II.    SPECIFIC PROVISIONS

       A. QUESTIONS AND COMMENTS

           Questions and comments regarding this bid must be submitted in writing to City of
           San Diego, Purchasing Division, ATTN: Michael Winterberg, 1200 Third Avenue,
           Suite 200, San Diego, CA 92101; or by fax to (619) 533-3230; or by e-mail to
           MWinterberg@sandiego.gov, no later than 5:00 p.m. on May 4, 2006.

       B. PRICING

           Prices quoted shall include all delivery charges and shall be FOB Destination to:

           •   General Services Department
               Equipment Division
               2740 Caminito Chollas

       C. AWARD
           This bid shall be awarded on an item by item basis, or in any group or combination of
           items, or as a lot, as may be in the best interest of the City.
       D. SUBMITTALS
           1. BID SUBMITTAL
               Bids must be returned in a sealed envelope to the Purchasing Division, 1200 Third
               Avenue, Suite 200, San Diego, CA 92101. The bid number and closing date/time
               must be referenced on the outside of the envelope (lower left corner). Bids must
               be received by the Purchasing Reception Desk prior to bid opening at 2:30 p.m.
               on bid closing date. Faxed bids will not be accepted.

               The original and one (1) copy of bid, including any attachments, shall be
               submitted.

           2. SUBMITTALS REQUIRED WITH BID

               Failure to provide the required submittals with the bid may be cause for the bid to
               be rejected as non-responsive.

               a. Bidder’s References (as specified in Section II, paragraph H).
               b. Copy of Manufacturer’s Warranties (as specified in Section II, paragraph N).
               c. Local Warranty Service Facility Contract Information, (as specified in
                  Section II, paragraph N).
               d. Equipment Specifications Brochure (as specified in Section II, paragraph R).

           3. SUBMITTALS REQUIRED UPON PROVISIONAL AWARD

               Failure to provide the following documentation within the time period specified
               may be cause for the provisional award to be voided and the bid to be rejected as
               non-responsive.

               a. Insurance Requirements (as specified in Section II, paragraph G).
               b. Taxpayer Identification Number (W-9) as specified in City of San Diego
                  General Provisions, Section C, paragraph 15, if not currently on file.
               c. Business Tax License (as specified in Section II paragraph BB), if not
                  currently on file.

       E. OPTION TO RENEW

           The City reserves the option to renew the contract for four (4) additional one (1) year
           periods under the terms and conditions of the current contract beginning on the
           anniversary of the commencement of contract. The renewal is contingent on a mutual
           agreement between the City and the Contractor with such agreement to be confirmed
           sixty (60) days prior to the expiration of the contract period. Either the City or the
           Contractor may decline to confirm the renewal of the contract for any reason
           whatsoever, which shall render the renewal option null and void.

           The City’s initial letter offering the Bidder an opportunity to renew the contract does
           not constitute an award of the option period. Any option acceptance must be
           confirmed by the City, in writing, before it becomes valid.

           Bidder shall indicate the maximum percentage increase to which the prices in effect
           at the end of the current contract year would be subject if the renewal options were
           exercised. _________%

           Failure to submit or complete the price increase section above will be construed to
           mean that prices bid will not be increased during any option period. The City will not
           grant an option, if the Contractor requests a price increase which exceeds above stated
           percentage, with the possible exception regarding diesel engine emissions standards,
           as delineated in Section II, paragraph X “Changes in Emission Requirements”. If a
           price increase is requested, the Contractor must provide detailed supporting
           documentation to justify the requested increase. The requested increase will be
           evaluated by the City, and the City reserves the right to accept or reject such request.

           This section will not be considered in the evaluation for award.

           The City may also desire to extend a contract on a month-to-month basis upon
           expiration of the current contract period under the terms and conditions of the current
           contract unless modified in writing. The renewal is contingent on a mutual agreement
           between the City and the Contractor with such agreement to be confirmed in writing
           prior to the expiration of the contract period.

       F. PRICE ADJUSTMENT CLAUSE FOR OPTION RENEWAL

            In the event the Contractor does not request a price increase at the time of the
            contract renewal, and the Manufacturer subsequently announces a general increase in
            the price of their products, or compliance with imposed emissions standards requires
            alteration of diesel powered equipment, the Contractor may request an increase at
            that time. The Contractor must provide detailed supporting documentation from the
            Manufacturer to support the requested increase. The requested increase shall not
            exceed the percentage increase indicated in the “Option to Renew” clause, with the
            possible exception regarding diesel engine emissions standards, as delineated in
            Section II, paragraph X “Changes in Emissions Requirements”.

       G. INSURANCE REQUIREMENTS

           All required insurance shall be submitted to Purchasing within ten (10) days of
           provisional award. Failure to provide the insurance certificates within the time frame
           specified by the City shall be cause for the bid to be rejected as non responsive.
           Contractor shall maintain insurance in full force and effect during the entire period of
           performance under contract. Failure to do so shall be cause for termination of the
           contract.

           All policies must have a thirty (30) day non-cancellation clause giving the City thirty
           (30) days prior written notice in the event a policy is canceled.

           At the end of each contract year, the City reserves the right to review insurance
           requirements and to require more or less coverage depending upon assessment of the
           risk, the Vendor’s past experience, and the availability and affordability of increased
           liability insurance coverage.

           Insurance coverage must be from an insurance carrier licensed in the State of
           California and rated “A” or better by the A.M. Best Key Rating Guide.

           The following coverage is required:

           1. Commercial General Liability for a minimum of one million dollars each
              occurrence ($1,000,000.00 EO). The City of San Diego must be named as an
              additional insured on the certificate.

           2. Workers’ Compensation coverage in accordance with the laws of the State of
              California. Policy must contain a Waiver of Subrogation of Rights against the
              City of San Diego.

       H. REFERENCES/QUALIFICATIONS

           Bidders are required to provide references from a minimum of three (3) customers
           that have purchased the same make/model and major component design of equipment
           bid. This will enable the City to judge product reliability and performance, Vendor
           performance, ability to obtain replacement parts in a timely manner, downtime, and
           other information.

           Unsatisfactory references will be grounds for rejection of bid. Equipment that has a
           poor performance history with the City of San Diego will be rejected. Bids from
           vendors who have, in the past, given poor of inefficient warranty service on
           equipment similar to that herein will be rejected.

           To enable the City to evaluate the responsibility, experience, skill, and business
           standing of the Bidder, the following documents must be included with the bid
           submittal:
           •   Bidder’s References (use form on page 62).

       I. DEMONSTRATIONS

           Bidders may be required, at their sole expense and upon receipt of a written notice
           from the Purchasing Division, to demonstrate their proposed equipment for a
           minimum of three (3) days in San Diego prior to awarding the contract. Bidder shall
           furnish demonstration equipment within seven (7) calendar days upon receipt of a
           written demonstration request.

           Equipment provided for the demonstration shall be completely identical to all
           equipment bid. A demonstration will allow the city to evaluate criteria including, but
           not limited to equipment productivity, serviceability, and maneuverability. The City
           shall be the sole judge of the suitability and acceptability of any equipment proposed
           or demonstrated.

       J. ORDERS

           The City does not have an immediate need for any of the vehicles as described in the
           Pricing Pages, and will not be placing an immediate order for these items. However,
           the City anticipates that orders may be placed throughout the contract period and the
           estimated annual quantities are based on past experience.

       K. VEHICLE/EQUIPMENT REGISTRATION AND LICENSE PLATES

           The Contractor shall obtain the exempt registration and license plates.

           The legal registration title shall be as follows:

               City of San Diego
               Equipment Division

               City Equipment I.D. No. ______________

           Prior to applying for Exempt “E” license plates, the Contractor shall contact the
           City’s Equipment Coordinator at (619) 527-7571 to obtain a City of San Diego
           Equipment identification number for each vehicle/equipment. This number must
           appear on the final registration certificate.

           Some equipment may be purchased via the City’s Equipment and Vehicle Financing
           Program. These units will require that the Vehicle Financing Program Provider
           be listed as Lien holder on vehicle/equipment registration. Contact the Equipment
           Division Engineer at (619) 527-7561 for Lien holder verification.

           A facsimile of the registration card shall be inserted in the registration holder and
           each holder shall be attached inside the equipment. The location and method of
           attachment of the registration holder to the equipment shall be approved by the
           Equipment Division Engineer prior to installation.

           The original registration card shall be included with the warranty documents upon
           delivery of each unit to the City. These documents shall be contained in a document
           delivery envelope.

           The license or identification plates shall be installed prior to delivery of each unit.

       L. DELIVERY

           To optimize Equipment Division labor requirements, all new equipment deliveries
           shall be scheduled in advance. The successful Bidder, upon receipt of City Purchase
           Order or Master Lease authorization, and prior to submittal of factory order, shall
           contact the Equipment Division Engineer at (619) 527-7561 to establish delivery
           intervals.

           The equipment shall be delivered complete and ready for operation. It shall be new
           and the latest model and, except as otherwise specified, be standard in all respects. It
           shall have all the usual equipment and features as shown by current Manufacturer’s
           Fleet Buyer’s Guide catalogues. It shall be fueled and completely lubricated, and all
           pre-delivery services shall have been performed. Delivery time is Monday through
           Friday, 10:00 a.m. to 3:00 p.m.

           The City will not pay for any equipment that is not delivered as specified in the bid.
           Conformity to equipment specification and the subsequent equipment acceptance date
           will be determined by the Equipment Division Engineer. Payment terms will be
           based on date of acceptance by the City.

       M. EQUIPMENT AND VEHICLE FINANCING PROGRAM

           The City reserves the right to make a direct purchase of proposed equipment, or to
           arrange financing under the City’s Equipment and Vehicle Financing Program.

           If the City chooses to utilize its Equipment and Vehicle Financing Program, the
           successful Bidder shall sell the equipment to the City’s lessor under the same terms
           and conditions offered to the City. (See Attachment.)

       N. WARRANTY

           All equipment shall have the regular Manufacturer’s standard guarantee and warranty
           against defects in material and workmanship. In no case shall coverage be less than
           twelve (12) months after a unit is placed in service. Where a standard Manufacturer
           warranty exceeds a period of one (1) year, this warranty shall also be provided to the
           City. Bidders shall submit a copy of the Manufacturer’s warranty with their bid.
           Should there be a conflict between the Manufacturer’s warranty and these
           specifications, these specifications shall prevail as may be in the best interest of the
           City.

           Bidder shall establish and deliver to the City a one (1) year service contract with an
           approved local warranty service facility. A local warranty service facility is hereby
           defined as a warranty service facility located within the County of San Diego.
           Contractor shall furnish with their bid written verification of the local warranty
           service facility contract. Contract and service facility shall have prior approval of the
           Deputy Director, General Services/Equipment Division or their designee.

           In the event of a breakdown or failure of the equipment during the warranty period
           and upon receipt of notice (written or verbal) from the City, Contractor shall take
           satisfactory action to effect repair or replacement of affected parts within
           forty-eight (48) hours.

           Transportation of the equipment from any City of San Diego Station, or place of
           breakdown, to the warranty service facility for warranty work and back, shall be the
           responsibility of the Contractor. This includes towing when necessary. If the City
           must have the equipment towed for reasons of security or safety, the Contractor shall
           be responsible for all costs.

       O. PARTS STIPULATION

           The successful Bidder shall ensure adequate and continued parts support for the
           useful life of the equipment. The successful Bidder shall provide access to
           proprietary parts for the equipment for a period of not less than five (5) years from the
           last delivery of the equipment. Parts must be available in San Diego County and/or
           received by the City of San Diego within forty-eight (48) hours from placement of the
           order.

           Parts shall include, but not be limited to, those for the cab and chassis and related
           components such as engine, transmission, suspension, and brakes. Additionally, all
           proprietary consumable and wear parts for the equipment and its related components
           shall be included.

           It is the intent of the City to have a full compliment of fast moving spare parts in
           stock prior to the first delivery of the equipment. The successful Bidder shall provide
           the City with a recommended minimum stock parts list for the equipment within
           forty-five (45) days of award of contract.

           Failure to comply with these stipulations may result in the termination of this contract
           by the city.

       P. KEYS

           All locks on delivered equipment shall be operable with one (1) key. Five (5) keys
           for each lock shall be provided upon delivery. Key codes shall be furnished for all
           equipment delivered.

       Q. EQUIPMENT LINE SHEET

           The successful Bidder shall provide, upon delivery of each unit, a copy of the
           factory/OEM line sheet indicating parts identification particular to the delivered unit.

       R. EQUIPMENT SPECIFICATION BROCHURES

           Each Bidder shall furnish, as a part of the bid, equipment specification brochures
           clearly describing the equipment they propose to furnish. These accompanying
           documents shall clearly indicate all points specified herein. Failure to provide a
           brochure may cause the bid to be rejected as non-responsive.

       S. EQUIPMENT SPECIFICATIONS FORMS

           Each Bidder shall complete and furnish, as a part of the bid, the specifications forms
           herein. Any deviations to the specifications must be clearly stated in the bid
           submittal. Any deviations will be evaluated and may be basis for rejection if they are
           found to be detrimental to the operation of the City. The specifications forms shall be
           completed in its entirety. Failure to provide complete, accurate Equipment
           Specifications Forms may cause the bid to be rejected as non-responsive.

       T. MANUFACTURER’S CERTIFIED TRAINING

           The successful Bidder may be required, at the City’s discretion, to conduct
           manufacturer’s certified operator and mechanic training. Special emphasis shall be
           given to any unique characteristics of the equipment and repair. The City will not pay
           any cost incurred by the successful Bidder in providing the training. Training shall be
           provided by a manufacturer’s qualified instructor.

       U. MANUALS

           One (1) set each of the following manuals shall be provided for each type of
           equipment upon delivery:

              •     Operation Manual
              •     Service Manual
              •     Parts Manual

       V. LABELS

           All signs and labels required by Department of Transportation (DOT), ANSI
           (American National Standards Institute), and California Occupational Safety and
           Health Administration (Cal-OSHA) shall be affixed.

       W. CODE COMPLIANCE

           All equipment delivered under these specifications shall comply with all applicable
           provisions of the most recent California Vehicle Code, DOT Standards, ANSI and
           Cal-OSHA codes.

       X. CHANGES IN EMISSIONS REQUIREMENTS

           The City acknowledges that state and/or federal emissions requirements that are
           applicable during the term of this contract may change at any time during this
           contract and such changes may include equipment alterations and/or equipment
           upgrades to the specifications herein. The Contractor shall be responsible for
           immediately notifying the City in writing of any state and/or federal changes in
           emissions requirements occur. In cases where these changes require a price increase,
           the contractor shall notify the City immediately of such increase in writing and shall
           provide detailed supporting documentation to justify the requested increase. The
           contractor must include details of any special equipment and/or equipment upgrades
           that are mandated for installation as a result of the change in emissions requirements.
           The requested increase will be evaluated by the City, and the City reserves the right to
           accept or reject, based on whether it is determined by the City to be fair and
           reasonable.

           Except as otherwise specified herein, the City of San Diego General Provisions, dated
           January 3, 2005, (on file in the Office of the Purchasing Agent) are incorporated as
           part of this bid and any resulting contract by reference. The General Provisions are

       B. SPECIFICATIONS FOR EMULSION SYSTEM

           An emulsion spraying and storage system shall be mounted transverse on the truck
           chassis behind the cab and in front of the dump body. The system shall be bolted to
           the frame.

           1. Tank

               A dual compartment tank constructed of 10 gauge steel with bottom
               reinforcements shall be provided. Storage capacities shall be 130 gallons
               emulsion and 20 gallons solvent. Tank dimensions shall be 30" height, 16" wide
               and 72" long. The following additional features are required.

               a. 4" clean out on curbside near tank bottom.
               b. 6" curbside filler cap.
               c. Removable fill basket strainer.
               d. Shall be capable of being switched from emulsion to solvent utilizing one (1)
                  valve lever.
               e. Oil temperature gauge, 0 to 250 degrees with a guard shall be mounted curb
                  side.
               f. A fold up platform to aid in filling the tank shall be provided on the curb side.

           2. Heater

               The heating system shall use the vehicle cooling system as a heat source. A 1"
               internal serpentine steel tube shall circulate hot water to maintain the appropriate
               emulsion temperature. A temperature control valve shall be provided at the tank.
               Two (2) 3/4" pipe fittings at the curb side bottom of the tank shall be provided to
               connect the coolant circulating line to the vehicle. Two (2) ¾" severe duty cooling
               hoses shall supply and return coolant from the emulsion system.

           3. Auxiliary Electric Heat

               A 110 VAC heating system shall be provided. The heating element shall be low
               density stainless steel.

           4. Emulsion Oil Pump

               A remote mounted emulsion oil pump shall be gear type, rated at 20 GPM at 420
               engine RPM minimum. The pump shall be fully hydraulic, utilizing the dump
               body hydraulic system. The pump shall be mounted outside the frame rail, aft of
               the curb side fuel tank. The emulsion pump controls shall be fully accessible
               from the right (curb) side of the body at the emulsion tank. The pump shall be
               reversible to draw material back to the tank.

               The emulsion oil shall be plumbed to the curb side of the emulsion tank trough a
               3/4", steel line equipped with a ball valve shutoff. The plumbing shall include a
               re-circulation line. An adjustable pressure relief valve shall be installed in the oil
               system for controlling spray pressure.

               Pump shall be driven by a gasoline powered auxiliary engine with a minimum
               displacement of 5 cubic inches. Engine shall be electric start.

           5. Emulsion Spray Unit

               Spray system shall be plumbed to rear (curb) side of the truck. A spring loaded
               hose reel shall be provided with 25' of ½" diameter oil resistant hose. 1/2" x 72"
               steel application wand with changeable brass nozzles shall be provided. Wand
               shall be held in place by a storage holster.

       C. SPECIFICATIONS FOR DUMP BODY HOIST

           1. Body Construction

               The unit shall be rated as a heavy duty rear dump body for a single axle chassis.
               All steel utilized in fabrication shall be rated “hi-tensile” and 50,000 psi yield
               strength. The body, tailgate, and cab shield shall be 10 gauge. The floor shall be
               1/4". The body shall be continuous welded. The longitudinals and crossmembers
               shall be interlaced. Crossmembers shall be full width and continuous welded to
               the inside of the sloped rubrail. Floor shall be supported at a maximum of every
               12". Top rail shall be fully boxed with 2" wide board pockets. Sides shall have a
               fully boxed and sloped horizontal brace. Body shall have full height and depth
               front and rear corner posts. Tailgate shall be double acting with greased zerk
               fittings, with 1-1/4" hinge pins offset forward a minimum of 5". Tailgate shall
               have fully boxed and sloped upper rails, lower rails, and horizontal brace.
               Tailgate shall incorporate roll type ditch gate (guillotine style is not acceptable).
               Body shall include a 10" spreader apron.

           2. Body Dimensions

               The following exact body dimensions and features shall be provided:

               defined by the National Truck Equipment Association with a minimum capacity
               of 7.5 tons. Hoist shall have a minimum 50º dump angle. Pump shall be a direct
               mount, gear type capable of cycling the hoist up in a maximum of 30 seconds at
               1,000 RPM.

           4. Hydraulic Reservoir

               The hydraulic reservoir shall be of sufficient capacity to operate the hoist
               cylinders while operating the emulsion pump. The tank shall be constructed of 10
               gauge steel minimum. The reservoir shall be equipped with an accessible sump
               and utilize spin-on 10 micron return filter and a stainless steel ball valve for filter
               changes.

           5. Body Accessories

               Shall be provided and installed as follows:

               a. Install 18" x 18" x 36" underbody tool box left/street side, Weather Guard
                  Model 536, or equal. A continuous horizontal tie down rod (1/2" MS or 1/2"
                  rebar) on both sides and on tailgate shall be provided and installed as low as
                  body style will allow.

           6. Installation
               The installation of the dump body on the cab and chassis shall be done in
               accordance with current industry practice. The dump body shall be centered

               interference as the dump body is raised or lowered. All welding is to be done by
               qualified welders. Welds exhibiting evidence of lack of penetration or lack of
               fusion will be cause for rejection of the delivered equipment. Weld slag shall be
               removed prior to application of primer paint. Hydraulic hoses and electrical
               wiring shall to properly secured to prevent damage by movement or vibration.
               All workmanship shall be equal, as a minimum, to current automotive industry
               specification and practice. Drilling or welding of chassis frame side members is
               prohibited and such practices will result in rejection of delivered equipment.

           7. Mounting and Safety Requirements
               The completed dump body shall comply with all applicable requirements of the

           3. Header Board

               The header board provided shall be constructed of 3/4" exterior grade plywood. It
               shall be approximately 30" high and full body width. The header board shall be
               bolted to four (4) full height vertical 2" x 3" x 1/4" angles. The two (2) inboard
               vertical angles shall be in line with and welded to the body longs as well as the
               forward cross sill. The two (2) outboard vertical angles shall be welded to the
               forward cross sill and underbody horizontal angles (2" x 3" x 1/4") approximately
               24" long.

           4. Floor Covering

               The body indicated in the bid paragraph shall be covered with 1/8" steel diamond
               tread plate.

           5. Legal Equipment

               Combination stop, turn, and tail light assembly shall be provided. Combination
               and clearance lights shall be recessed and mounted in rubber grommets. All
               wiring shall be enclosed in a loom. Rear wheel mud flaps shall be provided.

           6. Installation

               The installation of the body on the cab and chassis shall be done in accordance
               with current industry practice. The body shall be centered laterally on the truck
               frame and there shall be no evidence of binding or interference. All welding shall
               be done by qualified welders. Welds exhibiting evidence of lack of penetration or
               lack of fusion will be cause for rejection of the delivered equipment. Weld slag
               shall be removed prior to application of primer paint. Electrical wiring shall be
               properly secured to prevent damage by movement or vibration.

               The installation of the body shall be accomplished utilizing 5/8" tie bolts and
               3/8" x 2" x 3" angle iron clip plates (“U”-bolt installations are not acceptable.)

               All workmanship shall be equal, as a minimum, to current automotive industry
               specification and practice. Welding of chassis frame members is prohibited and
               such practices will result in rejection of delivered equipment.

                    include three (3) per side, of 3" x 3" x 3/8" angle, equally spaced apart, and

               c. Understructure

                    Shall be longitudinal design utilizing a flange of eight (8) gauge, 100,000 psi,
                    fabricated design, located directly under floor plate. Shall include 4" torque
                    tube and three (3) front structural cross members for support.

               d. Rear Crossmember

                    Shall be one (1) piece, full width and boxed, constructed of 100,000 psi steel.

                    position for dumping large rocks by means of hydraulic cylinders. Hydraulic
                    cylinders are to be located inside the rear corner posts for protection from
                    loader damage. The tailgate latch shall be air operated with air to open and

                    will not allow the gate to be raised until the air latch device is released.

           3. Hoist and Pump

               Hoist shall be hard chrome shaft telescopic single cylinder type. The cylinder
               shall be double acting and pivot on greaseless composite bearings. The hoist shall
               be front mount type with 6" first moving stage, 3-stage with 138" stroke. The
               hoist shall be trunnion mounted with small end of cylinder down to insure self-

           This specification describes the requirements of equipment to be installed on a two
           (2) axle truck to patch pot-holes and maintain City streets. The equipment shall be
           designed to be fully operational from the driver’s position in the cab of the truck.

           The completed unit shall conform to all requirements of the California Motor Vehicle
           Code. Code requirements shall include, but not be limited to the following:

           •   Gross vehicle weight requirements.
           •   Bridge formula weight requirements.
           •   Legal axle weight requirements.
           •   Vehicle length/width/height requirements.

           1. Operation Features

               Operational features of the equipment provided shall be as follows:

               a. Clean - dust shall be removed from the pot-hole by high volume air flow
                  creating a clean hard surface.

               b. Tack - a mixture of air and asphalt emulsion spray shall be applied as a binder
                  for the pot hole repair.

           2. Patching Systems
               The following systems shall be provided with the materials, and stored separately

                    Shall be capable of spraying independently for tack and with aggregate to
                    create the patching mix. The following additional requirements shall be

                    1) Tack tank shall be pressurized 60 psi to 120 psi.
                    2) A four hundred (400) gallon horizontally installed, insulated, asphalt
                       storage tank shall be provided.
                    3) All hoses shall be insulated and petroleum resistant.
                    4) An electrical immersion type overnight heater consisting of two (2) 4500
                       watt thermostatically controlled elements shall be provided. Each element
                       shall be encased in a water heat exchanging tube. Heat for on-the-go use
                       shall be provided by the engine cooling system.
                    5) Fill opening shall be 12" in diameter and equipped with a hinged closure
                       sealing cap.
                    6) A top deck safety emulsion overflow basin 54" x 83" shall be provided.
                    7) A 4" dial thermometer shall be located on the emulsion tank and be visible
                       from the driver’s seat.
               b. Aggregate System
                    Shall be designed to utilize 3/8" clean stone. The following additional
                    requirements shall be provided:
                    1) Aggregate hopper shall have five (5) cubic yard capacity and incorporate
                       an adjustable control gate.
                    2) Hopper shall incorporate fill opening to permit easy loading with typical
                       front-end loader.
                    3) Hopper shall be equipped with control gates to disperse aggregate.
                    4) Aggregate shall flow from the hopper via a feed slide meter gate system.
                    5) A one (1) piece double acting aggregate delivery boom shall be provided
                       and be equipped with aggregate hose and hose reel. The hose provided
                       shall be 3-1/2" rubber lined, abrasion resistant non-kinking hose with
                       spiral wire reinforcement.

                    EQUIPMENT AND VEHICLE FINANCING PROGRAM
                                Vendor Requirements

The Equipment and Vehicle Financing Program is a lease-to-purchase program to finance City
equipment acquisitions. At the City’s option, the Equipment and Vehicle Financing Program
may be used to fund new acquisitions. The following information outlines the Equipment and
Vehicle Financing Program requirements for vendors.

EQUIPMENT ORDERS

Successful Bidders will receive an Order Letter in place of a Purchase Order from the City’s
Financing Services Department. A sample Order Letter is attached. The Order Letter will
designate the equipment to be ordered and will confirm that the City has obtained pre-approval
from a lease provider to fund the acquisition.

       •   Sign the Order Letter and return a copy to City of San Diego Financing Services,
           within ten (10) business days to acknowledge receipt of the order.

       •   The Order Letter will designate a lease number to be used by the Vendor on all
           shipping and billing documents.

DOCUMENTATION REQUIRED FROM VENDORS PRIOR TO FUNDING

The lease provider will make full payment to the Vendor upon receiving approval from the City.
The City will provide approval only after the equipment has been accepted by the acquiring
Department and the complete documentation from the Vendor detailed below has been received.

       •   Two invoice copies are required: one (1) to be provided directly to the City
           Department acquiring the equipment and one (1) to be provided directly to the City’s
           Financing Services Department. Addresses are provided in the Order Letter.

       •   A copy of the Manufacturer’s Certificate of Origin for vehicles is required by the
           City’s lease provider prior to funding the equipment. Vendors are requested to
           provide a copy of the Manufacturer’s Certificate of Origin to the City with the
           invoices at the time of delivery or a minimum of seven (7) business days prior to
           receipt of funds.

       •   The lease provider is required to be designated as lienholder on the title and
           Manufacturer’s Certificate of Origin for all vehicles purchased. The City will be
           named as titleholder.

SALES TAX PAYMENT

Sales tax will not be financed.

       •   Sales tax will be paid by the City directly to California vendors in a separate check at
           7.75%.

       •   Sales tax will be paid by the City directly to the State of California at 7.75%, for out-
           of-state vendors. This will be confirmed in the Order Letter. If further verification of
           sales tax payment is required by out-of-state vendors, contact the Master Lease
           Program Administrator.

PAYMENT FOR EQUIPMENT

Funding will require a minimum of seven (7) business days for processing by Financing Services
and the City’s lease provider, after receipt of written acceptance of the equipment from the
acquiring City department. Acquisitions CAN NOT and WILL NOT be funded until the
acquiring City department accepts and approves the equipment.

Funds will be wired or overnighted by the lease provider, depending on the dollar value of the
acquisition. Financing Services will notify vendors of the date funds are scheduled to be wired
or overnighted.

To receive wired funds, vendors must provide the following information on COMPANY
LETTERHEAD:

       •   Name, address and telephone number of bank to which funds are to be wired;
       •   Bank routing number;
       •   Account number and account name;
       •   Signature and title of person supplying this information; and,
       •   Vendor federal tax I.D. number.
