      PROJECT DESCRIPTION
      An application for a Conditional Use Permit (CUP) to allow the sales, service and consumption of beer and wine
      at an existing full service restaurant. The existing restaurant had a CUP approval for the sales, service and
      consumption of beer and wine which expired, located at 126 North Brand Boulevard, in the “DSP /M” - Downtown
      Specific Plan zone, Maryland District, described as Portions of Lots 5, 6, and 7, Block 1, Glendale Boulevard
      Tract.

PROJECT PROPOSAL: The request is for renewal of an existing conditional use permit
(CUP) to allow continued sales, service and consumption of beer and wine at an existing full
service restaurant (I Love Tofu & BBQ Restaurant) in the DSP, Downtown Specific Plan
zone, in the Maryland District The sale of beer and wine is incidental to the primary dining
function of the restaurant. Sales, service, and consumption of beer and wine at the subject
restaurant were granted by conditional use permit case No PCUP 2005-033, which expired
on November 10,2010.

      A.     Applicant Proposes: Renewal of a CUP to allow sales, service and
             consumption of beer and wine at an existing full service restaurant (I Love Tofu &
             BBQ Restaurant).

      B.     CEQA Status: Exempt

      C.     Previous Permits for the Site: Conditional Use Permit Case No. PCUP 2005-
             033 was granted on November 10, 2005, to allow the sales, service and on-site
             consumption of beer and wine at a full service restaurant in the CBD, Central
             Business District zone. The subject restaurant (I Love Tofu & BBQ Restaurant) is
             located in the DSP/M, Downtown Specific Plan / Maryland zone.

      D.     Recommendation: Approval of the conditional use permit.

SITE CONTEXT

GENERAL PLAN: Commercial Regional.

DESCRIPTION OF EXISTING PROPERTY AND USES: The full service restaurant is one
of the commercial uses on the site, which includes a beauty college, a shoe store, and a
sandwich shop. No parking spaces are located on the site. The site is bounded by Brand
Boulevard to the west, commercial buildings to the north and south, and an alley to the east.

COMMENTS FROM OTHER CITY DEPARTMENTS: The Police Department has made
recommendations and conditions, which have been incorporated in the conditions of
approval of the CUP.

REQUIRED FINDINGS
Pursuant to Section 30.42.030 of the Glendale Municipal Code, a conditional use permit
may be granted only if the following findings of fact can be made:

A. That the proposed use will be consistent with the various elements and objectives of the
   general plan.

B. That the use and its associated structures and facilities will not be detrimental to the
   public health or safety, the general welfare, or the environment.

C. That the use and faCilities will not adversely affect or conflict with adjacent uses or
   impede the normal development of surrounding property.

D. That adequate public and private facilities; such as utilities, landscaping, parking spaces
   and traffic circulation measures are or will be provided for the proposed use.

For applications involving the sale, service or consumption of alcoholic beverages, the
following criteria shall be considered in making the findings in subsections "A" through "D"
above:

    1. That where an existing or proposed on-site use is located in a census tract with more
         than the recommended maximum concentration of on-site uses or that where an
         existing or proposed off-site use is located in a census tract with more than the
         recommended maximum concentration of off-site uses, both as recommended by the
       . California Department of Alcoholic Beverage Control, such use does not or will not
         tend to intensify or otherwise contribute to the adverse impacts on the surrounding
         area caused by such over concentration.
    2. That where the existing or proposed use is located in a crime reporting district with a
         crime rate which exceeds twenty (20) percent of the city average for Part I crimes, as
         reported by the Glendale Police Department, such use does. not or will not tend to
         encourage or intensify crime within the district;
    3. That the existing or proposed use does not or will not adversely impact any church,
         public or private school or college, day care facility, public park, library, hospital or
         residential use within the surrounding area.
    4. That adequate parking and loading facilities are or will be provided for the existing or
         proposed use or other reasonable alternatives satisfy the transportation and parking
         needs of the existing or proposed use.

        the existing or proposed use does or will serve a public necessity or public
        convenience purpose for the area.                                .

 ANALYSIS OF C.U.P. REQUEST! REQUIRED FINDINGS

 The full service restaurant has operated at 126 N. Brand Boulevard in the Maryland District
 of the DSP since March 2, 2010. The CUP Case No: PCUP-2005-033 was issued for
 serving and on-site consumption of beer and wine in the restaurants at this location since
 2005. The neighborhood (Maryland District I Non-Auto Dealer Commercial) is comprised of
 a combination of entertainment, restaurant, retail and service uses. On March 2, 2010, a
 zoning use certificate was issued to allow the restaurant (I Love Tofu and BBQ) to operate.
 The change of ownership does not constitute a need for a new CUP. The existing CUP
 Case No. PCUP-2005 c 033 expired on November 10, 2010. Hence the current application for
 the CUP is submitted .

. The full service restaurant (I Love Tofu and BBQ) use and the proposed incidental serving
  and consumption of beer and wine on the premises are consistent with the various elements
  of the General Plan. The Land Use Element of the General Plan for "Commercial Regional"
  encourages commercial uses, such as restaurants. The purpose of commercial activity is to
  provide convenience and encourage healthy urban districts with opportunities for interaction
  between uses. The restaurant and the incidental serving of alcoholic beverages provide a
  service and convenience to the community and interacts with the surrounding uses.,

 The restaurant has operated at its current location serving beer and wine with meals since
 March 2010 without detriment to the public health, safety or environment as well as having
 no adverse impactor conflicts with adjacent uses. The Police Department and
 Neighborhood Services Division have not expressed any major concerns regarding this
 application. According to the Police Department, the restaurant is located in census tract
 3020.02, which allows for 3 On-Sale licenses. There are currently 23 On-Sale
 establishments in this tract. Based on Part 1 crime statistics for census tract 3020.02 in
 2009, there were 227 crimes-173% above the city-wide average of 84.

 The number of on-sale establishments in the tract is well above the number allowed.
 However, the serving and sale of alcoholic beverages for on-site consumption in the
 restaurant will not intensify the current situation since this restaurant is one of the existing 23
 on-sale establishments in the tract. Therefore,
 the CUP for the sale, service and consumption of beer and wine will not contribute to
 adverse impacts on the surrounding
 area. Staff has proposed conditions to ensure the on-site consumption is limited in
 frequency and hours of operation (see the "conditions of approval").

 A full service restaurant is a .permitted use in the DSP/M zone and serving and sale of
 alcoholic beverages incidental to the serving of a meal is conditionally permitted. Allowing
 the serving, sale and consumption of beer and wine at the restaurant will not conflict with
 adjacent uses, which are mainly commercial, retail, and restaurant uses. No physical
 expansion of the restaurant or new construction is proposed. There is a library and a small
 park within one mile of the subject restaurant. However, the establishment is not a bar or

Furthermore, parking meters are available on Brand Boulevard and at the rear of the
restaurant, across the service alley, a city-owned multi-level parking structure, provide
sufficient and easily accessible parking spaces to the patrons of the restaurant.

The purpose of the Circulation Element of the General Plan is to ensure that existing
development is provided with adequate and safe streets, capable of accommodating traffic
associated with the proposed use. Brand Boulevard is a Major Arterial street, which has the
capacity to carry and accommodate the traffic generated in this commercial neighborhood.
In addition, to allow the restaurant to continue the sales, serving and consumption of beer
and wine should not affect traffic as the restaurant has been operating and serving beer and
wine since March 2010 and prior to this, other restaurants at this location have served beer
and wine since 2005.

                                   Draft Findings

1. That the proposed use will be consistent with the various elements and
   objectives of the general plan. The full service restaurant (I Love Tofu and BBQ) is
   located in the Downtown Specific Plan/Maryland (DSP/M) zone, Commercial Retail.
   The restaurant use and the proposed incidental serving and consumption of beer
   and wine on the premises are consistent with the various elements of the General
   Plan. The Land Use Element of the General Plan for "Commercial Regional"
   encourages commercial uses, such as restaurants, which serve community. The
   restaurant and the incidental serving of alcoholic beverages provide a service and
   convenience to the community.

2. That the use and its associated structures and facilities will not be detrimental
   to the public health or safety, the general welfare, or the environment. The
   serving of alcoholic beverages will be complementary and incidental to the
   restaurant's primary dining function. Serving alcoholic. beverages with meals is
   common, provides a public convenience in a full service restaurant, and has not
   proven detrimental to the public health or general welfare or environment at this
   location since the current owner took over operations in March, 2010. Other
   restaurants have served beer and wind at 126 N. Brand since 2005.

3.' That the use and facilities will not adversely affect or conflict with adjacent
    uses or impede the normal development of surrounding property. The
    restaurant is a permitted use in the "DSP" Zone. No addition to the existing
    restaurant is proposed and it has functioned at its current location serving beer and
    wine since March, 2010. Prior to this other restaurants have served beer and wine at
    this location since 2005, without adversely affecting adjacent uses.

   There are no churches, schools or hospital within a mile of the project. There is a
   library and a small park within one mile of the subject \estaurant. However, the
   application is for serving and consumption of beer and wine within the restaurant and
   incidental to the serving of food. The establishment is not a bar or liquor store and
   sales of beer and wine for off-site consumption is not proposed. In addition, the
   surrounding area is fully developed. Therefore, the use will not adversely affect or
   conflict with adjacent uses or impede development in the area.

   The Police Department and Neighborhood Services Division have not expressed
   major concerns regarding this application, but have made recommended conditions
   for the Planning Hearing Officer to consider.

4. That adequate public and private facility such as utilities, landscaping, parking
   spaces and traffic circulation measures are or will be provided for the
   proposed use. All services and utilities such as gas, electricity, and phone lines are
   available since the site is fully developed. Approval of the CUP for the sales, service
   and on-site consumption of beer and wine at the existing restaurant should not
   generate a need foradditional parking. Furthermore, parking meters are available on
   Brand Boulevard and at the rear of the restaurant, across the service alley, a city-
   owned multi-level parking structure, provide sufficient and easily accessible parking
   spaces to the patrons of the restaurant.

development is provided with adequate and safe streets, capable of accommodating
traffic associated with the proposed use. Brand Boulevard is a Major Arterial street,

commercial neighborhood. In addition, to allow the restaurant to continue the sales,
serving and consumption of beer and wine should not affect traffic as the restaurant
has been serving beer and wine since March, 2010, and prior to this, at previous
restaurants beer and wine was served since 2005, without adverse impacts.

                            Draft Conditions of Approval

1. That the use shall be in substantial accord with the plans submitted with the
   application and presented at the hearing except for any modifications as may
   be required to meet specific Code standards or other conditions stipulated
   herein.

2. That any expansionbr modification of the facility or use which intensifies the
   existing conditional use permit shall require a new conditional use permit
   application. Expansion shall constitute additional floor area, increased hours of
   operation, or any physical change as determined by the Planning Hearing
   Officer, with concurrence of the Director of Community Development.

3. That all licenses and permits as required or approvals from Federal, State,
   County or City authorities, including the City Clerk, shall be obtained and kept
   current at all times.

4. That the premises be maintained in a clean and orderly condition, free of weeds,
   trash, and graffiti.

5. The front and back doors of the establishment shall be kept closed at all times while
   the location is open for business, except in case of emergency.

6. That the restaurant shall comply with the "Fresh Air (smoking) Ordinance".

7. That adequate means be provided for the collection of solid waste generated at the
   site and that all recyclable items be collected and properly disposed of to the
   satisfaction of the Integrated Waste Management Administrator of the city of
   Glendale.'                                             .

8. That all music, lighting, noise and odors shall be confined to the occupancy so as not
   to disturb occupants of other businesses or properties and patrons on the public
   right-of-way. The business shall comply with all state and local laws and ordinances
   concerning excessive noise and disturbing the peace.

9. That no separate bar area to serve alcoholic beverages shall be permitted inside the
   restaurant.

10. That no exterior signs advertising the service of alcoholic beverages are permitted.

11. That the sale of alcoho.lic beverages at the restaurant shall be incidental to serving
    food.

12. That the sales, service and consumption of alcoholic beverages shall be permitted
    only between the hours of 11 am to 10:00 pm each day of the week.

13. That the premises shall be made available and accessible to any authorized City
    personnel (Fire, Police, Neighborhood Services, Planning, etc.), for inspection to
    ascertain that all conditions of approval of this conditional use permit are complied
    with.

    private party rental where access by the general public is restricted.

17. There shall be no video machine maintained upon the premises.

18. Live entertainment is permitted with the exception that no karaoke, no bikini activities
    or events, no lingerie activities or events, no swimwear activities or events, nor any
    similar activities or events be allowed where partial clothing of male or female
    entertainment is provided.

19. The sale of beer and wine for consumption off the premises is strictly prohibited.

20. The establishment shall not be used as tavern. Taverns include bars, pubs, cocktail
    lounges and similar establishments. Any establishment serving alcoholic beverages'
    which has a dance floor of greater than 200 square-feet is considered a nightclub
    and is not allowed under this permit.
