					After a great deal of consideration, we of the RAMP Steering Committee (RAMP) have
concluded that it will be in the best interest of the citizens of Austin and, more
particularly, the property owners of plots in Austin Memorial Park, to recommend to the
Parks Department, City of Austin (PARD), that the city make available to Covenant
Presbyterian Church (church) a certain plot of ground out of Austin Memorial Park
Cemetery (AMP) for parking purposes, as follows:

Provision for a Parking Lot


1. The city is to make available to the church a plot of ground with the minimum space
needed for parking 184 cars, the dimensions to be approximately 650' in the east-west
dimension by 150' in the north-south dimension, and the northwest corner of the plot to
be in the northwest corner of AMP in that part of AMP better known as block 12.

2. The following restrictions and provisions are to apply:
        a. The plot is to begin in the northwest corner of AMP.
        b. The parking lot area is to be completely fenced off from AMP; the fence is to
        be 6 feet high and is to be built of either chain link or of masonry.
        c. There is to be no entry into the parking lot area from the cemetery.
        d. The church is to provide vegetative cover on its side of the fence to provide
        visual screening of the parking lot from the cemetery.
        e. The church is to design and provide a drainage system which is acceptable to
        the city and which does not adversely affect the cemetery in any way, physically
        or aesthetically.
        f. All parking is to be solely at ground level, with a deed restriction against any
        sort of multi-level parking garage, and with a further restriction against festivals,
        parties, or similar functions, on or around the parking lot area.
        g. All costs and expenses of building and maintaining the parking lot are to be
        solely at church expense, including the cost of surveying the stated plot of land.
        h. The city may elect whether to:
                (1) Deed the said space to the church in fee simple. Or
                (2) Amend the existing joint-usage agreement between the church and the
                city, so as to provide additional parking for both the church and patrons of
                the Northwest Recreation Center, under terms mutually agreeable to both
                parties.

3. Screen off from the cemetery the area behind the recreation center by providing
vegetative cover planted on the recreation center side of the existing chain link fence; the
vegetation, when mature, is to provide a minimum height of 6 feet.
Capital and Other Improvements

In exchange for receiving the land required to support its need for additional parking,
the church agrees to donate the sum of $1,000,000 to the city, that amount to be deposited
into a special fund to provide certain improvements to AMP, as follows:

1. Design and build a 2,700-niche columbarium/garden complex to be located in AMP at
a spot to be selected later, with architectural plans subject to approval by RAMP and the
city. (Not to exceed: $500,000). 14. RAMP recommends to PARD that the columbarium
be sited preferably just east of the eastmost road in the cemetery and just south of the
existing small drainage canal. In the alternative, RAMP recommends that the
columbarium be placed just north of the eastmost road in the cemetery, just after the point
at which it curves west.

2. Provide a boundary survey of all the remaining undeveloped land in AMP
not currently sold, or under contract of sale. Provide for survey, platting, and irrigating of
the approximately 11 acres of undeveloped land lying (Not to exceed: $70,000.)

3. Ready the remaining land to be suitable for burial. Remove from AMP the unsightly
"road fill" area. It is possible that this fill can be moved to provide fill for low areas in
Evergreen Cemetery, with attendant advantage to both cemeteries, including the resulting
provision of new salable burial property in Evergreen. If that proves unworkable, then the
road fill is to be hauled away to whatever site will accept it. (Not to exceed: $100,000)

4. Provide suitable vegetation to provide a visual screen to block off view the existing
service and supply area just inside the Hancock entrance to AMP, at a cost estimated to
be. Landscape and provide necessary building maintenance to the existing buildings at
the Hancock entrance, including cleaning and pointing-up the stone on the buildings and
entrance. (Not to exceed: $)10,000

5. When the "road fill" and other debris is removed, and the survey and irrigating are
complete, PARD should promptly begin to offer individual plots in the new area for sale
and burial.

6. Once improvements have been completed, remaining funds from the $1,000,000
should be used to establish a Perpetual Care Fund exclusively for Austin Memorial Park.
(Not to be fewer than: $200,000)

7. If the city elects to deed the land for parking, the city is urged to amend the existing
dedication to include the term "...dedication exclusively to cemetery burial purposes" to
apply to the remaining land. See Affidavit of Declaration of Dedication, executed
November 9, 1992, filed at page 0801, volume 11825, Deed Records of Travis County,
Texas.
Recommendations:

1. RAMP recommends that PARD increase the present cost of plots in AMP to a value
nearer current market, and that at least part of the increase be used to provide a perpetual
care fund exclusively for AMP.

2. RAMP requests that if and when PARD schedules a public hearing on the church
proposal, as amended herein, that it publish said notice in the Austin American Statesman
in addition to erecting a sign at the Hancock entrance to AMP. This will accommodate
and inform any property owners who do not visit the cemetery regularly. Even better, the
published notice should set forth the main points of agreement between PARD, the
church, and RAMP.

3. If the city elects to deed the land for parking, the city is urged to amend the existing
dedication to include the term "...dedication exclusively to cemetery burial purposes" to
apply to the remaining land. See Affidavit of Declaration of Dedication, executed
