The County of Mercer is conducting a voluntary Cooperative Contract Purchasing System.
Sealed bids which will be received by the Purchasing Agent acting as Lead Agent on behalf of
all contracting units located within the geographic boundaries of Mercer County.

Notice is hereby given that on May 14, 2008 at 11:00 AM (Prevailing time), sealed bids will be
opened and read in public by the Purchasing Agent in the Mercer County McDade

INTENT
The County of Mercer requests bids for 2009 or newer International Dump or
Equivalent. The awarded vendor must provide the manufacturer’s warranty. The County
requests the bid price for one (1) year or until the model is no longer available.
Additional units of the equipment referenced in the bid specification may be purchased
pending availability of funding. The County reserves the right to purchase up to seven
(7) units of model #7400 SFA-4X2 and four (4) units of model #7600 SFA-6X2.

It is the intent of this specification to describe and govern the purchase and installation
of an International Chassis 2009 Model Year or Newer (Or Equivalent) together with
other associated equipment as described herein. The manufacturer, make, exact model
and literature shall be submitted with bidder’s proposal. The following specifications
describe our minimum requirements for the quality and type of equipment to be
furnished. Bidder may offer equipment which exceeds these requirements. All
references to brand name shall be interpreted as brand or equivalent. Bids which fail to
meet these requirements will be considered non-responsive to our needs.

The unit shall be new and of the latest design and be in current production at the time of
the submission of the bid. The chassis manufacturer, whose equipment or products are
bid, shall have a factory authorized service warranty and parts distribution facility
located within approximately a 20 mile radius of the using agency. All chassis bids must
be offered by an authorized truck dealer for warranty, parts and service. All
subcontractors installing equipment for components must also be an authorized
stocking distributor of that equipment for the purpose of warranty, parts and service.

CHASSIS CAB SPECIFICATIONS: International Model #7400 SFA-4 x 2 (or an
equivalent) 2-Man Cab. Chassis Factory built with a one piece roof.

All standard and optional equipment listed shall be Original Equipment Manufacturer’s
(OEM) items, when available.

SERVICE MANUALS:
A complete set of service, parts and wiring diagrams shall be supplied with total order in
paper form. One (1) owner’s manual shall be included. CD Rom format only.

DELIVERY:
The units shall receive all pre-delivery preparation at successful vendor’s facility, prior
to final delivery to the County. The successful vendor shall be responsible for final
deliveries to the County.      Vehicle will be licensed to the County of Mercer with
registration and tags included. The title will state “COUNTY OF MERCER.”

PARTS & SUPPLIES:
The successful bidder shall supply a list of recommended parts and supplies which the
County should stock at a Central Warehouse. The list shall be prepared for the first
through eight years of operation. The list shall include part number, quantity,
description, price and possible source of supply.                       ___ ___

DEALER NETWORK:
The successful bidder shall supply a list of authorized service facilities
for heavy-duty trucks which are near the County maintenance facility.        ___   ___

WARRANTIES:
All units delivered must be guaranteed to be free from defects in materials, design and
workmanship for chassis: 2 years/unlimited miles from date of final delivery, excluding
normal wear items. Seven (7) years 75,000 miles or 2700 hours on engine and engine
electronics. (Example-injectors, control system, internally lubricated parts, fuel
Transfer pump, turbo charger, water pump and wiring) 100% parts and labor.
Transmission to have a 5 year 100% parts and labor warranty unlimited miles , year
rust thru warranty on the cab. Towing for 5 years 100,000 miles. Frame rails
have to have a 7 year warranty.                                                ___ ___

Switch Pack:
(6) Six factory installed switches must be installed in the dash One power module with 6
channels 20 amp max per channel, 80 amp max Output. The switches must control the
power module through multiplex Wiring. Power module to be mounted at the battery

Two way radio package: Must be chassis factory wired in header storage area for the
later installation of a 2-way radio. Must include antennas mounted on mirrors.

A (2) Two radio system is to be fully installed in the vehicle Kenwood model TK762GK
or equivalent. VHF 25-watt. Radio must include an antenna and be fully compatible with
current fleet radios. Radio installer must utilize the chassis factory power wire provided

Trailer Brakes: Truck must be equipped with both electric and air Trailer brake
capability. Gladhands must be supplied at the pintle plate, As well as tractor protection

The dump body shall be a heavy-duty cross-memberless contractor body for use on a
single axle chassis. The hoist shall be an arm type design. The complete body, hoist,
and cylinder package must be supplied by a single manufacturer and be a proven
standard production model. Literature must be supplied for the body and hoist with the
bid proposal.

2. All exposed side bends to be 1” radius.

3. Top rail to be a fully enclosed dirt shedding section measuring 4-5/8”
   wide by 8-3/8” tall, with top and outer sides utilizing large radius bends
   to form a dirt shedding design for maximum strength and safety.

4. Sides shall have one full-length self-cleaning horizontal side brace with
   a minimum 4-1/2” front face with 1 ½” exposed radiuses extending 3-1/4”
   in depth to a 9” flared back.

5. Heavy duty front corner posts to be a minimum of 3-7/8” deep with the
   front edge parallel to the front head sheet and the rear edge sloped to
   match side bracing.

shall also have 2 handles which allows the operator a means of removing the lid. It also
shall have, one each side, rubber pull-down straps to secure the lid while in transit. The
box must be built of a minimum of 10 gauge material, fully welded, double lapped at the
rear for strength where it is welded to the frame. Must be able to remove lid without
removing ladder.

All valving in the entire circuit shall be in the control component box. There can be no
outside valves on the frame rails or between the components. Everything must be
contained in the one box and mounted to the frame by 4 bolts to facilitate easy removal.


UNIVERSAL SHAFT WITH A COVER: The engine crankshaft to be connected
to the pump by a universal splined slip-shaft with adjustment or slip of 2” (5.1cm) to
allow easy removal of engine fan belt. Universal shaft to have standard S.A.E. flange u-
joint connection compatible with engine crankshaft connection is to be disconnected
when fan belt is change. The other end of universal shaft to be connected to pump
input shaft. The drive and driven units must be parallel to one another within plus or
minus 1 degree and slip joint at center of travel. The joint operating angle to be within
3 to 5 degrees. Must not exceed 5 degrees, grease fitting to be clearly marked and
readily accessible, is not permanently lubricated type. Protective removable 10 gauge
(3.5mm) sheet metal cover to be installed over universal shaft if shaft
 extends beyond radiator (grill).


CLOSE COUPLED PUMP: The hydraulic pump is to be close coupled and mounted
behind the front bumper. Distance from front of truck to back of the pump must not
exceed 16”. The plow bumper angle must be an integral part of the bumper mounting
brackets and bumper. Bumper angle must be tied back to chassis frame.

NOTE: Truck chassis is to have a special heavy duty front bumper. The bumper is to
be standard factory bumper modified to fit plow hitch and tapered to the chassis
contour. Steps under front bumper.

HYDRAULIC TANK: The hydraulic left hand frame mount tank shall be a minimum of
30 gallons made of 10 gauge material with baffles. It shall contain a minimum of 8” x 8”
cleanout cover on the top, a breather type vent, a filler neck with a 3 micron screen, and
turn-lock type cap. Internally in the tank shall be a 100 micron suction strainer with a 2”
suction port. The porting to the pump must be a minimum of 2” piping, non-galvanized
and be secured by hycon clamps (NO EXCEPTIONS). The circuitry returning must
come through a minimum of a 50 gallon flow rate filter, 1300 square inches of filtration
area, minimum 1 ¼” piping. The hosing returning all oil must come through 1 ¼”piping
minimum. The filter must also contain a 25 lb. bypass condition indicator, and a bypass
mounted internally in the filter. There also must be a ¼ turn valve mounted on the
suction side of the tank piping. On the side of the tank, shall be a fluid level gauge
combination high/low mark, plus temperature of IL. Hydraulic tank is to be mounted
behind cab. Where hoses are used in lieu of piping and hycon clamps, the hoses must
be secured by heavy-duty clamps and routed in such a manner that they do not
interfere or come close to heat and where they can be damaged by chafing, etc.
Hoses, where applicable, must be wrapped with a heavy-duty vinyl spiral wrap. Final
determination of hose routing and piping shall be at the discretion of the county.

HOSES: All hoses terminating to hydraulic cylinder and or hydraulic motors
are to be NPT to JIC. All hoses connecting to the pump shall be 2-braided for extra
strength on the pressure side; steel tubing with hycon clamps is to be supplied running
from front to rear underneath truck on both pressure and suction side. The return shall
be a joint return through a ¾” line terminating in a 1” return hose back to tank circuit.
One hose shall go from the box to this filer to eliminate the excess hosing or wear factor

MAIN CONTROL VALVE ASSEMBLY: To be electric over hydraulic, mounted in box,
solenoid operated in lieu of manual valve. Provide standard spreader control valve in

BODY LIFT CIRCUIT: Section will direct flow to double acting body hoist cylinder. In
the dump body circuit, there must be a second fixed relief pre-set at a 500 lb. limit. It
must be installed inside the valve body; outside frame rail mount will not be acceptable.
This valve is to protect the hoist cylinder against static intensification.

PLOW LIFT CIRCUIT: Valve will direct flow to a double acting 4” x 10” lift cylinder.
There shall be a pilot operated check valve mounted to the lift cylinder. Also in this
circuit shall be a restriction to eliminate the slamming down of the plow. This must be
installed internally external restriction will not be allowed.

SPREADER HYDRAULICS: Valve for solenoid operated on/off and reverse shall
operate electrically from dash mounted controls. All other controls are to be mounted in
the sealed box. Spinner and conveyor speed shall be full adjustable.

The custom truck attachment shall consist of a minimum ½” side plates reinforced and
bolted as far back on the truck frame as feasible. The vertical risers shall be a minimum
of 4” x 3” x ½” angle. The horizontal member to which the base of the lift cylinder pins
shall be a minimum 4” x 4” x ½” angle boxed in with a ¼” x 4” bar. The pump mounting
bracket shall be a minimum of 6” x 4” x ½” angle with ½” angle with ½” plate gussets on

heights (12” and 15”) on 21” hole centers for connection of the plow to the hitch. The
bottom of the hitch behind the connecting points (for the plow) shall be adequately

forward.

NOTE: The entire assembly shall be designed to allow ample rising, lowering and

Lower         12 degrees for blade wear and road surface irregularities.

Oscillation   15 degrees total, to lift heel of plow during
              transport and conform to road service irregularities.

Permissible Misalignment in Hitching: Loop at rear of plow can be high or low through a
range of six (6) inches. Truck can be right or left of center through a range of seven (7)
inches. The plow hoist cylinder must be 4” double acting.

MOLDBOARD: The moldboard shall be a minimum 29” high inside at the nose end
and 51” high inside at the discharge end. It shall clear a path of 9’3” at an angle of 35
degrees. The minimum acceptable weight of this plow shall be 1660 pounds.


The moldboard shall be brake formed to a series of panels from 8 gauge hot rolled
sheet and shall incorporate a formed channel at the top for added rigidity. Six (6) 3/8”
vertical ribs and a 3/8” nose plate shall be welded to the back of the moldboard and to
the bottom cutting edge reinforcement.

CUTTING EDGE: Shall be of abrasion resistant steel, C-1085 or equivalent. It shall not

punched centers. It shall be reversible for double wear. A replaceable nose piece shall

edge.

MOLDBOARD SHOES: (Qty – 2) shall be from abrasion resistant steel (minimum
Brinell of 360) and located at the right and left hand extremities of the rear of the cutting
edge reinforcement.

CUTTING EDGE REINFORCEMENT: Shall not be less than
6” x 4” x ¾” steel angle with ½” plate gussets welded to framework.

TRIP MECHANISM: Shall be of the enclosed canister design. The canister shall be
30-1/4” long and 6” in diameter. Enclosed within the canister shall be two (2)
compression springs, 26” long, made from alloy spring wire. One spring shall be 5-3/8”
O.D. x 3-7/8” I.D. and the other spring shall be 3-3/8” O.D. x 2-1/8” I.D. The main trip
rod shall be made from 1-3/8” cold rolled steel, 27-1/4” long with a yoke threaded to one
end for attaching to the moldboard. A recoil spring shall be placed on the trip rod
between the yoke and canister housing. The canister shall pivot on two (2) 1-1/4”
journals. Two (2) trunnion plates of ½” plate shall carry the canister and in turn be
bolted to the driveframe in such a manner as to be movable for cutting edge adjustment.

TUBULAR DRIVEFRAME: The driveframe shall be designed in such a way that it is an
integral bolt-on part of the moldboard, thereby enhancing overall structural integrity of
the complete snowplow. The driveframe shall incorporate a main drive member from 4”
x 3” x ¼” wall rectangular structural tubing, which by bolting to the vertical ribs at the
moldboard assembly also serves as the lower reinforcing member of the moldboard.
Two (2) lateral members from 4” x 3” x ¼” wall rectangular structural tubing shall weld to
and extend rearward from the main drive member to a ¾” x 6” wide rear bearing plate,
which shall serve as the mounting surface for an oscillating drive bar. Additional
reinforcement members shall consist of two (2) truss members, a main driveframe
angle, pivot frame and oscillating drive bar. The truss members shall be from 4” x 3” x
3/8” angle, and the main drive angle shall be from 6” x 4” x ½” angle. Two (2) additional
pieces of 4” x 3” x ½” angle shall be electrically welded perpendicularto the maindrive
angle connecting with the truss members so to form a rigid structure. Three (3) hinge
points of ½” plate shall be provided for pinning the moldboard to the driveframe, over an
80” span. Three (3) 1-1/4” pins shall pin the moldboard t the driveframe. A locking
plate cut from ½” steelplate with seven (7) locking positions shall be welded to the two
(2) truss members.

HARDWARE PLATING: All nuts, bolts and chain shall be zinc plated.

PAINT: All snowplow components shall be shot blasted and painted with
one (1) coat of primer and one (1) coat of finish paint.


SCREW ADJUSTABLE WHEELS: Two (2) 10” diameter wheels made from abrasion

GENERAL:
This under-tailgate spreader shall be of the bottom opening design. The entire unit will
rigidly mount to the sides of the dump body & below the floor level of the dump box with
single pin quick detachable hardware. This mounting shall allow the dumping of
materials without interference from the spreader. The overall spreader width shall not e
over 96”. This unit will spread free flowing granular materials, abrasive and chemicals
and be factory adapted to accept automatic control systems.

HOPPER: Rigid 7 gauge one piece end plates shall be continuously welded to a 10
gauge auger trough. The unit will have a 10 gauge three point hinged bottom that,
when released, exposes the entire length of the auger for easy clean-out. This hinged
bottom shall be held in place by two (2) heavy duty cam locks with a lift handle for
convenient one man operation. The anti-flow cover over the discharge opening is to be
10 gauge steel construction and removable without the use of tools. The 10 gauge
cover/back plate will be a one piece hinged integral part of the nit that may be raised
when spreading and lowered when dumping. This cover shall be locked in the raised
position by two (2) simple captivated latches.

FEED MECHANISM: The 6” (nominal) heavy duty auger shall consist of 3/8” fliting
which is welded to a Schedule 40 (ASTM) pipe. This auger shall have continuous and
reverse fliting to the discharge port for more uniform dump body emptying and shall be
supported by 1-1/4” shafting ends. The auger shafts will be supported in a sealed, self-
aligning precision single row radial bearing with grease fittings. The drive end bearing
shall attach to a removable 10 gauge end plate. The discharge port shall be located on
the left side of the trough.

SPINNER: The spinner shall consist of a disc and (6) vanes formed into a single unit
from polyurethane, resulting in a flat trajectory and a uniform spreading variable
spreading patterns left, center or right. This will be accomplished by sliding the hinged
frame sideways on the shaft so that the point at which the material hits the spinner disc
is varied. The entire spinner assembly shall be easily removed by pulling two (2) pins
and uncoupling (2) hydraulic “quick disconnect” hoses. The spinner speed and the
auger feed rate shall be both variable through the optional dual flow or servo valve
system. The spinner disc will be mounted directly onto the hydraulic motor shaft by
means of a cast iron spinner hub. The spinner assembly will be linked to the truck frame
with a universally mounted parallel arm to keep the spinner horizontal to the road at all
dump box angles. A spinner shield shall be provided to prevent material from striking
the truck.

POWER TRAIN: There shall be two (2) separate hydraulic “orbital type” motors
capable of delivering high torque at low speeds to power both the spinner and the
auger. Power shall be transmitted from the motor sprocket to the auger by a 5:1
reduction gear box. This gear box shall mount directly to the auger pipe by a non
corrosive sleeve with a ½” grade 5 bolt. The gear box will have a right hand rotation
with a bronze worm gear drive. The gear box is driven by hydraulic orbital type motor
that is bolted onto the gear box.

The independent spinner motor shall mount directly to the spinner disc eliminating any
power loss by transmission. The spinner speeds and auger feed rate are both variable.


MOUNTING: This spreader shall fasten to the side of the dump body using quick
disconnect pins for quick mounting and removal of spreader without use of special tools.

UNIVERSAL SHAFT WITH A COVER: The engine crankshaft to be connected to the
pump by a universal splined slip-shaft with adjustment or slip of 2” (5.1cm) to allow easy

NOTE: Truck chassis is to have a special heavy duty front bumper. The
bumper is to be standard factory bumper modified to fit plow hitch and

HYDRAULIC TANK: The hydraulic left hand frame mount tank shall be a minimum of
30 gallons made of 10 gauge material with baffles. It shall contain a minimum of 8” x 8”
cleanout cover on the top, a breather type vent, a filler neck with a 3 micron screen, and
turn-lock type cap. Internally in the tank shall be a 100 micron suction strainer with a 2”
suction port. The porting to the pump must be a minimum of 2” piping, non-galvanized
and be secured by hycon clamps (NO EXCEPTIONS). The circuitry returning must
come through a minimum of a 50 gallon flow rate filter, 1300 square inches of filtration
area, minimum 1 ¼” piping. The hosing returning all oil must come through 1 ¼”piping
minimum. The filter must also contain a 25 lb. bypass condition indicator, and a bypass
mounted internally in the filter. There also must be a ¼ turn valve mounted on the
suction side of the tank piping. On the side of the tank, shall be a fluid level gauge
combination high/low mark, plus temperature of IL. Hydraulic tank is to be mounted
behind cab. Where hoses are used in lieu of piping and hycon clamps, the hoses must
be secured by heavy-duty clamps and routed in such a manner that they do not
interfere or come close to heat and where they can be damaged by chafing, etc.
Hoses, where applicable, must be wrapped with a heavy-duty vinyl spiral wrap. Final
determination of hose routing and piping shall be at the discretion of the county.

HOSES: All hoses terminating to hydraulic cylinder and or hydraulic motors are to be
NPT to JIC. All hoses connecting to the pump shall be 2-braided for extra strength on
the pressure side, steel tubing with hycon clamps is to be supplied running from front to

PLOW LIFT CIRCUIT: Valve will direct flow to a double acting 4” x 10” lift cylinder.
There shall be a pilot operated check valve mounted to the lift cylinder. Also in this
circuit shall be a restriction to eliminate the slamming down of the plow. This must be
installed internally external restriction will not be allowed.

SPREADER HYDRAULICS: Valve for solenoid operated on/off and reverse shall
operate electrically from dash mounted controls. All other controls are to be mounted in

The custom truck attachment shall consist of a minimum ½” side plates reinforced and
bolted as far back on the truck frame as feasible. The vertical risers shall be a minimum
of 4” x 3” x ½” angle. The horizontal member to which the base of the lift cylinder pins
shall be a minimum 4” x 4” x ½” angle boxed in with a ¼” x 4” bar. The pump mounting

             Oscillation   15 degrees total, to lift heel of plow during

             Permissible Misalignment in Hitching: Loop at rear of plow can
             be high or low through a range of six (6) inches. Truck can be
             right or left of center through a range of seven (7) inches.

MOLDBOARD: The moldboard shall be a minimum 29” high inside at the nose end
and 51” high inside at the discharge end. It shall clear a path of 9’3” at an angle of 35

MOLDBOARD SHOES: (Qty – 2) Shall be from abrasion resistant steel (minimum
Brinell of 360) and located at the right and left hand extremities of the rear of the cutting
edge reinforcement.

CUTTING EDGE REINFORCEMENT: Shall not be less than 6” x 4” x ¾” steel
angle with ½” plate gussets welded to framework.

TRIP MECHANISM: Shall be of the enclosed canister design. The canister shall be
30-1/4” long and 6” in diameter. Enclosed within the canister shall be two (2)
compression springs, 26” long, made from alloy spring wire. One spring shall be 5-3/8”
O.D. x 3-7/8” I.D. and the other spring shall be 3-3/8” O.D. x 2-1/8” I.D. The main trip
rod shall be made from 1-3/8” cold rolled steel, 27-1/4” long with a yoke threaded to one
end for attaching to the moldboard. A recoil spring shall be placed on the trip rod
between the yoke and canister housing. The canister shall pivot on two (2) 1-1/4”
journals. Two (2) trunnion plates of ½” plate shall carry the canister and in turn be
bolted to the driveframe in such a manner as to be movable for cutting edge adjustment.

TUBULAR DRIVEFRAME: The driveframe shall be designed in such a way that it is
an integral bolt-on part of the moldboard, thereby enhancing overall structural integrity
of the complete snowplow. The driveframe shall incorporate a main drive member from
4” x 3” x ¼” wall rectangular structural tubing, which by bolting to the vertical ribs at
the moldboard assembly also serves as the lower reinforcing member of the moldboard.
Two (2) lateral members from 4” x 3” x ¼” wall rectangular structural tubing shall weld
to and extend rearward from the main drive member to a ¾” x 6” wide rear bearing
plate, which shall serve as the mounting surface for an oscillating drive bar. Additional

points of ½” plate shall be provided for pinning the moldboard to the driveframe, over an
80” span. Three (3) 1-1/4” pins shall pin the moldboard t the driveframe. A locking
plate cut from ½” steel plate with seven (7) locking positions shall be welded to the two
(2) truss members.

HARDWARE PLATING: All nuts, bolts and chain shall be zinc plated.

PAINT: All snowplow components shall be shot blasted and painted with one (1) coat
of primer and one (1) coat of finish paint.

GENERAL:

This under-tailgate spreader shall be of the bottom opening design. The entire unit will
rigidly mount to the sides of the dump body & below the floor level of the dump box with
single pin quick detachable hardware. This mounting shall allow the dumping of
materials without interference from the spreader. The overall spreader width shall not e
over 96”. This unit will spread free flowing granular materials, abrasive and chemicals
and be factory adapted to accept automatic control systems.

HOPPER: Rigid 7 gauge one piece end plates shall be continuously welded to a 10
gaugeauger trough. The unit will have a 10 gauge three point hinged bottom that, when
released, exposes the entire length of the auger for easy clean-out. This hinged bottom
shall be held in place by two (2) heavy duty cam locks with a lift handle for convenient
one man operation. The anti-flow cover over the discharge opening is to be 10 gauge
steel construction and removable without the use of tools. The 10 gauge cover/back
plate will be a one piece hinged integral part of the nit that may be raised when
spreading and lowered when dumping. This cover shall be locked in the raised position
by two (2) simple captivated latches.

FEED MECHANISM: The 6” (nominal) heavy duty auger shall consist of 3/8” fliting
which is welded to a Schedule 40 (ASTM) pipe. This auger shall have continuous and
reverse fliting to the discharge port for more uniform dump body emptying and shall be
supported by 1-1/4” shafting ends. The auger shafts will be supported in a sealed, self-
aligning precision single row radial bearing with grease fittings. The drive end bearing
shall attach to a removable 10 gauge end plate. The discharge port shall be located on
the left side of the trough.

SPINNER: The spinner shall consist of a disc and (6) vanes formed into a single unit
from polyurethane, resulting in a flat trajectory and a uniform spreading pattern from 4 to
40 feet. The spinner assembly shall be adjustable allowing for variable spreading
patterns left, center or right. This will be accomplished by sliding the hinged frame
sideways on the shaft so that the point at which the material hits the spinner disc is
varied. The entire spinner assembly shall be easily removed by pulling two (2) pins and
uncoupling (2) hydraulic “quick disconnect” hoses. The spinner speed and the auger
feed rate shall be both variable through the optional dual flow or servo valve system.
The spinner disc will be mounted directly onto the hydraulic motor shaft by means of a
cast iron spinner hub. The spinner assembly will be linked to the truck frame with a
universally mounted parallel arm to keep the spinner horizontal to the road at all dump

box angles. A spinner shield shall be provided to prevent material from striking the

POWER TRAIN: There shall be two (2) separate hydraulic “orbital type” motors
capable of delivering high torque at low speeds to power both the spinner and the
auger. Power shall be transmitted from the motor sprocket to the auger by a 5:1
reduction gear box. This gear box shall mount directly to the auger pipe by a non-
corrosive sleeve with a ½” grade 5 bolt. The gear box will have a right hand rotation

exceed 16”. The plow bumper angle must be an integral part of the bumper mounting
brackets and bumper. Bumper angle must be tied back to chassis frame.

NOTE: Truck chassis is to have a special heavy duty front bumper. The bumper
is to be standard factory bumper modified to fit plow hitch and tapered to the
chassis contour. Steps under front bumper.

HYDRAULIC TANK: The hydraulic left hand frame mount tank shall be a minimum of
30 gallons made of 10 gauge material with baffles. It shall contain a minimum of 8” x 8”
cleanout cover on the top, a breather type vent, a filler neck with a 3 micron screen, and
turn-lock type cap. Internally in the tank shall be a 100 micron suction strainer with a 2”
suction port. The porting to the pump must be a minimum of 2” piping, non-galvanized
and be secured by hycon clamps (NO EXCEPTIONS). The circuitry returning must
come through a minimum of a 50 gallon flow rate filter, 1300 square inches of filtration
area, minimum 1 ¼” piping. The hosing returning all oil must come through 1 ¼”piping
minimum. The filter must also contain a 25 lb. bypass condition indicator, and a bypass
mounted internally in the filter. There also must be a ¼ turn valve mounted on the
suction side of the tank piping. On the side of the tank, shall be a fluid level gauge
combination high/low mark, plus temperature of IL. Hydraulic tank is to be mounted
behind cab. Where hoses are used in lieu of piping and hycon clamps, the hoses must
be secured by heavy-duty clamps and routed in such a manner that they do not
interfere or come close to heat and where they can be damaged by chafing, etc.
Hoses, where applicable, must be wrapped with a heavy-duty vinyl spiral wrap. Final

HOSES: All hoses terminating to hydraulic cylinder and or hydraulic motors are to be
NPT to JIC. All hoses connecting to the pump shall be 2-braided for extra strength on
the pressure side, steel tubing with hycon clamps is to be supplied running from front to
rear underneath truck on both pressure and suction side. The return shall be a joint
return through a ¾” line terminating in a 1” return hose back to tank circuit. One hose
shall go from the box to this filer to eliminate the excess hosing or wear factor from
chafing. The line must be Schedule 80 piping with short hose connections between
tank and pump.

MAIN CONTROL VALVE ASSEMBLY: To be electric over hydraulic, mounted in
box, solenoid operated in lieu of manual valve. Provide standard spreader control
valve in box.

BODY LIFT CIRCUIT: Section will direct flow to double acting body hoist cylinder. In
the dump body circuit, there must be a second fixed relief pre-set at a 500 lb. limit. It
must be installed inside the valve body; outside frame rail mount will not be acceptable.
This valve is to protect the hoist cylinder against static intensification.

PLOW LIFT CIRCUIT: Valve will direct flow to a double acting 4” x 10” lift cylinder.
There shall be a pilot operated check valve mounted to the lift cylinder. Also in this
circuit shall be a restriction to eliminate the slamming down of the plow. This must be
installed internally external restriction will not be allowed.

SPREADER HYDRAULICS: Valve for solenoid operated on/off and reverse shall
operate electrically from dash mounted controls. All other controls are to be mounted in
the sealed box. Spinner and conveyor speed shall be full adjustable.

      SPECIFICATIONS FOR MANUAL TILT CUSTOM TRUCK ATTACHMENT

FOR METROPOLITAN PLOWS
The custom truck attachment shall consist of a minimum ½” side plates reinforced and
bolted as far back on the truck frame as feasible. The vertical risers shall be a minimum
of 4” x 3” x ½” angle. The horizontal member to which the base of the lift cylinder pins
shall be a minimum 4” x 4” x ½” angle boxed in with a ¼” x 4” bar. The pump mounting
bracket shall be a minimum of 6” x 4” x ½” angle with ½” angle with ½” plate gussets on
either side of the pump flange hole. The hitch shall provide a minimum of two push
heights (12” and 15”) on 21” hole centers for connection of the plow to the hitch. The
bottom of the hitch behind the connecting points (for the plow) shall be adequately
reinforced to transmit all plowing forces to the truck frame. The upper half of the truck
attachment will be manual tilt. This will allow you to tilt the truck hood grill assembly
forward.

NOTE: The entire assembly shall be designed to allow ample raising, lowering and
oscillation of the plow and shall at least meet the following minimum:

             Degree of Flexibility:

             Raise         32 degrees for transport clearance

             Lower         12 degrees for blade wear and road surface
                           Irregularities.

             Oscillation   15 degrees total, to lift heel of plow during transport and
                           conform to road service irregularities.

             Permissible Misalignment in Hitching: Loop at rear of plow can be high or
             low through a range of six (6) inches. Truck can be right or left of center
             through a range of seven (7) inches. The plow hoist cylinder must be 4”
             double acting.

SCREW ADJUSTABLE CASTER WHEELS:
Two (2) 10” diameter wheels made from abrasion resistant steel with Timken bearings
on vertically mounted screw adjustable brackets with screw handles. Must be bolted.

GENERAL:
This under-tailgate spreader shall be of the bottom opening design. The entire unit will
rigidly mount to the sides of the dump body & below the floor level of the dump box with
single pin quick detachable hardware. This mounting shall allow the dumping of
materials without interference from the spreader. The overall spreader width shall not e
over 96”. This unit will spread free flowing granular materials, abrasive and chemicals
and be factory adapted to accept automatic control systems.

HOPPER: Rigid 7 gauge one piece end plates shall be continuously welded to a 10
gauge auger trough. The unit will have a 10 gauge three point hinged bottom that,
when released, exposes the entire length of the auger for easy clean-out. This hinged
bottom shall be held in place by two (2) heavy duty cam locks with a lift handle for
convenient one man operation. The anti-flow cover over the discharge opening is to be
10 gauge steel construction and removable without the use of tools. The 10 gauge
cover/back plate will be a one piece hinged integral part of the nit that may be raised
when spreading and lowered when dumping. This cover shall be locked in the raised
position by two (2) simple captivated latches.

FEED MECHANISM: The 6” (nominal) heavy duty auger shall consist of 3/8” fliting
which is welded to a Schedule 40 (ASTM) pipe. This auger shall have continuous and
reverse fliting to the discharge port for more uniform dump body emptying and shall be
supported by 1-1/4” shafting ends. The auger shafts will be supported in a sealed, self-
aligning precision single row radial bearing with grease fittings. The drive end bearing
shall attach to a removable 10 gauge end plate. The discharge port shall be located on
the left side of the trough.

SPINNER: The spinner shall consist of a disc and (6) vanes formed into a single unit
from polyurethane, resulting in a flat trajectory and a uniform spreading pattern from 4 to
40 feet. The spinner assembly shall be adjustable allowing for variable spreading
patterns left, center or right. This will be accomplished by sliding the hinged frame
sideways on the shaft so that the point at which the material hits the spinner disc is
varied. The entire spinner assembly shall be easily removed by pulling two (2) pins and
uncoupling (2) hydraulic “quick disconnect” hoses. The spinner speed and the auger
feed rate shall be both variable through the optional dual flow or servo valve system.
The spinner disc will be mounted directly onto the hydraulic motor shaft by means of a
cast iron spinner hub. The spinner assembly will be linked to the truck frame with a
universally mounted parallel arm to keep the spinner horizontal to the road at all dump
box angles. A spinner shield shall be provided to prevent material from striking the
truck.

POWER TRAIN: There shall be two (2) separate hydraulic “orbital type” motors
capable of delivering high torque at low speeds to power both the spinner and the
auger. Power shall be transmitted from the motor sprocket to the auger by a 5:1
reduction gear box. This gear box shall mount directly to the auger pipe by a non-
corrosive sleeve with a ½” grade 5 bolt. The gear box will have a right hand rotation
with a bronze worm gear drive. The gear box is driven by hydraulic orbital type motor
that is bolted onto the gear box.

The independent spinner motor shall mount directly to the spinner disc eliminating any
power loss by transmission. The spinner speeds and auger feed rate are both variable.


MOUNTING: This spreader shall fasten to the side of the dump body using quick
disconnect pins for quick mounting and removal of spreader without use of special tools.

             INSTRUCTIONS TO BIDDERS AND STATUTORY REQUIREMENTS

1. SUBMISSION OF BIDS

A.    Sealed bids shall be received by the County of Mercer in accordance with public
      advertisement as required by law, with a copy of said notice being attached hereto and made
      a part of these specifications.

B.    The bid shall be submitted in a sealed envelope: (1) addressed to the County of Mercer, (2)
      bearing the name and address of the bidder written on the face of the envelope, and (3)
      clearly marked "BID" with the contract title and/or bid # being bid.

C.    It is the bidder's responsibility that bids are presented to the County at the time and at the
      place designated. Bids may be hand delivered or mailed; however, the County disclaims any
      responsibility for bids forwarded by regular or overnight mail. If the bid is sent by express
      mail service, the designation must also appear on the outside of the express mail envelope.
      Bids received after the designated time and date will be returned unopened. Express mail
      shall be delivered to the Department of Purchasing, 640 S. Broad Street, Room
      109, Trenton, New Jersey 08611.

D.    The Mercer County Park Commission and the Mercer County Library System are considered
      agencies of the County entitled to participate in the contract(s) resulting from this bid.

E.    Sealed bids forwarded to the County before the time of opening of bids may be withdrawn

      for a period of sixty (60) calendar days.

          indirectly, confers or agrees to confer any benefit not allowed by law to a public servant.
      •   Bidder should consult the statutes or legal counsel for further information.

I.    If not submitting a bid proposal in accordance with the attached instructions and
      specifications, the outside of the above stated envelope shall be plainly marked “NO BID”
      when being returned. If bidder wishes to remain on bid list, please mark “NO BID - PLEASE
      RETAIN ON BID LIST” on front page of this proposal. Failure to comply may result in bidder
      being dropped from bid list.

J.    Contract shall be awarded to the lowest responsible bidder as declared by the County of
      Mercer. The contract awarded between the County of Mercer and the successful bidder
      shall establish the contractual obligation regarding specific items, specifications and services
      to be provided to the county.

K.    Successful bidder shall not assign, transfer, convey sublet or otherwise dispose of the
      contract or any part thereof to anyone without the written consent of the County of Mercer.

L.    The County of Mercer reserves the right in the event of unsatisfactory service to cancel the
      contract awarded to the successful bidder and procure the goods or services from other
      sources and hold the contractor responsible for any excess cost.

M.    The successful bidder agrees that he will make no claim for additional payment or any other
      concession because of any misrepresentation or misunderstanding of the contract on his
      part, or of any failure to fully acquaint himself with any conditions relating to the contract.

N.    If the request for proposal involves the use of equipment or machinery, bidder shall submit a
      list of same owned by the bidder necessary to perform the work being sold.

O.    Bidders are cautioned to fill in all information as requested on the proposal forms to serve as
      a basis for making awards. The county, without invalidating the contract, may order changes
      consisting of additions, deletions or modifications and the contract sum shall be adjusted
      accordingly.

P.    Bidder shall list all deviations from the specifications as contained herein when returning
      proposal as specified.

Q.    The bidder, if awarded a contract, agrees to protect, defend and save harmless the County
      of Mercer against any damage for the payment for the use of any patented material process,
      article or device that may enter into the manufacture, construction or form a part of the work
      covered by his contract, and he further agrees to indemnify and save harmless the County of
      Mercer from suits or actions of every nature and description brought against it, for or on
      account of any injuries or damages received or sustained by any parties, by, or from any acts
      of the contractor, his servants or agents.

 R.   Bidder must provide Certificate of insurance in a form and amount acceptable to the County
      of Mercer including General Liability, Automobile, Workman’s Compensation and such other
      coverage as may be deemed necessary by the County of Mercer for the work, services or
      goods being bid.

S.      Bidder shall submit financial statements if requested showing its financial ability to perform
        the work being bid. The County reserves the right to require additional financial
        documentation prior to the award of bid if, in the opinion of the County, the financial
        statements submitted with the bid are deemed to be inadequate. Failure to comply with this
        requirement may result in being rejected at the option of the County.

2. INTERPRETATION AND ADDENDA

The bidder understands and agrees that its bid is submitted on the basis of the specifications
prepared by the owner. The bidder accepts the obligation to become familiar with these
specifications. Bidders are expected to examine the specifications and related bid documents with
care and observe all their requirements. Ambiguities, errors or omissions noted by bidders should
be promptly reported in writing to the appropriate official. Any prospective bidder who wishes to
challenge a bid specification shall file such challenges in writing with the contracting agent no less
than three business days prior to the opening of the bids. Challenges filed after that time shall be
considered void and having no impact on the contracting unit or the award of a contract pursuant to
N.J.S.A. 40A:11-13. In the event the bidder fails to notify the owner of such ambiguities, errors or
omissions, the bidder shall be bound by the requirements of the specifications and the bidder’s
submitted bid. No oral interpretation and or clarification of the meaning of the specifications for any
goods and services will be made to any bidder. Such request shall be in writing, addressed to the
owner’s representative stipulated in the specification. In order to be given consideration, a written
request must be received at least seven (7) business days prior to the date fixed for the opening of
the bid for goods and services.

All interpretations, clarifications and any supplemental instructions will be in the form of written
addenda to the specifications, and will be distributed to all prospective bidders. All addenda so
issued shall become part of the specification and bid documents, and shall be acknowledged by the
bidder in the bid. The owner’s interpretations or corrections thereof shall be final. When issuing
addenda, the owner shall provide required notice prior to the official receipt of bids to any person
who has submitted a bid or who has received a bid package pursuant to N.J.S.A. 40A:11-23c.1.

Discrepancies in Bids: If the amount shown in words and its equivalent in figures do not agree, the
written words shall be binding. Ditto marks are not considered writing or printing and shall not be
used. In the event that there is a discrepancy between the unit prices and the extended totals, the
unit prices shall prevail. In the event there is an error of the summation of the extended totals, the
computation by the owner of the extended totals shall govern.

3. BRAND NAMES, STANDARDS OF QUALITY AND PERFORMANCE

Brand names and/or descriptions used in these specifications are to acquaint bidders with the types
of goods and services desired and will be used as a standard by which goods and services offered
as equivalent will be evaluated. Variations between the goods and services described and the goods
and services offered are to be fully identified and described by the bidder on a separate sheet and
submitted with the bid proposal form. Vendor literature WILL NOT suffice in explaining exceptions to
these specifications. In the absence of any exceptions by the bidder, it will be presumed and
required that the goods and services as described in the bid specification be provided or performed.
It is the responsibility of the bidder to document and/or demonstrate the equivalency of the goods
and services offered. The County reserves the right to evaluate the equivalency of the goods and
services.

In submitting its bid, the bidder certifies that the goods and services to be furnished will not infringe
upon any valid patent or trademark and that the successful bidder shall, at its own expense, defend
any and all actions or suits charging such infringement, and will save the County harmless from any
damages resulting from such infringement.

Only manufactured and farm products of the United States, wherever available, shall be used
pursuant to N.J.S.A. 40A:11-18. The contractor shall guarantee any or all goods and services
supplied under these specifications. Defective or inferior goods shall be replaced at the expense of
the contractor. The contractor will be responsible for return freight or restocking charges.

4. PRICING INFORMATION FOR PREPARATION OF BIDS

A. The County is exempt from any local, state or federal sales, use or excise tax.

B. Estimated Quantities (Open-End Contracts): The County has attempted to identify the item(s) and
  the estimated amounts of each item bid to cover its requirements; however, past experience
  shows that the amount ordered may be different than that submitted for bidding. The right is
  reserved to decrease or increase the quantities specified in the specifications pursuant to N.J.A.C.
  5:30-11.2 and 11.10. NO MINIMUM PURCHASE IS IMPLIED OR GUARANTEED.

C. Contractor shall be responsible for obtaining any applicable permits or licenses from any
  government entity that has jurisdiction to require the same. All bids submitted shall have included
  this cost.

D. Bidders shall insert prices for furnishing goods and services required by these specifications.
  Prices shall be net, including any charges for packing, crating, containers, etc. All transportation
  charges shall be fully prepaid by the contractor, F.O.B. destination and placement at locations
  specified by the County. As specified, placement may require inside deliveries. No additional
  charges will be allowed for any transportation costs resulting from partial shipments made for the
  contractor's convenience.

5. METHOD OF CONTRACT AWARD

A. The length of the contract shall be stated in the technical specifications. Pursuant to
  requirements of N.J.A.C. 5:30-5.1 et seq., any contract resulting from this bid shall be subject to
  the availability and appropriation of sufficient funds annually. Please see Section entitled
  Termination of Contract, Sub-section E, for additional information.

B. If the award is to be made on the basis of a base bid only, it shall be made to that responsible
  bidder submitting the lowest base bid.

C. If the award is to be made on the basis of a combination of a base bid with selected options, it
  shall be made to that responsible bidder submitting the lowest net bid.

D. The County may also elect to award the contract on the basis of unit prices.

E. The form of contract shall be submitted by the County to the successful bidder. Terms of the
  specifications/bid package prevail. Bidder exceptions must be formally accepted by the County.

6. TERMINATION OF CONTRACT

A. If, through any cause, the contractor shall fail to fulfill in a timely and proper manner obligations
  under the contract or if the contractor shall violate any of the requirements of the contract, the

  County shall there upon have the right to terminate the contract by giving written notice to the
  contractor of such termination and specifying the effective date of termination. Such termination
  shall relieve the County of any obligation for balances to the contractor of any sum or sums set
  forth in the contract. County will pay only for goods and services accepted prior to termination.

B. Notwithstanding the above, the contractor shall not be relieved of liability to the County for
  damages sustained by the County by virtue of any breach of the contract by the contractor and the
  County may withhold any payments to the contractor for the purpose of compensation until such
  time as the exact amount of the damage due the County from the contractor is determined.

C. The contractor agrees to indemnify and hold the County harmless from any liability to
  subcontractors or suppliers concerning payment for work performed or goods supplied arising out
  of the lawful termination of the contract by the County under this provision.

D. In case of default by the contractor, the County may procure the goods or services from other
  sources and hold the contractor responsible for any excess cost.

E. Continuation of the terms of the contract beyond the fiscal year is contingent on availability of
  funds in the following year's budget. In the event of unavailability of such funds, the County
  reserves the right to cancel the contract.

F. ACQUISITION, MERGER, SALE AND/OR TRANSFER OF BUSINESS, ETC.

  It is understood by all parties that if, during the life of the contract, the contractor disposes of
  his/her business concern by acquisition, merger, sale and or/transfer or by any means convey
  his/her interest(s) to another party, all obligations are transferred to that new party. In this event,
  the new County(s) will be required to submit all documentation/legal instruments that were
  required in the original bid/contract. Any change shall be by the County.

G. The contractor will not assign any interest in the contract and shall not transfer any interest in the
  same without the prior written consent of the County.

H. The County of Mercer reserves the right, at its option, to terminate this contract upon giving thirty
 (30) days written notice to the contractor.

7. PAYMENT

No payment will be made unless duly authorized by the County of Mercer’s authorized
  representative
and accompanied by proper documentation. B. Payment will be made in accordance with the County
  of
Mercer’s policy and procedures.

8. TRANSITIONAL PERIOD

In the event services are terminated by contract expiration or by voluntary termination by either the
Contractor or The County of Mercer, the Contractor shall continue all terms and conditions of said
contract for a period not to exceed thirty (30) days at the County’s request.

STATUTORY REQUIREMENTS
REQUIRED AFFIRMATIVE ACTION EVIDENCE
No firm may be issued a contract unless it complies with the affirmative action provisions of
N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq. The following information summarizes
the full, required regulatory text, which is included as Appendix A of this bid specification.

Goods And Services (including professional services) Contracts
Each contractor shall submit to the public agency, after notification of award but prior to
execution of a goods and services contract, one of the following three documents:

             •   A photocopy of the Federal Letter of Affirmative Action Plan Approval, or;
             •   A photocopy of a Certificate of Employee Information Report; or
             •   A photocopy of an Employee Information Report (Form AA302) which is
                 available upon request.

Maintenance/Construction Contracts
After notification of award, but prior to signing the contract, the contractor shall submit to the
public agency compliance officer and the Division of Contract Compliance and Equivalent
Employment Opportunity in Public Contracts (Division) an initial project workforce report (Form
AA201) provided to the public agency by the Division for distribution to and completion by the
contractor, in accordance with N.J.A.C. 17:27-7.

AMERICANS WITH DISABILITIES ACT OF 1990
Discrimination on the basis of disability in contracting for the purchase of goods and services is
prohibited. Bidders are required to read Americans With Disabilities language that is included in
this specification and agree that the provisions of Title II of the Act are made a part of the
contract. The contractor is obligated to comply with the Act and to hold the County harmless.

STATEMENT OF CORPORATION OWNERSHIP
N.J.S.A. 52:25-24.2 provides that no corporation or partnership shall be awarded any contract
for the performance of any work or the furnishing of any goods and services, unless, prior to the
receipt of the bid or accompanying the bid of said corporation or partnership. Bidders shall
submit a statement with the bid setting forth the names and addresses of all stockholders in the
corporation or partnership who own ten percent or more of its stock of any class, or of all
individual partners in the partnership who own a ten percent or greater interest therein. Failure
to submit a stockholder disclosure document shall result in rejection of the bid.

PROOF OF BUSINESS REGISTRATION
N.J.S.A. 52:32-44 requires that each bidder (contractor) submit proof of business registration
with the bid proposal; failure to do so is a fatal defect that cannot be cured. Proof of registration
shall be a copy of the bidder’s Business Registration Certificate (BRC). A BRC is obtained from

NEW JERSEY WORKER AND COMMUNITY RIGHT TO KNOW ACT
The manufacturer or supplier of chemical substances or mixtures shall label them in accordance with
the N.J. Worker and Community Right to Know Law (N.J.S.A. 34:51 et seq., and N.J.A.C 5:89-5 et
seq.,). Containers that the law and rules require to be labeled shall show the Chemical Abstracts
Service number of all the components and the chemical name. Further, all applicable Material
Safety Data Sheets (MSDS) and hazardous substance fact sheet, must be furnished.

PREVAILING WAGE ACT
Pursuant to N.J.S.A. 34:11-56.25 et seq., contractors on projects for public work shall adhere to all
requirements of the New Jersey Prevailing Wage Act. The contractor shall be required to submit a
certified payroll record to the owner within ten (10) days of the payment of the wages. The contractor
is also responsible for obtaining and submitting all subcontractors' certified payroll records within the
aforementioned time period. The contractor shall submit said certified payrolls in the form set forth
in N.J.A.C. 12:60-6.1(c). It is the contractor's responsibility to obtain any additional copies of the

THE PUBLIC WORKS CONTRACTOR REGISTRATION ACT
N.J.S.A. 34:11-56.48 et seq. requires that a general or prime contractor and any listed
subcontractors named in the contractor’s bid proposal shall possess a certificate at the time the bid
proposal is submitted. After bid proposals are received and prior to award of contract, the
successful contractor shall submit a copy of the contractor’s certification along with those of all listed
subcontractors. All non-listed subcontractors and lower tier sub-subcontractors shall be registered
prior to starting work on the project. It is the general contractor’s responsibility that all non-listed
sub-contractors at any tier have their certificate prior to starting work on the job.

PAY TO PLAY
Starting in January, 2007, business entities are advised of their responsibility to file an annual
disclosure statement of political contributions with the New Jersey Election Law Enforcement
Commission (ELEC) pursuant to N.J.S.A. 19:44A-20.27 if they receive contracts in excess of
$50,000 from public entities in a calendar year. Business entities are responsible for determining if

PROMPT PAYMENT
In compliance with N.J.S.A. 2A:30A-1 et seq., the County of Mercer shall impose the following
payment process:
The County of Mercer shall pay the submitted bill not more than 30 calendar days after the
receipt of the bill by the County if the vendor has performed in accordance with the contract and
the work has been and certified by the County. The billing shall be deemed “” and “certified” 20
calendar days after the owner receives it, unless the County provides, before the end of the 20-
day period, a written statement of the amount withheld and the reason for withholding payment.

BID SECURITY AND BONDING REQUIREMENTS
The following provisions, if indicated by an (x), shall be applicable to this bid and be made a part
of the bidding documents:

A. (X) BID GUARANTEE
Bidder shall submit with the bid a certified check, cashier's check or bid bond in the amount of
ten percent (10%) of the total price bid, but not in excess of $20,000, payable unconditionally to
the County. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of
Bid Bond from a surety company authorized to do business in the State of New Jersey and
acceptable to the County. The check or bond of the unsuccessful bidder(s) shall be returned
pursuant to N.J.S.A. 40A:11-24a. The check or bond of the bidder to whom the contract is
awarded shall be retained until a contract is executed and the required performance bond or
other security is submitted. The check or bond of the successful bidder shall be forfeited if the
bidder fails to enter into a contract pursuant to N.J.S.A. 40A:11-21. Failure to submit a bid
guarantee shall result in rejection of the bid.

B. (X) CONSENT OF SURETY

Bidder shall submit with the bid a Certificate (Consent of Surety) with Power of Attorney for full
amount of bid price from a Surety Company authorized to do business in the State of New
Jersey and acceptable to the County stating that it will provide said bidder with a Performance
Bond in the full amount of the bid. This certificate shall be obtained in order to confirm that the
bidder to whom the contract is awarded will furnish Performance and Payment Bonds from an
acceptable surety company on behalf of said bidder, any or all subcontractors or by each
respective subcontractor or by any combination thereof which results in performance security
equivalent to the total amount of the contract, pursuant to N.J.S.A. 40A:11-22.

Failure to submit a consent of surety form shall result in rejection of the bid.

C. (X) PERFORMANCE BOND

Bidder shall simultaneously with the delivery of the executed contract, submit an executed bond
in the amount of one hundred percent (100%) of the acceptable bid as security for the faithful
performance of this contract. Failure to submit this with the executed contract shall be cause for
declaring the contract null and void pursuant to N.J.S.A. 40A:11-22.

TIE BIDS: Tie bids will be decided by the Mercer County Board of Chosen Freeholders price
and other factors considered.

DEMONSTRATION
If so requested, the vendor shall provide demonstration.

SAMPLE
If so requested, the vendor shall submit a sample of the units or merchandise.

MANUFACTURERS’ NAMES
Any manufacturers’ names, trade names, brand names or catalog numbers used in the
specifications are for the purpose of describing and establishing general quality levels. Such
references are not intended to be restrictive. Bids will be considered for any brand, which
meets or exceeds the quality of the specifications listed for any item.

AWARD/REJECTION
In accordance with N.J.S.A. 40A:11-24, all contracts will be awarded or all bids will be rejected
within sixty (60) days of the receipt of bids unless vendor agrees to extend for a longer period of
time.

(A.)    Cost Estimates
All bids may be rejected when the lowest bid substantially exceeds Cost Estimates for the
project.

(B.)    Abandonment
All bids may be rejected when Mercer County abandons the project.

(C.)    Revisions
All bids may be rejected when the specifications are substantially revised.

(D.)    Provisions of Law
All bids may be rejected when the purposes and/or provisions of law are violated.

(E.)    State Contract
All bids may be rejected when the County decides to use the State Contract for the goods or
services needed.

(F.)   Availability of Funds
Pursuant to statutory requirements, any contract resulting from this bid shall be subject to the
availability and appropriation of sufficient funds annually.

(G.)   Multiple Bids Not Allowed
More than one bid from an individual, a firm or partnership, a corporation or association under
the same or different names shall not be considered.

(H.)   Unsatisfactory Past Performance
Bids received from bidders who have previously failed to complete contracts within the time
scheduled therefore, or who have performed prior work for the County of Mercer in an
unacceptable manner, may be rejected.

(I.)    Failure to Enter Contract
Should the bidder, to whom the contract is awarded, fail to enter into a contract within 21 days,
Sundays and holidays excepted, the County of Mercer may then, at its option, retain the
bidder’s bid deposit/bond and accept the bid of the next lowest responsible bidder.

COMMUNICATIONS AFTER THE BID OPENING
It is highly improper for a bidder after bid opening to contact any representative of the County
of Mercer to discuss the bids. The solicitation package contains all documents and
instructions. These may be supplemented by any comments you wish to make. Such
additional material and comments must be submitted with the bid. Should there be any
questions concerning the bid submitted, you will be contacted by a representative of the
County of Mercer and any discussion or contact will be limited to the questions of the
representative.

INDEX RATE
If the County of Mercer desires to extend a contract under the provisions of N.J.S.A. 40A:11-15
or N.J.S.A. 18A:18A-42, the index rate is the basis to determine the appropriate increase in the
contract price. The following are the requirements for using this provision:
Contracts for services, the statutory length of which is for three years or less, may only include
provisions for no more than one (1) two-year or two (2) one-year extensions. The original bid
specifications and contract must include language that explains the possibility for an extension.

Immigration and Naturalization Laws and Criminal Background Check (As
Applicable)

The vendor must comply with all Immigration and Naturalization Laws as are
currently in force on each potential employee to work under this contract on
County of Mercer property and will not employ individuals who are not properly
registered with the United States Citizenship and Immigration Service. Successful
bidder will provide a photocopy of the Alien Registration Form or I-94 Arrival/Departure
Form to the County of Mercer at least ten (10) days prior to any of its employees being
permitted to work under this contract on County of Mercer property.

The vendor must contact the New Jersey State Police to perform a Criminal
Background Check on each potential employee to work under this contract on
County of Mercer property. A copy of the results of the Criminal Background Check
must be provided to the County of Mercer at least ten (10) days prior to an employee
being permitted access to County of Mercer property. The County of Mercer will notify
the vendor if a proposed vendor employee will not be permitted to work under this
contract within ten (10) work days following receipt of the results. If the County of
Mercer does not notify the vendor of such exclusion within ten (10) days the vendor may
assign said employee to work under the contract.

The vendor must also inform the County of Mercer of all Immigration and Naturalization
status changes and arrests of its employees working under this contract on County of
Mercer property for the duration of the contract. In this regard, the vendor shall make
quarterly inquiry of all employees working under this contract as to any Immigration and
Naturalization changes and employee arrests.

                                   Executive Order 98 - 1

      WHEREAS it is in the interests of the county to purchase goods and services from
responsible contractors that provide quality and services at a competitive price; and

        WHEREAS the county does not desire to do business with companies that compete by
exploiting their workforce rather than by running efficient, reliable and responsible operations;
and

       WHEREAS, the county purchases items of apparel and textiles, which is an industry in
which many scandals have been uncovered in which producers maintain sweatshop conditions,
such as paying poverty wages, violating workplace regulations, and suppressing worker rights;
and

       WHEREAS, such conditions in apparel and other industries threaten the jobs and
working conditions of all workers; and

        WHEREAS, it is the policy of the county that it should not purchase, rent or lease goods
or services produced under such conditions; and

       WHEREAS, sweatshop conditions flourish when the conditions of workers are hidden;
and

       WHEREAS, pressure from institutional purchasers such as governments is one of the
most effective ways to combat sweatshop production,

        THEREFORE IT IS HEREBY ORDERED, that it is the policy of the county that it should
not purchase, lease, rent or take on consignment goods or services produced under sweatshop
conditions, and that the following guidelines, criteria and procedures are adopted:

Section 1:    The procedures and guidelines set forth herein shall apply to items of apparel
              and textiles, such as clothing, headwear, footwear, linens and fabric, as well as
              to any other industry designated by the county executive as vulnerable to
              sweatshop competition.

Section 2:    In order to ensure that the county contracts with vendors that have responsible
              employment practices, the following criteria will be used in contracting for goods
              and services:

       A.     Preference will be given whenever possible to goods or services produced in the
              U.S.A.

       B.     The county will whenever possible only contract with vendors with responsible
              employment practices, as defined in Section 3.B below.

Section 3:    The County shall require of every bidder for contracts covered under Section 1:

       A.     Disclosure of all sub-contractors and sites. The bidder or vendor shall identify
              the name and address of each subcontractor to be used, as well as the address
              of all locations, including sub-contractor locations, substantially involved in

             providing goods or services covered by this act.       Such information will be
             considered public information.

       B.    Certification of Compliance. The bidder or vendor shall certify each location,
             including sub-contractor locations, substantially involved in producing or

             1.     Compensation. Wage and benefit levels must be sufficient to meet basic
                    needs and provide some discretionary income for a family of 4 (a “living
                    wage”).

             2.     Rights. The company respects workers’ rights to speak up about working
                    conditions, without fear or retaliation, and to form unions of their own
                    choosing without employer resistance. Due process and just cause
                    procedures are used for discipline or discharge, with recourse to
                    arbitration. The company complies with all laws, regulations and
                    standards governing the workplace. The company does not use child
                    labor, forced labor, corporal punishment. The company does not
                    discriminate in hiring, promotion or compensation on the basis of race,
                    national origin, religion, gender, sexual preference, union affiliation, or
                    political affiliation.

             3.     Safety and Health.     The factory provides a safe and healthy work
                    environment.

Section 4:   The county, at its discretion, may refuse to award a contract or terminate a
             contract or ban a vendor from holding contracts with the county for filing false
             information or for failing to file information required under this act. The county
             may, at its discretion, require correction and remediation of violations of the
             standards listed in section 3.B prior to renewing commerce with the contractor.
             The county may require further proof of compliance with the standards listed in
             Section 3.B. Upon request the contractor or subcontractor will make all relevant
             records available to the county or its designee.

The contractor and the County of Mercer, (hereafter “owner”) do hereby agree that the
provisions of Title 11 of the Americans With Disabilities Act of 1990 (the "Act") (42 U.S.C. S121

connection therewith. In any and all complaints brought pursuant to the owner’s grievance

pursuant to said grievance procedure. If any action or administrative proceeding results in an
award of damages against the owner, or if the owner incurs any expense to cure a violation of
the ADA which has been brought pursuant to its grievance procedure, the contractor shall
satisfy and discharge the same at its own expense.

The owner shall, as soon as practicable after a claim has been made against it, give written
notice thereof to the contractor along with full and complete particulars of the claim, If any action
or administrative proceeding is brought against the owner or any of its agents, servants, and
employees, the owner shall expeditiously forward or have forwarded to the contractor every
demand, complaint, notice, summons, pleading, or other process received by the owner or its
representatives.

It is expressly agreed and understood that any approval by the owner of the services provided
by the contractor pursuant to this contract will not relieve the contractor of the obligation to
comply with the Act and to defend, indemnify, protect, and save harmless the owner pursuant to
this paragraph.

It is further agreed and understood that the owner assumes no obligation to indemnify or save
harmless the contractor, its agents, servants, employees and subcontractors for any claim
which may arise out of their performance of this Agreement. Furthermore, the contractor
expressly understands and agrees that the provisions of this indemnification clause shall in no
way limit the contractor’s obligations assumed in this Agreement, nor shall they be construed to
relieve the contractor from any liability, nor preclude the owner from taking any other actions

PART 1604 -- GUIDELINES ON DISCRIMINATION BECAUSE OF SEX

1604.11 Sexual Harassment

        (a) Harassment on the basis of sex is a violation of Sec. 703 of Title VII (of the
Civil Rights Act of 1964). Unwelcome sexual advances, requests for sexual favors, and
other verbal or physical conduct of a sexual nature constitute sexual harassment when
(1) submission to such conduct is made either explicitly or implicitly a term or condition
of an individual’s employment, (2) submission to or rejection of such conduct by an
individual, or (3) such conduct has the purpose or effect of unreasonably interfering with
an individual’s work performance or creating an intimidating, hostile or offensive working
environment.

       (b) In determining whether alleged conduct constitutes sexual harassment, The
Commission (EEOC) will look at the record as a whole and at the totality of the
circumstances, such as the nature of the sexual advances and the context in which the
alleged incidents occurred. The determination of the legality of a particular action will
be made from the facts, on a case by case basis.

       (c) Applying general Title VII principles, an employer, employment agency, joint
apprenticeship committee or labor organization (hereinafter collectively referred to as
“employer”) is responsible for its acts and those of its agents and supervisory
employees with respect to sexual harassment regardless of whether the specific acts
complained of were authorized or even forbidden by the employer and whether the
employer knew or should have known of their occurrence. The Commission will
examine the circumstances of the particular employment relationship and the job
functions performed by the individual in determining whether an individual in
determining whether an individual acts in either a supervisory or agency capacity.

       (d) With respect to conduct between fellow employees, employer is responsible
for acts of sexual harassment in the workplace where the employer (or its agents or
supervisory employees) knows or should have known of the conduct, unless it can be
show that it took immediate and appropriate corrective action.

       (e) An employer may also be responsible for the acts of non-employees, with
respect to sexual harassment of employees in the workplace, where the employer (or its
agents or supervisory employees) knows or should have known of the conduct and fails
to take immediate and appropriate corrective action. In reviewing these cases the
Commission will consider the extent of the employer’s control and any other legal
responsibility, which the employer may have with respect to the conduct of such non-
employees.

                MERCER COUNTY’S POLICY ON SEXUAL HARASSMENT


The County of Mercer is committed the principle that sexual harassment of employees is an
abuse of authority and constitutes prohibited, unprofessional and unacceptable conduct. Sexual
harassment is defined as unwelcome sexual advances, requests for sexual favors and other
verbal or physical conduct of a sexual nature when:


       A.)    Submission to such conduct is explicitly or implicitly made a term or condition of
              an individual’s employment, or

       B.)     Submission to or rejection of such conduct by an individual is used as the basis
              for employment decisions affecting such individual, or

               INSURANCE AND INDEMNIFICATION REQUIREMENTS

If it becomes necessary for the contractor, either as principal or by agent or employee,
to enter upon the premises or property of the County in order to construct, erect,
inspect, make delivery or remove property hereunder, the contractor hereby covenants
and agrees to take use, provide and make all proper, necessary and sufficient
precautions, safeguards, and protection against the occurrence of happenings of any
accidents, injuries, damages, or hurt to person or property during the course of the work
herein covered and be his/her sole responsibility.

The contractor further covenants and agrees to indemnify and save harmless the
County from the payment of all sums of money or any other consideration(s) by reason
of any, or all, such accidents, injuries, damages, or hurt that may happen or occur upon
or about such work and all fines, penalties and loss incurred for or by reason of the
violation of any County regulation, ordinance or the laws of the State, or the United
States while said work is in progress.

The contractor shall maintain sufficient insurance to protect against all claims under
Workers Compensation, General Liability in the amount of $1,000,000.00 single
occurrence and $2,000,000.00 general aggregate and Automobile Insurance and shall
be subject to approval for adequacy of protection and certificates of such insurance
shall be provided the County when required at the County’s option. In all cases where a
Certificate of Insurance is required, the County is to be named as an additional insured.

WAIVER OF SUBROGATION CLAUSE
Contractor, as a material part of the consideration to be rendered to the County, hereby
waives all claims against the County for damages to the goods, wares and merchandise
in, upon or about said premises, and contractor will hold the County exempt and
harmless from any damage and injury to any such person or to the goods, wares or
merchandise of any such person, arising from the use of the premises by the contractor
or from failure of the contractor to keep the premises in good condition and repair as
herein provided.

                                   CONSENT OF SURETY


In consideration of the promises and of One Dollar to it in hand, paid by the County of Mercer,
New Jersey, the receipt whereof is hereby acknowledged, the undersigned Surety consents and
agrees that if the contract for which the preceding proposal is made be awarded to the
