           LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976, PART II




NOTES FOR APPLICANTS

1.   An application for the grant or renewal of a private hire vehicle licence shall be submitted by the
     vehicle owner only on the form prescribed by the Council. Please complete this application form
     in all respects in Blue or Black INK in BLOCK CAPITAL LETTERS. When complete, please
     return the form to:

     The Head of Environmental Health Services, Rushmoor Borough Council, Council Offices,
     Farnborough Road, Farnborough, Hampshire, GU14 7JU.

2.   A separate application form is required for each vehicle for which a licence is required.

3.   To allow us to begin to process your application, we need the Vehicle Registration Document,
     the Insurance Certificate for the vehicle and the fee to be submitted with this application form.
     Please check to ensure you have all the necessary documentation with you before you submit
     your application. If you are applying for the first grant of a new licence, or if you are a new owner
     of the vehicle we also require a sales receipt and/or letter(s) of sale to allow us to establish
     that the vehicle is owned by the applicant proprietor(s).

4.   An application, completed in full (to include all the necessary documentation and the fee) must
     be submitted not less than 28 days prior to the expiry of the previous licence. If this
     application is for the grant of a new licence, applicants are advised that processing the
     application will, under normal circumstances, take at least 28 days. It is the applicant’s
     responsibility to ensure that all documents and forms are submitted in good time. Any owner
     and/or driver of any vehicle operating without a licence due to a failure to submit all necessary
     application documentation may be deemed to be in breach of licence conditions and subject to
     action in accordance with the Councils enforcement policy.

5.   It is the applicant’s responsibility to provide the Licensing Officer with a valid MOT Certificate
     AND a Pass Certificate from a vehicle inspection facility approved by the Council. The Licensing
     Officer will not licence any vehicle without these documents. The Pass Certificate must indicate
     that the vehicle inspection has been undertaken within two months from the date for which the
     licence is required. The approved inspection facilities are detailed below:

     A fee of £40:00 will be charged for the Council inspection ONLY. A joint MOT and Council
     Inspection will cost £70:00.

     A valid MOT certificate MUST be presented/obtained at the inspection. This is the case for all
     vehicles (including new vehicles).

   6.     Applicants must be aware that private hire vehicle licences will only be issued in respect of
          vehicles that may be described as hard top saloons, estate cars and people carriers. A private
          hire vehicle licence will not be issued to the following vehicle types: Fairways, TXI, TXII,
          Metrocabs similar ‘black cabs’, the Volkswagen Sharan, the Mercedes Eurocab, the Peugeot
          Euro 7, the Fiat Eurocab or other such vehicle fitted with any top box or sign displaying the word
          ‘TAXI’. Left hand drive vehicles will not be eligible as private hire vehicles except for American-
          style stretch limousines which have express written approval, following application, from the
          Head of Environmental Health Services of the Council.

   7.     Licences will not be granted in respect of vehicles with less than four or more than eight
          passenger seats. All new vehicles must be licensed by the Council within two weeks of
          registration with the DVLA. No vehicle licence shall be issued to or held by any person(s) under
          the age of 17 years.

   8.     Certain vehicles may be exempted from the need to display hard interior and exterior licence
          plates in favour of a soft windscreen plate issued by the Council. Should you wish to take
          advantage of the exemption offered, you must do so in accordance with the ‘Council guidelines
          exempting vehicles from the need to display hard exterior plates in favour of a soft windscreen
          plate’; enclosed.

   9.     Applicants should read and understand the Standard Conditions (enclosed) in respect of a
          private hire vehicle licence before completing this application form. Failure to comply with such
          conditions may result in any licence issued being suspended and/or revoked. If you have any

       material particular in giving information shall be guilty of an offence and shall be liable to formal

       Rushmoor Borough Council within 48 hours.

SECTION .4. – HARD PLATE(S) EXEMPTION
                           (BY THE APPLICANT PROPRIETOR)
  GUIDELINES EXEMPTING PRIVATE HIRE VEHICLES FROM THE NEED TO DISPLAY HARD EXTERIOR
                    PLATES IN FAVOUR OF A SOFT WINDSCREEN PLATE
1.0. The Exemption

     In accordance with Section 38 of the Town Police Clauses Act 1847, a licence plate issued by the Council
     must be affixed to Hackney Carriages. There is no provision for the Council to make exemptions from this
     requirement and accordingly such plates must be displayed at all times. Private Hire Vehicle plates must be
     displayed in accordance with Section 48(6)(a) of the Local Government (Miscellaneous Provisions) Act
     1976. These plates must be fixed to the vehicle in the same manner as that prescribed for a Hackney
     Carriage.

     However, the plate need not be displayed on Private Hire Vehicles during the period that such a vehicle is
     used for carrying passengers for hire or reward to / from or in connection with any wedding ceremony or
     under a contract for the hire of the vehicle for a period of not less than 24 hours. In addition, Section 75(3)
     of the Local Government (Miscellaneous Provisions) Act 1976, enables the Council to permit the vehicle to
     be used on specific occasions without the need to display any such plate. However, such exemptions are
     only effective if the Council gives notice in writing to the proprietor of the vehicle concerned. In all other
     cases, failure to display a plate in accordance with the requirements of at the Act could result in a fine
     imposed by the magistrate’s court of up to £1,000.

     Rushmoor Borough Council operates an exemption scheme and accepts exemptions from the need for
     Private Hire Vehicles to display hard exterior and interior plates in favour of a soft windscreen plate. Such
     exemptions are granted only with the written consent of the Head of Environmental Health Services of the
     Authority and are subject to the following terms and conditions of use:

1.1. If the vehicle is being used under the terms of the exemption in force, the Private Hire Driver of the
     exempted Private Hire Vehicle must display or keep within the vehicle his/her Private Hire Drivers Licence
     and the certificate of exemption (and display the soft windscreen plate in accordance with the terms of the
     exemption).

1.2. The plates and documentation must be made available for inspection by the Police and any authorised
     officer of the Council at all times.

1.3. If the Private Hire Vehicle operates outside the types of use for which the exemption is granted, then the
     exemption is nullified and hard exterior and interior plates must be used on the vehicle.

2.0. Applications for Exemptions

     Applicants should be aware that apart from exceptional circumstances, the Council would not be prepared
     to give a general dispensation from displaying a Private Hire hard plate. Applicants must therefore give a
     full explanation of their reasons for applying for an exemption which must be made in writing to the Head of
     Environmental Health Services of Rushmoor Borough Council giving all the details of the vehicle
     concerned, the owners/proprietors of the vehicle and the drivers.

     Applicants should also be aware that the exemption may be revoked at any time at the discretion of
     Rushmoor Borough Council and that all plates remain the property of the Council.

                          STANDARD CONDITIONS
                        IN RESPECT OF A PRIVATE HIRE VEHICLE

           LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976, PART II

1)   Application for the grant or renewal of a private hire vehicle licence.

     (a)     An application for grant or renewal of a private hire vehicle licence shall be submitted by
             the owner of the vehicle to the Council on the form prescribed by the Council.

     (b)     For vehicles less than eight years old, the period of a licence shall be for 12 months.
             Vehicles eight years old or more will be licensed for a period of six months.

     (c)     An application, completed in full (with all the necessary documentation, including a valid
             MOT certificate, a pass certificate from an approved vehicle inspection facility, the DVLA
             vehicle registration document and the fee) for the grant or renewal of a private hire
             vehicle licence shall be submitted at least 28 days prior to the date for which the licence
             is required. Applicants must note that any person driving a private hire vehicle without a
             valid private hire vehicle licence will be in breach of legislative provisions and subject to
             appropriate enforcement action. Applicants are advised that the Council require at least
             a 28 day period to process the licence following receipt of the completed application and
             relevant paperwork. It is the applicant’s responsibility to ensure that all documents and
             forms are submitted in good time. In any case, if a licence has expired and has not been
             renewed for a period of 28 days after expiry, any subsequent application for the grant or
             renewal of a licence shall be treated as a grant in all respects.

     (d)     Produce and maintain a certificate of insurance (or appropriate cover note) for “hire and
             reward”, to include “private hire” in conjunction with the insured’s occupation or
             business. The insurance should insure against “third party” risks or be “fully
             comprehensive”.

     (e)     At the time of each application for grant or renewal of a private hire vehicle licence, the
             private hire vehicle must undergo and pass a vehicle examination to consist of both an
             MOT and the Council’s additional licence checks. The additional licence checks must be
             undertaken no more than two months prior to the date for which the licence is required.
             The vehicle MOT must be conducted within 28 days of the additional licence checks.

     (f)     No licence will be issued to a person under the age of 17 years.

2)   Vehicles eligible for private hire vehicle licensing

     (a)     Licences will only be issued in respect to vehicles that may be described as hard top
             saloons, estate cars and people carriers. Left hand drive vehicles will not be eligible as
             private hire vehicles other than left hand drive American-style stretch limousines but only
             following the express written approval, on application, from the Head of Environmental
             Health Services.

     (b)     Licences will not be issued to the following vehicle types: Fairways, TX1, Metrocabs and
             similar “black cabs” or any vehicle fitted with any top box or sign displaying the word
             “TAXI”. No such top box or sign must be fitted at any time to a private hire vehicle.

     (c)     Licences will not be granted in respect of vehicles with less than four or more than eight
             passenger seats. The maximum number of passengers will be fixed by the Council and
             shown on the vehicle plate and on the vehicle licence.

     (d)     Each vehicle must have an adequate number of doors for the safe access/egress of
             passengers of the vehicle and for the sole use of the passengers.

     (e)     Luggage must be capable of being securely fastened during transit

3)   Exterior signing and advertising

     (a) No approval will be given to any sign which includes the word “taxi” or any other words
         which in the opinion of the Council may give the impression that the vehicle is a hackney
         carriage or may be used to ply for hire.

     (b) No advertisement shall be displayed in relation to the promotion of cigarettes or tobacco
         products, alcohol, contraceptives, sex shops or sex articles, establishments offering
         betting or gaming, or amusements (with or without prizes). The Council reserves the
         right in its absolute discretion to require any advertising material deemed unacceptable
         to the Council and displayed on or in any vehicle to be removed.

     (c) No advertising, or any other material, is to be displayed at any window within the vehicle
         at any time, other than that which is required in law.

     (d) No sign or any other advertising material shall be affixed to any part of a vehicle other
         than to the lower panels of the front and rear passenger or driver doors of the vehicle.

     (e) Roof lights, or any other signs on the exterior of the vehicle, will not be allowed on
         licensed private hire vehicles.

     (f)   Should a vehicle be granted an exemption from the need to display hard licence plates
           in favour of a soft windscreen plate, this vehicle may display no advertising material
           anywhere on the outside of the vehicle and no advertisement in the interior of the
           vehicle that may be readily visible from the outside of the vehicle.

4)   Licence plates interior and exterior

     (a) The exterior hard licence plate issued by the Council shall be affixed to the rear of the
         vehicle on a rigid flat surface so as to be clearly visible at all appropriate times and
         secured by four fixing bolts.

     (b) The licence plate shall be maintained in a clean and legible condition.

     (c) The interior hard licence plate issued by the Council shall be affixed to the interior of the
         vehicle so as to be clearly visible at all times to the passengers.

     (d) Certain vehicles may be exempted from the need to display the hard exterior and interior
         plates in favour of a soft windscreen plate issued by the Council, but only with the
         written consent of the Head of Environmental Health Services (HOEHS). It is a condition
         that, should vehicle owners wish to take advantage of the exemption offered, they do so
         in accordance with the “Council guidelines exempting vehicles from the need to display
         hard exterior plates in favour of a soft windscreen plate”.

5)   Vehicle examination

     (a)   At all times the vehicle must be maintained in all respects to the standard established at
           the time by the Council for a vehicle examination.

     (b)   Prior to the grant of the new private hire vehicle licence it is required that the vehicle
           undergo a vehicle examination to consist of both an MOT and the Council’s additional
           licence checks.

     (c)   Each vehicle less than eight years old shall be submitted annually at renewal, or
           otherwise at the Council’s direction, for a vehicle examination (that includes both MOT
           and the Council’s additional licence checks) and any other examination as the Council
           may decide, to determine the suitability of the vehicle for the purposes of a vehicle.

     (d)   Vehicles eight years old or more shall be submitted at six monthly intervals at renewal,
           or otherwise at the Council’s direction, for a vehicle examination (that includes both
           MOT and the Council’s additional licence checks) and any other examination as the
           Council may decide, to determine the suitability of the vehicle for the purposes of a
           vehicle. The full renewal fee shall be payable at each renewal.

6)    Reporting of accidents

      (a)    The owner shall notify the Council in writing within 48 hours of the occurrence of any
             accident to or involving any private hire vehicle.

      (b)    In the event of an accident, the Council may direct that any vehicle involved in any
             accident shall be examined, at the cost of the vehicle owner, to determine any damage
             caused and may direct that any such vehicle shall be withdrawn from service until such
             damage is adequately repaired.

7)    Transfer of interest

      (a) If the owner of a licensed vehicle transfers or sells his/her interest to another person
          holding either a driver’s or vehicle licence, he/she shall give advance notice in writing to
          the Council 28 days prior to the transfer, specifying the name and address of the person
          to whom the interest will be transferred.

      (b) The person to whom the interest is to be transferred or sold will make an application to
          the Council for the licence to be re-issued to him/her in the manner prescribed above,
          the application to include all the relevant documentation and the standard fee.

      (c) Vehicle licence plates must not be transferred from vehicle to vehicle unless approval is
          given in writing by the Council following application in accordance with these conditions.

8)    Fees

      (a)    The fee payable for the licensing of private hire vehicles shall be in accordance with the
             Council’s current scale of charges.

      (b)    On grant of a private hire vehicle licence, a deposit according to the scale of charges
             must be paid for each exterior and interior hard plate set issued by the Council.

      (c)    If it is the case that an application for exemption (from the need to display hard exterior
             plates in favour of a soft windscreen plate) is received and granted, then the soft plate
             will be issued upon receipt of a further deposit. A fee of £10 for the administration of the
             application for each vehicle shall be payable.

      (d)    Such deposits shall be refunded in full if the hard plates and soft windscreen plates are
             returned to the Council in good order on the termination of the licence.

9)    Garaging of vehicles

      (a)    The vehicle owner shall notify the Council of all addresses where any licensed private
             hire vehicle is kept when not in use and shall notify the Council in writing of any change
             of such addresses within five days.

      (b)    The licensed operator shall not permit a greater number of licensed private hire vehicles
             to be kept on any premises than has been granted by any planning permission in
             respect of those premises.

10)   Taximeters

      (a)    Where any licensed private hire vehicle is fitted with a taximeter the licensed operator
             shall cause:

            (i)     The taximeter to be securely fixed to the vehicle in such a position so as to display
                    the fare to the passengers at all times.

             (ii)   Each taximeter display shall be capable of being illuminated when in operation and
                    shall be so lighted during the hours of darkness as defined by the Road Traffic Act
                    1972 and at any other time at the request of the hirer.

             (iii)    A fare chart shall be affixed to the inside of the vehicle and visible to the
                      passengers at all times to accord with the rate displayed on the taximeter while the
                      taximeter is in operation.

             (iv)     The taximeter shall be fitted with a locking device and sealed so as to prevent any
                      driver or any unauthorised person from tampering with the taximeter or its proper
                      operation.

11)   Extinguishing appliances

       A one kg dry powder fire extinguisher must be carried in such a position as to be secured, yet
       readily available for use at all times either in the main body of the vehicle or in the boot. It
       must be maintained to the relevant British Standard and in accordance with manufacturer’s
       instructions.

12)   First aid kit

       A first aid kit must be carried on the vehicle and maintained at all times. The kit should contain
       at least the following:

        •    Ten moist antiseptic wipes (individually wrapped)
        •    Two triangular bandages (individually wrapped)
        •    Individually wrapped sterile adhesive dressings (24 assorted sizes)
        •    Three large sterile unmedicated ambulance dressings (not less than 15.0cm x 20.0cm)
        •    Two sterile eye pads with attachments
        •    One pair of rustless blunt ended scissors
        •    Safety pins (10 assorted)
        •    5 pairs of sterile disposable gloves

13)    Guide dogs, assistance dogs and other animals

       (a)   Private hire vehicles and hackney carriages must carry a guide dog or assistance dog
             belonging to a passenger, free of charge, unless the driver has a proven medical
             condition that would preclude such action. That condition must be notified in writing to
             the Council, with the necessary medical proof, to establish the medical condition.
             Consent to exempt the driver from the requirements of this section of the standard
             conditions must be obtained in writing.

       (b)   No animals other than those owned by fare paying passengers shall be carried in or on
             any licensed vehicle whilst the vehicle is so engaged under the terms of its licence.

14)    Change of circumstances

       Any material change of circumstances must be reported in writing within 48 hours to the Head
       of Environmental Health Services.

15)    General

       The Council may vary any or all of the conditions or regulations in respect of the licensing of
       private hire vehicles at any time.

       Any licence issued may be suspended, revoked, or not renewed, in accordance with the
       provisions of the Local Government (Miscellaneous Provision) Act 1976.

       No persons, other than fare-paying passengers are to be carried by the driver during the
       course of his/her business. No person under the age of 14 years may be carried in the front
       seat of the vehicle at any time.
