The present agreement shall enter into force on the date signed.

1. General
DBI product certification is based on the regulations applying to the product concerned and
procedures RL 100 and RL 200 describing the certification process and the relevant criteria.

The object of product certification is to document that the customer’s product conforms
with the applicable regulations and standards.

The customer receives:
    A certificate of conformity prepared by the DBI provided satisfactory conformity with
       the relevant product standard can be documented.
    An invoice for Procedures of certification.

2. Basis for the issue of a certificate of conformity

Together with the present agreement, the test documentation, other technical documentation (as
specified in Guideline 003) and applicable regulations and standards, the application submitted
by the customer constitutes the overall basis for the issue of a certificate of conformity.

Besides the standards mentioned in annexes 1 and 2, the certification documentation consists of:

      Guideline 003: Automatic fire prevention facilities – Certification of systems and system
       components for automatic fire prevention systems.
      Regulation 232, The testing part.

3. Procedures of certification

System and product certification is performed by inspecting and assessing test documentation
and the other technical documentation, cf. Guideline 003.

Inspection is carried out by DBI’s certification personnel.

4. Issue of a certificate of conformity

A certificate of conformity will be issued for each system and/or system component provided the
system/system component conforms with the documentation.

System components/products which are certified for conformity with a non-harmonised standard
are issued with a DBI certificate (national certificate).
If there are non-compliances with the product standard requirements, DBI cannot issue a
certificate unless the non-compliance is acceptable to the DBI. In such cases the non-compliance
must be specified on the certificate and any limitations or conditions for use of the product must
be described.

System components/products which are certified for conformity with a harmonised standard are
issued with an EC certificate (CPD certificate).
An EC certificate cannot be issued if non-compliances with the product standard requirements
are found.

One copy of the certificate is sent to the customer.

4.a Maintaining the certificate of conformity

There is no annual product follow-up for system components and products, which have been
certified by DBI for conformity with a non-harmonised standard.
However, where continuous use of the DBI-logo has bee granted on certified products, periodic
evaluation of the marked products conformity with certification standards is required.
DBI must be advised of any changes to the product or its specifications which may affect the
conformity of the product, and must re-evaluate the impact of these changes.


In the case of system components and products which are certified by the DBI for conformity
with a harmonised standard, the DBI must visit the production site to inspect production and
audit the quality control system at the production site. Normally this is done once a year unless
otherwise stated in the harmonised standard.

5. Obligations

DBI shall undertake to:
- Issue certificates of conformity in accordance with the DBI quality handbook and the
   accreditation issued by DANAK
- To treat all information and disclosures concerning the customer in confidence and to store
   this information in an adequate manner
- To obtain the applicant’s consent if work related to certification is performed by third parties
- To inform certification holders in writing of any changes in the certification basis of
   importance to them, such as the introduction of new standards, regulations, procedures etc,
   transition rules etc and the consequences of these
- To inform certificate holders in writing of changes in DBI’s accreditation status and the
   consequences of such, including, upon being ordered to do so by the accreditation body,
   informing the certificate holder of the recall of already issued, accredited certificates.

The customer shall undertake to:
- Appoint a qualified contact person who will assist in the performance of the product
   certification process
- To comply with the relevant stipulations of the certification scheme
- To take all the necessary measures for the implementation of assessment, including providing
   opportunities for the inspection of documentation and access to records, personnel and other
   areas with a view to inspection, monitoring and evaluation if deemed necessary by the DBI or
   the requirements of the harmonised standard
- To give all the information necessary for the assessment of the products to be certified
- To send written permission to use the test documentation and other technical documentation
   provided this is not the property of the customer
- To use systems/system components in accordance with the certificate
- Not to make changes to the certified product without the prior consent of the Danish Institute
   of Fire and Security Technology
- To inform the DBI of all changes of significance to certification, including changes to the test
   documentation upon which the issue of certification is based, to the manufacture of the
   product, its specifications or, for CPD-certified products, changes to the quality system
- Not to use product certification in a way that would bring the DBI into disrepute
- Not to produce declarations about certification which the DBI might regard as misleading or
   unauthorised
- To comply with the DBI’s requirements when referring to product certification in the media,
   e.g. in documents, brochures or advertisements
- Only to make declarations about certification within the area for which certification has been
   granted
- Only to use certification to show that the certified products conform to the specified stan-
   dards
- To stop using advertising materials referring to certification should certification be suspended,
   discontinued or withdrawn
- To return all certification documents upon suspension or withdrawal of certification if so re-
   quired by the DBI
- In the event of the customer wishing an extension, to apply in writing for a new certificate to
   be issued at the latest three months before the expiry of the certification period. A list of
   complaints received during the period of validity and a list of the certificate holder’s remedial
   measures must be attached to the application. The certificate can only be renewed if there
   have not been changes in the certification system without the simultaneous adaptation of the
   product

-   To record all complaints and remedial measures relating to product conformity with the
    certification documentation and upon request make these records available to the DBI
-   If production inspection is included in the agreement to document that such inspection is
    performed in accordance with the requirements of Guideline 003
-   Only to use DBI’s logo if this has been agreed with the DBI in each individual case and only
    to use this together with the certificate holder’s own logo and name. DBI´s logo may not be
    more prominent than these
-   To comply with the stipulations in Technical Regulation no 1 (DANAK) with regard to the use
    of the DANAK logo.

6. Liability

The DBI cannot be held liable for damages which are not entitled to cover by the DBI’s
professional indemnity insurance.

At the request of the customer, the DBI is responsible for ensuring that all materials, descriptions,
reports and drawings are sent to the customer upon expiry of the present agreement, in that the
DBI must at all times comply with the rules applying to storage.
Requests must be submitted in writing at the latest together with notice to terminate the
agreement.
If such a request is not submitted, the DBI will shred the material when its obligations relating to
DBI accreditation have been fully complied with.

The customer shall be responsible for ensuring that information which is not described in the
documentation is notified in writing to the DBI to the extent this may influence product
certification, just as the responsibility for test documentation and other technical documentation
also rests with the customer.

7. Fees

The fee established upon entering the agreement is DKK 1250.00 ex VAT per hour consumed
(2009 prices).
The fee will be collected upon the sending of the certificate of conformity, but the DBI will issue
current invoices every third month. Case handling fees shall be due regardless of whether the
product obtains certification or not.

Production inspection fees will be charged per inspection visit according to the time spent on the
inspection visit and other case handling as well as the DBI’s travel and meals costs.

An annual fee of DKK 7100,00 ex VAT (2009 prices) shall be payable for certificates of conformity
for systems.

Fees shall be index regulated as follows:
- General indexation as a consequence of changes in of the price index will be specified in the
invoice submitted.
- Other price rises will be announced separately.

8. Payment terms

30 days net. After the due date, invoices will be subject to penalty interest of 5% p.a. over the
discount rate.

9. Termination of the agreement

The agreement is binding for one year from the date of its entering into force.
Subsequently, either party may terminate the agreement in writing at three months’ notice.
However, amounts claimed will not be credited, and thus the customer is not released from
payment.

10. Disputes

Appeals, complaints and disputes brought against the DBI as certification body will be processed
in accordance with procedures in the DBI quality handbook.

11. Insurance

The DBI's professional indemnity insurance covers any liability for damages to which the DBI
might become subject during the performance of the institute’s business, providing such claims
for damages are brought and notification about them is given to the DBI within the term of the
agreement.

12. Miscellaneous

ABR 89 with subsequent amendments applies to sales and delivery terms and conditions besides
the present agreement.
To be valid all agreements must be drawn up in writing.
The DBI takes no responsibility for the materials submitted if these are used for purposes other
than those stated or if used by third parties besides the customer. Transcript of materials or
transfer of the content to other documents releases the DBI from responsibility for the contents
of the materials.

The customer may not make incorrect references to the certification scheme or make other
misleading use of the certificate and infringe limitations on use which may be contained in the
certificate. The DBI is bound to take appropriate measures in case of misuse.

The customer is bound to accept that DANAK may participate in the performance of the task solely
for the purposes of inspecting the work of the DBI. This will involve no extra cost for the customer.

If during the certification period legal requirements arise resulting in changes to the product, e.g.
through changes in standard wordings, the certificate will be withdrawn in accordance with the
legal requirements.

With his signature the customer confirms the present agreement on the implementation of the
certification procedure for all of the products mentioned in the above form with a view to
certification in accordance with the abovementioned standard(s). The agreement includes the
submission to the DBI of test reports and technical product documentation, including datasheets,
manuals, composite drawings, parts lists and other documentation needed for the secure
identification of the certified product.
The applicant also agrees to comply with the certification requirements as specified in Guideline
003 "Certification of systems and system components".
