Terms Jurats Notarial act in which a Notary certifies having watched the signing Of a document (s) and having administered an Oath or Affirmation To which the signer declare the document to be truthful and accurate. Oath An Oath is a solemn pledge to a Supreme Being. An affirmation is also a solemn spoken Pledge, except that it does not invoke or Or refer to Supreme Being, but is "affirmed” upon one's personal honor. An Oath and affirmation are legally equivalent and place the oath taker or Affirmant under the penalties of perjury. The following statute illustrates that a Notary Public is one Of many officers authorized to administer oath and affirmations. Oath 32-1-105 The administration of an oath or proof of acknowledgement Of any instrument may be performed for use in this state with the Same effect as if performed by a notary public in this state before 1- A Justice, Judge or clerk of any court of record of the United States or territory 1- Jurat (oath) or affirmation Oath -Do you solemnly swear that you are (name of person) sign his his or her name to... Administer oaths or affirmations: The individual taking the oath or affirmation raises one's right hand while you, the notarial officer, state the words of the oath or affirmation. The oath taker then repeats these words back to you In some cases a written statement must then be signed, and the notarial officer completes the document as required. Acknowledgments Take acknowledgments: The document signer must present the document to you, the notarial officer, and acknowledge or declare (state) that he or she previously signed the document, or the the document signer can sign the document in your presence. If the document is signed in a representative capacity for example, the person is an officer of a corporation, the person must declare (state) to you that he or she signed the document with proper authority and executed it as the act of the the person or entity represented. Acknowledge acknowledge implies the disclosing of something that has been or might be concealed . admit implies reluctance to disclose, grant,or concede and refers usually to facts rather than their implications .own implies acknowledging something in close relation to oneself ..a vow implies boldly declaring, often in the face of hostility, what one might be expected to be silent about .confess may apply to an admission of a weakness, failure, omission, or guilt .
