Home Construction Agreement Provision-Radon

RADON: Radon is a naturally occurring substance (gas) and has been shown to have adverse health effects if present in high concentration. Seller makes neither expressed nor implied warranties concerning radon levels at the Premises. Buyer is responsible for determining if radon gas tests should be performed and, if so, Buyer should be responsible for all costs involved in the testing as well as any additional costs associated with changes in construction plans in an attempt to reduce radon gas levels. Seller shall not be liable for any damages, claims, actions or other liabilities, whether direct or indirect, caused by or occurring out of elevated radon gas levels. Seller shall not be responsible for, and Buyer hereby releases Seller from, any claims, damages, costs, expenses, and/or liabilities resulting from or relating to radon gas levels.
