NEW AUTOMOBILE WARRANTIES 1. Manufacturer’s Warranty Most new automobiles are covered by a warranty from the manufacturer (this written warranty is often called an "express" warranty). New car warranties generally cover the cost of parts and labor for repairs that are the fault of the manufacturer, but not repairs that are the fault of the buyer or a third party. Usually, some parts are excluded from coverage. To find out the specific terms of your warranty, you must read the manufacturer’s written warranty statement. 2. Connecticut’s Lemon Law In addition to the manufacturer’s warranty, Connecticut has implemented a “Lemon Law” to protect new car buyers. The Connecticut “Lemon Law” applies only to new car purchases, not the purchase of a used car. In general, the Lemon Law covers all NEW automobiles: 1) Which do not conform to the manufacturer’s express warranty (discussed above); 2) Which have substantial defects affecting the use, safety or value of the vehicle; and, 3) Which have defects that occur during the first 2 years from the original owner’s delivery date or the first 18,000 miles on the odometer (whichever comes first). If, after “a reasonable number of attempts” to remedy the defect (usually four), the vehicle still does not conform to the manufacturer’s warranty, the Lemon Law provides an informal process by which a state arbitrator can remedy the dispute. Possible remedies may include a refund or replacement vehicle. For more information on Connecticut’s Lemon Law please contact the Naval Legal Service Office. USED AUTOMOBILE WARRANTIES Connecticut also requires that automobile dealers include warranties on certain used cars that are less than seven years old. To qualify for this warranty the automobile: 1) Must be purchased from a state licensed used car dealer (to check if a particular dealer is state licensed, you can call the Dept. of Motor Vehicle Dealers & Repair Licensing at 860-263-5056); and 2) Must be purchased for at least $3,000. The length of the warranty depends upon the amount paid for the automobile. If the vehicle’s purchase price was at least $3,000 but less than $5,000, the warranty is effective for 30 days after the purchase date or 1,500 miles (whichever occurs first). If the purchase price was $5,000 or more, the warranty is in effect for 60 days after the purchase date or 3,000 miles (whichever occurs first). Purchase price includes all amounts charged for the vehicle, including the value of any trade-in vehicle, but excludes any finance charge. An automobile that falls under this warranty must be mechanically operational and sound at the time of purchase as well as throughout the warranty period. If, during the warranty period, the vehicle is not mechanically operational and sound, the dealership is required to restore the vehicle to this condition. The warranty covers 100% of parts and labor necessary to make the vehicle mechanically operational and sound. If the automobile does not qualify for the used car warranty, then it most likely will be sold “As Is”. "As Is" means the seller is not liable for any defects.
