TD112 (Rev11) APPLICATION FOR A HOME OFFICE TRAVEL DOCUMENT How to apply for a Home Office Travel Document (The application form can be found at the back of this booklet) This guide provides information to help you fill out the application form. You must fulfil both these criteria 1. You should have more than 6 months outstanding leave to enter/remain before applying for a Travel Document. What if you don't have enough leave? Other countries will often not accept a Travel Document with less than 6 months validity on return to the United Kingdom. If you have 6 months or less outstanding leave to enter or remain (at the time of your application for a Travel Document) you can apply for an extension, although no guarantee can be given that further leave will be granted. Please telephone 0870 241 0645 to obtain an application form for further leave. If further leave is granted you can apply for a Travel Document. Please do not send applications for further leave to the Travel Documents Section. 2. You must be lawfully resident in the UK in one of the following groups (as shown on your Home Office status letter) GRANT OF ASYLUM • You have been recognised as a refugee under the terms of the 1951 United Nations Convention Relating to the Status of Refugees. • You can apply for a Convention Travel Document (blue). STATELESS PERSON • You have been recognised as a stateless person under the terms of the 1954 United Nations Convention Relating to the Status of Stateless Persons. • You can apply for a Stateless Persons' Document (red). INDEFINITE LEAVE TO REMAIN (but have not been recognised as a refugee). • You must have first completed a period of limited leave to enter/remain, and subsequently have been granted indefinite leave to remain. • To qualify for a document you must also provide documentary evidence to show that you have been formally and unreasonably refused a Passport/Travel Document by your own National Authorities. This means that you will have to apply for a Passport/Travel Document from your own National Authorities before applying for a Home Office Travel Document. • If your application for a Passport/Travel Document from your own authority is unreasonably refused, then you can apply for a Home Office Certificate of Identity (brown). LIMITED LEAVE TO ENTER/ REMAIN (Grants of limited leave to remain include: -leave to enter/remain on an exceptional basis -discretionary leave to enter/remain -grant of humanitarian protection.) • Grants of exceptional or discretionary leave to enter/remain, and humanitarian protection are known as limited leave, as they are granted with a time limit. They must be based on a failed asylum claim to qualify for a Home Office Travel Document. • To qualify for a document you must also provide documentary evidence to show that you have been formally and unreasonably refused a Passport/Travel Document by your own National Authorities. This means that you will have to apply for a Passport/Travel Document from your own National Authorities before applying for a Home Office Travel Document. • You must specify the country or countries you wish to visit (including any countries you may need to pass through in transit), and provide documentary evidence of your need to travel. This is explained further in the guidance notes under section 7b. • If you fulfil all the criteria under 'LIMITED LEAVE TO ENTER/REMAIN' you can apply for a Home Office Certificate of Identity (brown). 2 TD112 (Rev11) Leave to enter/remain in the United Kingdom Refugee Stateless person Indefinite leave to enter/remain (without refugee status) Limited leave to enter/remain Type of document Convention Travel Document (blue) Fee for an adult document £42 (valid for 10 years) Fee for a child's document £25 (valid for 5 years) £25 (valid for 5 years) £115 (normally valid for 5 years) £115 (normally valid for 1 year, dependent on leave) Stateless Persons' £42 (valid for 10 Document (red) years) Certificate of Identity (brown) Certificate of Identity (brown) £195 (normally valid for 5 years) £195 (normally valid for 1 year, dependent on leave) How to apply for a Travel Document What to do first: Please check that you have all the documents needed for your application: • Two identical endorsed colour photographs should be submitted. • Please enclose either the original or a copy of your valid status letter from the Home Office that shows that you have permission to stay in the United Kingdom and/or a copy of your UK residence permit if you have one. • Enclose any Passport or Travel Document that you have. Certificates of Identity (brown document): If you are applying for a Certificate of Identity, you will need to apply for a Passport/Travel Document from your own National Authority first. If your application for a National Passport/Travel Document has been unreasonably refused, notification of this refusal should be submitted with your application for a Home Office Travel Document. You must also show why the refusal is unreasonable. There are some cases where you will be refused which we would NOT deem to be unreasonable. Some examples of what we would consider to be a reasonable refusal are: • You have been refused a Passport because you have not completed military service. • You have been refused a Passport because you did not provide evidence to confirm your identity. • You have been refused a Passport because you have a criminal record in your country. What to do next: • Please carefully check that you have completed each section relevant to your application and that you have enclosed the necessary documents. • If, after posting, you realise that you have forgotten to enclose something, please do not send it separately, as this will only delay the application fur ther. Your application will be returned to you with a request for any missing information/documents. • Tear off and keep the guidance notes in a safe place. They should not be submitted with the application form. • If other members of your family are applying for Travel Documents, please enclose all applications in one envelope. 3 TD112 (Rev11) Where to apply: All applications for Travel Documents must be made by post. You should complete the application form and acknowledgement card and return them along with the correct documents and appropriate fee in the pre-addressed envelope provided. Applicants are advised to send all documents by recorded delivery. Checking the progress of your application: The Travel Documents Section does not have a Public Caller Unit. Visiting any other Public Caller Unit will not enable you to check the progress of your application or submit any documents in support of your application. If you wish to check on the progress of your application you should call the number provided below. If there is a problem with your application we will let you know as soon as we can. If you need to contact us, call the Immigration and Nationality Enquiry Bureau on: 0870 606 7766. How to pay £ All fees must be paid in postal orders. We are unable to accept cheques. • Postal orders should be made payable to “The Accounting Officer, Home Office.” Please supply postal orders to the exact value of the amounts listed on page 3. • You do not need to send any additional money for postage and packing. Paying more or less than the listed amounts will delay the consideration of your application. • If you are unsure how much you need to pay, please call 0870 606 7766. • The Home Office does not refund the fee if your application is refused or withdrawn. • Do not make any arrangements to travel until you are in possession of your Travel Document. An estimated time to process your application will be provided on the card acknowledging receipt. Please include the name and address of where you would like the Travel Document sent to on the enclosed acknowledgement card. The acknowledgement card must be completed and returned with the completed application form. If you do not return a completed card your fees will not be acknowledged and you will not receive an estimated time to process your application. Lost or Stolen Documents: • If your previous Travel Document has been lost or stolen or is otherwise unavailable it may take longer to issue a replacement because the Home Office needs to undertake enquiries. • Please remember that the checks made before issuing a Travel Document are necessary to prevent the misuse of identities and on occasion enquiries may take time to resolve. • All applications to replace lost or stolen Travel Documents require a full police report and a clear and concise explanation detailing the circumstances of the loss. 4 TD112 (Rev11) Priority requests • ALL applications are dealt with in the order in which they are received. • The Home Office will only consider dealing with an application out of turn if there is a medical emergency or a family funeral. In this case documentary evidence must be submitted in the form of a recent medical report or doctor's letter by fax on 0208 760 3385 before we can consider giving an application priority. If no evidence is submitted, or it is decided that priority is not appropriate, the application will remain in the queue and will be dealt with in date order. Children It is not possible for children to be named on the Travel Document of their parent or guardian. Children who wish to hold a Travel Document should apply using a separate application form. Children who are aged 15 or under can obtain a child's document. Applicants aged 16 or over must apply for an adult document. The Travel Documents Section do not grant leave. Children should have more than 6 months leave to remain in this country when applying for a Travel Document. Children should normally travel on a British passport if they were born in the United Kingdom: • before 1 January 1983 or • on or after 1 January 1983 to a parent who was a British Citizen on the date of the child's birth or • on or after 1 January 1983 to a parent who was settled in this country on the date of the child's birth. Further information on nationality of children born in the United Kingdom on or after 1 January 1983 is available from the Nationality Directorate, India Buildings, Water Street, Liverpool, L2 0QN. Convention Travel Documents (blue): • Travel Documents will normally be valid for travel to all countries except those from which asylum was sought and/or your country of origin. Stateless Persons' Documents (red): • Travel Documents will normally be valid for travel to all countries. Certificates of Identity (brown): • Indefinite leave to remain: will normally be valid for travel to all countries except those from which asylum was sought and/or your country of origin. • Limited leave to enter/remain: will only be valid to the countries listed in section 7b, for which documentary evidence of a need to travel had been submitted. Countries who are party to the Schengen agreement, along with the Republic of South Africa, will often not accept a Home Office Certificate of Identity as a valid travel document. You should check with the Embassy of the country you wish to travel to before applying. 5 TD112 (Rev11) How to complete the form Please use BLACK ink and complete the form in BLOCK CAPITALS. NOTE for section 7a Passport/National Authorities: Refugees/Stateless Persons: If the letter sent to you when your application for asylum was decided says that you have been accepted in this country as: • a refugee under the terms of the 1951 United Nations Convention Relating to the Status of Refugees or, • a stateless person under the terms of the 1954 United Nations Convention Relating to the Status of Stateless Persons, you are not required to complete this section. Go to section 8. All other applicants: You are required to complete this section. You must explain why you cannot get a Passport or other Travel Document from your own National Authorities and submit documentary evidence showing a formal and unreasonable refusal to issue a Passport/Travel Document by your own authorities. You should apply for a Passport/Travel Document from your Embassy or High Commission before applying for a Home Office Travel Document. If after application, you are unreasonably refused a Passport/Travel Document by your own authorities, notification of the refusal should be submitted with your application for a Home Office Travel Document. These requirements may only be waived under the following circumstances: In some cases the Home Office may accept that you have a fear of the authorities in your country, and as such may waive the above requirement. In this case the Home Office would not insist upon a letter from your Embassy or High Commission. The grant letter sent when the Home Office decided your application will tell you if this aspect of your claim has been accepted. If you have not been allowed to stay for this reason, but for some other reason instead (such as your family circumstances or your medical condition), you must still try to obtain a Passport/Travel Document. If you do not have access to an Embassy or High Commission, or you are unsure whether you have an Embassy or High Commission, call 0870 606 7766. 6 TD112 (Rev11) NOTE for 7b. Indefinite leave to enter or remain: If the letter sent to you when your application was decided says that you have been accepted in this country as: • a refugee under the terms of the 1951 United Nations Convention Relating to the Status of Refugees; • or a stateless person under the 1954 United Nations Convention Relating to the Status Stateless Persons • or that you have been granted indefinite leave to remain; You are not required to complete this section. Go to section 8. Granted leave for a limited period: IMPORTANT INFORMATION • Travel Documents issued to applicants with limited leave will be valid for one year, unless there is an exceptional reason to change the duration of the document's validity, or you have less than one year's leave to remain. • Certificates of Identity (brown documents) will only be issued to applicants with limited leave for essential travel. You must show that you need to travel for one of the four reasons given below by submitting documentary evidence with your application. This is explained under each category. Documents will not be issued for any other purpose. • Documents are issued to facilitate travel, they will not be issued to be used solely for identification purposes. Please note: A holiday is not considered to be an essential reason for travel. • If you are unsure as to whether you qualify, please call: 0870 606 7766. Documentary evidence The work of the Travel Documents Section may include a check to confirm that any evidence submitted in support of any application is genuine. In particular, the Home Office may contact the person who writes in support of your application. In some cases further evidence or explanation may be requested. 1. Travel for essential employment/business related reasons: You must give a clear explanation of the employment/business need to travel in section 7b, and provide documentary evidence as explained below. Documentary evidence: Employees: You must provide a pay-slip, and a letter from your employer specifying the reason for travel to a named country or countries, and why it is £ necessary for the applicant to go, rather than another employee. Self-employed applicants: You must provide a recent balance sheet and a profit and loss account for your business, or other satisfactory evidence that £££ your business exists as a going concern, and a letter specifying the reason for travel to a named country or countries. 7 TD112 (Rev11) 2. Travel on compassionate grounds: The examples below show what is meant by compassionate grounds. You may wish to contact the Immigration and Nationality Bureau on 0870 606 7766 for advice before submitting your application. • Applications will be considered on the basis of a life-threatening illness or funeral of a close relative. By close relative, we usually mean a parent, child or sibling. • Applicants wishing to attend a funeral or visit other relatives who are suffering from life threatening illness should explain why they consider the relationship close. • Applications will also be considered from people who need to travel for urgent and essential medical treatment. Documentary evidence: •Medical evidence (a letter from the doctor or hospital treating your relative) or evidence of funeral arrangements must be submitted with the application. If this is not written in English, a certified English translation should be provided. •If you are travelling for treatment yourself, a doctor recognised by the General Medical Council must provide a letter explaining why satisfactory treatment cannot be given in the United Kingdom, and stating the country where treatment is to be given. 3. Travel for essential educational trips : You must state your reasons for travel in section 7b and submit documentary evidence as explained below. Documentary evidence: • A letter from the headteacher of a bona fide education institution or, in the case of further or higher education, the head of the applicant's department, specifying the reason for the visit. The letter should confirm that you require a document for a specific trip or trips. • Applications related to educational trips organised by other recognised groups will also be considered. Such applications must be supported by an official of the organisation concerned. 4. Travel for religious reasons and other compelling reasons of conscience: You must state your reasons for travel in section 7b and submit documentary evidence as explained below. Documentary evidence: •Applicants wishing to travel for reasons arising from religious conviction should provide a letter from a priest, cleric or other official recognised within their faith, explaining the reasons why it is important that the trip is undertaken. •Applicants wishing to travel for other important reasons of conscience should provide a full explanation and a letter from a person in a relevant, responsible position who can confirm the reasons for the journey and why it is important. 8 TD112 (Rev11) NOTE for section 8 and 9 Please use the following guide to determine how to complete these sections: The applicant is aged 15 or under • Parent/guardian/person with parental responsibility signs section 8. • Leave section 9 blank. • Parent/guardian/person with parental responsibility signs section 8. • Applicant signs section 9. • Leave section 8 blank. • Applicant signs section 9. Dark glasses are not acceptable. • The photographs should not be pinned, stapled, glued or taped to the application form. Please take extra care in these areas: 1. Applying for the correct document: Do not apply for a Convention Document or a Stateless Persons Document unless you have been recognised as a refugee or a stateless person. If you are unsure call 0870 606 7766 before applying. 2. Incorrect fees: Required fees are stated on page 3 of this booklet. Please pay the exact fee stated. 3. Section 9 of the form not signed: If you are aged 16 or over, section 9 should be signed. 4. Photographs not endorsed: Photographs for first time applications and applications to replace lost/stolen documents should be endorsed and signed by a professional person. 5. Applications for Certificates of Identity (brown document)- no documentary evidence submitted: Applicants with indefinite leave to remain who are not refugees should submit documentary evidence showing their application for a Passport/Travel Document from their own National Authority has been refused. Applicants with limited leave should submit documentary evidence showing their application for a Passport/Travel Document from their own National Authority has been refused, as well as evidence of an urgent need to travel (as explained in the guidance notes for section 7b). Please complete this form using BLACK INK and CAPITAL LETTERS. Please ensure you only write inside the white boxed areas and do not mark any other areas of the form. Failure to enclose required documents or information will result in delays, or the return of your application to yourself.
