with this seminar focused on character and fitness issues, as well as on the impact of lawyer criminal convictions.

The High Price of Prosecutorial Discretion/Indiscretion by TRT (2.0 ethics, 2.0 total, 73175)
_____June 30, _____July 6, _____July 27, _____August 17,
Is a prosecutor truly a minister of justice and not simply an advocate (Comment 1 to MR 3.8)? Professionalism and training standards are
examined with an eye to prosecutor’s role in instances of wrongful prosecution/incarceration. Major emphasis is devoted to prosecutorial
misconduct at the federal and state levels. Intentional prosecutorial misconduct of Michael B. Nifong is reviewed anew for additional light this
seminal case might shed on future prosecutorial discretion/indiscretion.
Impact of Lawyer Advertising on the Profession by TRT (2.0 ethics, 2.0 total, 73176)
_____June 30[4-6pm], _____July 5, _____August 1,
Love it or hate it, lawyer advertising is here to stay. Bates v. State Bar of Arizona (1977) opened the floodgates for professional advertising.
Many of today’s television advertisements are aimed at clients with personal injury claims, often handled by what are sometimes referred to as
settlement mills. Who is the true beneficiary of this change, permitting lawyer advertising? Here we revisit professionalism in light of lawyer
advertising, as well as examine the potential collision between legal ethics and lawyer advertising.
Ethics and the Election/Selection of Judges by TRT (2.0 ethics, 2.0 total, 73177)
_____July 8, _____August 4, _____August 29,
Love them or hate them, we cannot do without judges. At question is the best way of filling the bench. Special interest is devoted to judicial
missteps including a judge’s 6-year delay in entering judgment in a civil matter and a judge stopping a trial to marry the alleged abuser and his
victim. We will consider best means of addressing these issues? Is it the election or selection of judges? Examine Caperton vs. Massey
under the microscope.
Globalization and the Changing Roles of In-house and Outside Counsel by TRT (2.0 ethics, 2.0 total, 73178)
_____June 29[4-6pm], _____July 7, _____August 3, _____August 24,
Globalization continues as a major force affecting the practice of law both here and abroad. This is especially applicable with in-house and
outside counsel issues where roles are rapidly changing in this 21st century. Issues involving corporations and the privilege will increasingly
impact domestic and foreign practitioners. Special attention is devoted to MJP as a functioning concept of practical concern, especially when
considering the role of corporate counsel.
Not for Government Lawyers Only by TRT (2.0 ethics, 2.0 total, 73179)
_____July 1, _____August 2, _____August 16,
This seminar focuses on unique role differences that exist between government and private lawyers. Further, government lawyers are special
types of civil servants, especially when applying the Whistleblower Protection Act. Would society be better served if government lawyers who
leak information were afforded added protection? How might bar ethics committees respond to any special confidentiality exemptions for
government lawyers?

Arbitration - Fundamentals and Practice by TRT (2.0 sub, 2.0 total, 73181)
_____July 11, _____August 15,
Arbitration, the hiring of a "private judge" to resolve a dispute, is often elected as a method of alternative dispute resolution when the parties
desire a binding decision. Understanding the fundamentals of arbitration enhances your ability to plan the strategy of your arbitration session.
This seminar will examine these fundamentals and discuss your obligation to advise your clients as to the availability of arbitration. The
practice of arbitration includes issues to address in the pre-hearing conference, structuring pre-hearing discovery, arbitrating with or without a
transcript, requesting a reasoned award, and possible challenges to the arbitrator’s award.
Mediation - Fundamentals and Practice by TRT (2.0 sub, 2.0 total, 73182)
_____July 14, _____August 19,
Mediation is the most prevalent method of alternative dispute resolution. Understanding the fundamentals of mediation enhances your ability
to plan the strategy of your mediation session. This seminar will examine the mediation fundamentals and discuss your obligation to advise
your clients as to the availability of mediation. The practice of mediation includes choosing methodology, defining the mediator’s role, and
understanding how the attorney and client interact in the mediation process.

Climate of Law or Law of Climate by TRT (2.0 sub, 2.0 total, 73184)
_____July 12, _____August 10,
Seminar focuses on the "Climate of Law" as legal/political/public-policy issues impacting, and being impacted by, the "Law of Climate"
meaning application of the scientific method to determine the extent of scientific knowledge about Earth's climate in the past, the present and
the future. Legal issues include such things as international treaties and protocols, the UN Inter-Governmental Panel on Climate Change, the
Federal Rules of Evidence governing the admissibility of Scientific Evidence. Scientific issues include focus on the scientific method as the
standard by which science separates "the wheat from the chaff" in evaluating scientific theories, hypotheses, postulates and speculations in
the endeavor to understand the "laws" of physics and chemistry that affect our environment and human activity.
Complex Litigation—Is It Obsolete? by TRT (2.0 sub, 2.0 total, 73185)
_____July 13, _____August 5,
Seminar focuses on whether mega-complex litigation is making litigation obsolete for mega-complex cases. Are we encountering increasing
numbers of cases for which the complexity of litigating them makes litigation an obsolete form of resolving such controversies? How can
controversies be resolved by litigation which intrinsically may require a decade or more if such litigation is to methodically handle all pertinent
issues of law and fact in a manner consistent with centuries of law and procedure designed to do so in vastly simpler times with respect to
vastly simpler issues? Could the effect of this problem be to require more such issues to be decided by extra-judicial means such as
"mediation" or by legislation or by simply broadening the areas in which free societies simply choose to allow the market to determine the
outcome of such controversies rather than pursuing an elusive, if not illusory, goal of seeking to assemble enough human wisdom (in the
context of the adjudicative process and/or the legislative process) to resolve such problems. These are not idle questions. Do they focus this
broader controversy on determining whether "command" economies can serve the goal of human progress as well as market-driven
economies?
