AT RISK OF
                                                                         FLOODING          12.3
-    When a site for which work is proposed is situated in a zone at
     risk of flooding and the reference code shows that the site is
     situated above the applicable flood level, as determined
     according to the provisions of article 12.2, the following
     provisions apply in place of those set out in article 12.1:

-    filling works are prohibited except for those required to protect
     a construction or existing work, or work authorized by virtue of
     this section;

-    all work or construction shall respect the preventive and
     mitigative norms set out in the Building By-law in force.
     However, it is not obligatory to respect the preventive
     standards for an accessory building that does not have
     permanent, continuous foundations.

The ground survey shall be carried out by a member of the
Quebec order of land-surveyors, and the results shall be
reproduced on a detailed map showing the limits of the property in
question and the site covered by the works. The plan shall be
presented with the application for a permit or certificate of
authorization.

Any new land use, all new construction and all tree cutting are
prohibited in zone CONS-12 because of the risk of soil erosion.

Notwithstanding the first paragraph, a detached single-family
dwelling may be built on a property that was cadastred on January
4, 1999 or, if it was not cadastred, was described by metes and
bounds in one or more deeds registered on that date and which
could be cadastred by virtue of the provisions of the Subdivision
By-law in force. The works are subject to the following conditions:

-    the slope of the parcel of land at the site planned for the
     construction is less than 15 %;

-    the cleared area on the parcel of land shall not exceed
     800 m²;

-    all parts of the ground left bare shall be stabilized by
     vegetative cover, at the latest by the expiration of the initial
     building permit.

                                           BANKS AND SHORES

On or below the shores of a lake or the banks of a water course,
and on or above a 10-metre strip measured from the limit of a
wetland, no work, cutting of trees other than for sanitary cut, no
digging or excavation, no filling or construction and no septic tank
or septic system is permitted. Moreover, the vegetative cover shall
be preserved in such a way as to create no site where erosion
may occur.

Notwithstanding the preceding paragraph, the following are
permitted:

-    works to reverse a man-made situation by returning the bank
     or shore to its natural state, on the condition that it does not
     interfere with the free flow of water nor adversely affect the
     flora and fauna. In all cases, plans and specifications for the
     work to be carried out shall be prepared by an expert-
     consultant. Written confirmation that the works have been
     carried out in compliance with the plans presented shall be
     provided by an expert in the matter;

-    works required to anchor a dock or wharf for boats;

-    repairs to an existing structure;

-    replanting and planting of pioneer or common plants on
     shorelines and on the banks of other bodies of water;

-    landscaping works for public purposes, such as a shoreline
     path, picnic area, beach, hydraulic structure, sedimentation
     basis, breakwater, fish ladder; on the condition that it is an
     integral part of a comprehensive plan;

-    work related to the installation of a water supply connection, a
     water and sewage system, or a pumping station;

-    when the slope of the shoreline or riverbank is less than
     30 % :

     .     development of an access way no more than 5 metres in
           width, at an oblique angle to the shore or river bank rather
           than along the shore or river bank, except to get around a
           physical barrier on the site. No part of the surface of the
           access way may be covered by concrete or asphalt.

-    when the slope of the shoreline or river bank is equal to or
     greater than 30 %:

     .     the pruning needed to make a “window” in the greenery
           5 metres in width or clear a trail or a stairway of 1.2 metre
           in width at most to allow access to the lake, body of water
           or wetlands;

-    constructions, structures and works for municipal, public or
     commercial purposes or for public access, duly submitted for
     authorizations by virtue of the Environmental Quality Act
     (R.S.Q., c.Q-2) or the Wildlife Conservation Act (R.S.Q., c.C-
     6.1);

-    an individual well;

-    construction of culverts and bridges to facilitate crossing
     watercourses, and construction of an access road to such a
     crossing;
                          -
-    reconstruction or enlargement of an existing road including a
     farm or logging road , in which case this should be done on
     the part farthest from the littoral;

-    works to stabilize shorelines and river banks, in the following
     order of priority and according to the following conditions:

     .     re-establishment of the vegetative covering and natural
           character of the shoreline or riverbanks when the slope,
           the type of soil, and the conditions of the property so allow;

     .     when the slope, type of soil or conditions of the property
           do not allow it to be stabilized by vegetation:

           -     creation of a riprap (piled stones as covering) with
                 vegetation;
           -     creation of a riprap without vegetation;
           -     creation of gabions (stone cribs);
           -     creation of a retaining wall;

-    repair works to an existing construction, including
     maintenance, inside renovation, exterior wall covering,
     windows and work to extend to the ground the exterior wall
     covering of the structure or to attach a trellis of decorative
     wood from the floor of the structure to the ground level below;

-    siting or carrying out the installation of an outlet for an
     underground or surface drainage system;

-    installation of a sealed tank for an existing residence;

-    installation of a hedge or fence;

-    on the shore or riverbank of an ephemeral stream and within a
     10 m-strip of land at the edge of wetlands, cultivation as part
     of an agricultural operation is permitted up to a minimum
     distance of 3 m from the high water mark or the limit of the
     wetlands.

certificate of authorization, issued in accordance with the
prescriptions of the Permits and Certificates By-law.

                                              SECTION 4

                                            THE LITTORAL




                                                                         PROVISIONS
                                                                         RELATED TO THE
                                                                         LITTORAL             12.7
Any use of the littoral of a lake or body of water, or development of
any structure or work above the littoral is forbidden. Without
restricting the generality of the preceding, specifically forbidden
are filling works with any kind of material whatsoever; excavation;
and cantilevered construction.

Notwithstanding the preceding paragraph, the following are
permitted:

-    a dock, floating platform not attached to the shore, a shelter or
     structure for a boat;

-    landscaping for public purposes such as a beach, a hydraulic
     structure, a sedimentation basin, a breakwater, a fish ladder,
     on the condition that it is an integral part of a comprehensive
     development plan;

-    works to return to its natural state a man-made situation, on
     the condition that it does not interfere with the free flow of
     water and does not adversely affect the flora and fauna. In all
     cases, plans and specifications for the works to be carried out
     shall be prepared by an expert- consultant. Confirmation that
     the works have been carried out in accordance with the plans
     presented is required from an expert resource;

-    installation of a water supply connection;

-    the encroachment necessary to carry out authorized works to
     stabilize the shore;

-    construction of culverts and bridges to facilitate crossing
     watercourses, and construction of an access road to such a
     crossing; measures to retain or attenuate problems of erosion
     and sedimentation shall be provided for during the works;

-    cleaning and maintenance works, without clearing, carried out
     by a local or regional government in a body of water according
     to powers and responsibilities conferred on it by the Municipal
     Code (R.S.Q., c.C-27.1) and the Cities and Towns Act
     (R.S.Q., c.C-19);

-    repair of an existing structure. If this is a shelter or other
     structure to protect a boat, maintenance and renovation of the
     interior and exterior, windows and the roof are permitted,
     provided that these works do not change the use of the
     building;

-    constructions, structures and works for municipal, public or
     commercial purposes, or for the purposes of access by the
     public, duly submitted for authorization by virtue of the
     Environmental Quality Act (R.S.Q., c.Q-2) or the Wildlife
     Protection Act (R.S.Q., c.C-6.1);

-    an ice-fishing shack.

Pouring cement on the littoral is strictly prohibited except in the
case of a repair of an existing concrete structure protected by
acquired rights.

Works carried out on the shoreline shall first be the subject of a
certificate of authorization issued in accordance with the
prescriptions of the Permits and Certificates By-law.

               DOCKS OR WHARVES, BOAT SHELTERS AND FLOATING PLATFORMS




                                                                       DIMENSIONS       12.9
The width of a private dock may not exceed 2 m.

The length of a private dock may not exceed 15 m. Nevertheless,
when the depth of water during periods of low water is less, at this
distance, than 1.2 m, the length may be extended to reach a water
depth of 1.2 m without exceeding 30 m in length. The length of the
dock is measured starting from the high water mark.

The surface area of a private dock may not exceed 30 m².
However, if the maximum length of 15 m is exceeded, the
maximum surface area is set at 60 m².

The area of a boat shelter or any other structure to protect a boat
may not exceed 37.5 m² and the height may not exceed 5 m
above the high water mark.

The surface area of a floating platform not attached to the shore
or bank may not exceed 15 m².

                                                                       NUMBER          12.10
One single dock or wharf, one boat shelter or structure to protect
a boat and one floating platform not attached to the shore is
permitted for each property adjacent to a lake or body of water.

Notwithstanding the first paragraph, when the property adjacent to
a lake or body of water is the site of more than one residence, a
dock and a boat shelter or other structure to protect a boat is
permitted for each residence adjacent to the shore.

When the frontage on the lake is at least 15 m, the dock or boat
shelter or other structure to protect a boat shall be situated at a
minimum distance of 5 m from any property line or the extension
of the property lines into the littoral.

When the frontage of the property on the lake is less than 15 m,
the dock or boat shelter or other structure to protect a boat shall
be placed in the middle of said frontage.

However, when the topography of the property prevents such a
location, it shall be placed as near as possible to the centre of the
lake frontage.

Notwithstanding the first and second paragraphs, a dock or a boat
shelter or any other structure to protect a boat may be located on
an area that has been altered. However, in choosing a place that
has already been altered, the minimum siting norms or those that
are as close as possible to the minimum norms must be
respected.

No part of a dock or boat shelter or other structure to protect a
boat may overlap the extension of the property line into the littoral.

A dock or a boat shelter or a structure to protect a boat shall be
situated:

-    at least 3 m (9.9 ft.) from the limits of the public road right-of-
     way;

-    at least 1 m (3.3 ft.) from an accessory building;

-    at least 3 m (9.9 ft.) from a principal building, except if it is
     attached to it.

A dock or wharf shall be installed perpendicularly (at a right angle)
to the shore for the first 5 metres of its length unless this is
impossible because of the configuration of the property or the
width of the body of water.

At no point above the littoral may a boat shelter or other structure
to protect a boat be more than 10 m from the high water mark.

A floating platform shall be entirely situated in a 30 m-strip of land,
measured from the high water mark. It shall be placed in such a
way that it is readily visible in the day and at night.

The provisions of this article do not apply to a public wharf.


                                                                           CONSTRUCTION
                                                                           CRITERIA          12.12
A dock or wharf, a boat shelter or other structure to protect a boat
shall be constructed on pilings, posts or cribs or shall be
prefabricated of floating platforms, in such a way as not to prevent
the free flow of water.

A post or pilings may not be more than 30 cm in diameter or more
than 30 cm on each side in the case of piles, or a non-cylindrical
post.

A crib may not be more than 2 m in diameter or more than 2 m on
each side in the case of a non-cylindrical crib. The height of a crib
may not be greater than 2.7 m. There should be a minimum
distance of 3 m between each crib.

A boat shelter or other structure to protect a boat shall be built in
such a way as to minimize the risk of erosion and not to cause any
change to the littoral or shoreline. In addition, 80 % of the surface
of walls shall remain open and unobstructed.

The use of treated wood is permitted only if it is factory-treated
wood. The use of creosote-treated wood is forbidden. It is
forbidden to treat wood with pesticides.

The provisions of this article do not apply to a public wharf.

                                                                          OPERATIONS         13.1
Cutting of commercial species of trees is forbidden within the
limits of a sector where forestry operations are prohibited, as
identified on the map entitled “Areas of Forestry Operations”.

Notwithstanding the first paragraph, trees of commercial species
may be cut if they are decaying, diseased or dead, under the
following conditions:

-    a forestry engineer shall confirm the cut to be carried out, and
     each tree to be cut shall be marked;

-    cutting should be carried out when the ground is frozen to a
     depth of at least 30 cm;

-    no heavy machinery shall drive within 15 m of the high water
     mark of a lake or body of water.
                                                                          STRICTLY LIMITED
                                                                          FORESTRY
                                                                          OPERATIONS         13.2
Within an area of strict limitations on forestry operations, as
identified on the map entitled “Areas of Forestry Operations”, only
the following types of cutting are permitted:

a) cutting of commercial species to uniformly remove 30 % at
   most of commercial wood from the forestry stand in which
   forestry activities take place every 12 years. The wood cut and
   left at the roadside, or in a stacking or storage area or any
   other development related to the forestry operation (except for
   a logging road or a drainage ditch) shall be counted in the
   calculation of the rate of removal;

b) sanitation or recovery cutting of windfall if this is prescribed by
   a forestry engineer, a biologist or a sylvicultural technician or if
   it is defined in the forest management plan;

 c) cutting of trees to clear the width needed to dig a forestry
    drainage ditch, not wider than 6 m;

d)    cutting of trees required to clear the width needed for the
     construction of a logging road, not wider than 10 metres. The
     entire network of logging roads may not exceed 10 % of the
     area of land where trees are being cut.


No heavy machinery may be driven within 15 m of the high water
mark of an intermittent body of water or ephemeral stream or un-
named permanent body of water. Within this strip of 15 m, it is
prohibited to create a logging road except for a road used as a water-
crossing.

                                                                           TYPE I
                                                                           FORESTRY
                                                                           OPERATION       13.3
Within the limits of a Type I forestry operations sector, as
identified on the map entitled “Forestry Operations Sectors”, only
the following types of cutting are permitted:

a)     cutting of commercial species to remove up to 40 % of the
       commercial-grade timber in the stand in which forestry
       activities are carried on every 12 years. The wood cut and left
       at the roadside, or in a stacking or storage area or any other
       development related to the forestry operation (except for a
       logging road or a drainage ditch) shall be counted in the
       calculation of the rate of removal;

b)     sanitation or recovery cutting of windfall trees if this has been
       prescribed in writing by a forestry engineer, biologist or
       sylvicultural technician, or if they are defined on a forestry
       management plan;

c)     cutting of trees required to clear the width needed for a
       forestry drainage ditch, not wider than 6 m;

d)     cutting of trees required to clear the width needed for the
       roadbed of a logging road, not larger than 10 metres. The entire
       network of logging roads may not exceed 10 % of the area of
       land that is being cut.

                                                                           TYPE II FORESTRY
                                                                           OPERATION          13.4
       Within the limits of a Type II forestry operations sector, as
       identified on the map entitled “Forestry Operations Sectors”, the
       cutting of commercial species is permitted according to the
       following conditions:

a) When the cutting is intended to remove up to 40 % of
   commercial-grade timber in the stand in which forestry
   activities are carried on every 12 years, the work shall be done
   in patches or gaps. Each gap may not exceed an area of 4
   hectares, in compact parcels and each shall be separated
   from the others by at least 100 m. The “buffer” spaces
   separating the gaps should be left intact until at least 50% of
   the regeneration in the cut-over gap has reached a height of 4
   m in height. The wood removed to be left at the roadside, or in
   a stacking or storage area or any other development related to
   the forestry operation (except for a logging road or a drainage
   ditch) shall be counted in the calculation of the rate of
   removal;

b) A conversion cut is authorized when the stand in which work is
   being carried out is made up of poplars, birch or birch groves
   and is at least 1 ha in area. The type and area of the stand
   shall be confirmed by a forestry engineer, biologist or forestry
   technician;

c)    sanitation or recovery cutting of windfall trees if this has been
     prescribed in writing by a forestry engineer, biologist or
     sylvicultural technician, or if it is defined in a forestry
     management plan;

d)     the network of logging roads may not exceed 10 % of the
       surface area of the property on which logging is being done,
       and the cleared width for a logging road may not exceed 10
       m;

e) The width of the cleared right-of-way for digging a forest drainage
    ditch may not exceed 6 m.

Notwithstanding the provisions of the first paragraph, it is
forbidden to cut more than 40 % of the commercial-grade of
wood of a stand in which forestry operations are carried on
every 12 years in the strip of land 50 m from one side to the
other of the public road right-of-way

                                                                        LAKES, BODIES OF
                                                                        WATER AND SCENIC
                                                                        ROADS               13.5
The provisions of article 13.1 apply in a 15m-strip of land
measured from the high water mark of all lakes and named,
permanent bodies of water.

The provisions of article 13.2 apply in a 15 m-strip of land
measured from the high water mark of all lakes and named,
permanent bodies of water, as well as in a 50 metre-strip of land
measured from the road right-of-way of all picturesque, panoramic
and scenic roads, except those situated in a sector where forestry
operations are prohibited. In this case, the provisions of article
13.1 apply.

The provisions of article 13.3 apply in a band situated between 15
and 30 m of the high water mark of all lakes and permanent
bodies of water, except those situated in a sector where forestry
operations are prohibited, or in a sector where there are strict
limitations on forestry operations. In this case the provisions of
articles 13.1 or 13.2 apply, depending on the case.

In the case of incompatibility between the prescriptions related to
tree cutting as set out in this by-law, the strictest prescription
applies.

Articles 13.3 and 13.4 do not apply to tree cutting when harvesting
trees grown in a plantation. Nor do they apply to tree cutting to
bring land into cultivation, on the condition that the cut is carried
out on land that has already been farmed or for which a certificate
of authorization for a change of use of the immovable has been
obtained.

                                                                        CUTTING TREES FOR
                                                                        THE PURPOSES OF
                                                                        CONSTRUCTION      13.8
In all zones, trees may be cut to clear a place to site a building or
a structure, or lay out the site or for a use in compliance with the
planning by-laws for which the authorizations and permits required
by the planning by-laws have been obtained. However, in zones
CONS-4, CONS-5, CONS-6, CONS-7 and CONS-8, tree-cutting
for these purposes is subject to the following conditions:

-    the maximum area for one compact, cleared area is 800 m²;

-    the maximum total of all cleared areas on the same parcel of
     land is 1,200 m²;

-    when the total of all cleared areas exceeds 800 m², the
     cleared area where the principal building will be sited may not
     exceed 600 m² in one compact area;

-    the width of the cleared way for an access road may not
     exceed 8 m.

For the purposes of the application of the first paragraph, two
cleared areas not separated by a strip of trees at least 10 m wide
are considered as being one single area.

Cleared areas occupied by an access way are not considered in
the calculation of the cleared area.

                                                                         TREE-CUTTING
                                                                         RESTRICTIONS
                                                                         IN CERTAIN ZONES   13.9
Notwithstanding articles 13.1 to 13.5, in commercial, conservation,
residential and seasonal-recreational zones, it is prohibited to cut
a tree larger than 30 cm (1 ft.) in diameter 1 m (3.3 pi) from
ground level, unless it can be shown to the building inspector that:

-    the tree is dead or afflicted with an incurable disease;

-    the tree is damaging the foundations of a building or the
     building itself, an underground pipe, a sidewalk or a paved
     surface;

-    the tree is a danger to public safety;

-    cutting is required for the purposes of laying out a site, a
     structure or construction for public purposes;

-    cutting is required to carry out works authorized by this by-law,
     for which a permit or certificate of authorization has been
     obtained when required.

In conservation zones and in places where the slope of the
property exceeds 15 %, trees that are to be cut shall first be
marked at the D.H.P. and at the stump.

It is forbidden to plant a tree within 1.5 m (4.9 ft.) of the limits of
the public road right-of-way.

It is forbidden to plant poplar, trembling aspen, cottonwood,
Lombardy poplar, hybrid black poplar, white willows or silver
maple within 7.5 m (24 ft.) of the limit of the public road right-of-
way and within 10 m (32.8 ft.) of a water or sewage pipe.

Any tree of 10 cm or more at the D.H.P., that could be damaged
during construction work, shall be protected by an enclosure of
boards a minimum thickness of 15 mm (5/8 in.), held in place
around the trunk by metal strapping.

For works carried out on the shore or bank, a certificate of

The following provisions apply to a dump situated on lot 896 on
the 7th Range of the official cadastre of Bolton Township, and no
longer in use:

-    it is forbidden to put up a principal building on the site of the
     dump;

-    it is forbidden to build a well for the consumption of potable
     water within 300 m, or a pond within 150 m of the limits of the
     property on which the dump is situated. The minimum
     distances do not apply if a study of the soil characteristics
     shows that there is no risk of contamination of the water in the
     well or pond.

The provisions of the first paragraph do not apply when written
permission has been given by the Quebec Ministry of the
Environment.

                                                                           SCRAP YARDS       14.2
The following minimum distances apply in proximity to a scrap
yard. They also apply, reciprocally, to any new scrap yard. The
distances are measured from the limits of the part of the property
used:

-    construction for residential purposes:              100 m
-    construction for commercial purposes:               100 m
-    wells for potable water:                            100 m
-    road:                                                35 m

                                                                           QUARRY OR
                                                                           SAND PIT       14.3
The following minimum distances apply in proximity to an operat-
ing quarry or sand pit. They also apply, reciprocally, to any new
quarry or sand pit.

The distances are measured from the limit of the parcel of land
that could be worked by virtue of an operating permit from the
Quebec Ministry of the Environment. In the case where there is
no operating permit, the distances are measured from the limit
of the part of the property being worked:

-    construction for residential purposes :
     . 600 m from a quarry;
     . 150 m from a sand pit;

-    construction used for accommodation:
     . 600 m from a quarry;
     . 150 m from a sand pit;

-    road :
     . 70 m from a quarry;
     . 35 m from a sand pit.

Except in a quarry or sand pit located in industrial zone I-1, it is
prohibited to extend operations on a property that did not belong
to the operator of said quarry or sandpit on January 4, 1999.

The following provisions apply in proximity to a source of potable
water serving more than one consumer, with the exception of a
water intake in a body of water:

-    no activity, no use, nor any work is authorized within 30 m of
     the water source, with the exception of any work needed by or
     connected with the collection of water such as a pumping
     station, reservoir, or booster;

-    no cattle-raising operation, no spreading of fertilizer nor
     spreading of farm manures is authorized within 100 m of a
     source of water;

-    no quarry or sand pit, no landfill site and no transfer centre for
     dangerous products is authorized within 300 m of a water
     source.

                                                                            HAZARDOUS WASTES
                                                                            ELIMINATION SITE 14.5
It is prohibited to erect a structure on a hazardous waste
elimination site, as identified in this chapter. It is also prohibited to
carry out any land use or any activity that would or could disturb
the vegetative cover in such a way as to open up the
contaminated or dangerous material stored in such a site.

                  SPECIAL SITING NORMS RELATED TO AGRICULTURAL ACTIVITIES



                                                                         INTERPRETIVE
                                                                         RULES              14.6
The provisions of articles 14.7 to 14.9 apply reciprocally between
a specified agricultural activity situated in a permanent agricultural
zone and a specified non-agricultural work or activity in the “white
zone”. If an animal-raising operation, a place for the storage of
liquid farm wastes, or an activity to spread farm manures exists,
within a permanent agricultural zone, the siting of a public road, a
dwelling or a protected immovable is subject to the minimum
distances set out in these articles. On the other hand, if there
exists, in the “white zone”, a public road, a dwelling, or a protected
immovable, the siting of an animal-raising operation, a place to
store liquid farm wastes or an activity to spread farm manures in
the permanent agricultural zone is subject to the minimum
distances set out. Moreover, the siting of a specifed agricultural
use in the permanent agricultural zone must respect the minimum
distances related to the limits of the urban perimeter or a zone
identified in one of articles 14.7 to14.9.

Articles 14.7 to 14.9 do not apply if the public road, the dwelling or
protected immovable is situated in the permanent agricultural
zone. In this case, the following minimum distances apply,
reciprocally, between the non-agricultural works and activities and
the animal-raising operation, the storage place for liquid farm
wastes or the spreading of farm manure:

-    public road:                           37 m
-    dwelling:                             184 m
-    protected immovable:                  367 m

Articles 14.7 to 14.9 do not apply if the specified agricultural
activity and the specified non-agricultural work or activity are both
situated in the white zone.

The word “dwelling”, used solely for the purposes of the
application of articles 14.7 to14.9, does not include a habitation or
dwelling that belongs to the property owner or operator of the
facilities for raising animals that are in question, to a shareholder
or director of a corporate entity (moral person) that is the owner or
operator of these facilities, nor to a dwelling that is used as
accommodation by an employee of the animal-raising facility.

                                    SPECIAL PROVISIONS RELATED
                          TO CERTAIN USES, CONSTRUCTIONS AND STRUCTURES


                                              SECTION 1

                                           SWIMMING POOLS



                                                                         SITE       15.1
An outdoor pool shall be installed in such a way that no part of it is
situated within 6 m from the road limits in the case of a public road
and at a distance of at least 1.5 m of any property line or within
1 m (3.3 ft.) of any building constructed on the same property, with
the exception of a service building for the swimming pool.

A swimming pool may not occupy more than 30 % of the area of
the property on which it is built.

                                               SECTION 2

                               SERVICE STATIONS, GAS BARS AND CAR WASHES




                                                                         GENERAL
                                                                         PROVISIONS       15.2
A service station or a gas bar is subject to the following provisions:

a) Access to the site

     There may be no more that two (2) entrances from each side
     of the lot fronting on the street.

     In all cases, entrances for vehicles must be situated at least
     7.5 m (25 ft.) from the intersection of two (2) road right-of-way
     lines.

     The maximum width of an access is 11 m (36 ft.).

b) Uses permitted in the setbacks

     Pumps, lamp-posts, and two signs are permitted in the front
     yard.

     However, a space of at least 6 m (20 ft.) shall be left between
     the island with the gas pumps and the road right-of-way line,
     and 4.5 m (13 ft.) between the principal building and the island
     with the gas pumps. The island may be covered with a roof
     that is attached to the principal building or freestanding, and
     the minimum clearance shall be 3.8 m (12.5 ft.). The roof line
     shall stop a minimum distance of 60 cm (2 ft.) from the road
     right-of-way line.

c) Walls and roof

     A gas bar or service station shall have exterior walls made of
     brick, stone, concrete or any other non-combustible material.
     The roof shall be covered with a non-combustible material.

d) Grease pit, etc.

     A service station shall have a closed area for lubrication,
     repair and cleaning or washing of automobiles and these
     various operations shall be carried on inside this area.

e) Gas tanks

     Gas shall be stored in underground tanks that may not, under
     any circumstances, be situated underneath a building. No
     more than 4.5 litres (1 imp. gal.) of gasoline may be stored
     inside a building.

f) Refuelling

It is prohibited to fuel automobiles by means of a pipe, hose or
     any other device that has been suspended over or stretched
     across a public thoroughfare.

g)         Prohibited uses

     A service station or gas bar may not be used for residential,
     industrial, public or commercial purposes, except for shops to
     repair automobiles. However, a gas bar may have a
     dépanneur or convenience store.

h) Washrooms

     A service station or gas bar shall have separate washrooms
     for men and women, properly indicated.

i)   Laying out Parking Spaces

     The driveable area of parking spaces shall be paved with
     asphalt; unpaved areas shall be grassed or landscaped.
                                                                      SITING NORMS
                                                                      FOR BUILDINGS       15.3
The following requirements apply to a new construction and to a
change of destination of an existing building:

-    minimum area of the building:
     service station: 112 m² (1,200 ft.²)
     gas bar:          10 m² (107 ft.²)

-    minimum front setback:
     9.1 m (30 ft.)

-    minimum rear setback:
     4.6 m (15 ft.)

-    number of storeys of the principal building:

A car-wash unit may be incorporated into a gas-bar or service
station if the property has a minimum area of 1,858 m²
(20,000 ft.²) for service station, or 1,258 m² (13,540 ft.²) for a gas
bar. To incorporate more than one car-wash unit, an area of
456 m² must be added for each additional unit.

In front of each car-wash unit in a service station or gas-bar there
shall be a space where at least four cars may be parked in a
waiting line, with one (1) space of 3 m by 6.7 m (9.8 ft. by 21.9 ft.)
per automobile.

                                           LAKES AND ARTIFICIAL PONDS



                                                                           DEVELOPMENT
                                                                           NORMS             15.5
Filling and excavation work intended for the development of lakes
or artificial ponds shall respect the following conditions:

a) except in the case of a spring-fed lake or pond, the construction
    of the lake or pond shall by-pass the actual bed of the source of
    water (i.e. be outside it);

b)     in no case may an existing watercourse be used to develop
       an artificial body of water;

b)     an artificial lake or pond shall be at least 15 m (49.2 ft.) away
       from any public traffic thoroughfare;

c)     the average minimum depth is 2 m (6.5 ft.);

d)     the slopes of the talus or embankment of the retaining
       structure shall not exceed 30°. This embankment shall be
       grassed or otherwise stabilized immediately after
       construction.

                                           CAMP GROUNDS




                                                                          SETBACK          15.6
The laying out of all camp grounds (including camp sites) shall
respect a minimum setback of 10 metres from any property limit,
and 100 metres from any street or public road right-of-way with the
exception of the laying out of one or more access roads to the
camp ground.

In the camp ground:

-    a single principal building per camp ground is authorized, with
     a maximum height of 8 m (26 ft.) and a maximum of one
     storey;
-    only accessory buildings for community services for the camp
     ground are authorized, on the condition that they are not
     higher than a maximum height of 8 m (26 ft.). No accessory
     building of any kind whatsoever is authorized on camp sites
     intended for tents, tent-trailers, trailers, motorized trailers or
     recreational vehicles. Any modification or enlargement of
     trailers, motorized trailers or recreational         vehicles is
     prohibited.

The relationship between the number of camp sites and the area
laid out for or used as a camp ground may not exceed 20 camp
sites per hectare.

The minimum area set aside for site development or use as a
camp site for a tent, tent-trailer, trailer, motorized trailer or
recreational vehicle shall be 150 sq. metres.

                                           GARAGE SALES

Garage sales are allowed subject to the following conditions:

-    The sale shall take place on a property occupied for
     residential purposes (art. 4.2);

-    The garage sale shall be carried out by the occupant of a
     dwelling unit situated on the property where the sale is being
     held;

-    The sale may last a maximum of 48 hours;

-    A maximum of three garage sales per dwelling unit per year
     are permitted.

                                             SECTION 6

                                              TRAILERS




                                                                        INSTALLATION,
                                                                        STORAGE            15.11
A trailer may only be installed on a camp ground. A trailer may not
be installed elsewhere except for the purposes of temporary
storage. In this case, the trailer may not be stabilized by levellers
or other means, the awnings shall be lowered or rolled up, the
doors locked and the windows closed. It is forbidden to park or
store a trailer on a vacant lot.

                                                                        USE                15.12
It is forbidden to use a trailer as a permanent residence. It may
only be used when it is installed at a camp ground, and then, only
on a seasonal basis, not to exceed 180 days per year.

                                              SECTION 7

                                           FOREST SHELTER




                                                                         SITING      15.13
A forestry shelter may only be erected on a property with a
minimum area of 20 hectares, except in zones RUR-1 and RUR-2
as provided for in article 5.1. Only one forestry shelter is permitted
per parcel of land.

The forestry shelter shall be sited a minimum distance of 15 m
from any property line, and 50 m from the limit of the public or
private road right-of-way. It shall not be visible from the road.

When the shelter is located in a zone that is part of a permanent
agricultural zone, its use shall be related to a forestry activity
taking place there.

                                              SECTION 8

                              SECONDARY RESIDENTIAL BUILDINGS (COTTAGES)

taken into account when calculating the land used by principal
building.
                                                                     SEPTIC SYSTEM       15.17
The secondary residential building shall be attached to a system
to purify wastewater in compliance with the applicable by-laws.
