Buyer: Please review this contract. A completed copy of the Contract will be given to the
Buyer at the time of possession of the agreed upon puppy/dog.
I do not accept deposits for my puppies. I, in no way, want anyone to
feel obligated to take one of my puppies due to a non-refundable
deposit. The choice of taking one of my puppies is because you *want*
one of my puppies, not because of monies lost.
No puppy will be shipped. The Buyer shall take physical possession of the puppy at a pre-
arranged time and site.
This contract constitutes a legally binding agreement between CYCLONE Border Collies, Karen
Herceg, herein known as the Breeder,

known as the Buyer.
The puppy/dog referred to herein is described as follows: (The Breeder will fill this block in when
a selection has been agreed upon by the Breeder and the Buyer for identification purposes).
This contract agreement facilitates the sale of one live puppy/dog, herein referred to as
"Puppy/Dog" from the Breeder, for the consideration of $900.00 to be paid to the Breeder at the
time of possession by the Buyer.
In no case shall a dog be released by the Breeder without payment in full according to this
Contract. Personal checks are not accepted, unless received by the Breeder no later than 2
weeks (14 days) before possession of puppy.
The Buyer will complete and send either via email or through the USPS a Puppy/Dog
Application. Receipt of the Application by the Breeder does not guarantee a sale offer from the
Breeder. Once the Puppy/Dog Application has been received and accepted by the Breeder from
the Buyer, the Breeder shall contact and consult with the Buyer and may make an offer to the
Buyer at the time when the puppies are about 6 (six) weeks of age. At this time, the terms of the
Puppy Contract will be discussed.
The Puppy Contract will be signed by both the Breeder and Buyer at the time of possession by
the Buyer of the puppy. The Puppy Contract will identify which puppy/dog has been selected and
accepted. The Buyer will receive a copy of the completed Contract.
NOTE: If the Buyer fails to respond within two (2) calendar days after the Breeder makes a
written selection offer to the Buyer, the said puppy/dog will then be available for placement with
other applicants. There are no guarantees that the puppy/dog will be available for placement after
the two (2) day response period.
No puppy shall leave the breeder’s residence before eight (8) weeks of age. The Breeder has
chosen to abide by the new vaccination protocols and will not have the puppies vaccinated until
they are eight (8) weeks old. A copy of the new vaccination protocol will be provided to the Buyer
upon possession of the puppy at no earlier than eight (8) weeks of age.
PART II (The Buyer will initial the indicated boxes). The Buyer certifies that he/she is 18 years
or older. The Buyer Agrees to:

copy of the examination results will be faxed or sent to the Breeder within 5 business days of the
examination date. Failure to do so will render the health guarantee null and void.
Obtain an eye examination on this puppy/dog in accordance with the CERF at the age of one
(1) year old and biannually to ten (10) years of age. The Buyer agrees to provide the reports to
the Breeder at no cost to the Breeder within 15 days of the said test. Failure to provide the
reports to the Breeder may deem this contract null and void.

register the puppy/dog in the AKC registry with the prefix name "Cyclone’s". The Buyer
agrees to register the puppy/dog under all other registries with the prefix name "Cyclone’s”. This
litter produced is to be known as “All Good Things” litter. The registered name shall so reflect a
reference in whole or in part of the litter theme. The complete registered name must be used any
time the puppy/dog is shown in competition, in any event, or referred to in any publication. The
registered name must be agreed upon by both the Breeder and Buyer, will not be changed for
any reason throughout the puppy/dog’s life, and will follow the puppy/dog throughout any

castration and the Buyer agrees that NO semen from this puppy/dog will be collected prior to
castration for later use. The Buyer agrees that the female puppy/bitch will be spayed NO
EARLIER than the age of fourteen (14) months old. The Buyer agrees that the female will NOT
be bred prior to spay. If the female becomes pregnant prior to spay, the Buyer agrees to have
the pregnancy terminated via licensed veterinary procedure. The Buyer is aware that
termination of a pregnancy may cause severe health complications to the female. A copy
of the spay/neuter vet certificate will be provided to the Breeder within fifteen (15) calendar days
of the procedure.

The Buyer certifies that he/she will be the principle owner and caregiver of the said puppy/dog
and that the said puppy/dog is NOT being purchased with the intent that the puppy/dog will be
used as a gift or present to any third party, including, but not limited to, the Buyer’s friends and
The Breeder guarantees that the puppy/dog will be free of disease for a period of ten (10)
calendar days after receipt of the live puppy/dog by the Buyer. A copy of the veterinary health
check will be supplied to the Buyer upon possession of the puppy/dog at eight (8) weeks of age.
A copy of the vaccination record will be supplied to the Buyer upon possession of the puppy/dog
after eight (8) weeks of age. If the puppy/dog is due for vaccinations, and the Buyer fails to
provide vaccinations on that day, this guarantee is null and void if the puppy contracts diseases
that would otherwise be prevented by those vaccinations. The Breeder shall not be responsible
for any medical costs incidental to the puppy/dog after the puppy/dog leaves the physical
possession of the Breeder.
The Breeder shall not be responsible for the safety of the puppy/dog while in transit to the
Buyer’s place of residence, to include any and all incurred injuries as a result of transportation
accidents or acts of negligence by another party.
The Breeder makes no guarantees or warranties other than specifically described in this
contract to include congenital, genetic or idiopathic defects or abnormalities. Every effort is made
by the Breeder to produce healthy, responsibly bred puppies/dogs (pedigrees screened as
carefully as possible for OCD, PRA, CEA, HIP DYSPLASIA, THYROID abnormalities, and
EPILEPSY). The Breeder certifies that any known defect in the dog’s pedigree will be disclosed
in writing to the Buyer prior to purchase of this puppy. If the puppy/dog presents with OCD, PRA,
CEA, HIP DYSPLASIA, THYROID Abnormalities, or EPILEPSY, the Breeder will not be held
responsible for any compensation or reimbursements to the Buyer, however, as the Breeder
stands by the Cyclone Border Collies name and reputation, the Breeder may opt to offer
compensation on an individual basis.
The Breeder asserts that the Dam and Sire were not known to have any of the aforementioned
defects prior to this breeding.
The Breeder certifies that both Dam and Sire obtained negative BRUCELLOSIS tests prior to
The Breeder shall provide to the Buyer American Kennel Club registration certificates (litter or
individual) for each puppy/dog. If the certificate has not been received from the registry at the
time of sale, the Breeder will provide the Buyer evidence that the registration has been applied
for, and upon receipt from the registry, the Breeder will forward the certificate to the respective
The puppy/dog will be registered with the American Kennel Club (AKC) with the Buyer as the
Owner and the Breeder as the Co-Owner. The Breeder/Co-Owner elects to use the AKC Limited
Registration program for puppies/dogs sold. Once the purchased puppy is spayed and/or
neutered and the Breeder/Co-Owner has received certification of spay/neuter, the Breeder/Co-
Owner will sign full ownership over to the Buyer.
The Breeder retains the right to amend the spay/neuter stipulations in this contract in the event:
1) The Buyer desires to show this puppy/dog in conformation competition.
2) The puppy/dog represents the standard as described and set forth by The Border Collie
Society of America, the parent club of the AKC, upon evaluation of the puppy/dog by the
Breeder and/or another reputable border collie breeder/exhibitor agreed upon by the
3) The puppy/dog achieves a Championship or is pointed in any AKC venue, by the age of
fourteen (14) months, provided the puppy/dog represents the standard as described and
set forth by The Border Collie Society of America, the parent club of the AKC, and upon
evaluation of the puppy/dog by the Breeder and/or another reputable border collie
breeder/exhibitor agreed upon by the Breeder.
4) The Breeder and Buyer both agree to keep the puppy/dog intact.
Changes in the contract in reference to the above items will only be approved by the Breeder
with the execution of an additional Breeder’s Contract.
The original Breeder retains FIRST OPTION purchase rights to the said puppy/dog. The Buyer
agrees that the said puppy/dog will not be destroyed, sold, given away, transferred, leased,
bequeathed, or donated to any other person or organization under any circumstances without
written consent by the original Breeder to waive FIRST OPTION purchase rights by the original
Breeder. The FIRST OPTION purchase price shall be no more than half of the original purchase
price from the original Breeder. Failure to offer FIRST OPTION purchase rights to the Breeder
violates the stipulations of this Contract and will constitute BREACH of CONTRACT, prosecutable

and may result in mandatory confiscation and return of the puppy/dog to the Breeder.
I have read and understand the stipulations of the Contract and voluntarily agree to all
elements, stipulations and provisions herein.
