service.
Why is this document important?
This Acceptable Use Policy agreement is an important legal document that forms part of our Terms of Service agreement. Before
you buy any product from us, please read this document carefully. Please keep this agreement with your other important
documents relating to our service.

This acceptable use policy governs the use of our web hosting service. Violation of this agreement may result in suspension or
termination of your service. In the event of a dispute between you and us regarding the interpretation of this agreement, our
interpretation, in our reasonable judgment, shall govern.

Money back guarantee
After you purchase a web hosting product from us, you have 14 days to consider the information in this agreement and the product
you have purchased. If you wish, and provided you have not broken any terms of this agreement, you can cancel your service within
14 days from the day your service was ordered. We will then refund any money you have paid, minus any services or surcharges
that are non-refundable. Further details about our refund policy are contained within this document.

Your full and correct disclosure of facts
You must comply with our duty of disclosure when you order a product from us. We may ask you for information about your web
hosting requirements, web hosting history, and yourself, which is used by us to consider your application for web hosting. You must
answer any questions honestly and tell us anything you or a reasonable person in the circumstances would include in their answer.

Not meeting your responsibilities
If you do not meet your responsibilities, it may lead to us:
– cancelling your web hosting services or related product
– passing on costs incurred by us due to you not meeting your responsibilities
If fraud is involved, we can treat your service as if it had never existed.

O FFENSIVE C ONTENT
You may not publish or transmit via our service any content that we believe:
- Constitutes child pornography
- Constitutes pornography
- Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech
- Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes
- Is defamatory or violates a person’s privacy
- Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or
interferes with an investigation by law enforcement
- Improperly exposes trade secrets or other confidential or proprietary information of another person
- Is intended to assist others in defeating technical copyright protections
- Infringes on another person’s trade or service mark, patent, or other property right
- Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking
- Is otherwise illegal or solicits conduct that is illegal laws applicable to you or to us
- Is otherwise malicious, fraudulent, or may result in retaliation against us by offended viewers

Content published or transmitted via our service includes web content, e-mail, bulletin board posting, chat and any other
type of posting or transmission that relies on any internet serviced provided by us.


I NTERNET A BUSE
You may not engage in illegal, abusive, or irresponsible behaviour, including:
- Unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of
a system or network or breach security or authentication measures (including those belonging to us and our customers)
without express authorization of the owner of the system or network
- Monitoring data or traffic on any network or system without the authorisation of the owner of the system or network
- Interference with service to any user, host or network including, without limitation, mail bombing, flooding, or deliberate
attempts to overload a system and broadcast attacks
- Use of an internet account or computer without the owner’s authorisation, including, but not limited to, internet scanning,
password or, security hole scanning and port hole scanning
- Forging of any TCP-IP packet header or any part of the header information in an –email or newsgroup posting
- Any conduct that is likely to result in retaliation against our network
- Use of our network in a way that unreasonably interferes with our other customers use of the network

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should
change your password periodically.


B ULK C OMMERCIAL E-M AIL
You must obtain our advance approval for any bulk commercial e-mail, which will not be given, unless you are able to
demonstrate all of the following to our reasonable satisfaction:
- Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in
procedure
- Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of
the e-mail address for which the consent is given
- You retain evidence of the recipient’s consent in a form that may be promptly produced on request, and you honour the
recipient’s and our requests to produce consent evidence within 72 hours of the receipt of the request
- The body of the e-mail must describe how the e-mail address was obtained, and information on how to request evidence of
the consent
- You have procedures in place that allow a recipient to revoke their consent. Revocations of consent must be honoured
within 72 hours.
- You must post an abuse@yourdomain.com email address on the first page of any website associated with the e-mail, you
must register that address at abuse.net, and you must promptly respond to messages sent to that address
- You must have a privacy policy posted for each domain associated with the mailing
- You have the means to track anonymous complains
- You may not obscure the source of your e-mail in any manner. Your e-mail must include the recipients e-mail address in the
body of the message or in the “TO” line of the e-mail
- You must comply with the CAN SPAM Act and any other applicable law

These policies apply to messages sent using your service provided by us, or to messages sent from any network by you and
any person on your behalf that directly or indirectly refer the recipient to a site hosted via your service provided by us. In
addition, you may not use a third party e-mail service that does not practice similar procedures for its customers.
We may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a
random sample of your list at any time.

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated they do not wish to
receive it. You must comply with the rules of any network you access or participate in using your service provided by us.


C OPYRIGHT
You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by
copyright law unless:
- You have been expressly authorised by the owner of copyright for the work to copy the work in that manner
- You are otherwise permitted by established Australian copyright law to copy the work in that manner

We will terminate the service on repeat copyright infringers.

If you believe your copyright is being infringed by a person using our network, please send your written notice of copyright
infringement to us via email to abuse@catsnine.com

Your notice must include:
- A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly
infringed
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted words at a single site are
covered by a single notification, a representative list of such works at that site
- Identification of the material claimed to be infringing or to be the subject of infringing activity that is to be removed or
access to which is to be disabled, and information reasonable sufficient to permit us to locate the material
- Information sufficient to permit us to contact you, such as an address, telephone number and e-mail address
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by
the copyright owner, the copyright owner’s agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury that you authorised to act on
behalf of the owner of an exclusive right that is allegedly infringed


L IMITATIONS
The abuse and misuse of system resources will not be tolerated.
We do not allow chat rooms to be operated on our hosting environment. We do not allow IRC or IRC bots to be operated on
our servers.

Online problems occur continuously. There might come a time when you cannot access your website or any other service.
This is not necessarily due to us. Your ISP may be experiencing technical difficulties, or there may be routing issues between
your ISP and the data enter utilised by us. We cannot bear the responsibility of such problems. Our monitoring agents
determine the uptime of our service, and not any one client’s experience.

You must have valid and current information on file with your domain name registrar for any domain hosted on our network.



D ISCLAIMER
We are under no duty, and do not by this agreement undertake a duty, to monitor or police our customer’s activities and
disclaims any responsibility for any misuse of our network. We reserve the right to add, delete, or modify any provision of this
policy at any time without notice.

The Acceptable Use Policy is this document and contains the terms we and you must abide by. It tells you what your rights
and responsibilities are together with what we consider acceptable and unacceptable use of our services and/or network. It
should be read together with any other communication sent by us.

service to you.

– if we will be able to provide you with services

– we should know about because of the business we are in or
– we tell you we do not want to know.
If you are unsure it is better to tell us. If you do not tell us something which
you know or should know is relevant, we might cancel your service or, if fraud is involved we can treat the service as if it had
never existed.

The amount you pay us for any product or service we provide you with. You also pay GST and any
additional government charges if applicable.
