July 25, 2006 Michael Chiotti Chico Drain Oil Service/ Fortuna 200 Dunsmore Drive Fortuna, CA 95540 CALL-IN LETTER FOR STANDARDIZED PERMIT RENEWAL APPLICATION AND INVITATION TO PERMIT APPLICATION WORKSHOP Dear Mr. Chiotti: Our records indicate that the Standardized Hazardous Waste Facility Permit issued by Department of Toxic Substances Control (DTSC) to Chico Drain Oil Service – Fortuna located at 200 Dunsmore Drive, Fortuna, California will expire on December 31, 2007. Title 22, California Code of Regulations, section 66270.10(h) [Cal. Code Regs, tit. 22, §66270.10(h)] requires that "any hazardous waste management facility with an effective permit shall submit a new application at least 180 days before the expiration date of the effective permit". Why is DTSC asking you to submit a renewal application early? With this call-in letter, DTSC is requiring the submission of a new application to renew your permit by December 29, 2006. The early call-in is necessary in order to have a complete application 180 days before the expiration date of your permit. DTSC needs the additional time to process the permit renewal to avoid lapse in the effective date of your existing permit. What happens if DTSC does not receive a complete application? If your new application to renew your permit is not received by the December 29, 2006 deadline, DTSC cannot guarantee that the review of your application will be completed 180 days prior to the expiration date of your existing permit. If your application is not deemed complete at least 180 days prior to the expiration date of your existing permit, your existing permit will expire after December 31, 2007. What constitutes a complete permit application? Your permit application must consist of a Part A application and a Part B application. The Part A application consists of the following forms (enclosed): (1) Standardized Permit Series Determination (2) Standardized Permit Notification for Hazardous Waste Facilities

(3) Hazardous Waste Facility Standardized Permit Unit-Specific Form The Part B application (operation plan) shall include the general requirements in Cal. Code Regs., tit 22 § 66270.14 and the applicable specific Part B information requirements in Cal. Code Regs., tit 22 § 66270.15 through 66270.27. DTSC has enclosed several documents to guide you in preparing a complete permit application. Disclosure statement requirements: State law requires that all applicants applying for a permit need to complete a disclosure statement. Enclosed are the disclosure statement and the instructions for completing it. The disclosure statement will be part of your permit application but must be sent to DTSC’s Headquarters at: Department of Toxic Substances Control Regulatory and Development Division Hazardous Waste Management Program P.O. Box 806 Sacramento, California 95812-0806 Attn: Disclosure Statement Unit Any questions regarding the disclosure statement should be directed to Ms. Karla Gillespie at 916-323-8510. We would encourage you to send the disclosure statement by certified mail since it contains sensitive information and you may want to track the delivery. DTSC has these forms available in electronic version; for a copy, please contact Alejandro Galdamez of my staff at agaldame@dtsc.ca.gov. Application fees for processing permit renewal: There is a fee for the processing of your permit application. DTSC has a Standard Permit activity fee which is based on the size of your facility. Enclosed is a list of the Standardized Permit Renewal Activity Fees and Annual Fees. Additionally, California Health and Safety Code, Section 25205.7 allows the applicant the option of reimbursing DTSC for the actual costs for processing your permit application rather than paying DTSC’s Standard Permit activity fee. If you are interested in this option, please indicate in the cover letter of your new permit application submittal. We will provide you with an estimate if you choose this option. Environmental review fees: There is a separate fee for the cost of complying with the California Environmental Quality Act (CEQA). Pursuant to the California Public Resource Code, Section 21089, a lead agency may charge and collect a reasonable fee from any person proposing a project subject to the provisions of this division in order to recover the estimated costs incurred in preparing a negative declaration or an environmental impact report. We will provide you with an estimate after the receipt of your application.

Invitation to a permit application workshop: To facilitate the preparation of a complete Standardized Permit Renewal Application, DTSC plans to hold a workshop at our Berkeley Office on August 30, 2006. The agenda for the workshop will be mailed to you in a separate letter. The purpose of the workshop is to explain the permit renewal process and to go over DTSC's permit application requirements. We strongly encourage Chico Drain Oil Service to take immediate action to meet the applicable requirements to avoid lapse of its current permit. If Chico Drain Oil Service cannot attend the workshop or has additional questions following the workshop, DTSC will be happy to schedule a pre-application meeting prior to the December 29, 2006 deadline.
