June 18, 1971, a notice of proposed implementation of a modifi­ cation of NIH copyright policy was pub­ REGISTER, Volume lished in the FEDERAL 36. No. 118. Institutions receiving grant support from the National Institutes ,of Health were also informed of the proposed modification through publication in the “NIH Guide for Grants and Contracts-No. 7’’ on June 14, 1971. The responses to these notices fell primarily into two groups. The first expressed concern that the proposed policy affected the copyright on books or similar types of publications. These correspon­ dents were assured that no such change was implicik or explicit in the proposed change. The se6Ond group of reswnses related to the impact of the proposed change upon scientific journals. These were con­ sidered with great care. In conjunction with the DHEW Ofece of the General Counsel, it was concluded that the argu­ ments which were advanced would not preclude the adoption of the proposed policy change. Thus, under the provisions of 0 52.23, 35 FR 5470, notice is hereby given that the National Institutes of Health copyright policy is amended to read as follows: “Except as may otherwise be provided under the terms and conditions of a specific grant award, the grantee may copyright or arrange for copyright, without prior National Institutes of Health approval, any publication, film or other similar communication material devel­ oped or resulting from a project supported in whole or in part by a National Institutes of Health grant. Such copyright. however, is subject to a royaltyfree, nonexclusive and irrevocable license or right in the government to reproduce, translate, publish. use, disseminate, and dispose of such material and,to author­ ize others to do so. In addition, communi­ cations in primary scientific journals publishing initial reports of original research supported in whole or in part by the National Institutes of Health may LE copyrighted by the journal with the understanding, however, that individ­ uals are authorized to make, or have made by any means available to them, without regard to the copyright of the journal, and without royalty, a single f copy o any such article for their own use.” Dated September 27. 1973. An Ischemic Heart Disease SCOR i s d e f i n e d as a u n i t encompassing r c u l t i d i s c i p l i n a r y c l i n i c a l and fundamental r e s e a r c h d i r e c t e d a t t h e r e d u c t i o n of d e a t h and d i s a b i l i t y from ischemic h e a r t d i s e a s e . The complete spectrum of ischemic h e a r t d i s e a s e i s a p p r o p r i a t e f o r t h e Ischemic Heart Disease SCORs, from t h e e a r l y d e t e c t i o n of l a t e n t ischemic h e a r t d i s e a s e t o such problems as a c u t e myocardial i n f a r c t i o n , sudden c a r d i a c d e a t h , angina p e c t o r i s , c o n g e s t i v e h e a r t f a i l u r e , emergency-medical care, and c a r d i a c r e h a b i l i t a t i o n . The Ischemic Heart Disease SCORs r e p r e s e n t a c o n t i n u a t i o n of t h e Myocardial I n f a r c t i o n Research Unit (MIRU) program now more b r o a d l y focused on t h e v a r i o u s m a n i f e s t a t i o n s of ischemic h e a r t d i s e a s e . These Ischemic Heart Disease SCORs are n o t t o b e confused w i t h t h e N a t i o n a l Research and Demonstration Centers which t h e I n s t i t u t e c u r r e n t l y i n t e n d s t o e s t a b l i s h . h'hile a R&D Center i s i n t e n d e d t o b e mre comprehensive t h a n a SCOR, t h e a c t i v i t i e s of a SWR c o u l d become a r e s e a r c h component p a r t of such a Center. Although t h e s u p p o r t mechanism f o r t h e s e SCORs w i l l b e t h e g r a n t - i n - a i d , i t w i l l d i f f e r from o t h e r r e s e a r c h g r a n t s b o t h i n i t s g o a l o r i e n t a t i o n and i n t h e degree of d i r e c t p a r t i c i p a t i o n by t h e N a t i o n a l Heart and Lung I n s t i t u t e . The Program Announcement and G u i d e l i n e s i s b e i n g s e n t t o t h o s e on t h e m a i l i n g l i s t of t h e C l i n i c a l Cardiac Diseases Branch, i n c l u d i n g t h e Deans and Chairmen of t h e Departments of Medicine, Surgery, and Cardiology a t a l l medical s c h o o l s . The b a s i c agreement i s a master c o n t r a c t e n t e r e d i n t o between t h e c o n t r a c t o r and N I H t h a t p r e s c r i b e s terms and c o n d i t i o n s uniformly a p p l i c a b l e t o a l l N I H r e s e a r c h c o n t r a c t s w i t h t h e c o n t r a c t o r . I n d i v i d u a l p r o j e c t s a r e funded as s p e c i f i c c o n t r a c t s which are a u t o m a t i c a l l y i n c o r p o r a t e d i n t o and made a p a r t of t h e b a s i c agreement. Each c o n t r a c t i s a s e p a r a t e arrangement and w i l l , a c c o r d i n g l y , i n c l u d e some s p e c i a l p r o v i s i o n s t a i l o r e d t o t h e requirements of t h e p a r t i c u l a r p r o j e c t . However, g e n e r a l c o n t r a c t terms and c o n d i t i o n s w i l l be governed by t h e p r o v i s i o n s of t h e b a s i c agreement. Thus, t h e b a s i c agreement r e f l e c t s t h e ground r u l e s u n d e r l y i n g t h e c o l l a b o r a t i v e arrangement between N I H and t h e c o n t r a c t o r . I t does n o t , of c o u r s e , r e p r e s e n t a commitment by N I H t o make f u t u r e awards. Experience has shown t h e b a s i c agreement t o be an e f f e c t i v e a i d i n s i m p l i f y i n g a d m i n i s t r a t i o n and c o n t r o l of c o n t r a c t s as w e l l as s t a n d a r d i z i n g t h e r e l a t i o n s h i p s between p a r t i e s .
