NB: Before purchasing the jetty, it is important to ascertain whether the jetty has been
altered in any way without the prior written consent of the Department. If it has been
altered and the the Department is not satisfied that it complies with the regulations, then the
transfer of the jetty licence may be refused and the licence cancelled.

Under the Jetties Act 1926, all private jetties require a licence issued by the Chief Executive Officer
(CEO) in the Department of Transport The licence is required irrespective of the ownership of the
waters in which the structure is located.
Under Section 3 of the Jetties Act 1926, a jetty is defined as including a wharf, pier, grid, slip,
landing place, stage, platform, or similar structure, whether fixed or floating, erected or placed,
wholly or in part, in, on or over any waters and any ramp which is or may be used for the purpose
of launching or landing a vessel.
Fees & Charges for a Licence are as follows:
Application Fee (non-refundable) $ 71.00 To be remitted with application.
Fee for transferring licence (incl shared licence) $240.00 These amounts are not required
Annual Fee $109.00 until an invoice is issued.
Annual Fee for shared jetty $ 55.00
The above fees are subject to change without notice.
The Jetty Licence Application form is to be completed and returned to the Department of
Transport, Coastal Facilities Business Unit, 1 Essex Street, Fremantle, with the following:-
1. The application fee as specified on the bottom of the form;
2. a copy of Certificate of Title showing you as the owner of the property near the jetty site. The
licence will only be issued in the name of the property owner, as shown on the Certificate of
3. When transferring the licence, written advice is required from the current licensee advising the
Department of the transfer. (Form A attached).
4. For licences to be issued in company names (as shown on the Certificate of Title) the following
must also be provided:
a copy of the company's Certificate of Incorporation;
the names and addresses of the company directors (who will be the guarantors under the
the company's ACN or ABN.
Public Access & Public Liability
Applicants should be aware of the public liability risk that accompanies having a jetty and
the indemnity provided to the CEO in the Department of Transport and the Crown under the
licence. Licensees should, therefore, ensure that they have adequate public liability
insurance specifically covering the jetty.
OTHER IMPORTANT INFORMATION
When the subject property is sold, the application should be made at the same time to transfer the
jetty licence. Please refer to clause 1(h) of the licence agreement, which states that “the licensee
is not to assign or transfer the rights hereby conferred unless permission in writing is
obtained from the licensor”
Applications to transfer a jetty licence, received after the property sale, will be processed as normal
but, should approval for transfer not be given for any reason, the repair or removal of the structure
may remain the previous owner’s responsibility (particularly if located on a public foreshore).
Therefore, before purchasing a property with a jetty, you should ensure:
that the jetty is in a sound condition and suitable for transfer and continuation of a licence;
that the number is displayed on the jetty structure. (If the number is not displayed, and you
do not know what it is, please contact the Maritime Licensing Officer who will provide you
with one). The number must be placed above the winter high-water level, so that it is clearly
visible from the shore or water and it should be of a contrasting colour to the jetty and have
figures at least 75mm high;
that the licensee is not in breach of any of the conditions of the licence and that all licence
fees are up to date. The Department does not reimburse any fees on the cancellation or
transfer of a licence.
It is recommended that, for jetty licence transfers associated with property sales/purchases, the
applicant seek an adjustment to the property purchase price to reflect any unused or unpaid
licence fees as per normal conveyancing practices.

NB: Clause 1(g) of your licence agreement states:
“to the satisfaction of the Licensor display the licence number allocated for that purpose on such
part or parts of the jetty as the Licensor directs so as to be clearly visible from the shore and the
