I.       DISCUSSION



The applicant, King Street Cats, Inc., requests special use permit approval for the operation of a
cat shelter located at 25 S. Dove Street.



The subject property is one lot of record with

mall building. Access to the property is from Dove
Street.

The surrounding area is occupied by a mix of industrial uses. Immediately to the north and west
is the Duke StreetITelegraph Road interchange. To the south is another industrial flex mall
building containing commercial storage units. To the east is an automobile repair business.



King Street Cats, Inc. has been operating in Alexandria since 2000, and is currently located in a
space at 213 King Street, which is zoned KR/I(lng Street retail. An animal shelter is not a
permitted use in the KR zone, therefore King Street Cats, Inc. is proposing to relocate to the
subject site.



The applicant proposes to operate an animal shelter for cats where they can be housed and
receive veterinary care prior to adoption. The facility would be open to the public for adoptions
on weekends, with additional scheduled appointments during the week.

Capacity:             Approximately 25 cats will be housed in the shelter at a given time.
                      Additional cats are kept in foster care with volunteers.

Hours:                Employees and volunteers may work daily between 6:00 a.m. and 11:OO
                      p.m. The facility is open to the public from 12:OO noon and 5:00 p.m. on
                      Saturday and Sunday, and by appointment only.

Number of Patrons:    The applicant expects approximately 40 people on site during the open
                      hours on weekends.

TrashILitter:         Trash is collected weekly. Volunteers also monitor the site for any litter.

Overnight kenneling is identified as an industrial use in the ordinance. Industrial uses, other than
long term storage, have a parking requirement of 1.1 spaces for every 600 square feet. Parking
for the subject use would be most similar to an industrial use; therefore two spaces would be
required under the Zoning Ordinance. The applicant has two assigned parking spaces on the
property. In addition, on weekends, when other businesses in the building are typically not open,
there is additional parking available.



The subject property is located in the OCM(5O)IOffice Commercial Medium (50) zone. The
current and previous uses in the subject building are noncomplying industrial uses. Section 12-
302(B) of the Zoning Ordinance allows one noncomplying use to replace another noncomplying
use only with a special use permit.

The proposed use is consistent with the Taylor RunfDuke Street Small Area Plan chapter of the
Master Plan which designates the property for moderate intensity uses.


11.     STAFF ANALYSIS

Staff supports the proposed animal shelter for cats. King Street Cats, Inc. has operated in the
City for nearly ten years without documented complaints. The applicant has submitted over 30
letters of support for the organization from citizens, volunteers, and members of the business
community. The location is separated from residential uses by a major arterial road and highway
interchanges, so there will be little or no impact.

Trash Can, Litter and Street Tree Requirements
No street trees are being required in this case because the location is internal to an industrial area.
The industrial nature of the area is also the reason that no trash can is being required, although
the applicant will have to contribute to the City's Litter Control Fund. These conditions may
change as a result of Council's policy discussion on these issues scheduled for June 9.

With the following conditions, staff recommends approval of the special use permit.


111.   RECOMMENDED CONDITIONS

Staff recommends approval subject to compliance with all applicable codes and ordinances and
the following conditions:

1.     The special use permit shall be granted to the applicant only or to any corporation in
       which the applicant has a controlling interest. (P&Z)

The hours during which the animal shelter is open to the public shall be limited to
between 12:OO noon and 5:00 p.m., Saturday and Sunday, and by appointment only
Monday through Friday. (P&Z)

The applicant shall control odors from operations at the site and prevent them from
leaving the property or becoming a nuisance to neighboring properties, as determined by
the Department of Transportation & Environmental Services. (T&ES)

All loudspeakers shall be prohibited from the exterior of the building, and no amplified
sounds shall be audible at the property line. (T&ES)

Pet carriers or pet products shall not be cleaned outside, nor shall any residue be washed
into the streets, alleys or storm sewers. (T&ES)

Deliveries, loading, and unloading activities shall not occur between the hours of
11:OOpm and 7:OOam. (T&ES)

The applicant shall provide storage space for solid waste and recyclable materials
containers as outlined in the City's "Solid Waste and Recyclable Materials Storage Space
Guidelines", or to the satisfaction of the Director of Transportation & Environmental
Services. The City's storage space guidelines and required Recycling Implementation
Plan forms are available at: www.alexandriava.gov or contact the City's Solid Waste
Division at 703-5 19-3486 ext. 132. (T&ES)

Litter on the site and on public rights-of-way and spaces adjacent to or within 75 feet of
the premises shall be picked up at least twice a day and at the close of business, and more
often if necessary, to prevent an unsightly or unsanitary accumulation, on each day that
the business is open to the public. (T&ES)

Applicant shall contribute $575.00 to the Litter Control Fund for the installation of litter
receptacles along the public right-of-ways. Monetary contribution to be submitted to the
Department of T&ES, Engineering Division, Room 4130,301 King Street within 60 days
of City Council approval. (T&ES)

The applicant shall require its employees who drive to use off-street parking and provide
employees who use mass transit with subsidized bus and rail fare media. The applicant
shall also post DASH and Metrobus schedules on-site for employees. (T&ES)

The applicant is to contact the Community Relations Unit of the Alexandria Police
Department at 703-838-4520 regarding a security survey for the business.

The Director of Planning and Zoning shall review the special use permit after it has been
operational for one year, and shall docket the matter for consideration by the Planning
Commission and City Council if (a) there have been documented violations of the permit
conditions which were not corrected immediately, constitute repeat violations or which
create a direct and immediate adverse zoning impact on the surrounding community; (b)

       the director has received a request from any person to docket the permit for review as the
       result of a complaint that rises to the level of a violation of the permit conditions; or (c)
       the director has determined that there are problems with the operation of the use and that
       new or revised conditions are needed. (P&Z)

13.    Trash and garbage shall be placed in sealed containers which do not allow odors to
       escape and shall be stored inside or in a closed container which does not allow invasion
       by animals. No trash and debris shall be allowed to accumulate on site outside of those

NARRATIVE DESCRIPTION

3 The applicant shall describe below the nature of the request in detail so that the Planning
 .
Commission and City Council can understand the nature of the operation and the use. The description
should fully discuss the nature of the activity. (Attach additional sheets if necessary.)
King Street Cats Inc. (KSC) has been incorporated since January 2003 as a 501(c)(3)
nonprofit organization, but has existed since 2000. Throughout the years, KSC has aided
the Alexandria community by rescuing housing and re-homing approximately 250 cats
per year. On average we have 25 cats in our care center and additional cats in foster care
with volunteers. This service has reduced the overpopulation burden of the Alexandria
Animal Shelter. All of our cats and kittens are sterilized prior to adoption and receive
full veterinary care before adoption. We are a true no-kill free-roaming cat care center
and we are the only cat-exclusive welfare organization serving Alexandria. We
specialize in helping difficult-to-adopt cats, such as elderly, timid, and sibling pair cats,
such cats which would have difficulty being in a traditional shelter setting.

In addition to adoption services, KSC also provides education and outreach to Alexandria
and the surrounding communities. Our services primarily consist of educating others
about animal cruelty prevention and proper cat care, including resolving behavioral issues
that often result in cats being surrendered to shelters or abandoned outdoors. Our goal of
education is to prevent any cat from losing its home and reduce animal abuse. Through
our phone service, we take calls daily from individuals seeking advice on cat issues, from
individuals wishing to bring their cat to us for re-homing, or from people who found a
stray or kitten that needs a safe shelter. KSC has recently started providing cat food at no
cost to individuals who are financially struggling and wish to keep their cat, and we have
increased our ability to board former KSC-cats at our facility while their family has
extensive travel or has temporarily lost their joblhome.

KSC is far more than an animal shelter and is not comparable to one. What distinguishes
us are the following: (1) We are a private organization that is solely run by volunteers and
is 100% donor-funded. We do not have any employees and do not receive any
government funds. (2) We are not an open-admission organization and take in homeless,
abused and abandoned cats when space permits. (3) We are a shelter where cats safely
roam free (and only are temporarily caged for medical or behavioral issues). (4) We do
not euthanize any cat unless it is fatally ill beyond veterinary repair and is deemed
humane for the cat. (5) We contractually require that our adopted cats be returned to us in
the event that the adopter cannot keep the pet, and we provide continuing help to adopters
in the months and years after the adoption. (6) We follow-up on all adoptions at three
different times to insure the cat is adjusting well. All of those services differentiate KSC
from many animal shelters and is why KSC is more appropriately a cat welfare
organization.

In our current location at 21 3 King Street, KSC has never received a complaint and has
received overwhelming support from neighboring stores and residents. When visitors
come to Old Town Alexandria, particularly in the Spring and Summer, they pay a visit to
our facility and commend us on a clean facility and our good work. We continually
receive praise that we have the cat-friendliest cats in the area because our cats live
together and learn to co-exist. KSC has been a staple in Old Town Alexandria since 2000
and through this application we are hoping to continue our service to Alexandria.

I am the President of King Street Cats, Inc. and submit this Special Use Permit
Application to you for consideration of us occupying and renting 25 South Dove Street.
King Street Cats became a 501c3 nonprofit organization in January 2003 and existed
several years before then. Ethel Beun, our founder and owner of the building at 2 13 King
where we have been located, had a vision that King Street Cats could provide a societal
benefit to Alexandria and the surrounding communities by reducing the cat over
population plaguing the area, by reducing the number of cats burdening the Alexandria
Animal Shelter, and educating pet owners about proper cat care that would result in less
cats being abandoned.

King Street Cats has successhlly run its business since its inception and without one
complaint against us. We often have out-of-state and foreign visitors stop by our
orphanage because of its uniqueness. We assist approximately 250 cats and kittens per
year, and we spay-neuter every cat before adoption, thus helping reduce the cat over
population problem. We are a unique organization that is not comparable to any animal
shelter. Although we do house on average 25 cats and kittens in our orphanage, we are an
outreach and welfare organization. We provide continuing follow up on all our adoptions
and frequently take phone calls from individuals who adopted from us years earlier and
have a question. We have a foster care network of volunteers who take cats and kittens
into their homes until they are adopted, and we spare no expense on our veterinary care.
We also insist that all our cats are returned to us if the owner is unable to care for the cat.
I personally know of no other similar organization, and I frequently travel the country
due to my work for a national animal welfare organization.

King Street Cats is run solely by volunteers and we are financed solely through private
donations. We have a large donor base of supporters in the Alexandria community,
including many businesses. Although King Street Cats was previously denied the
opportunity to remain in Old Town where we have been a staple since approximately
2000, we are hopehl that our SUP application will be granted so that we can occupy 25
South Dove Street. King Street Cats wishes to continue assisting Alexandria's cats and to
continuing bringing good will to the community.

The purpose of this letter is to support the relocation efforts of King Street
Cats (KSC). I am the trustee for the property currently occupied by KSC,
and they have operated from this location for approximately ten years. They
must relocate because this building will be leased and/or sold.

KSC has provided an invaluable service to the City of Alexandria and the
broader area of Northern Virginia. Individuals who must give up their cats
for various reasons, including death of the owner, illness within the family,
relocation, or economic hardship are greatly relieved if they can place the
animal with a no-kill shelter such as KSC. In addition, KSC has taken in
many stray cats over the years. They have been remarkably successful in
placing these cats in loving homes. To my knowledge, there is no equivalent
organization in this area that offers the range of services provided by KSC.

KSC has rescued,hundreds of cats over the years. The organization has,

through the Vola Lawson Shelter. Through their dedication they are able to protect and place
special needs cats that are not as "marketable to the general public because of unique

Two years ago on January M I adopted Bro and Sis, they had been turn into King Street
because their owner was moving and could not take them with her, She had taken them as
kittens 6 years before from the King Street location!

They had always been together, and were what many consider middle aged to senior cats. Both
were quite fearful and after 8 months of having been "almost" taken but passed by for younger
and cuter kittens they had stopped eating and playing over about thanksgiving, they were taken
by a volunteer to her home and it was from there that I found them through the website.

For the first several weeks they would only huddle together and stayed on my sun porch - in my
very winning and determined way (some of you herein chuckle) they have become very beautiful
and loving pets. I have attached their recent photos.


The would never have survived the limitations of the animal shelter - only with a very special
rescue foundation do I have my furry friends today.

In the first place, KSC partially fulfills some of the goals outlined in the Strategic Plan
approved by City Council. It helps Alexandria be a "city that respects, protects, preserves

Finally, KSC helps the City with its current fiscal crisis. KSC helps foster more than 250

   I just wanted t o take an opportunity to bring t o your attention the
fantastic work that the King Street Cats organization does for the City of
Alexandria. I moved here late last year and found King Street Cats pretty
quickly while strolling through Old Town. When I stopped in to visit and
gave my name as a potential volunteer, I was happy to see and hear about
all the good work that their animal welfare organization does for these
poor abandoned animals.

   I understand that King Street Cats doesn't only help the animals, but it
also helps the community by taking in cats that would otherwise wind up a t
the city shelter and be cared for a t the cost of the taxpayers. As a tax-
paying Alexandria resident, I'm grateful for the service that their
organization provides, helping not only the animals but the city and its
residents too. Anyone who sacrifices their own time to help save money is
doing a service to everyone in the community, especially in these economic
times.

   When I heard that King Street Cats was losing its current rent-free
location in Old Town, it saddened me. I'd hate to see them have to shut
down their operation; they help so many poor abandoned animals, many of
whom are former pets of Alexandria residents. I sure hope that the city
offers their support to this wonderful organization in i t s time of need. I'm
happy t o help them out in any way I can, myself.

   Please know that there are many other people like myself who
appreciate the service that King Street Cats provides our community.
Alexandria is a great city, and it is people like those running and supporting

and its efforts to lease space within the City in order to continue providing outreach,

volunteering with King Street Cats, and have been able to observe first hand the many

King Street Cats has been an important part of the local community for over ten years,
and I believe it is essential that any move be to a location within the City of Alexandria.

important. I am a condo owner at Palazzo at Park Center Condominiums, which is a pet friendly
condominium. Because of the current economy I have seen a number of owners and owner's
tenants lose their homes. Sometimes the tenants do not have much time to find new living
quarters, and many times may have to move into apartments where pets are not allowed.

Having a cat welfare organization such as King Street Cats is not only humane to the animals but
also "humane" to the owners who have to give up loved pets.

shelter as well as many other shelters in the metropolitan area to save
animals that would otherwise be euthanized. It educates people as to proper
and humane care for animals, including the importance of neutering. Over
the years, it has saved and found homes for hundreds of cats and kittens who
would otherwise be on the streets of Alexandria or put to sleep.

The group is unique and has been a model for how the public and private
nonprofit sectors can work together. It is completely managed through
volunteers and private contributions. It is an asset to the community and
deserves the enthusiastic support of City officials.

Please grant all the necessary approvals and permits to allow the group to
continue to have a place to operate its rescue activities and be a part of the
civic life of the City of Alexandria. It is the responsible, humane thing to
do.

acknowledged the good work of the KSCS and had nothing but respect for the owner and
volunteers of this worthwhile organization. With the passing of our lovely owner Ethel

find another wonderful place to house these poor little funy individuals. They need our
help and we need your help to find a warm and secure spot to continue the good work of

SUBJECT:       APPLICATION OF TREES AND TRASH CAN POLICY TO JUNE SUP
               CASES


ISSUE: How to apply the new policy for funding street trees and trash cans to the SUP
cases on Council's June docket.

RECOMMENDATION: That Council apply the new policy and condition language
regarding trees and trash cans to the June SUP cases as,outlined below.

BACKGROUND: One June 9, Council acted to adopt a policy with regard to SUP
conditions for streetscape funding. Specifically, Council directed staff to include the
following condition in all new SUP cases, including those approved administratively.
The condition is not to be applied to cases seeking to amend an existing SUP or where
there is a separately established funding stream for the same features.

      The applicant shall contribute $500 to the City's Streetscape Improvement
      Fund for street trees and trash cans.

The above condition makes for consistent application and is to replace the site specific
analysis and application of requirements for street trees and trash cans, tailored to the
circumstances of a particular location, that had previously been staffs practice.

APPLICATION OF THE NEW RULE TO JUNE SUP CASES
There are seven SUP cases on Council's June docket. Two are new SUP cases to which
Council's new condition language applies. The remaining five cases seek amendments to
previously approved SUPS, and the new language does not apply in those cases. Staff
drafted the June staff reports, including conditions, based on its prior practice, however,
staff indicated to the Planning Commission and the applicant that the conditions might
change as a result of Council's discussion on June 9. To apply its new policy to the June
cases, Council needs to make the following changes to the cases below at its June 13
hearing.
New SUP Cases
SUP #2009-0015, Bashford Lane Apartments parking reduction by RPJ (docket item #4):
Add new condition language.

SUP #2009-0016, Dove Street Cat Shelter (docket item #5):
Add new condition language; and
Remove condition #9 requiring $575 contribution for litter fund.

SUP Amendment Cases
SUP #2009-0014, Cafe Pizzaiolo Restaurant (docket item #3):
No changes.

SUP #2009-0021, Umbrella SUP Extension (docket item #6):
Remove Condition # 19 requiring $1 150 contribution for new trash can; and
Remove Condition # 21 requiring the replacement of two new street trees.

SUP #2009-0018, Momo Sushi (docket item #9):
No changes.

SUP #2009-0020, Landinis (docket item #14)
Remove condition 30 requiring $575 contribution for litter fund.
