TO COMPLETE THIS TRANSACTION, PLEASE READ THE FOLLOWING TERMS AND
CONDITIONS. BY SUBMITTING THIS ORDER, YOU ARE INDICATING THAT YOU HAVE READ
AND AGREE TO BE BOUND TO THESE TERMS AND CONDITIONS.

SCOPE OF AGREEMENT

The purpose of this HP Computer Hardware Recycling Service Agreement (the
“Agreement”) is for Hewlett-Packard (Canada) Ltd. (“HP”) to provide a service to manage
your unwanted computer hardware through donation, reuse, or recycling (the “Service”).
Computer Hardware means HP and non-HP CPUs, monitors, printers and peripheral
devices (collectively “Computer Hardware”). HP will, upon receipt of Customer’s
payment and acceptance of these terms and conditions, accept delivery of Customer’s
properly packaged Computer Hardware. HP will in its sole discretion be responsible for
either donating Customers’ Computer Hardware to charity or ensuring the Computer
Hardware is reused or recycled.

CUSTOMER RESPONSIBILITIES

Customer will package the Computer Hardware in accordance with HP’s Packing
instructions and make the packaged Computer Hardware available for pickup by a HP
arranged carrier.

Customer acknowledges that this service applies only to Computer Hardware and that
material shipped is only Computer Hardware and no other products or materials will be
shipped. Customers will ensure that the Computer Hardware shipped matches the
Computer Hardware description contained in Customer’s order.

Customer is responsible for the deletion of all confidential and personal data that may be
contained within the Computer Hardware. Customer acknowledges and agrees that HP
will not be in any way responsible for any loss incurred by Customer or any third party
relating to confidential or personal data that Customer has not removed from the
Computer Hardware prior to shipping.

NOTE: This service is not intended for any computer equipment that is or has become
contaminated or suspected of being contaminated with chemicals, biological agents or
other substances that are not integral to the original new equipment or otherwise
associated with normal office or household environments. Products that may be
contaminated must be decontaminated prior to their return to HP. HP does not offer
decontamination services. Please call HP at 1-888-485-1849 before ordering if you are
unsure about the status of your equipment.

SERVICE CANCELLATION POLICY

Customer may cancel this Service on the same business day as the Service is ordered and
obtain a refund or credit. To cancel the Service, you must call HP at 1-888-485-1849.
Shipping and handling charges may not be refunded.


LIMITED WARRANTY

HP warrants that it will perform Services using reasonable care and skill.

THIS WARRANTY IS YOUR SOLE AND EXCLUSIVE WARRANTY AND REPLACES ALL OTHER
WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

HP’S AGGREGATE LIABILITY TO CUSTOMER FOR ANY REASON AND UPON ALL
CLAIMS AND CAUSES OF ACTION HEREUNDER OR IN ANY WAY CONNECTED TO
OR COLLATERAL TO, EITHER DIRECTLY OR INDIRECTLY, THE SUBJECT MATTER OF THIS
AGREEMENT, SHALL BE LIMITED TO THE AMOUNT OF FEES PAID BY CUSTOMER FOR
THE SERVICE. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION OR CLAIMS
INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF
WARRANTY, NEGLIGENCE, STRICT LIABILITY OR OTHER TORTS. IN NO EVENT WILL
HP BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, INCIDENTAL OR
PUNITIVE DAMAGES, INCLUDING WIHTOUT LIMITATION LOSS OF DATA, LOSS OF
PROFITS OR LOSS OF SAVINGS OR REVENUE, EVEN IF HP HAS BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES.

GENERAL

Nothing in this Agreement affects any statutory rights of consumers that cannot be waived or limited by
contract.

HP does not represent that Customer is eligible for a charitable tax deduction as a result of this Service.

To the extent permitted by local law, neither Customer nor HP will bring a legal action, under this
Agreement, more than two years after the cause of action arose unless otherwise provided by local law
without the possibility of contractual waiver or limitation.

Neither party will be liable for its failure to fulfill any obligation hereunder due to causes beyond its
reasonable control.


Customer may not assign, or otherwise transfer, this Agreement or any rights under it without HP’s prior
written consent. Any attempt to do so is void.

In the event that any provision of this Agreement is held to be invalid or unenforceable, the remaining
provisions of this Agreement remain in full force and effect.

These Services and this Agreement are offered only in Canada.


This Agreement is made under and will be construed in accordance with the laws of the Province of Ontario
and, where applicable, Canada and without giving effect to its choice of law rules.
This HP Computer Hardware Recycling Service Agreement (the “Agreement”) is the complete and only
agreement regarding your purchase of the HP Computer Hardware Recycling Service (“Service”) for both
HP and non-HP computer hardware.
