TENDER NOTICE FOR NIFT CANTEEN
Sealed tenders in two bid system i.e. Technical Bid & Financial Bid are invited to run NIFT Canteen in the NIFT Campus, Sector II, Doorbhash Nagar, Rae Bareli (Uttar Pradesh) for the students, staff & visitors. The period of proposed contract will be one year only: Eligibility: An Agency/ Firm having an experience of 3 years of running Canteen, is eligible to apply. Detailed tender documents may be obtained from the office of The Assistant Registrar, NIFT, Rae Bareli on any working day w.e.f. 14th July, 2009 to 22nd July, 2009 between 10.00 A.M. to 5.00 P.M. on payment of Rs.200/- (Non Refundable) in the form of D.D. drawn in favor of “ National Institute of Fashion Technology” payable at “Rae Bareli”. The completed tender is required to be submitted along with the E.M.D. of Rs.10,000/- in the form of D.D. drawn in favour of “National Institute of Fashion Technology” payable at “Rae Bareli”. The EMD in the form of DD should be kept with the Technical Bid. The last date to submit the completed tenders in the office of The Assistant Registrar (NIFT, Rae Bareli) is 23rd July, 2009 on or before 03:00 P.M. The Technical & Financial Bids should be kept in separate sealed covers, with “Technical Bid” &”Financial Bid” super scribed on the envelope. These two sealed covers may be kept in a third sealed cover along with the tender documents, with “Tender for Canteen” super scribed on the envelope. The name and address of the Agency/Firm must be mentioned on each envelope. The Technical Bids will be opened on 23rd July, 2009 at 03:30 P.M. in the Registrar Room, in the presence of the tenderers or their authorized representatives. The date to open the Financial Bid will be announced on the same day. Incomplete tenders and those without proper E.M.D. shall be summarily rejected. The tender details are also available on the NIFT websites http//www.nift.ac.in. The bidders who have downloaded the documents from the website should attach a separate DD/Pay Order of Rs.200/- (Non refundable) as tender cost, in favour of NIFT, Rae Bareli along with the bid document. Terms and Conditions For the award of „Canteen Contract‟ for National Institute of Fashion Technology, Rae Bareli Centre functioning under Ministry of Textiles, Govt. of India.
1. The contract will be awarded on the basis on highest maintenance charges offered for use of the NIFT premises. The Successful Tenderer will have to enclose D.D. of earnest money with Technical Bid which will be refundable only in case of non acceptance of the offer. 2. Tenders shall be submitted in official tender form only. If submitted in any other form the same shall be summarily rejected. No tenderer shall be issued more than one tender form. 3. Tenders received without prescribed Earnest Money Deposit (EMD) shall not be considered. 4. The schedules issued with the form of tender listing the menus etc. for Canteen services to be rendered, must not be altered by the tenderer. Any modifications/alterations of the schedules considered necessary by the tenderer should be in the separate letter accompanying the tender. 5. No paper shall be detached from the tender. 6. The name and address of the tenderer shall be clearly written in the space provided and no overwriting corrections, insertion shall be permitted in any part of the tender unless duly countersigned by the tenderer. The tender should be filled in and submitted in strict accordance with the instructions laid down herein otherwise the tender is liable to be ignored. 7. The tender is liable to be ignored if complete information is not given there in or if the particulars and date (if any) asked for in the Schedule to the tender are not filled in. 8. Individual signing the tender or other documents connected with the tender must specify whether he signs as : (i) (ii) A sole proprietor of the concern or constituted attorney of such sole proprietor. A partner of the firm if it is a partnership firm, I which case he must have authority to execute contracts on behalf of the firm and refer to arbitration disputes concerning the business of the partnership either by virtue of partnership agreement or by a power of attorney duly executed by the partners of the firms. Director or Principal Officer duly authorized by the Board of Directors of the company.

In case of (ii) a copy of the partnership agreement or general power of Attorney, in either case attested by a Notary Public should be furnished or an affidavit on stamp paper duly sworn or affirmed by all the partners admitting execution of the partnership agreement or the general power of attorney should be furnished. The attested copy of the certificate or registration of firm should be attached along with the tender papers. In case of partnership firm. Where no authority to refer dispute concerning the business of the partnership has been conferred on any partner, the tender and all other related documents must be signed by all the partners of the firm. In case of (iii) the person signing the tender should be authorized by a resolution passed by the board of directors and a copy of the resolution attested by the Principal Officer should be attached.

10. The tender submitted in sealed envelopes mentioned “Tender For NIFT Stationery Shop” addressed to the Assistant Registrar / Purchase Officer, National Institute of Fashion Technology, NIFT Campus, Doorbhash Nagar, Rae Bareli – 229 010 and be dropped in the tender box available at NIFT campus on or before 23rd July, 2009 up to 15:00 hrs. The tenders will be opened on the same day at 15:30 hrs. in the presence of such of the tenders who may wish to be present, either by the themselves or through their authorized representatives. 11. A demand draft of Rs.10,000/- (Rupees Ten Thousand Only) is required to be deposited as a Earnest Money Deposit in favour of “ National Institute of Fashion Technology, Rae Bareli”. The Earnest Money deposit of the successful tender shall be liable to be forfeited if he does not fulfill any of the following conditions. (i) An agreement is signed by him in the prescribed form with in 10 (Ten) days of the receipt of the letter awarding the contract. The Canteen Services shall commence within 10 (Ten) days of the receipt of the letter awarding the contract.
(ii)
12. The bids should be valid in the case of all the tenders for at least 2 months from the date of opening of the tender and if any tenderers withdraws or alters the terms of the tender during the period, the Earnest Money Deposit shall be forfeited. In the case of the successful tenderer, rates quoted shall be valid for the entire period of the contract. 13. Corrections, if any, must be attested. 14. Late tenders will not be considered. 15. The successful tenderer has to deposit a demand draft of Rs.20,000/- (Rupees Twenty Thousand only) as refundable security deposit in the favour “National Institute of Fashion Technology, Rae Bareli”. No interest shall accrue on this deposit, which will be returned after the successful completion of contract and after adjusting dues if any, of the contractor to NIFT. The EMD of successful tenderer will be converted as security deposit and the EMD of unsuccessful tenders will be refunded. 16. National Institute of Fashion Technology, Rae Bareli reserves the right to accept or reject any or all the offers either fully or partly without assigning any reasons. 17. The contract will be operative for one year from the date of award, extendable by the NIFT for another period of one year subject to satisfactory working, on the same terms and conditions. 18. The contract once awarded can be terminated by either party after giving one month notice to the other party. Nevertheless, NIFT may terminate the contract of the contractor without any notice in case the contractor commits a breach of any of the terms of the contract. NIFT’s decision that a breach has occurred will be final and shall be accepted without demur by the contractor.

19. The contractor will have to provide specify number of employees who will be stationed at NIFT Campus and provide complete details about them. The contractor will also provide police verification report of all his/her employees working within NIFT Campus. 20. The contractor will have to submit an affidavit at the time of signing the agreement indicating that all employees of the contractors are paid the minimum wage as per Minimum Wages Act of U.P. Government. 21. The contractor will be solely and exclusively responsible to adhere to meet out all statutory obligations under Indian law in respect of compliance of all the rules, regulations and directions give by ay statutory authority with regard to safety, labour laws or any other prevalent laws both of Central & State Enactments and submit an undertaking and proof of payment to its employees as per minimum wages rates, PF & ESI remittances to NIFT each month along with claim / ills for payments. 22. The contractor will also submit a medical certificate on half yearly basis that all his/her employees handing food are not having any contiguous diseases. 23. The contractor will ensure neat and clean clothes and aprons used by his/her employees handing food at all times. Every employee so appointed by the contractor shall wear the prescribes uniform. The said uniform shall be provided by the Contractor at his own cost. 24. The contractor shall provide identity cards to its employs approved by the Administration Department of the NIFT and the expenditure born by the contractor. 25. The contractor shall not be allowed to keep his/her employees outside NIFT Canteen between 11:00 P.M. to 5:00 A.M. on any day. 26. The canteen shall remain open from 7:00 A.M. to 10:00 P.M. from Monday to Sunday. However, depending on the exigencies, the contractor may be required to keep the Canteen open beyond 10:00 pm also. 27. The contractor will occupy the accommodation earmarked for canteen and kitchen and shall not occupy the adjacent verandas and open space. 28. The contractor will ensure that his/her employees do not loiter around in the campus. In case of any loss of NIFT caused by the employees of the contractor, the contractor will be penalized at the discretion of NIFT. 29. NIFT reserves the right to ask & require the contractor to remove any person deployed by the contractor without assigning any reasons of notice. 30. The contractor will ensure high standard of cleanliness, hygiene and sanitation in the kitchen and canteen. The contractor will make the arrangements for keeping all eatables in covered showcase, free from flies and insects. Adequate numbers of dustbins will be provided by the contractor to ensure proper disposal of garbage. There should not be any littering of unused food or any other articles within the canteen. 31. The contractor will ensure that the cooks have proper shave and clipped nails while cooking food and should wear apron and head gear.

32. The contractor will ensure that the cooked and uncooked food is stored properly and no stale food is served. In case of any food poisoning, the contractor will be held solely responsible and will be penalized beside legal action. 33. The raw materials used for cooking can be checked by NIFT officials at any time and if substandard/unauthorized materials are found, the contractor will be penalized at the discretion of NIFT and contractor will have to abide by it. 34. The contractor will be required to display the rate list of all the food articles, soft drinks, tea, coffee and juice etc. sold in the canteen. The rates of the items sold in the NIFT canteen shall not be more than the local market rate and will be certified and reviewed by Committee of NIFT officials on regular basis. 35. The contractor is required to provide the following facilities in the canteen: i) Breakfast ii) Lunch : : Indian, South Indian and Continental. Standard meals (Thali comprising of two vegetables, Dal, Curd/Raita, Rice and Chappati/ Roti ), Special meals and combination as required. 36. Besides vegetarian items, the contractor must provide non vegetarian food i.e. Chicken, Mutton, Fish etc. also, at least twice a week. Separate provision of utensils must be made for non-vegetarian items. 37. The Contractor should have sufficient equipment & crockery and other items normally required in a Good Canteen. He should have sufficient utensils, crockery and other infrastructure to provide the service and Buffet Lunch/ Dinner/ Tea Party. 38. The Contractor should take all safety measures while running Canteen. He will keep a FirstAid box. 39. The contractor is required to pay the electricity charges on actual basis base on meter reading. 40. The contractor shall abide by all laws of the land including labour laws, tax deduction liabilities, welfare measures of its employees. 41. NIFT will deduct Income tax at source under section 194-C of the Income tax Act, 1961 from the contractor.

42. The rates for different items shall be as per list enclosed. The Contractor intends to serve eatables not specified in the enclosed list, possible with the approval of rate by Committee of NIFT officials. 43. The Registrar or its authorized representative/Canteen committee member (s) may inspect the preparation from time to time and reject such preparations, which are not considered wholesome or hygienic without any compensation. 44. No responsibility will be taken by the NIFT for credit sales losses or pilferage. 45. As per the NIFT policy, payment and receipts to Government and Semi Government Agencies would be rounded off to the nearer higher rupee and in other cases the rounding off will be to nearest, i.e. paise 50 or above will be rounded off the near higher rupee and paise less than 50 will be ignored. 46. No legal right shall vest in the contractor’s workers to claim employment or otherwise absorption in NIFT nor the contractor’s workers shall have any right whatsoever to claim the benefit and/ or emoluments that may be permissible or paid to the employees of NIFT. The workers will remain the employees of the contractor and this should be the role responsibility of the contractor to make it clear to its workers before deputing them to work at NIFT. 47. The contractor shall not engage the services of any sub contractor or transfer the contract to any other person. If, it is found at any time that the approved contractor has enable the work, the NIFT has right to terminate the contract and to forfeit all security deposit. 48. Firms submitting tender would be considered to have read & accepted all terms & conditions. No enquires verbal or written shall be entertained in respect of acceptance or rejection of the tender. 49. The bidder should indicate the name of one firm along with location where they are currently having business with them and which can be seen by the NIFT Officers. 50. Dispute if any, arising out of the contract shall be settled by mutual discussion or arbitration by sole Arbitrator to be appointed by DG, NIFT at New Delhi as per the provisions of the Indian Arbitration and Conciliation Act, 1996 and the rules framed there under. Any Arbitrator appointed shall not have the jurisdiction to pass any interim awards, or to grant interest higher than 8% charged simply on the award amounts or amounts payable to either party. 51. The contractor shall submit duly signed undertaking enclosed with the tender document.
