3. Documents shall be handed over to the participating parties in this tender against a
   non-refundable fee of KD 3000/-.

4. The bidder shall return the CD after duly singed and stamped in a manner showing
    that he has been informed of all the contents contained therein and his unconditional
    concerned to all the provisions stated therein without any reservation, and all other
    required documents as described in the instructions document.
5. In case of any inquiries by any bidder, he shall submit the same 3 weeks prior to the
    offer submission date (closing date).
6. The Closing Date for offer submission at the PAHC Headquarters shall be at 1.00 p.m.
    on Sunday, 12.11.2006.
7. The bidder shall provide an initial guarantee in a form of a bank guarantee in favor of
    PAHC in the form of a letter of guarantee or certified cheque issued by a local
    accredited bank and valid throughout the contract period in an amount of KD
    1,500,000/-, and no interest shall be payable for this guarantee and the bidder creditors
    shall have no right to retain the same.
8. Offer shall be valid for 90 days as from the date of opening the envelopes.
9. The implementation period for this tender works shall be 990 days, including
    preparation period of 10% of the above period and it shall start as from the date of site
    delivery or the date of issuance of the works commencement order, whichever is
    earlier.
10. The bidder shall view the site (in a way that denies any kind of ignorance) and shall be
    assure of all the information stated in the tender documents. Either the bidder has seen
    the site or not he shall be considered fully aware of all conditions regarding the site,
    and no claim shall be accepted in this regard either before or after the signature of the
    contract.
11. The second party shall undertake to maintain the works according to the conditions
    stipulated in the special conditions document.
12. The final guarantee (contract bond) shall be 10% of contract value in a form of a bank
    guarantee in favor of PAHC issued by a local accredited bank and valid throughout
    the contract works implementation period until the date of the initial delivery of the
    works, and no interest shall b payable for this guarantee and the bidder creditors shall
    have no right to retain the same.
13. The advance payment shall be 10% of contract value to be payable to the contractor
    according to the contract/tender conditions.
14. The retention money shall be 10% of completed works value.
15. The minimum third party guarantee shall be 75,000/- KD.
16. Each tenderer shall attach along with his offer the certificate of compliance with
    national manpower percentage issued by the Ministry of Social Affairs & Labor,
    otherwise any offer which is not accompanied with this certificate shall be disregarded
    pursuant to the provision of article 6 of law no. 19/2000 on support and
    encouragement of national manpower and the Council of Ministers resolutions in this
    respect.
