                             REGULAR MEETING
                         MONDAY, SEPTEMBER 21, 2009
                           CHESTER MEETINGHOUSE
                              4 LIBERTY STREET
                           CHESTER, CONNECTICUT


CALL TO ORDER: Mario Gioco, Chairman, called the meeting to order at 7:38 p.m.

SEATING OF MEMBERS: In attendance included: Jim Miller, Tom Englert, Andy
Vomastek (seated for John DeLaura), Mark Borton and Mario Gioco.

APPROVAL OF MINUTES:

Jim Miller made a motion to accept the meeting minutes from August 17, 2009, with
corrections. Tom Englert seconded the motion. The motion passed. Mark Borton
abstained.

Correction: page 3 – last paragraph - add “beyond the proposed footprint”

OLD BUSINESS

Public Hearing – Raymond & Joan Galeotti, 288 Middlesex Avenue, section 60B
setback, map 4, lot 15, zone R2.

The Public Hearing for 288, Middlesex Avenue was opened at 7:42 p.m. by Chair Mario
Gioco Mario.

Mr. Galeotti reported they are requesting a variance for a set-back which would allow
them to add a kitchen. He continued that the house is already built within the set-back
and there is no other space on the property for the proposed addition. This property sits
in both Haddam and Chester. The applicant has already received permission for their
project from the town of Haddam, the CT River Gateway Commission in Haddam
(meeting scheduled with CT Gateway Commission in Chester for 10/1/09) as well as the
railroad.

Mr. Galeotti stated that the hardship is due to the fact that the property is very
convoluted. It pre-dates zoning regulations, the town lines run through the kitchen and
there are issues with the railroad tracks.

Mr. Galeotti presented pictures of the house and property (Exhibits A, B and C)

Jim Miller asked if there were any topography issues with the property. Mr. Galeotti
responded no, the property is flat and little grading will be necessary. Mr. Galeotti was
hopeful that the DEP would address erosion issues in the future.

No comments were received from the public. ZBA members had no questions for the
applicant.

Mark Borton made a motion to close the Public Hearing at 7:52 p.m. Tom Englert
seconded the motion. The motion passed unanimously.

Consideration of Variance

Raymond & Joan Galeotti, 288 Middlesex Avenue, section 60B setback, map 4, lot 15,
zone R2.

Mark Borton commented that this is a classic case of a hardship imposed by imminent
domain splitting a property into two. ZBA members agreed.

Tom Englert added that the house was built prior to the land being split by the railroad.

Jim Miller made a motion to grant the variance of section 60 B based on a hardship
unique to this property which is that the railroad runs through the property dividing it into
two pieces, the house pre-exists zoning regulations and the proposed project is keeping
with the purpose of zoning and the character of the neighborhood. Mark Borton
seconded the motion. The motion passed unanimously.

Mario Gioco reported that this will be posted in the Hartford Courant and residents will
have 15 days object. If no objections are received, the variance will be issued and
available at Town Hall. In order for the variance to be valid, it must be recorded at Town
Hall (there is a fee for recording).

NEW BUSINESS

Receipt of New Applications

Skyview Properties – 59 Winthrop Road

Mario Gioco distributed the application from Skyview Properties and ZBA reviewed
same.

The application was reviewed for completeness. It was reported that a Cease and Desist
Order has been issued. This was included in the application.

Mario Gioco reported that the Cease and Desist Order should be dated July 20, 2009.
The applicant initialed this change.

Jim Miller made a motion to receive the application from Skyview Properties. Tom
Englert seconded the motion. The motion passed unanimously.

Mario Gioco reported that this Public Hearing will be included on the October agenda.

Theodore & Molly Lund, 97Turkey Hill Road, tax map 2, lot 26, zone R2
Seeking variance from section 60B setback

The application was distributed and reviewed for completeness.

Jim Miller requested a map of wetlands. An A2 survey on the property was also
requested to provide information on the location of the driveway, elevation and
topography.

Jim Miller made a motion to receive the application from Theodore & Molly Lund,
conditional based on the request for wetland information and an A2 survey. Mark Borton
seconded the motion. The motion passed unanimously.

OTHER BUSINESS

2010 Meeting Dates

Jim Miller made a motion to approve the meeting dates as presented. Mark Borton
seconded the motion. The motion passed unanimously. The dates are as follows:

1/25/10, 2/22/10, 3/15/10, 4/19/10, 5/17/10, 6/21/10, 7/19/10, 8/16/10, 9/20/10, 10/18/10,
11/15/10, 12/20/10

Jim Miller made a motion to set the time of the above meetings at 7:30 p.m. Mark
Borton seconded the motion. The motion passed unanimously.

AUDIENCE OF CITIZENS

None.

ADJOURNMENT

Jim Miller made a motion to adjourn the meeting at 8:10 p.m. Mark Borton seconded the
motion. The motion passed unanimously.
