                                                    PART II
                                        RULES AND REGULATIONS


1.0   PRELIMINARY

1.1   These rules and regulations (hereinafter referred to as the "House Rules") which      General
      constitute the House Rules of Danau Permai Condominium (DPC) are to promote
      the harmonious occupancy of the condominium therein, to protect all occupants from
      annoyance and nuisance caused by any improper use of the Complex thereof,
      thereby providing maximum enjoyment of the premises and its facilities.

1.2   (a)   The House Rules are formulated to serve as a guideline which govern the         Objective
            occupation and usage of the Condominium. All occupants and guests in the
            Condominium shall be bound by these rules. It is the Management's desire to
            create awareness amongst all occupants to achieve the common goal of a
            comfortable life in a peaceful environment of Condominium Living. The co-
            operation of all occupants in complying with all the rules is required.

      (b)   The full authority and responsibility for the enforcement of these Rules lies   Enforcement
            with the Management Corporation. The House Rules may only be
            amended by a referendum of the Registered Owners (refer to Section
            3.02 of Article III - By-Laws) at the annuai general meeting. Suggestions
            are welcome from all Occupants but they must be put in writing to the
            Management who reserves the right to add, alter, accept or reject any
            suggestions.

1.3   In these House Rules, unless the context otherwise requires, each of the              Definitions
      following words or expressions shall have the meaning stated against it as
      below:-

      (a)   "Occupants" includes owners, lessees, lawful servants, agents and
            licensees;

      (b)   "Proprietor" refers to person/s who owns a unit of the condominium and
            who has legal and/or beneficial title to the same;

      (c)   "Guest" refers to any persons who is not an owner-resident or lessee-
            resident and whose presence in the Complex is at the invitation of either
            an owner-resident or lessee-resident;

      (d)   "Lessee" refers to a person/s who is for the time being leasing a
            condominium unit and who is also residing therein;

      (e)   "Resident" refers to a person who is either a lessee or an owner of the
            condominium unit and who is also presently residing in DPC.

      (f)   "Managemenf' refers to the Management Corporation or MC or any
            appointed Management Company, authorized by the Management
            Corporation to enforce these rules;

      (g)   "Any other personnel" includes contractor, deliverymen, servicemen, etc;

      (h)   "Common Areas" means all areas in the Complex with the exception of
            the housing units.

      (i)   "Manager" refers to the person or body corporate appointed by
            Management Corporation to manage and administer the maintenance of
            the complex.

      (j)   "Complex" refers to the whole area within the compound of Danau Permai
            Condominium

      (k)   "Chairman" refers to the Chairman of the Management Corporation.

2.0   MANAGEMENT COUNCIL
      The Management Corporation, as provided for under the Strata Titles Act 1985,     Management
      shall elect a Council to perform the Management Corporation's duties and          Council
      conduct its business and for the purpose exercise any of the Management
      Corporation's powers and duties.

2.1   The agenda of the Annual General Meeting shall include:-
      - The election of 'not less than three and not more than fourteen'
         council members who are registered owners, to serve on the
         Management Corporation
      - In the event that there are less than the required number of persons
         nominated to stand for elections as Council members, the then existing
         council members can appoint the appropriate persons to serve as fellow
         council members or as non-executive working members of the Council.

2.2   Upon the completion of the election of the Council members, the Chairman          Sub-
      shall be entitled to appoint heads of sub-committees from the list of Council     Committees
      members. The heads of sub-committees shall have full discretion to appoint the
      members of the respective sub-committees.

      (a)   Legal sub-committee
            All legal matters howsoever arising shall be referred to the legal sub-     Legal
            committee who shall then advise the MC accordingly on such matters.         Matters

      (b)   Correspondence
            All incoming correspondence must be acknowledged by the Secretary of        Secretary
            the Council. All outgoing correspondence must be prepared by the
            Secretary and signed by the Chairman. Copies of all incoming and
            outgoing correspondence must be circulated to the Council members.

      (c)   Council members shall not be accorded any special benefits I
            privilege.
            They shall serve as members of the MC on a voluntary basis and shall
            not be entitled to any salary. However, council members shall be entitled   Spouses
            to reimbursement of any approved expenditure incurred in the discharge
            of their duties as council members.

      (d)   Not withstanding of anything in the Rules and Regulation, the spouses of
            Registered Owners are entitled to serve in and head the sub-
            committees of the Management Council. They must provide
            documentary proof of their marital relationship.

      (e)   A member of the Management Council may terminate his service by
            giving one-month notice of his intention to resign. A member of the
            Management Council will be terminated should that member not attend
            three consecutive meetings of the MC without leave or by motion of 2/3
            of the attendees of the Management Corporation's Extraordinary
            General Meeting.

            The council shall publish the cessation of any Council member's term of
            office.

2.3   All contractors shall be selected by the open tender system whereby the           Selection of

      quotations are received. The contractors are strictly prohibited from employing
      illegal workers. Workers are strictly prohibited from entering any condominium
      unit unless with written approval from the resident or the MC.

      (a)   The Management Company shall abide by the duties and obligations of         Management

3.0   PARCEL / APARTMENT UNIT

3.1   (a)    An apartment unit shall be used only for residential purposes and
             shall not be used for business or any other purpose illegal or
             otherwise which may be injurious to the reputation and/or safety of
             the Complex.                                                                    Residential

      (b)    A shop unit shall be used only for approved commercial uses as                  only
             stipulated in the Sale and Purchase Agreement with the original
             proprietor (Developer) or any other uses as the Management deems
             fit.

      (c)    The Owner shall submit to the Manager his current mailing address
             and contact telephone number and all other relevant information
             which the Manager shall require from time to time.

3.2   (a)    Guests invitees of the Residents would only be permitted into the
             Complex after the security guard has confirmed with the Occupants
             the identity of such guests. All guests of Residents would be required
             to provide their personal particulars to the security guards before             Resident’s
             being permitted entry into the Complex and/or apartment units. The              Guests
             security guards shall have the right to insist that the identity card or
             other personal card or personal identification card, be deposited
             at the guard house or recorded by the guard before any guest(s),
             visitor(s), workmen or maids or drivers are permitted entry into
             the complex.

      (b)    Residents must inform the security guards of their likely guests by
             furnishing relevant details beforehand.

      (c)    The Residents shall be responsible for ensuring that their
             guests/invitees comply with the House Rules at all times and that
             their behaviour is not offensive and/or a nuisance and shall be
             liable for any damage caused by their guests/invitees.

3.3   The owner must notify the Management in the event he lets out the
      Notification Apartment. The Owner shall furnish the Management with                    Notification
      such details, including but limited to name of the tenants, term of                    regarding
      tenancy, tenant’s vehicle number, nationality, copy of identification                  letting out
      cards, etc. regarding of the letting out as the Management may require
      from time to time.

3.4   Nothing shall be allowed, done or kept in the Apartment or Common Area                 Floor
      Floor which may overload or impair the floors, walls or roofs thereof or               loading
      cause a loading increase in insurance premium rates or the cancellation,
      invalidation or non-renewal of existing insurance policies.

3.5   No livestock, pets or other animal whatsoever shall be allowed or kept in any
      part of the Complex except for fishes and small birds. The Management                  Household
      reserves the right to remove any pets found within the Complex at the                  Pets
      owner's expense. (The Local Government Act. 1976 – Law Section 8(2)
      amended effective 23/6/2001 or as may be amended from time to time). The
      Management shall at its discretion report such violation to the governing Authority.

3.6   (a)    All Occupants shall at all times conduct themselves in a manner                 Nuisance
             which will not cause any annoyance to other persons. Excessive
             noise, unruly or offensive behaviour is not permitted.

      (b)    Radio, T. V, hi-fi or other musical instruments shall be operated at a
             volume so as not to interfere with the peaceful enjoyment of other
             occupants.

      (c)    All Occupants are requested not to sound their car horn unnecessarily
             so as not to cause disturbance or annoyance to other residents in the
             neighbourhood.

       (d)    Indoor games such as "Mahjong" shall be restricted within a private
              apartment only. Players shall lay sufficient cushioning on the table so
              as to ensure that no excessive noise will be emitted.

       (e)    A thick folded kitchen towel must be put under a mortar ("Iesung")
              before pounding chillies etc. to lessen noise.

3.7    (a)    No awnings, shades, screens, venetian blinds, window grilles, door grilles
              and lanai grilles shall be erected without the written approval of the                 Renovation
              Management and subject further to their Architect's design (Management).

       (b)    Repair can be done to the internal walls only and subject to the prior written
              approval of the Management Corporation. No structural renovation changes
              to the Apartment are allowed. (See rule 5.0 for details).

3.8    No radio or television antenna shall be attached to or hung from the exterior of
       walls or be allowed to protrude through wall, windows, lanais or roofs.                       Antennae

3.9    An Occupant shall not make any immoral, improper, offensive or unlawful use of                Immoral or

3.10   Plants shall be maintained in a manner that will not create a nuisance to other
       occupants. All potted plants shall be placed in containers so as to prevent the dripping of   Plants and

3.11   Brooms, mops, cartons, notices, advertisements, posters, illumination or other means of
       visual communication shall not be placed on lanais, windows, doors or passages so as          Advertisement

3.12   Textile items such as clothes, towels and linen shall not be hung or placed in any area
       so as to be viewed from the outside of the Premises. In particular such textile item shall    Hanging of

3.13   (a)    Private parties of functions are limited to the designated function room (if
              reserved) or within a private apartment.                                               Parties and

3.14   (a)    Owners who are not residents in Malaysia shall appoint a local agent to
              represent their interests. Such Owners shall file the names, addresses and

       (b)    The absent Owner should, at his own expense, have an authorized agent or
              representative registered with the Management to conduct periodic inspections
              of his apartment and assume responsibility for the contents therein.

       (c)    The Management Corporation must be notified of the appointment of any
              Estate Agent by the Owner. All Estate Agents must be always
              accompanied by the security guards.

3.15   Once a condominium unit is leased out, the entitlement to the use of the Common Areas         Entitlement
       and the facilities is automatically transferred to the lessee and the Owner/lessor is no      Use of

3.16   (a)    No Occupant of the Complex is allowed to use any employee of the                       Use of

              maintenance staff of DPC condominium are not authorized or allowed to accept
              delivery of packages, parcels etc. or perform any kind of private work for any
              Occupant unless on orders of the Manager.

       (b)    No tips, gifts, or gratuities are to be offered to any employee of the Management.

3.17   No soliciting of goods and services or conducting religious or political                      Solicitation

3.18   Highly combustible substances such as petroleum products must not be kept           Limitation of

       details of new directors be not updated, the Management shall hold the
       original directors liable for any breaches of the House Rules.

       In the case of any change of ownership of any unit, the Owner shall be              Change of

       Failure to notify the MC of any change in the proprietorship of his parcel or any
       other dealings with his parcel for entry to the Strata Rolls monitored by the
       Corporation as required under By-law 5 for the Regulations of sub divided
       buildings as provided under Section 44 and 62 (Strata Titles Act 1985) shall be
       liable to a penalty of RM1,000.00.

3.20   All residents must apply for Access Card by submitting relevant particulars and     Access
       documents as required by the MC for a nominal fee. Each unit is limited to six      Card
       (6) passes (in accordance with DBKL requirements). This pass will serve as
       identification and must be produced upon request.


4.0    COMMON AREAS

4.1    The sidewalks, passages, lobbies, stairways and common corridors must not           Obstruction

4.8    (a)   There shall be no posting of advertisements, circulars or notices, etc. at   Notices etc.

             approved notices may be posted on the notice board provided.

       (b)   Residents are not permitted to affix or paint on any doors and windows
             of the housing unit or on any external part of the building or any part of
             the common entrances, passages, staircase landings, any trade,
             professional or business advertisement or notices.

4.9    The management shall be informed by the owner (by letter authorizing the
       Resident) at least 24 hours in advance of any moving in or out of the unit
       concerned, providing details of transport vehicles and workmen to assist the       Shifting
       security personnel to coordinate the moving, failing which the security guards     In/Out
       shall prevent access/exit as the case may be. The Occupant shall ensure that
       the Common Property is not damaged in the course of such moving.

4.10   (a)   No person shall wear a wet bathing suit, or drink or eat in any lift.
             Bicycles and any motorized form of transport (other than wheel chairs)       Lifts

             ingress

       (b)   Smoking in the lifts is strictly prohibited. Offenders shall be charged
             RM50.

       (c)   No person shall tamper with any of the lift controls in a manner so as
             prevent the proper functioning of the lifts.

       (d)   In the event of power failure or fire or other emergencies, Occupants
             must not use the lifts but should use stairways to vacate the Complex.

       (e)   Occupants must inform the Management of any shifting of furniture or
             heavy or bulky items which require using the lifts at least 24 hours in
             advance so that proper arrangements can be made to avoid causing
             any inconvenience to other Occupants. Residents shall be responsible
             for any damage to the lifts.

       (f)   Residents and their guests are strictly prohibited from committing
             mischief (as defined by section 425 of the Penal Code) or vandalism
             inside the lifts and the Management shall not hesitate to publish the
             photographs and names of such offenders on the Management's Notice
             Board.

4.11   (a)   Private parties or functions are limited to the Hall/BBQ Pit, designated     Parties and

             by reservation with the Management Office.

       (c)   The charges for the use of the Community Hall/BBQ Pit area: please           Rate Charges

       (d)   Residents or Owners intending to hold parties or social gatherings in
             their units are requested to inform the Manager.

       (e)   The Proprietors/occupants are strictly prohibited from organizing or
             having any private parties, meetings or gatherings or whatever nature in
             the complex except within their own condominiums unless prior written
             consent has been obtained from the Management Corporation.

4.12   Care should be taken when cleaning areas adjoining the external walls so as        External

5.0   RENOVATION. DELIVERY AND REMOVAL

5.1   Owners or lessees who intend to carry out renovation work are required to          Application

5.2   Maintenance and or renovation works delivery and removal of household items        Working

5.3   Installation of grilles at window, doors and sliding doors are permitted.          Installation

5.4   (a)   Air-Conditioner compressors should be placed at the yards and pipes          Installation

            not allowed through the gutters. Occupants installing such piping shall

      (b)   Such offenders shall be given an initial warning which shall be followed
            by a penalty of RM100.ln the event that such offending piping is not
            removed within 3 months of the initial warning mentioned herein before,
            the Management shall proceed to remove the said piping and impose a
            further penalty of RM100.

5.5   (a)   Minor Renovation includes woodwork, telephone and electrical wiring,         Category of

      (b)   Major renovation includes tiling and ceiling work, hacking work, change
            of floor plan orientation etc.

5.6   (a)   A deposit in the form of a cheque is required before the renovation          Renovation

            management office and use of common facilities etc. after all the
            works are completed and certified by the management:

            (i)    A refundable deposit of RM 1,000.00 for minor renovation.

            (ii)   A refundable deposit of RM 3,000.00 for major renovation.
                   Refundable after 3 months from completion.

      (b)   Such a deposit is to ensure that all unwanted material, debris, etc. are
            not left in the corridors, lift lobbies, fire escape staircase and that no
            part of the Complex is damaged. In the event that the clean-up costs
            and damages exceed the deposit, the Occupant responsible shall be
            charged the additional amount.

5.7   The refund of the deposit shall be made upon written confirmation by the           Refund of

5.8    All delivery, removal, renovation and maintenance works must be reported           Security

5.9    All contractors must report at the security check-point to obtain identification   Identification

5.10   All occupants/contractors are NOT allowed to tap water/electricity supply          Water and

       Management in enforcing the House Rules and the prosecution of such

       Residents are allowed to get some water should there be no incoming water
       supply in their units due to low pressure.

5.11   Packing and crating materials must be removed by the occupants and their           Packing And

5.12   All maintenance and or renovation works should be confined to the limits of        Renovation

       works are carried out according to existing rules and regulations of the

5.13   (a)   Owner/lessee shall be responsible for the conduct and behaviour of           Conduct And

             replaced or repaired at the expense of the owner/lessee concerned.
             The Management reserves the right to expel from the Condominium
             any contractor found misbehaving.

       (b)   No contractor or unauthorized persons are to be found in any part of
             the building except specified unit(s). If caught, the concerned will be
             barred from entering the building in the future.

       (c)   All owners' contractors must ensure that their workmen do not litter,
             deface or damage any parts of the Condominium.

       (d)   All workmen employed by the owner's contractor must be properly
             attired and confine themselves to the areas in which they are working.

       (e)   The owner's contractors shall ensure that his workmen do not cause
             nuisance, smell, noise vibrations or inconvenience to other occupants of
             the Condominium.

       (f)   Owners/residents shall ensure that their contractors check and clean all
             common areas daily where easement has been granted to facilitate their
             work.

       (g)   All excess construction material, debris, etc, must be removed and
             carted away by the occupant/appointed contractor to the dumping
             ground approved by authorities. These excess materials and debris are
             NOT ALLOWED to be left in the refuse rooms or any part of the
             complex.

5.14   The workmen are allowed to unload their materials, and equipment at areas              Building
       designated by the management. All building materials including sand, cement,           Materials

       apartment.


6.0    REFUSE DISPOSAL

6.1    No rubbish, rags, or other refuse shall be thrown or permitted to be thrown            General
       through the doors or windows of the premises except into the refuse bins
       provided in or outside the Complex. Offenders shall be reported to the
       Management. In the event that such offences are committed by the domestic

7.0    CAR PARK

       (c)    Any loss of proximity card must be reported in writing immediately and a
              police report made. A new proximity card would be issued at a penalty fee of

       (d)    Any illegally parked vehicle will be clamped and a penalty charge of

              Owner/Resident shall have to pay a penalty of RM 100 for the return of the
              proximity card.

8.0    RECREATIONAL FACILITIES – GENERAL RULES

8.1    The residents shall be entitled to use the recreational facilities and such        Use of

10.4   The Management Corporation shall have the right to install concealed             Security-

10.6   (a)   In cases where the service/maintenance charges are in arrears of 1         Defaulters

             Corporation's written reminder referred to earlier and the cost of
             issuing such a LOD shall be borne by the Owner concerned.

       (b)   In the event that the maintenance charges are still outstanding 7
             days after the issuance of the LOD, the Management Corporation
             shall discontinue services to the unit in question and also deactivate
             the access and proximity card of the defaulting Occupant and take all
             necessary action to prevent the owner or lessee resident from
             enjoying the facilities of the common areas.

       (c)   In the event that the maintenance charges are still outstanding, the
             Management Corporation shall proceed to recover sums due as
             provided under Section 53 & 53A of the Strata Title Act 1985 and the
             cost of the legal proceedings shall be borne by the defaulter. The
             Management Corporation shall continue to proceed with legal action
             against defaulters once the LOD is issued regardless of part-payment
             made by the defaulters.

       (d)   All defaulters shall lose their right to attend the Management
             corporation meetings and to propose any suggestions for the agenda of
             such meetings.

       (e)   The Management Corporation shall have the right to publish the names
             of all defaulters in any location or publication that the Management
             Corporation deems fit.

10.7   (a)   The Security guards have the authority to eject from the Complex any       Security

       (b)   The Security guards are obliged to report all cases of violence and
             breaches of the Penal Code to the police.

       (c)   The Security guards are authorised to deny entry to any vehicle without
             a valid access card without the need to give any reason to the driver of

       (d)   All guests must be registered at the guardhouse prior to seeking entry
             to the Complex. The security guards are authorised to deny entry to
             any guests who are not registered at the guardhouse.

       (e)   The Management Corporation shall prosecute any persons exercising
             violence against the Security guards under the Penal Code and under
             civil law.

       (f)   The security guards shall not have right of access to any floor of the
             Complex without the approval of the Management Corporation.

       (g)   The security guards are to strictly adhere to their job scope and any
             additional duties assigned to them by the Management Corporation
             from time to time.

       (h)   In cases of emergency, the security guards are to take instructions
              from the Management Corporation.

       (i)   All trespassers shall be prosecuted by the Management Corporation.

10.8   All Operators with businesses in the Complex shall be bound by their                 Operators

       by the House Rules. Breach of the House Rules by the Operator/s shall result
       in the termination of their contract with the Management Corporation in which

11.0   RULES AND REGULATIONS GOVERNING THE USE OF THE SWIMMING
       POOL AND JACUZZI

11.1   The swimming pool may be used only from 7.00am to 10.00pm and only                   Time
