Continuing Studies Reservation, and Release of Liability and Indemnification Form For the Eco Tour of the Galapagos Islands RESERVATION 1. Langara College reserves the right to substitute accommodation, carriers, and/or program leaders and to alter the itinerary of the program when deemed necessary or advisable without penalty or liability attaching to the college and/or its agents. 2. Langara College reserves the right to cancel any program prior to departure, without penalty or liability attaching to Langara College. Refunds will be assessed at that time by the Tour Company, Airlines and Insurance Company. 3. Langara College reserves the right to refuse registration to any person or member of any tour, or to expel any person whose actions or general department disrupt or impede the operation of the program or the welfare and enjoyment of the other members of the program. No refund will be made to any participant who is rejected by the tour operators for any such reason, nor can any refund be made to any participant who is unable to complete the tour, or any portion of the tour for any reason. 4. Langara College accepts no responsibility for lost or stolen tickets. RELEASE OF LIABILITY AND INDEMNIFICATION 1. Langara College, tour leader, Anoushiravan Dadgar, and/or its agents assume no liability in connection with the service of any train, boat, carriage, aircraft, bus, motor vehicle or other conveyance which may be used in the program described in the Galapagos brochure (the "program"). Neither will Langara College assume any liability for any illness, injury, loss, accident, death or delay which may be occasioned by reason of any defect in any vehicle or through the act, error, negligence or default of any company or person engaged in conveying the participants of this program. 2. Langara College and tour leader, Anoushiravan Dadgar, assume no liability for any cancellation, illness, injury, loss, accident, death or delay occasioned by the proprietor, employee, or service of any hotel, hostel or other type of accommodation used by the program. 3. Langara College and tour leader, Anoushiravan Dadgar, assume no liability for any cancellation, illness, injury, loss, accident, death or delay connected with the participants' engagement in optional activities (such as scuba diving). In consideration of being permitted to participate in the program, the undersigned does hereby for himself / herself, his / her heirs, executors, administrators, successors and assigns release and forever discharge Langara College and tour leader, Anoushiravan Dadgar, from any and all actions, claims or demands by reason of any loss or injury to person or property arising from the operation of the program, notwithstanding that the same may have been contributed to or occasioned by the negligence of Langara College and/or its agents or may have resulted directly or indirectly from the behavior of other tour participants, acts of God, strikes, government regulations, terrorist acts, thefts, illness or program changes over which Langara College and tour leader, Anoushiravan Dadgar, have no control. 5. I agree to save harmless and indemnify Langara College and tour leader, Anoushiravan Dadgar, from and against all claims, actions, costs or expenses in respect to death, injury, illness, loss or damage to person or property however caused arising out of or in connection with the operation of the program, whether or not the same may have been contributed to or occasioned by the negligence of Langara College and/or its servants or agents. 6. I agree that anyone participating in an active adventure travel program like the 'Galapagos' tour risks suffering bodily harm and/or injury. I also acknowledge that activities (including, but not limited to, interacting or swimming with seals and sharks, snorkeling, scuba diving, hiking, horseback-riding, and exploration of lava tunnels) are optional activities and are done completely at my own risk. 7. I agree to carry a passport that is valid for at least 6 months beyond the date of my expected return to Canada, and to secure and pay for this documentation well in advance of departure. 8. I agree to have travel insurance that covers personal accident, medical expenses and repatriation expenses as well as cancellation/interruption of intended trip. 9. I agree to bring any prescription medication and/or medical equipment necessary for a diagnosed medical condition, and I am wholly responsible for the import, use and export of any such materials/equipment. I should not assume that specific drugs, medication or medical supplies will be available in Ecuador, and must seek medical advice/approval from a practitioner in advance if there is any perceived risk of a medical incident/condition arising. I am responsible for all necessary vaccination prior to departure. I confirm that I have read and fully understood the Reservations and the Release of Liability and Indemnification prior to signing it, that I am age 19 or more, and agree that this agreement will be binding upon me.
