                                Community Amenity Local Law No. 1
   Gannawarra Shire Council (Council) on 21 April 2010 made a local law which is titled
Community Amenity Local Law No. 1 (the Local Law).
Purpose of the Local Law
   The purposes of the Local Law are to provide for the peace, order and good government of the
Shire by:
1.     Managing uses and activities on roads and Council land so that the Council is aware of uses
       or activities which may:
       1.1     interfere with the safety and convenience of people travelling on or using roads or
               Council land;
       1.2     impede free and safe access for people, in particular those with sight and movement
               impairment or disabilities;
       1.3     cause damage to Council and community assets;
       1.4     create a danger or expose others to risk; and
       1.5     be detrimental to the amenity of the area or the enjoyment of facilities on roads or
               Council land.
2.     Managing, regulating and controlling activities and uses on any land which:
       2.1     may be dangerous, cause a nuisance or be detrimental to the amenity of the area of the
               environment;
       2.2     are directed at maintaining a healthy and safe environment for residents and visitors;
       2.3     promotes community expectations and demands about a desired lifestyle and the
               availability of goods and services;
       2.4     identifying activities and uses that are not permitted; and
       2.5     providing for the administration of the Council’s powers and functions.
General purport of the Local Law
The Local Law:
1.     Repeals Local Law No. 1 2000.
2.     Makes it an offence for a permit not to be obtained before:
       2.1     using a heavy vehicle contrary to a signed restriction;
       2.2     droving or grazing livestock;
       2.3     placing advertising signs on a road;
       2.4     carrying out itinerant trading;
       2.5     displaying goods and services for sale or hire on a road or public place;
       2.6     providing outdoor eating facilities;
       2.7     occupying a road for works;
       2.8     having a street party, festival or procession;
       2.9     collecting money, gifts or subscriptions;
       2.10 placing bulk rubbish containers on roads;
       2.11 camping on Council land or private land;

      2.12 conducting carnivals and festivals;
      2.13 storing, assembling or dismantling vehicles, machinery and second-hand goods;
      2.14 keeping excess numbers of animals;
      2.15 using recreation vehicles;
      2.16 placing trade waste and waste hoppers on a road or Council land; and
      2.17 selling or offering for sale goods or services or soliciting money from house to house
      in the manner specified in the Local Law.
3.    Make it an offence for a person not to observe additional requirements relating to:
      3.1      using heavy vehicles on restricted roads;
      3.2      droving and grazing livestock on roads;
      3.3      advertising signs on roads or Council land;
      3.4      itinerant trading;
      3.5      display of goods for sale on a road;
      3.6      outdoor eating areas;
      3.7      street parties, festivals and processions;
      3.8      camping on Council land or public places;
      3.9      the keeping of animals;
      3.10 the location of trees, plants and signs;
      3.11 display of property numbers;
      3.12 naming of roads;
      3.13 removal of vehicle crossings;
      3.14 animal housing;
      3.15 domestic waste and recyclable material collection;
      3.16 commercial and industrial waste collection;
      3.17 transportation of wastes;
      3.18 storage of redundant refrigerators and similar containers;
      3.19 using toy vehicles on roads or Council land; and
      3.20 parking of vehicles in parking areas.
4.    Makes it an offence for a person to do prohibited things relating to:
      4.1      trading from designated trade areas;
      4.2      using toy vehicles in designated areas;
      4.3      riding horses on a road or Council land in designated areas; and
      4.4      repairing vehicles on a road.
5.    Regulates behaviour on roads, Council land and public places by creating various offences
      where the behaviour could:
      5.1      cause damage to the road or Council land;
      5.2      damage or interfere with the enjoyment of adjoining properties;
      5.3      interfere with the quiet enjoyment of persons using Council land; and
      5.4      consumption of alcohol.
6.    Prohibits open air burning in all areas except the farming zone.
7.    Prohibits the keeping of land so that it becomes dangerous, unsightly, detrimental to
      the general amenity of the neighbourhood or a danger to life or property from the threat
      of fire.

8.     Prohibits the depositing of specified materials in a street litter bin or recycling bin.
9.     Prohibits the provision or use of any glass container at any street party, carnival or festival
       for which a permit has been granted.
10.    Regulates the collection of animal litter on roads or Council land.
11.    Requires persons to take steps to prevent objectionable animal or bird noise from property.
12.    Incorporates a Policies and Procedures Manual which outlines the manner in which specified
       aspects of the Local Law will apply.
    Copies of the Local Law may be inspected at the Council offices at 47 Victoria Street, Kerang,
during office hours. The Local Law may also be inspected on Council’s website.

                          Local Law No. 1 – Meeting Procedure (2010)
    Notice is hereby given pursuant to section 119 of the Local Government Act 1989 that the
Strathbogie Shire Council, at its meeting held on 20 April 2010, resolved to revoke its Local Law
No. 1 – Meeting Procedures and Common Seal (2009), and adopt a new Local Law No. 1 – Meeting
Procedure (2010). The purpose of the local law is to regulate and control the procedures governing
the conduct of meetings.
    A copy of the local law may be inspected at the Shire Offices, corner Binney and

    The Moorabool Shire Council has prepared Amendment C06 to the Moorabool Planning

    –     amend Clause 21.06 – Heritage for the purpose of identifying the Bacchus Marsh
          Heritage Study and for providing greater clarity regarding the planning permit application
          requirements;
l   remove the existing Heritage Overlay HO21 described as Belle Vue at 25 Roch Court, Ballan,
    from the Moorabool Planning Scheme by:

    Under sections 17B and 17DA of the Crown Land (Reserves) Act 1978, I, Gavin Jennings
MLC, Minister for Environment and Climate Change, being satisfied that there are special reasons
which make the granting of a licence reasonable and appropriate in the particular circumstances
and to do this will not be substantially detrimental to the use and enjoyment of any adjacent land
reserved under the Crown Land (Reserves) Act 1978, approve the granting of three licences by
Seville Cricket and Recreation Reserve Committee of Management Inc. for the purpose of (a) tennis
and associated activities, (b) AFL football and associated activities, and (c) cricket and associated

                    ANTHRACNOSE HOST MATERIAL INTO VICTORIA
   I, Patrick Sharkey as delegate of the Minister for Agriculture, make the following Order:

1     Objective
      The objective of this Order is to prevent the entry or importation of the exotic disease lupin
      anthracnose into Victoria.
2     Authorising provision
      This Order is made under section 24 of the Plant Health and Plant Products Act 1995 (‘the
      Act’).
3	    Definitions
      In this Order –
      ‘accreditation program’ means any program under which a person is permitted to issue an
      assurance certificate, including any procedures available under the Interstate Certification
      Assurance (ICA) Scheme;
      ‘authorised inspector’ means a person authorised as an inspector under the Act;
      ‘lupin anthracnose’ means the exotic disease caused by the fungus Colletotrichum
      gloeosporioides (Penz.) Penz. and Sacc. (lupin strain);
      ‘lupin anthracnose host material’ means any lupin anthracnose host plant, agricultural
      equipment or used package;
      ‘lupin anthracnose host plant’ means any plant or plant product of Lupinus species;
      ‘Manager Plant Standards’ means the person for the time being occupying or acting in the
      position of Manager Plant Standards in the Department of Primary Industries.
4     Controls applying to lupin anthracnose host material
(1)   The entry or importation into Victoria of any lupin anthracnose host material is prohibited.
(2)   Sub-clause (1) does not apply if the lupin anthracnose host material –
      (a)     was grown on, sourced from or last used on a property that is located in a State or
              Territory or part of a State or Territory for which an area freedom certificate, issued
              by an officer responsible for agriculture in the State or Territory where the lupin
              anthracnose host material was grown, sourced or last used, is currently in force
              certifying that the State or Territory or part of the State or Territory is known to be
              free of lupin anthracnose; or
      (b)     is packed, labelled and certified in accordance with any conditions prescribed by an
              accreditation program administered by the department responsible for agriculture in
              the affected State or Territory; or
      (c)     is accompanied by a plant health declaration issued by an authorised person declaring
              that it has been treated in a manner approved by the Manager Plant Standards; or
      (d)     is treated in accordance with conditions specified in a permit issued by an inspector;
              and
      (e)     is accompanied by a plant health certificate issued by an officer of a department
              responsible for agriculture in the affected State or Territory certifying that it has been
              treated in a manner approved by the Manager Plant Standards.

5	       Verification	of	consignments
(1)      Where requested by an authorised inspector, lupin anthracnose host material imported into
         Victoria which is required by clause 4(2) to be accompanied by a certificate or declaration
         must be:
         (a)     presented to an authorised inspector for inspection; or
         (b)     verified by a person accredited to do so by the Department of Primary Industries.
         Note: Section 25 of the Plant Health and Plant Products Act 1995 provides that a person
         is guilty of an offence and a penalty not exceeding 50 penalty units in the case of a natural
         person, and 200 penalty units in the case of a body corporate, for knowingly breaching an
         Importation Order.

                              State Owned Enterprises Act 1992
                    VARIATION TO THE VICFORESTS ORDER IN COUNCIL
                                        Order in Council
    The Governor in Council, under section 16 of the State Owned Enterprises Act 1992, varies
the State Owned Enterprises (State Body – VicForests) Order 2003 (Gazette No. S198 28 October
2003 and Gazette No. G8 19 February 2009) as follows:
(a). Delete clause 3(7) and replace with new clause 3(7):
       ‘Clause 3(7): VicForests must undertake its commercial activities in a manner which will
       maximise the long-term economic returns to Victoria.’
(b). Insert new clause 3(8):
       ‘VicForests must operate in a framework consistent with Victorian Government policy and
       priorities.’

(c).    Delete clause 4(4) and replace with new clause 4(4):
        ‘Clause 4(4): The Directors of VicForests shall on the recommendation of the Treasurer
        and the Minister, be appointed by the Governor in Council having regard to the expertise
        necessary for VicForests to achieve its functions and objectives.’
(d). Delete clauses 4(6)(a) and replace with a new clause 4(6)(a):
        ‘Clause 4(6)(a): The Chair and the Directors shall be entitled to such remuneration as is
        determined in writing by the Treasurer and the Minister.’
(e). Delete clauses 5(1) and 5(2) and replace with new clauses 5(1) and 5(2):
        ‘5.    Chairperson
               (1)    The Treasurer and the Minister may appoint a director to be the chairperson of
                      the board.
               (2)    At the time of appointing a chairperson the Treasurer and the Minister must
                      determine the period of appointment, which may not exceed the remainder of
                      the appointee’s term as director.’
(f).    Delete clause 5(4)(d) and replace with new clause 5(4)(d):
        ‘Clause 5(4)(d): liaise with the Treasurer and the Minister.’
(g). Insert new clause 6:
        ‘6.     Designation of relevant Minister
               The Minister is designated as the relevant Minister for the purposes of the State
               Owned Enterprises Act 1992 in relation to VicForests.’
     This Order comes into effect from the date it is published in the Government Gazette.
