 Please be neighborly and do not park in front of your neighbor's garage and
discourage your guests or vendors that are visiting your home from doing the
 same. Those homeowners with garages closest to the front doors often find
 uninvited guests in their driveway, preventing them from entering or leaving

Dear Nantucket Cove Homeowner,

The following rules and regulations will be discussed and adopted in accordance with the
Nantucket Cove Condominium Association Declaration and the Illinois Condominium
Property Act, as follows:

Nantucket Cove Condominium Association is approximately 8}o/o owner occupied. The
Schaumburg Police Department suggested that we update our rules and regulations on
leasing and include a Crime Free Lease Addendum because we have units that are being
rented.

On January 2,2007, your board of Directors will approve this revision.

I have attached   a copy of the newly revised section on "Sales and Leasing", the Crime
Free Lease Addendum, Rider to Lease, and a Tenant's Completed Lease Package
checklist. Please note: you now must have a background/criminal check done on your
prospective tenants as well as the credit check. Your new tenants rnust sign a Crime Free
Lease Addendum. All residents residing in the unit must be included on the lease. The
credit/background/criminal check will cost you money, and that is something that each
individual homeowner is responsible for securing and providing to our offices. We
recommend that you amend the amount which you collect from your tenant for the credit
check to INCLUDE authorization and money for the full background/criminal check.

In summary, within one year EVERY LEASE WILL BE REQUIRED TO INCLUDE A
CRIME-FREE LEASING ADDENDLM AND CRIMINAL BACKGROLIND CFIECK.
30 days prior to each leasing expiring, the Association MUST receive, in Management's
offices, a copy of the Criminal Background check and the initials of the prospective
tenants on the Crime-Free Leasing Addendum, acknowledging that they have read and
understand the addendum. Management will respond within 10 days of receipt of this
documentation as to whether the lease may be secured with the prospective tenant.
Tenants who have been convicted of any criminaloffense in the last ten years, or ever
convicted of a felony which involved the health, safety or welfare of others, will be
DENIED the ability to rent at Nantucket Cove. The fìnes for violation of any of these
provisions are steep, and will be enforced.

Please callthe ofäce when you are in the process of renting your unit. We willbe happy
to send you a copy of the Nantucket Cove Rules and Regulations. You can give it to
your tenant which will allow them to read it before they sign the Tenant's completed
lease package page.

In addition, the Association is adopting the exact language that is contained within the
Illinois Condominium Property Act, as it relates to the responsibility of each owner with
regard to insurance. Most specifically, these laws will now be apart of your rules and
regulations, addressing the issue of unit to unit leaks. In summary, the upstairs unit
owner is responsible for their insurance to repair anything that may be leaking into a unit
below AND is responsible for resultant damage through their own insurance OR is
responsible for the deductible of the downstairs unit owner's policy. SHOULD A TINIT
TO I-]NIT LEAK OCCI.IR. EACH HOMEO\A/NER MUST FILE A CLAIM WITH
TFIEIR OIVN INSURANCE POLICY IMMEDIATELY. Again, either the upstairs unit
owner's policy will cover the damage to the unit below OR the upstairs unit owner will
pay the deductible of the downstairs unit owner's policy.

These changes go into effect on January 15,2007. Please read over the complete set
of documents to familiarize your self with the new changes. If you have any
questions, do not hesitate to call.

                        SECTION VII _ SALES AND LEASES

1.01          Every unit owner with intent to sell his/her unit shall give the manager at
              least thirty (30) days written notice.

t.o2          Before the Board will waive the right of first refusal to sell/lease a unit, it
              is the Unit Owner's responsibility to comply with the following.

              A.      SALES: Obtain a letter waiving the right of first refusal, current
              statement of account, current budget, Declaration, By-Laws, Rules and
              Regulations, and pay all fees in accordance with Management's current
              fee structure. The seller must follow the move-out rules.

              B. LEASE:' During the terms of the lease, no new roommate may move
              in without a new lease being generated, containing the names of all
              tenants residing in the unit. (A new roommate is someone staying longer
              than 30 days). A copy of the new lease, new lease rider & Crime Free
              Lease Addendum must be sent to the management office. A background,
              criminal & credit check must be done on the new person(s), prior to
              moving in. All moving rules must be followed during this time. For all
              the rules on moving, see SECTION VI-MOVING IN OR OUT.

       1.03   There are several important iterns that every investor-owner must
              consider before leasing his/trer unit. Nantucket Cove Condominium is
              a member of the Village of Schaumburg's Crime Free Multi-Ilousing
              Program. As a requirement of belonging to this program' Nantucket
              Cove Condominium Association has implemented and agreed to
              actively enforce the following rules:

              A Owners must notify prospective tenants that Nantucket Cove
                Condominium Association is a member of the Village of
                Schaumburg's Crime Free Multi Housing program.

              B. In accordance with ordinances in Schaumburg, all owners MUST
                 attend the Schaumburg Crime Free Housing Seminar.

              C    Owners must show prospective tenants the Crime Free Lease
                   Addendum. This addendum must b
                   to indicate they have seen it prior to completins the application.

              D.   Owners must get a completed application from prospective tenants.

              E. Owners must do a background,         criminal and credit check on
                   prospective tenants prior to their move into the unit. Owners, when
                   obtaining this information, may insert their name, as the owner that
           requires the information, along with the name of Nantucket Cove
           Condominium Association, as the party contracting for the
           background check. The owner, however, is ultimately responsible for
           the cost of the background check. In the event that the Association
           denies an Owner the right to rent his or her Unit to a prospective
           tenant, the Owner shall be responsible for providing a substitute tenant
           who complies with the requirements as outlined in the Lease
           Addendum. This must be done for everyone residing in the unit that
           are over the age of l2 years old. (Most owners collect an application
           fee adequate to cover the cost of the background/criminal/credit
           check) You must obtain a background/criminal/credit check
           through the vendor of the owner's choice and you must show proof of
           such, providing that proof at least 10 days prior to securing any lease
           with the tenant. During the term of this lease, no new roommate may
           move in without a new lease being generated, containing the names of
           all tenants residing in the unit. A new roommate is someone staying
           longer than 30 days. A copy ofthe new lease, new lease rider and
           Crime Free Lease Addendum must be sent to the management office.
           A background criminal check must be done on the person(s) prior to
           moving in. All moving rules must be followed during this time.

SHOULD ANY OWNER FAIL TO COMPLY WITH 1.038, THEY WILL BE
                     FINED $75O.OO

       F   All leases must be in writing and for a period of not less than one year.
           All leases must be in conformance with, and make specific reference
           to, the legal documents of the Association. Owners must get the
           Crime Free Lease Addendum & Lease Rider signed by all tenants and
           must make it a part of their lease. The Owner is also required to
           submit a signed copy of the Addendum to the Nantucket Cove
           Condominium Association's property management within l0 days of
           leasing their premises along with a Resident Information Form stating
           the number and name of all tenants, including children who will be
           residing at their unit. This information will also include the phone
           number of the unit, all work numbers, make and model of vehicles
           used by the occupants, and any allowed pets.

       G All leases must be current. The management office must be sent a
         copy of all updated leases & lease riders prior to the expiration date.
         Failure to do so will result in a $250.00 fine.

       H Do not discriminate on the basis of age, race, color, creed, national
         origin or sex.
                      I.   If a tenant violates the documents or rules and regulations, the owner
                           shall also be held responsible.

                     J.    Any violations of the Declarations, By-Laws or these Rules and
                           Regulations may result in a flat or daily fine or in more serious
                           situations, barring a tenant from moving in or eviction proceedings.
                           All fines, costs and legal fees will be charged to the unit owner.

                      K. Sub-leasing is not allowed.

                           Owners cannot rent their units to any person or persons who have been
                           convicted of any criminal offense in the last ten years, or ever
                           convicted of a felony which involved the health, safety or welfare of
                           others. (Any questions regarding specifics please call Nantucket Cove
                           Condominium Association's management oflice)

                      M. A violation of any or all the above rules (except 1.03E) as herein set
                         forth may result in a minimum $250.00 fine for the first violation, and
                         $500.00 for the second violation and $750.00 for the third violation.

1.04          Any time a crime is committed on this property which involves a resident, tenant,
              guest, or invitee of a tenant, resident or guest, the following fines will be assessed
              to the owner of the respective unit involved.

                      A. Crimes on this property    such as, but not limited   to: disturbing the
                           peace, fighting, disorderly conduct, vandalism, property damage,
                           offensive behavior, harassment, intimidation" public drunkenness
                           (adult), or party "out-of-control". First offense $250.00, second
                           offense $5 00. 00 and thereaft er $75 0. O0/incident.

                      B.   Crimes on this property such as, but not limited to: domestic violence,
                           child abuse, assault, battery, burglary, theft, public drunkenness
                           (minors), possession of illegal drugs, minors in possession of alcohol,
                           DUI, or possession of stolen property. First offense $250.00, second
                           offense $5 00. 00 and thereaft er $75 0. O0/incident.

                      C.   Crimes on the property such as, but not limited to: manufacturing or
                           distributing of illegal drugs; any crime related to gang activity; illegal
                           possession of firearms or weapons; discharge of a firearms, aggravated
                           assault, arson, sex offenses, class A misdemeanor, kidnapping or
                           murder. First offense $250.00 second oflense $500.00 and thereafter
                           $750.0O/incident.

TFIESE RULES BECOME EFFECTIVE on January 75,2001 All lease agreements signed prior
      to this date will be grand fathered,through the term of the lease or for one year from the
       effective dates of these nrles, whichever comes first, in regards to the Crime Free Lease
       Addendum. This means that if your lease renews prior to one year from the effective
       date, you must then provide Nantucket Cove Condominium Association management
       office, within l0 days of the renewal date, a signed copy of the Crime Free Lease
       Addendum no later than one year from the above date. Owners are immediately
       responsible for providing the association with the number and name of all tenants who
       are residing in their unit on an updated Resident Information form. The name(s) should
       be the same as those on the lease. Owners are also responsible for providing their tenants
       with information regarding this program and letting them know that crime will not be
       tolerated at Nantucket Cove.

Fines for actions of individuals may be mitigated on a case by case basis (depending on the
        severity of the crime or damage and positive action taken regarding correction), with any
        decision made to be in the discretion of the Board and their decision shall be final and
       binding.

                      CRIME-FREE LEASE ADDENDUM

In consideration of the execution or renewal of a lease of the dwelling unit identified in
the lease, Owner (or Owners' agent or representative) and Resident agree as follows:

                       1     Tenant, any member of the Tenant's household, a guest or
                             invitee in the unit or on the common grounds, or any other
                             person in the unit or on common grounds invited there in any
                             way by Tenant or a member of Tenant's household, shall not
                             engage or in any way be involved in, any criminal
                             activify, including drug related criminal activity, on or
                             near the said premises. Criminal activity shall include, but
                             is not limited to, drug-related criminal activity. "Drug-
                             related criminal activity" means the illegal manufacture, sale,
                             distribution, use, or possession with intent to manufacture,
                             sell, distribute, or use of a controlled substance (as defined in
                             Illinois Compiled Statutes)

                             Tenant, any member of the Tenant's household, a guest, or
                             invitee at the unit in the unit or on the common grounds, or
                             any person in the unit or on the common grounds invited
                             there in any way by Tenant or a member of Tenant's
                             household shall not engage in any act intended to
                             facilitate or that does facilitate criminal activity,
                             including drug-related criminal activity, on or near the
                             said property.

                       3.    Tenant, and every member of the household shall not permit
                             the dwelling unit to be used for criminal activity, or to
                             facilitate criminal activity, in the unit or on the common
                             grounds, including drug-related criminal activity, regardless
                             of whether the individual engaging in such activities is a
                             member of the household, a guest or invitee, and regardless
                             of whether the Tenant is at home during any such offense.

                       4.    Tenant, any member of the Tenant's household, a guest, or
                             invitee in the unit or on the common grounds, or any other
                             person in the unit or on the common grounds invited there in
                             any way by Tenant or a member of the Tenant's household,
                             shall not engage in the unlawful manufacturing, selling,
                         or giving of a controlled substance at
     use, storing keeping,
     any location whether in, at, on, or near the property.

5    Tenant, any members of the Tenant's household, a guest, or
     invitee in the unit or on the common grounds, or any other
     person in the unit or on the cornmon grounds invited there in
     any way by Tenant or a member of Tenant's household, shall
     not engage in any illegal activity, including prostitution as
     defined in the Illinois Compiled Stature, criminal street gang
     activity as defined in the Illinois Compiled Stature,
     threatening or intimidating as prohibited in the Illinois
     Compiled Stature, assault as prohibited in the Illinois
     Compiled Stature INCLUDING BUT NOT LIMITED TO
     the unlawful discharge of firearms on or near the
     dwelling unit or common grounds, or any breach of the
     lease agreement that otherwise jeopardizes the health,
     safety and welfare of the landlord, his agent or other
     tenant or involving imminent or actual serious damage as
     defined in the Illinois Compiled Stature.

6.   VIOLATION OF ANY OF THE ABOVE PROVISIONS
     SIIALL BE A MATERIAL AND IRREPARABLE
     VIOLATION OF THE LEASE AND GOOD CAUSE
     FOR TERMINATION OF TIIE TENANCY A single
     violation of any of the provisions of this added addendum
     shall be deemed a serious violation and material non-
     compliance with the lease. It is understood and agreed that a
     single violation shall be good cause for IMMEDIATE
     termination of the lease under the Illinois Compiled Stature.
     Unless otherwise provided by law, proof of violation shall
     not require criminal conviction, BUT SHALL BE BY A
     PREPONDERANCE OF THE EVIDENCE' Tenant consents
     to venue in any justice court precinct with the county
     wherein the unit is located in the event Owner initiates legal
     action against the Tenant. Tenant hereby waives any
     objection to any venue chosen by owner. Furthermore,
     Tenant agrees that in any legal proceeding brought by owner
     against Tenant that the Owner may, at Owner's sole
     discretion, allege that the rental value of Tenant's premises is
      less than the actual periodic rental payment Tenant is charge
      as set forth in this Agreement so that the action may the
     justice court system.

       Tenant agrees that service ofprocess ofany legal
       proceeding, including but not limited to, a special detainer
                                  or forcible detainer action, or service of any notice to
                                  Tenant, shall be effective and sufficient of purposes of
                                  providing legal service and conferring personal jurisdiction
                                  upon any Illinois court as to any tenant, co-signer, occupant
                                  or guarantor, if waived upon any occupant or other person
                                  of suitable age and discretion who is present at the
                                 premises and residing therein, notwithstanding the fact that
                                 a Tenant, co-signer, occupant or guarantor may reside at a
                                 different location other than the property address described
                                 in the lease agreement. This agreement regarding service is
                                 in addition to, and not in lieu of any manner of service
                                 authorized under Illinois law or rule. By signing this lease
                                 the undersigned hereby waives any objection to service
                                 carried out under the ierms of this agreement. This
                                 provision shall be effective for any extension, renewal or
                                 modification of the initial lease.

                           7.    In case of conflict between the provision of this addendum
                                 and any other provisions of the leases, the provisions of the
                                 addendum shall govern.

                                 This LEASE ADDENDTIM is incorporated into the lease
                                 executed or renewed this day between Owner and Resident.

                               RULES AND REGULATIONS
                                 AS TO INSURANCE FOR
                       NANTUCKET COVE CONDOMINIUM ASSOCIATION


Whereas, NANTUCKET COVE CONDOMINIUM ASSOCIATION is an lllinois condominium

association (the "Association") established pursuant to the Illinois Condorninium Properry* Act

(the ç'Act"); and is govemed by and through its Board of Directors (the "Board"); and

        Whereas, the Illinois General Assembly adopted Public Act92-518 that becomes

effective on June 1,2002 amending Section 12 and 12.l of the Act as to insu¡ance for the

Association, and

        Whereas, the Board pursuant to Section 18.4(h) of the Act has the authority to adopt and

amend rules and regulation for the Association covering the details of the operation and use of the

property, after a meeting of the Unit Orvners called for the specific purpose of discussing

proposed rules and regulations; and

        Whereas, the Board has determined that arnended rules and regulations are necessary in

order to implement the provisions of Public Act92-518, advise unit owners of their

responsibilities under the Act as to insu¡ance and to notify the current insurauce company for the

Association of the Board's position on insurance based upon the amendment to Section 12 of the

Act.

        Now, Therefore, Be      It and It Is Hereby Resolved      as follows:


1.      The recitals hereinabove set forth are incorporated herein as     if fully set forth.

2.      Property Insurance for the Association shall include the following:

        (a)        the Common Elements, Limited Common Elements and Units.

        (b)        as detennined from tirne to tirne by the Board, the property insurance shall


                   also include the bare walls, floors, and ceilings of the Unit, fixtures

                   located within the mfinished interior surfaces of the perimeter u'alls,
             floors and ceilings of tlie Units initially installed by the developer.

             conrmon Elements shall exclude floor, wall and ceiling coverings.

     (c)     provide coverage for special fonn causes of loss;

     (d)     the total amount of coverage shall not be less than the full insurable

             replacement cost, Iess deductibles, and include coverage for municipal

             building code requirements, at the time the insurance is purchased and at

             each renewal date.


J.   General Liability insurance shall have the following provisions:

     (a)     Commercial general liabiliry- insu¡ance against claims and liabilities

             arising out of and in connectio¡ with the ownership, existence, use, or

             managernent of the prope4y in a minimum amount of one million dollars

             ($1,000,000.00), insuring the Board, the Association, the managing agent,

             and their respective employees and agents and all persons acting as agents'

     (b)     The liability insurance shall also include r¡'orkers compensation, employment

             practices, environmental llazards and "host liquor" coverage'

     (c)     Unit Ormers iryill be included as additional insured parties for the limited

             purpose of claims and liabilities arising out of or in connection with their

              ownership, existence, use or maintenance of the Common Elements. The

              scope of coyerage must cover claims of one or more insured parties against other

              insured parties.

4    The Association and the managing agent shall both maintain fidelity bond coverage.

     The Association's coverage 'uvill include the managin g agent and their employees u'ho

     control or disburse frurds of the Association- The managing agent of the Association
                                                                                          u'ill

     maintain fidelity bond coverage for the amount necessary to protect Association funds

      rvith the Association namcd as a par!,entitled to make a claim against the bond. The
        coverage(s) for the fidelity bonds must be in amounts sufficient to cover association

        funds and resenes in the custody of the Association or the management company.

5.      The Board shall maintaùr directors and offrcers liability coverage in an amount deemed

        reasonable by the Board, if not otherwise established in the Declaration or By-Larvs         of

        the Association.

6.      At the time of the renewal of the insu¡ance policy for the Association     everSr   in5¡¡'uu""

        company submitting a bid rnust provide a quote for coverage        for   improvements or

        betterments to the Units that were installed by unit owners,     and     at the election of the

        Board, if this coverage is obtained, the increased cost will be assessed against the Units

        so affected. "Itnprovernents and betterments," under the Act, shall be defined as

        decorating, fixtures, and furnishings installed or added to and located within the

        boundaries of the Unit, including electrical fixtures, appliances, air-conditioning and

        heating equipment, r'r'ater heaters, or built-in cabinets installed by Unit Owners.

7   .   The Board reserves the right to determine in each case of a claim for damage to a Unit or

        Common Elements whether:

        (a)     to pay the deductible as a cornmon expense, or

        (b)     after notice and an opportunity for a hearing, to assess the deductible

                against the Owners who cased the damage or from'vvhose Units the

                damage or cause of loss originated, or

        (c)     to require the Unit Owners of the Units affected to pay the deductible

                amount.

8.      Each Unit Owner within the Association must obtain insurance coverage for their

        personal liabiliry and compensatory (not consequential) damages to another unit caused

        by the negligence of the Orvner or his or her guests, residents or invitees, or regardless       of

        negligence originating for the   Unit.   The personal liability of a Unit Owner will also

        include the deductible of the Owner whose Unit was damaged. If a Unit Ormer does not

       The Board of Directors has asked that you and your conhactor read and sign the following in acceptance

       the window project. This form will become a part of your ACC Application, and your application will not
                                                                                                                     be
       approved without it. Understand that you and your contractor accept all liability for violãtion of any of the
       below provisions:

        l.      Windows must match the existing windows in style and color - double hung and white.

       2-       Windows mt¡st match the existing windows in size, exactly. The windows at Nantucket Cove usually
                must be custom made. You may not compensate for a standard window by increasing the size of the
                molding. The windows must match the size, exactly.

       3'       Brick molding must match existing brick molding in size, shape, and color, although the Board does
                allow aluminum encasement of the brick molding, if you choose to do so.

       4-       No muntin bars are allowed (the grill puttg* in the glass)

       5.       ALL windows in your home must be done at the            same time - you may not do less than all of the
                windows.

       6-       Signs advertising the contactor you are using are NOT permitted on the properfy.

NOTICE IS HEREBY PROVIDED that the following rule change will be considered, and adopted
as follows:
                                        May 3, 2011
                                       Tuesday, 7 p.m.
            Meineke Center, Schaumburg Park District Building, 110 Weathersfield Way

                                        ASSESSMENTS AND COLLECTION
    1. All monthly assessments and any special assessment or other lawful charges of the Association are due and
 payable on the first (1st) day of each month. Payments received after the 1st of the month are late. Any payment of
           the foregoing which is received after the tenth (10th) day of the month shall receive a late charge.
 2. Any payment of less than the full amount of all assessments and other charges which are due in any given month
 or any payment which is made late shall cause the Unit Owner to be subject to late charge of forty dollars ($40.00)
for the month which shall be added to and deemed a part of the Unit Owner’s Common expenses and payable by the
                                                 first of the ensuing month.
      3. Unit Owners who are delinquent in the payment of Common Expenses shall be subject to legal action in
  accordance with the provisions of the Declaration and By-Laws. Once legal action has commenced, all legal fees
               and costs will be assessed to the Unit Owner as required by the Declaration and By-Laws.
 4. Unit Owners delinquent in assessments are considered unit owners not in good standing and are prohibited from
                access to the recreation facilities. This also pertains to renters of delinquent unit owners.
