MANUFACTURED, HOME DELIVERY AND INSTALLATION AGREEMENT
This Agreement is made this day of ______________________ (hereinafter “Seller”) and (hereinafter “Buyer”).

WHEREAS, Buyer has agreed to purchase a manufactured home (“Home”) from Seller and desires to have said manufactured home delivered and installed by Seller on Buyer’s property or the property of a third party. NOW THEREFORE, in consideration of the mutual promises herein contained, it is agreed and understood as follows: 1. GENERAL DELIVERY CONDITIONS: (a) Seller will utilize all reasonable efforts to prevent damaging Buyer’s yard, sidewalk, curb, and/or any other real or personal property. However, Buyer expressly understands that damage is sometimes unavoidable due to the weight of the homes. UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY DAMAGE TO ANY REAL AND/OR PERSONAL PROPERTY CAUSED BY THE USUAL AND ORDINARY INSTALLATION OF BUYER’S HOME. LIKEWISE, BUYER SHALL INDEMNIFY AND SAVE HARMLESS SELLER FROM AND AGAINST ALL CLAIMS AND DEMANDS OF THIRD PARTIES ON WHOSE PROPERTY THE HOME WILL BE INSTALLED, WHETHER FOR INJURY TO PERSON OR DAMAGE TO ANY PROPERTY WHATSOEVER, RESULTING FROM THE USUAL AND ORDINARY INSTALLATION OF BUYER’S HOME. The delivery price is based upon Buyer’s assurance that the delivery route is along acceptable all-weather, surfaced roads that are open and accessible from the point of origin to the final point of delivery. A representative of the delivery crew will inspect the route and list any potential difficulties, obstacles, or other problems as well as any required special arrangements that will all need to be addressed prior to delivery. Buyer will be responsible for removing, moving, or changing the location of any obstacles so that the Home may be delivered without damage, such as tree limbs, street signs, fences, mailboxes, etc. Buyer shall be responsible for obtaining written permission from any third parties over whose property Seller will travel to deliver the Home. If the Home will be delivered over a means of access other than a driveway, Seller will inspect the site to determine whether there is ample clearance and that the
