Minutes of a Meeting of the Town Board of the Town of Eastchester held on June 1, 2010 at 8:00
p.m., at the Town Hall, Eastchester, New York.

    IV.       SPECIAL PRESENTATION - GREEN DAY

Peter McCartt, Chairman of the Eastchester Environmental Committee announced the June 12
Green Day Celebration to be held at Town Hall from 10-4. There will be over 60 organizations
represented including vendors, exhibitors, food and music.

    V.        OPPORTUNITY TO ADDRESS THE BOARD ON AGENDA ITEMS

Note to the reader: During the First Opportunity to Address the Board, residents are asked to limit their
comments to Agenda Items. Frequently, a clarification or general question concerning an Agenda
Item is requested. The clarifications and additional information regarding a given Agenda Item will be
included at the point when the Item is considered and discussed by the Town Board.

David Levy suggested the Town „hold back‟ from going to bid for Traffic Line Striping during „these
tough economic times.‟ Mr. Levy issued several complaints regarding the Town Center Project
including, the drainage in the pedestrian crossing areas, a „broken walkway‟ and the „waste of money‟
in running electrical wires underground.

With regard to the Eastchester Child Development Center lease agreement, Peter DeFelice stated 50
years is „too long a lease.‟ Supervisor Colavita responded leases between non-profits and
municipalities are frequently 99 years. The Town can terminate the lease agreement if the building
falls in disrepair.

    VI.       APPOINTMENTS

              A) APPOINTMENT – HIGHWAY DEPARTMENT

At the request of the Superintendent of Highway, Hector DiLeo, Supervisor Colavita offered a motion
that was seconded by Councilwoman Ford to approve the probationary appointment of Dominick
Gizzo, 27 Tuckahoe Avenue, Eastchester, New York to the full time position of Skilled Laborer (Group
F, Step 4) at the annual salary of $61,046 effective June 11, 2010.

Mr. Gizzo has been employed with the Town for the past 7 years as a Laborer.

If approved he will be required to serve a probationary period which will run not less than twelve weeks
and not more than fifty-two weeks. Funds are provided in the 2010 budget.

On the roll call, all voted "AYE." Motion carried.

            B) APPOINTMENT – COMPTROLLER’S OFFICE

Councilwoman Ford offered a motion that was seconded by Councilman Cahalin to approve a Group
and Grade change for Rita Monaldo, Bookkeeper, in the Comptroller‟s Office. If approved she would
be moved to the CSEA Group VII, Step 4 at the annual salary of $63,199, effective June 11, 2010.
She is currently in CSEA Group VI, Step 5A at the annual salary of $60,652.

Rita has been with the Town since November, 2006. Since the reorganizing of the department she has
been given many added responsibilities such as monthly reconciliations and reports as well as many
other additional day-to-day functions of the office. This change will put her in the Group and Grade
that reflects her level of work.

If approved the change would be effective on June 11, 2010. Funds are available in the 2010 budget.

On the roll call, all voted "AYE." Motion carried.

    VII.    APPROVAL OF MINUTES

Councilman Cahalin offered a motion that was seconded by Councilman Salanitro to approve the
Minutes of the May 18, 2010 Town Board Meeting as prepared by Town Clerk Linda Doherty.

On the roll call, all voted "AYE." Motion carried.

    VIII.   REPORTS OF DEPARTMENTS, BOARDS AND COMMISSIONS

            A) LAW DEPARTMENT

                     i. RESOLUTION AUTHORIZING THE SUPERVISOR TO EXECUTE AND
                        DELIVER AN AGREEMENT OF LEASE BETWEEN THE TOWN OF
                        EASTCHESTER AND EASTCHESTER CHILD DEVELOPMENT CENTER

Kevin Cook, Director of Development, Family Community Services, provided an over view of the plans
for the renovation of the Eastchester Child Development Center (ECDC). The Center opened in 1968
at its current location in Tuckahoe under the administration of the Family Community Services (FCS).
Mr. Cook explained ECDC provides child care services to over 50 working families in the area, 1/3
from Eastchester, Tuckahoe and Bronxville. In October 2007 FCS services and assets were acquired
by Julia Dyckman Andruss Memorial.

Supervisor Colavita called the Center an „asset to the Town of Eastchester.‟ The Supervisor discussed
the neighborhood‟s support of the renovations to the facility and the process by which approval had
been received by the Tuckahoe Planning Board and the Tuckahoe Village Board.

Councilman Salanitro offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the Supervisor to execute and deliver an Agreement of Lease between the
Town of Eastchester and Eastchester Child Development Center whereby the Town of Eastchester
hereby agrees to lease to the tenant the premises located at 35 Bronx Street, Tuckahoe, New York for
the purpose of conducting a child recreation and day care center at that location.

On the roll call, all voted "AYE." Motion carried.

                     ii. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CERTIORARI
                          PROCEEDING BY BRONXVILLE TOWERS APARTMENTS, INC.
Councilwoman Ford offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the settlement of a certiorari proceeding instituted by Bronxville Towers
Apartments, Inc., affecting premises known as Section 4, Block 1, Lot 11 and also Section 5, Block 3,
Lot 1 and 1A, 1-11 Tanglewylde Avenue and 22 Garden Avenue – (Bronxville) as follows:

Supervisor Colavita offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the Supervisor to execute and deliver an agreement between the Town of
Eastchester and FDR DRIVE Band for a concert to be held on July 2, 2010 at Lake Isle Country Club.

                 C) MEMORANDUM FROM SUPERINTENDENT OF HIGHWAYS RE: PERMISSION TO
                 BID – TRAFFIC LINE STRIPING

     Councilwoman Ford offered a motion that was seconded by Councilwoman Marcotte to approve a
     Resolution authorizing the Highway Department to go out to bid to obtain pricing for Traffic Line
     Striping of various Town Roadways.

     Funding in the amount of $45,000 was previously approved by the Town Board to perform traffic line
     striping at various locations within the Town.

     On the roll call, all voted "AYE." Motion carried.

                 D) MEMORANDUM FROM SUPERINTENDENT OF HIGHWAYS RE: AWARDING OF
                 2010 SIDEWALK AND CURB REPLACEMENT CONTRACT

     On Tuesday, May 25, 2010, at 11:15 A.M. seven bids on the 2010 Sidewalk and Curb Replacement
     were opened and read aloud in the office of the Town Clerk, see below.

     The low bid, based on estimated quantities, was submitted by Paladino Concrete Creations
     Corporation, 315 N. MacQuesten Parkway, Mt. Vernon, NY 10550. This bid was reviewed and is
     accordance with bid specifications.

     Councilman Salanitro offered a motion that was seconded by Councilman Cahalin to approve a
     Resolution that the 2010 Sidewalk and Curb Replacement Contract be awarded to low bidder,
     Paladino Concrete Creations Corporation, 315 N. MacQuesten Parkway, Mt. Vernon, NY 10550 at the
     unit prices bid, not to exceed the total project allotment of $150,000.

                 E) MEMORANDUM FROM SUPERINTENDENT OF HIGHWAYS RE: AWARDING OF
                 2010 STREET RESURFACING CONTRACT

     On Tuesday, May 25, 2010, at 11:00 a.m., four bids on the 2010 Street Resurfacing Project were
     opened and read aloud in the Office of the Town Clerk, see below.

     The low bidder is Petrillo Contracting, Inc., 41 Edison Avenue, Mt. Vernon, NY 10550, who submitted
     a bid, based on unit prices, for the total amount of $627,000.00. This bid includes the resurfacing of
     various roadways within the Town of Eastchester, Bronxville & Tuckahoe Villages.

     Councilman Cahalin offered a motion that was seconded by Councilwoman Marcotte to approve a
     Resolution that the 2010 Street Resurfacing Contract be awarded to the low bidder, Petrillo
     Contracting Inc, at the unit prices bid.

                  F) MEMORANDUM FROM POLICE CHIEF RE: INSTALLATION OF VOICE
                  RECORDING SYSTEM

      Supervisor Colavita reviewed a request from Police Chief Tim Bonci regarding the authorization to
      install Verint Audiolog Recording system. The system would replace the current voice recording
      system (NICE) which is not compatible with the new phone service being installed in the Police
      Department by LightPath. The five year agreement has been reviewed by Town Attorney Lou Reda.
      There is no additional cost to the Town for the installation and the maintenance plan is approximately
      10% less expensive than the current maintenance plan.

Councilman Cahalin offered a motion that was seconded by Councilwoman Marcotte to authorize the
signing of the five year agreement for the Verint Audiolog Recording System for the Police
Department.

    XI.     COUNCIL MEMBER REPORTS

Councilwoman Ford acknowledged the participants and performers of the 90 Year Olds Celebration.
The cast performed an hour long show of song and dance for the celebrants. The program was
recorded and will be aired on the local channel.

Mrs. Ford reported over 100 people attended the premier of the Neighbor Next Door exhibition. Mike
Fix prepared the 70 framed stories of local soldiers and presented the display at the opening on May

27 at Concordia College.

The Friends of the Library Summer Movies Series will begin on June 15 and will run on Tuesdays
and Fridays throughout the season.

Councilwoman Marcotte reported the $2.00 Cable Card fee for „Basic‟ customers will no longer be
imposed.

Mrs. Marcotte announced a Public Hearing on the Con Edison proposed rate increase will be held on

June 8 at 1:30 at the Will Library in Yonkers. Mrs. Marcotte suggested residents attend the Hearing
or write/call the NYS Public Service Commission (1-800-355-2120).

Councilman Cahalin announced the Lake Isle Advisory Board would meet at 8:00 p on June 2 .

Councilman Salanitro encouraged residents to attend the Green Day Celebration on June 12 .

Mr. Salanitro reported the recent Community That Care meeting, “In Our Back Yards,” had been
attended by over 250 people. The group discussed underage drinking.

Supervisor Colavita reported new playground equipment has been ordered and will be installed at the
Garth Road Playground.

The Library Board is currently meeting with the engineer to review the HVAC plans and project.

In closing, Supervisor Colavita acknowledged the work done by Police Sergeant Joe Groccia in
preparing the 100 year history of the Department that was read at the recent Police Memorial
Ceremony. The following is a transcript of the history:

    XII.    SECOND OPPORTUNITY TO ADDRESS THE BOARD

Christine Valente (LSD – check spelling) encouraged the residents of the Leewood area to join the
Leewood Park Civic Association. The group had a productive meeting at Town Hall prior to the start of
the Town Board Meeting.

David Levy stated should there be surplus grant funds, all unused moneys should be returned to their
source and not spent by the Town.

Mr. Levy inquired about a pedestrian foot bridge, located in the Village of Tuckahoe. Village Trustee
Luigi Marcoccia, a member of the audience, provided the following explanation; the Village Engineer
deemed the bridge unsafe and recommended closure. The cost to replace the bridge would exceed
$1 million; therefore, the Village is seeking grant funding for the project.

Fred Moses stated the residents of the „Town Outside‟ paid for the Town Center project; therefore, the
area should be designated “Eastchester Square.” Mr. Moses made the following suggestions
regarding the area; relocate the clock, increase the illumination of the street lights, install a pedestrian
crossing at Parsons Place and plant mature trees.

There being no further public business, the meeting was adjourned at 9:40 pm with a moment of
silence for former Police Officers „Red‟ French and Joe Mariani, Sr. In addition, the Town Board
recognized those who fought the battle on the beaches of Normandy.
