WHEREAS Chapter 166 Florida Statutes authorizes municipalities to adopt ordinances

and resolutions to protect the citizen health safety and welfare in exercise of the
spolice power and

WHEREAS on April 19 2010 the City Council of the City of Groveland adopted
Ordinance 2010 0410 establishing a Rental Dwelling Unit License and Inspection
Program and

WHEREAS Ordinance 20100410 provides for City Council to adopt a resolution
setting forth the fees authorized by the Ordinance and

        WHEREAS the Cityof Groveland has the responsibility to enforce the Florida Building Code and
other related regulations relative to safe and habitable propertymaintenance and structures and

        WHEREAS the Housing Element ofthe City ofGroveland Coluprehensive Plan recommends that
the City establish principles and guidelines to promote the rehabilitation of housing regulate
demolition and improve housing quality to preserve quality ofhousing and

        WHEREAS there exists in the City structures used for human habitationwhich are or may
become inthe future substandard with respect to structure equipment or maintenance and may constitute a
menace to the health safety and welfare ofits citizens and

       WHEREAS experience has shown that it is oftentimes more difficult to engage in code
enforcementprocesses with regard to rented residential properties as opposed to owner occupied residential
properties and


       WHEREAS the City Council of the City of Groveland finds that a system of rental horsing
licensing and related regulations will help preserve maintain and upgrade neighborhoods to the benefit of
    s
the City economic safety social and environmental wellbeing and

       WHEREAS the City has found it necessary for the further protection of the health safety and
welfare of landlords tenants neighboringresidents and general citizens that measures be adopted regarding
code compliance responsibilities ofthe owners ofsaid properties offered forrent or lease and

       WHEREAS the City has adopted the International Property Maintenance Code that is referred to
as the Groveland Property Maintenance Code but it is necessary for further protection ofthe health safety
and welfare of landlords tenants neighboring residents and the citizens of the City at large that further
measures be adoptedrequiring the periodic licensure and inspection ofproperties for code compliance and
setting forth more particular responsibilities ofproperty owners ofproperties offered for rent and

       WHEREAS establishment of a rental dwelling inspection program is fundamental to the
 prevention ofblight and decay and the safeguarding ofthe public health safety and welfare ofthe citizens

         NOW THEREFORE BE IT ORDAINED by the City Council of the City of Groveland
 Florida as follows


            1 Legislative Finding The recitals
 SECTIONCouncil ofthe City ofGroveland set forth above are hereby adopted as legislative findings
 ofthe City

 SECTION 2 Short Title This Ordinance shallbe known and may be cited as the Groveland Residential
 Rental Inspection Ordinance

 SECTION 3 Definitions The following definitions shall apply to this Ordinance

 Change in Occupancy Anychange in occupancy ofthe majority of adult occupants of a rental dwelling
unit



       Agent Any person or firm
Localdwelling units are maintained that has charge care or control ofa building or part thereof in which
rental

Property Owner
                    Any person agent operator fimn corporation partnership association property
maintenance group or fiduciary having equal equitable orother interest in real property or recorded in the
official records as holding title to the property or otherwise having control of the property including the
local agent or the guardian of the estate of any such person and the executor or administrator of such
person estate

Rental Dwelling Unit A structure or part of a structure used as a home residence or sleeping place that
is occupied by one or more tenants for which the owner is receiving or is entitled toreceive rent or
compensation in any other form It does not include property approved and licensed for bed and breakfasts
hotels motels medical and educationalinstitutions assisted living facilities or other rentaldwelling units
exempt under the provisions ofthis Ordinance It does include the red property thestructure is constructed
on




Special Master Aperson or persons designated byCity Council pursuant to OrdinanceNo 2006 12222
hereby given authority to hearviolations and appeals as specified in this Ordinance

Vacancy Any change used interchangeably with Change in Occupancy vacancy means any change in
the occupancy ofthe majority of adult occupants ofa rental dwelling unit

SECTION 4 License Required forRental Dwelling Units It shall be unlawful forany property owner or
other person firnm corporationor other entity tooperate or causeto be rented any rental dwelling unit
without owner having fast obtained arental license in compliance with the provisions ofthis Code section
SECTION 5 Rental LicenseApplication Exemptions from Licensing and Inspections
     1 The ownerof each rental dwelling unit existing as of the effective date of this Ordinance
        shall file an application for a rental dwelling unit license listing each rental dwelling unit
        on a form prescribed by the City The rental dwelling unit license fee shall be
        determined by the number of rental dwelling units The owner of each rental dwelling

         unit constructed or converted to rental use after the effective date of this Ordinance shall
         file an application for a rental dwelling unit license on a form prescribedby the City prior
         to any initial occupancy The rental dwelling unit license fee shall be determined by the
         number ofrental dwelling units constructed or converted to rental use

    2 An agent may apply for a rental license upon exhibiting a sworn statement from the property
         owner provided that such authorization acknowledges receipt of a copy of this Ordinance and
         acknowledges that failure to abide by this Ordinanceor other applicablecodes and ordinances may
         result in a lien upon other property ofthe owner

         Exemptions No rental license or inspection isrequired ofany
             a
                 Rental dwelling unit occupied by the Property Ownereven though it is also
                 occupied by a tenant

             b Residential unitsrequired to be inspected on a periodic basis for compliance with State or
                 Federal housing standards provided however that the property owner must submit to the
                 City a Certificate ofInspection or other documentationverifying the compliance with said
                 standards furthermore nothingherein shall prohibit the City from conducting a complaint
                 driven or Code Inspectorinitiated inspection ofsuch dwelling unit
Nothing in these exemptions otherwiseexcuses property owners from compliance with the International
Property Maintenance Codethat is referred to as the Groveland PropertyMaintenance Code or any other
applicable codes or ordinances

SECTION 6 Rental License Fee and Inspection Fee

   1 A rental licenseshall be valid from April 1 through March 31 of each year A rental
     license required between April 1 and September 30 shall pay the rental dwelling license
        fee for the entire year An annual rental dwelling unit license required between October
        1 and March 31 shall pay a prorated rental dwelling license fee equal to onehalfof the
        license fee An owneris required to obtain a rental dwelling license fee prior to use as a
        rental dwelling unit except that all property owners of rental dwelling units within the
        City existing as of the effective date of this Ordinance shall applyfor and obtain a rental
        dwelling unit license within ninety 90 days of the effective date of this Ordinance

        The rental license fee shallbe charged for any license issued hereunder and for all tendered with an
        application for issuance of a license and annually thereafter on or before the date of the license
                   The receipt from the City
        renewal license has been issued that the rental license fee has been paid shall be evidence that
        the rental


  3 An inspection fee shall be assessed and paid before a rental inspection is conducted and a
        Certificate of Inspection is issued pursuant to Section 7 ofthis Ordinance A reinspection fee shall
        be assessed and paid to review corrective action required on a rental dwelling unit The inspection

        andre fees shall be establishedbyresolution ofthe City Council

        No refunds for license inspection orreinspection fees shall be made to those discontinuing
        operation or who sell transfer give away or otherwise dispose of a licensed property to another

        property owner If the property remains as a rental dwelling unit the current license may be
        transferred to the new owner and no additional fees are necessary for the remaining license or
        inspection periods however the new property owner shallsubmit a new completed application in
        compliance with the requirements of this Ordinance A license andCertificate of Inspection shall
        terminate upon failureto apply for their transfer within thirty30 days ofthe date ofsale or transfer
        ofownership ofarental dwelling unit

SECTION 7 Fees The fees shall be determined by City Council in the form of a Resolution
SECTION 8
                Rental Inspection Program Requirements The provisions of this Section shallnot be
interpreted as authorizing the City to conductinspections ofrental dwelling unitswithout the consent ofthe
owner or occupant or without an administrative inspection warrant It is not possible to implement this
Inspection Programcitywide immediately when this Ordinance becomeseffective however the following
requirements shall applycitywide

    1 This Inspection Program applies to all rental dwelling units Whenever a rental dwelling unit has a
        change in occupancy by rental a valid Certificate of Inspection from the City must exist for that
        unitbefore it canbe lawfully reoccupied by atenant

   2 It shall be unlawful for any owner of a rental dwelling unit to allow any tenant to occupy
        a rental dwelling unit ifthe required certificate ofoccupancy for the rental dwelling unit
        has not been issued bythe City as the time the occupancy commenced for that tenant
        Any tenant that occupies the rental dwelling unit in violation hereof shall be required to
        vacate the rental dwelling unit within 48 hours ofreceipt of a written notice from the
        Code Inspector

        Subsection 2of this Section shall not applyto tenants who began their tenancy in the subjectrental
       dwelling unit priorto the effective date ofthis Ordinance

   4 After a rental dwelling unithas been inspected the Certificate of Inspection shall be issued by the
       City ifthat rental dwelling unit and property complywith all applicable codes ofthe City
   5
       The City shall issue an inspection decal that shall be displayed in a front window of the rental
       dwelling unit and shall be applied by the CodeInspector It shall be a violation of this Code to
       remove this decal


   6 If the rental dwelling unit does not comply with the applicable provisions of all City codes that
     rental dwelling unit must be brought intocompliance before a Certificate of Inspection will be
     issued and occupancy allowed

  7 If the property does not complywith the applicable provisions of all City codes the rectal dwelling
       unit shall be brought into compliance before a Certificate of Inspection willbe issued for a rental
       dwelling unit

  8 For inspections involving multiple residential rental dwelling units that exceed four 4 at one
       location and uponthe consent ofthe owner or designee or issuance of an administrative inspection
       warrant a random samplingof the properties may be inspected at the discretion of the Building
       Official or Fire Chief or their designees The minimum random sampling ofthe property is thirty
       percent 30 of the rental dwelling units and the maximum isone hundred percent 100 ofthe

          trtal dwelling units Forpurposes of calculating inspection totals any fractionalportion ofarental
          dwelling wait shall becounted as an additional rental dwelling unit beinginspected

          A Certificate of Inspection shall be valid for up to thirty 36 months or upon a changein the
          tenant occupancy whichever occurs first It is the generalintent of this sectionthat each rental
          dwelling unitshall be inspected at least once every thirtysix 36 months unless a reinspection is
                     or unless
          warranted schedule the rental dwelling unit is vacant The City shall maintain an inspection andre
          inspection


     10 Rental dwelling units contained in structures that are less than five 5 years old are
          exempt from the initial inspection process but are not exempt from obtaining a rentallicense This
          exemption recognizes that newer structures receive initial inspections per the building
          code process and no further duplication isrequired for five5 years
          inspection
    11 Upon request of any tenant or prospective tenant the property owner or agent shall produce the
          Certificate ofInspection issued bythe City

    12 If the cutrent CertificateofInspection is lost or destroyed the property owner or agent may apply to
                  for
         the City of a duplicate certificate without reinspection unless inspection is due because of the
                      morethan
         passage                  six
                                  thirty 36      months
                                                             Whether within a two family or a multi family
         dwelling any rental dwelling units within a structure which are in compliance with all applicable
         codes may continue to be occupied even ifrental dwelling units in other portions ofthe structure do
         not comply with all applicable codes so long as the non compliant units do not create a hazard to
   the health and safety ofthe persons in the unitsin compliance passersby or nearby properties

SEC1 Conduct of Inspections Each property owner engaged in the rental of dwelling units shall
undertake to make such property available for a reasonable inspection of the exterior and interior of the

rental dwelling unitto determinecompliance with the City codes provided that the City shall at all times
honor the rights ofthe property owner and the tenant

         Inspections required underthis Ordinance shall bemade only byCode Inspectors designatedby the
         City Manager A law enforcement officer may accompany Code Inspectors provided that thereis
                                               spersonal safety is atrisk during the inspection
         probable cause to believe that an CodeInspector
                  unqualified person may accompany Code Inspectors without consent of the property
         No othertenant
         owner or

         Inspections shall be made at the request ofthe tenant at the request ofthe property ownerwhen the
         property is unoccupied betweenrentals or when the Code Inspector has reasonable suspicion
         supported by a sworn affidavit to believe that a health or safety violation exists inside thedwelling
         or when an administrative inspection warrant has been issued

         The Code Inspectorshall make hisor her inspections during normal City Hall business hours
         unless


         a The Code Inspector has made an appointment for another inspection tinge at the request ofthe
             property owner or tenant or

        b The Code Inspector has previously attempted two ormore times to completean inspection
                   al
            during nou City Hall business hours and has found no adult person on the premises
            authorized to admit the Code Inspector

   4 At the commencement ofeach inspection the Code Inspector shall exhibit his or her credentials
        and identification and advise the property owner tenant or adult person authorized to admit the
        Code Inspector that an inspection is required under the provisions ofthis Ordinance
   5
       Ifthe Code Inspector is denied admittanceby the property owner tenantor local agent or if the
       Code Inspector fails in at least three attempts to complete an inspection of the premises because
       there is no adult person on the premises to admit the Code Inspector the Code Inspector shall
       provide notice of failure ofinspection to the property owner in accordance with Florida Statute 162
        Within three days after receipt or refusal of such notice the property owner shall arrange the
        admittance ofthe Code Inspector to the premises for the completion ofthe requiredinspection If
       the property owner fails to arrange suchadmittance the City shall revoke the license and Certificate
       of Inspection and shall notify the property owner ofsuch revocation by certified mail If the
       pmperty owner thereafter continues to permit the rental of the premises without inspection the
                                                                 s
       property owner shall be subject to proceedings before the City Special Master for violation ofthis
       Ordinance and for any other Code violations which may be apparent

SECTION 10 Temporary Certificate ofInspection

   1 A temporary Certificate of Inspection may be issued by the Code Inspector when existing
     violations pose no serious or immediate threat to the health or safety of an occupant or occupants of
       adjacent dwelling units are not a blighting influence upon the surrounding neighborhood are not a
       serious threat to nearby properties and when the following conditions are met
       a
           The owner has been justifiably delayed in making the necessary corrections to permit the
           issuance ofa Certificate ofInspection and has a valid contract in writing with a person qualified
           to perform the work and furnish the materials to correct the violations any permits required to
           perform the work have been obtained and the contract specifies the dates for commencement
           and completion of the wodc or the owner provides a notarized sworn statement representing
           that the necessary work is to be accomplished by the owner and specifying the dateby which
           the work is to be completed and any permits required to perform the work have been obtained

       b The Code Inspector finds that the delay in the correction ofthe violations and the plans for such
         corrections are reasonable andthe work can be undertaken and completed while the premises
           are occupied

   2   A temporary Certificate ofInspection will state a specific date by which correction ofthe violations
       will be accomplished and will be valid until that date however no temporary Certificate of
       Inspection shall be valid for more than six 6 months A reinspection will be made immediately
       prior to or at the time of expiration ofthe temporary Certificate ofInspection

   3 Ifthe corrections have not been completed by the expiration date of the temporary Certificate of
       Inspection it shall be unlawful for the owner ofthe rental dwelling unit for which the temporary
       Certificate ofInspection has expired toallow any tenant to occupy that rental dwelling unit
SECTION 11 Temporary Waiver ofCertificate ofInspection

     1 In the event the Code Inspector is unable to respond to a requestfor inspection asprovided in this
       Ordinance oris unable to inspect prior to the expiration of a Certificate of Inspection the owner
         maybe issued atemporary waiver ofCertificate ofInspection
     2 Prior to obtaining a temporary waiver of Certificate of Inspection the owner shall submit to the
       City a sworn affidavit stating that the owner is not aware of any Major Violations orMinor
       Violations as defined herein and shall agree in writing in a form acceptable to the City to hold the
         Cityharmless from any claim damage or liability which may arise from or as a result ofany non
         disclosed Major Violations or Minor Violations Upon receipt ofsaid affidavit and hold harmless
         agreement the Cityshall issue a temporary waiver ofCertificate ofInspection
    3
         A temporary waiver of Certificate of Inspection may be issued if minor violations do not
         collectively constitute a major violation
    4
        A temporary waiver of Certificate of Inspection shall be valid for a period of no longer than
        fourteen 14 calendar days from the date the noticeof violation is issued or in the case ofnumber
         1 above the date application was submittedto the City

    5 An owner that has been issued a temporary waiver of Certificate ofInspection shall be allowed to
      permit achange ofoccupancy of the rental dwelling unitfor whichthe waiver was issued without
        the owner being in violation ofthis Ordinance

    6 Before thewaiver expires the CodeInspector shall inspect the housing unit and shall determine if
        the rental dwelling unit is eligible fora Certificate of Inspection Ifit is eligible the Code Inspector
        shall issuea Certificate of Inspection Ifit is not eligible the Code Inspector may issue anotice of
        violation



    7 Notwithstanding any other provision ofthis Section to the contrary ifthe City has through no fault
        ofthe owner of arental dwelling unit failed toinspect arental dwelling unit prior to the temporary
        waiver of Certificate of Inspection expiring the owner shallnot be in violationof this Section by
        allowing a tenantto occupy such rental dwelling unitprovided that such tenant was occupying the
        rental dwelling unit at the time the temporary waiver ofCertificate ofInspection expires
SECTION 12 No water shall be supplied or furnished to the rental dwelling unit unless and
until the owner has obtained a rental license Certificate of Inspection temporary Certificateof
Inspection ortemporary waiver ofCertificate ofInspection


                Transferability
SECTION 13 Non A rental license Certificate of Inspection temporary Certificate                      of
Inspection or temporary waiver of Certificate of Inspection shall not be transferred to any other rental
dwelling unit

SECHON 14 Delinquencies Violations and Revocation

               corrected and the rental dwelling unit passes inspection or until such time as the

   2 Violations Ifthe Code Inspectorfinds violations ofany applicable City codes in a rental dwelling
       unit the Code inspector may issue a notice ofMajor Violation or a notice ofMinor Violation to the
       property owner Refer toExhibit A for a list of major and minor violations If a violation is
       found that is not listed in Exhibit A
                                                 the Code Inspector has the authority to cite the major or
       minor violation at his discretion


       a MajorViolation shall mean a defect that is immediately dangerous to the health or safety of
         the occupants passersby occupants in other dwelling units on the property or nearby
         properties In addition fiveor more minor violations in a dwelling unit or upon the property
           shall be considered collectively as a major violation

       b Minor Violation shall mean a defect that is not an immediate hazard but ifallowed to rernain
           unrepaired will potentially cause a hazard or further property deterioration A maximum of
           four minor violations of applicable codes is allowed however if in the opinion of the Code
           Inspector two to four minor violations collectively pose an immediate danger to the health or
           safety ofthe occupants occupants in other dwelling units on the property passersby or nearby
           properties in the contiguous area such collective violations may be considered major
           violations

           Such violations shallbe cited in the notice of violation as major or minor violations and the
           nature ofthe violations shall be specified on the notice After the time specified for correction
           the Code Inspector shall reinspect the premises to confirm that the violations have been
           corrected If the violations havenot been corrected the Code Inspector may file a verified

 SECTION 15 Non Liability of City A rental license Certificate of Inspection temporary Certificate of
 Inspection temporary waiver of Certificate of Inspection inspection or reinspection is not a representation
 guarantee or warranty ofany kind bythe Cityofthe fitness ofthe rental dwelling unit forwhich the license
 and Certificate were issued nor is it a representation warranty or guarantee of any kind by the City that
such rental dwelling unit is in compliance with City Codes No person shall rely on the rental license or
Certificate of Inspection as a representation of the condition of such unit A statement in substantially this
form shall appear on each rental license receipt Certificate of Inspection temporary Certificate of
Inspection and temporary waiver ofCertificate ofInspectionissued bythe City
SECTION 16 Applicability of Codes and Laws The provisions of this Ordinance do not release any
property owner or person from the requirements of obtaining a Certificate of Occupancy or any
requirements of this Code theFlorida Building Code or any other applicable localor State laws
SECTION 17 Records


    1   Access to Records


            a Property owners ofrental dwelling units shall maintain a list ofthe names oftenants ineach
                 dwelling Such list shall be available to the City within a reasonable time

            b The property owner for arental dwelling unit shall make available to the City those rental
                 records necessary to determinewhen changes of occupancy have occurred Theserecords
                 shall be made availablewithin a reasonable amount of time upon written request bythe
                 City

            c It isnot theintent ofthe City to inspect financial records oftheproperty owner for therental
                of the rental dwelling unit but onlyto inspect thoserecords necessary to establish when
                 occupancychanges have occurred Inthe event the property owner or agent for the rental
                 of the dwelling unit keeps a log of changes of occupancy of the rental dwelling unit
                 contemporaneously with such changes in occupancy such a log when produced for
                 inspection will satisfy the requirements ofthis Section

SECTION 18 Required Notice in Lease Agreements Property ownersofrental dwelling units subject to
this Ordinanceshall include the following language in all leaseagreements entered into subsequent to the
effective date of this Ordinance Notice Aspects of this Lease are regulated by the Groveland Residential
Rental Inspection Ordinance pursuant to which you may have aright to request aninspection ofthe leased
property Youmay obtain a copy ofthe Ordinance from the City ofGroveland at City Hall

 SECHON 19 Unlawful Lease No owner shall enter into any agreement contract lease or sublease
 which provides for permits allows contemplates or facilitatesoccupancy of a rental dwelling unit in
 violation oftheprovisions contained in this Ordinanceor any other ordinanceof the CityofGroveland
 SECTION 20 Local Agent Required

     1 Each property ownerwhoapplies for arental dwelling unit license shall desigrtein theapplication
                 agent on the landlord                             s
         a local notices The localagent may be the landlord or the landlord representative authorized to
         receive              sbehalf


     2 Designated local agents shall maintain a current local telephone number and a current permanent
       local addressnot a public or private post officebox and the property owner shall provide
       notification within thirty30 days to the City Clerk whenever changes occur Forthe purposeof
         compliance with this Section a local address and local telephone number shallbe within Lake
         County or another county adjacent to Lake County

SECTION 21 Supplemental The provisions of this Ordinanceshall be supplemental to allother Codes
and Ordinances of the City The City may pursue any enforcement action or legal remedyavailable under

SECTION 24 Conflicts In any case where aprovision ofthis Ordinanceis found to be in conflict with a
provision of any other ordinance of this City the provision which establishes the higher standards for the
promotion and protection ofthe health andsafety ofthe people shall prevail
SECTION 25 Effective Date This Ordinance shall become effective immediatelyupon its
approval and adoption bythe City Council of the Cityof Groveland Florida however owners
of
        dwelling units existing as of the effective date of this Ordinance shall have until August
1 2010 to comply with the requirements hereof
