   PLAINTIFFS' RESPONSE TO NEW NGC, INC.’S MOTION FOR CONSIDERATION
  OF ITS MOTION TO STAY ON AN EXPEDITED BASIS OR, IN THE ALTERNATIVE,
              A STAY OF ALL PROCEEDINGS PENDING A RULING

         The Plaintiffs, GEORGE BRINCKU, BRENDA BRINCKU, LYDIA GARCIA,

  APOLINAR GARCIA, JAMES VISINTIN and JENNIFER PAIGE VISINTIN, hereby file their

  response to Defendant, NEW NGC, INC., d/b/a/ National Gypsum Company’s Motion for

  Consideration of its Motion to Stay on an Expedited Basis or, in The Alternative, A Stay of all

  Proceedings Pending a Ruling, and state as follows:

         1.     On August 3, 2010, Defendant, National Gypsum Company, filed its Motion for

  Consideration of Motion to Stay on an Expedited Basis or, in the Alternative, a Stay of All

  Proceedings Pending a Ruling [D.E. 91], to which this Response is directed.

         2.     The undersigned counsel either represent or are currently investigating claims of

  90 owners of residential homes in Florida containing synthetic drywall manufactured, sold,

  distributed, or supplied by National Gypsum from its Apollo Beach Plant who have experienced

  copper sulfide corrosion of HVAC or electrical systems (excluding the named Plaintiffs in the

  instant action).

          3.         As argued in Plaintiffs' Response to Defendant National Gypsum's Motion to Stay

  [D.E. 86], the putative class described in the Amended Complaint [D.E. 79] is limited to owners

  of residential homes in Florida with defective drywall from National Gypsum's Apollo Beach

  Plant that causes copper sulfide corrosion, such as the 93 claimants noted above.              The

  compelling circumstances to expedite the Court's review and hopeful denial of the Motion to

  Stay pursuant to Vital Pharm., Inc. v. Cytosport, Inc., 2009 WL 302277, at *2 (S.D. Fla. Feb. 9,

  2009), are that not only are that these Florida claimants driven from their own homes due to the

  National Gypsum’s defective drywall, but also many are facing foreclosure proceedings that

  could extinguish their very claims for the same. Therefore, delaying the instant matter, or

  discovery relating to the instant matter, will significantly prejudice Plaintiffs and the class they

  seek to represent.

          WHEREFORE, Plaintiffs respectfully request this Court grant an expedited review of the

  instant Motion [D.E. 91], and deny the stay requested in National Gypsum’s Motion to Stay

  [D.E. 83], but in no event grant any alternative relief staying discovery.
